Pursuant to due call and notice thereof Mayor Crepeau called the
meeting to order at 7:30 p.m.
Roll Call
Present - Mayor Henry J. Crepeau, Jr., Counci ImenRobert Woodburn,
Charles Crichton, James Wingert.
Absent - Councilman William Feyereisen.
Also Present - Treasurer Donald Lamb, Attorney James Lynden,
Engineer Donald Christoffersen, Clerk Administrator
Charlotte McNIesh, Deputy Clerk Dorothy Zehm.
Approval of Minutes
Wingert moved, seconded by Crichton, that Council approve the
Minutes of the Regular Council Meeting of. June 14, 1976, as amended.
Motion carried unanimously.
Approval of Minutes of.Speclal Council Meeting of June 21, 1976,
was deferred, pending re-write of.conditions re Skyline Builders
stockpiling (p. 3) by Clerk Administrator, for Council's considera-
tion on July 19th.
(McNlesh to contact Skyline Builders for up-date as to when oily
substance will be removed or covered up.)

REPORT OF VILLAGE ATTORNEY JAMES LYNDEN
Case No. 74-14, Pemtom - Fourth Addition
Lynden referred Council to his letter of July 12, 1976 re HOA
Letter of Credit and Development Agreement and Execution of the
Final Plat. He advised Counci I that the matters referred to in
paragraph 2 of his letter re the HOA Agreement have been taken
care of.
Woodburn moved, seconded by Crichton, that Council approve and accept
the Irrevocable Letter of Credit (ILC No. (424), approve the HOA
Deveiopment Agreement, and authorize execution of the Final Plat of
Townhouse Vi Ilages North Fourth Addition by the Mayor and Clerk
Administrator. Motion carried unanimously.
Case No. 75-23 Flahert 's Arden Bowl - Gradln and Landsca e Plans
Lynden referred Councii to his letter 0 July 12,19 ,Re Vacation
of Portions of Connelly Avenue; Grading and Landscape Plans of Flaher-
ty's Arden Bowl, ~nc., Indicating concern about the encroachment of
parking stalls, landscaping and bituminous islands upon the right-
of-way of Connelly Avenue, and referred the Councl.1 to Engineer
Christoffersen's letter of June 29, 1976, which he feels amplifies
the problems created by encroachments. Lynden noted that Planner
Fredlund (memorandum re Connelly Street Upgrading Site Plan Review.)
indicates that the parking and grading plans ara Justifiable but the
landscaping plan needs to be up-graded.
Lynden expressed concern re claims based on design of street which
could stem from a delay or lnabi lity of emergency vehicles in getting
to a fire or accident.
Flaherty suggested that situation be left as it is; does not believe
that traffic has increased as anticipated; would like to spruce up
the existing lot, by r.~triping and delineating area that Flahertys
are presently using; would prefer not to pave or plant the new lot
(north of McDonald's) until determination is made by Counci I re the
transfer of land, grading and landscape plan and roadway and parking

After discussion and review of the points noted in reports from Lynden
(7/12/76), Christoffersen (6/29/76) and Planner's memo, and discussion
of the proposed grading and landscape plan with Pat Flaherty, Council
referred the plans to Planner Fredlund for his recommendations to
Counci I re proposed changes, eliminating private parking on the street
rignt-of-way (except parallel parking along curb), widening road-
way to 36' to permit adequate radius for turning of semi-trucks and
emergency vehicles, providing better delineation of streets, provid-
ing alternate parking for stalls now indicated in right-of-way areas.

County Road F Improvement - Easement for Easterly Watermain Extension
Christoffersen referred Council to his letter of July 2, 1976, In
which he indicates three alternates to Council for the easterly water-
main extension.
After discussion, Crichton moved, seconded by Woodburn, that Council
authorize the Vi I lage Attorney to contact Mr. Reiling and obtain
the said 15' easement, as described by Engineer Christoffersen.
Motion carried unanimously.
(Christoffersen reported that Rei ling had offered this easement for
the future construction of the watermain to serve his property;
probably can be obtained therefore for $1.00 compensation.)
Application for Final Payment - Allied Blacktopping Inc. Sealcoating
Project
Christoffersen referred Council to Application for Payment No. I &
Final, from Allied Blacktop Co. and recommended payment thereof; re-
porting that Sealcoatlng job has been Inspected and conforms with
specifications.
Woodburn moved, seconded by Crichton, that
the 1976 sealcoatlng project and authorize
toppingm inc. in the amount of $12,668.72.

Resolution No. 76-29, Decl~ring Cost to be Assessed and Ordering
Preparation of Proposed Assessments for Indian Oaks Two
Woodburn moved, seconded by Wingert, that Council adopt Resolution
No. 76-29, RESOLUTION RELATING TO iNDIAN OAKS ~ ADDITION IMPROVEMENT
DECLARING COST TO BE ASSESSED AND ORDERING PREPARAT~ON OF PROPOSED
ASSESSMENT, as amended, Inserting ($56,502.81 as total cost to be
assessed and $0.00 as cost the City wi I I pay as its share of the cost.
Motion carried unanimously.
OTHER BUS I NESS
Sheehy Request to instal I Lights at Tennis Courts
After discussion of ordinance roquirements re lighting, review of
letter from Richard P. Sheehy (6/18/76) and sketches of light loca-
tions and estimatod distances fl'omhomes in the area, Council con-
curred that unless glare from I:ghts exceeds maximum permitted by
ordinance, Counci I action is n07 required; Council's responslblity
Is to enforce the ordinances.

Building Inspector was requested to determ.lne if lights violate glare
standards (Ord. 99). if no violation Is found, no Council action is
needed.
Arden Manor Amended Special Use Permit Provisions Discussion
Mr. David Anderso~ explained that for the last two weeks Arden Manor
has been operated by Citizens Mortgage; have not gone to Sheriff's
Sale to date; have right to make emergency repairs now, which they
are currently doing.
Mr. Bill Franzen reported accomplishments made by Citizen's Mortgage
these past two weeks:
a. emergency repairs on existing wel I.
b. repaired water main from old to new park which had broken.
c. cleaning up the park of trash and are cutting the weeds.
d. storm shelter area in community building has been cleaned
out, and lights installed; will be available for use as a
shelter by July 15th.

e. are working on the new well; after this is in operation

It was noted by Anderson and Franzen that they are concerned about
wording In the permit re permitting wood-sided homes only - feels
that aesthetically wood-sided homes deteriorate and look unattractive
much sooner than the metal-sided; suggested that perhaps a "mix"
could be permitted. He said all mobile homes are now constructed
under HUD requirements, to structural and fire code specifications.
Deslreability of a swimming pool Is also of concern; presents liability
problems - not sure It's wise for safety of the children.
In discussion of the streets and utilities, Franzen said they want
to first make sure that al I streets and uti litles, walks and curbs are
completed - wi II then have them inspected. Asked what would be expec-
ted of them if, after inspection, streets and utilities are not built
according to City specifications - will they have to tear them out
and re-build or fix deficiencies?
After discussion, Council requested Mr. Anderson and Mr. Franzen to
submit evidence in support of the changes they propose; noting that
one of the first requirements pending completion, before the Special
Use Permit can be obtained Is the park easement. Council noted that
the requirement of wood-sided homes was considered to be a standard
of excellence by the Council; if they are not, what Is? Council said
that residents of the park have the right to expect the amenities,
such as the pool, which were part of the approved ~l$n for the park;
determination on utilities and streets will be made after inspectl~ns
are completed.
Case No. 76-17, Richard Glvans - Sldeyard Setback Variance for Garage
at 1904 Glenpaul Avenue
Council was referred to the Planning Commission Minutes of 7/6/76,
Board of Appeals Report (6/28/76, Planner's Report and letter from
residents (6/4176).
After review of sketch present7d with application, and discussion
with Mr. Glvans re possible alternate garage locations, Wingert moved,
seconded by Crepeau, that Council approve the 8' sideyard setback
variance on the basis that it is appropriate to the area and an Im-
provement to the general appearance of the neighborhood. Motion
carried unanimously.
Shore Protection for Boat Ramp Faci Iltles - Tony Schmidt Park
Council reviewed the plans and Notification of Permit Application,
to the Department of Natural Resources.
Woodburn moved, seconded by Crichton, that Council approve the pla~s
for rip-rapping, as presented, and authorize execution of the appli-
cation by Mayor Crepeau, on behalf of the City Councl I. Motion carried
unanimously.

Approval of Instructor-aid - Girls' Gymnastic Program
Crichton moved, seconded by Woodburn that Patti Kile be hired as
Girls' Gymnastic Instructor 8 $3.50/hour, effective June 14, 1976.
Motion carried unanimously.
Arden Hills Building Supervisor Cost for Use of School Facilities
Council discussed memo from Buckley dated 7/7/76 re 1975-76 School
Bui Idlng Cost Sharing, and expressed concern re system apparently
used to determine total usage of buildings.
Crichton moved, seconded by Wingert, that Councl I authorize payment
of balance of $837.75 to Mounds View School District 621 for the
1975-76 school year building usage ($1964.75 total). Motion carrl~d.
unanimously.

Control
Wingert reported on June 16th RCLLG meeting and the dog control pro-

gram described by Tom Lewcock (New Brighton), which is evidently
working very wel I:
I. life-time license.
2. Community Service Officer has truck with radio, and patrols
at uncommon hours of day and night.
3. reduces hours police officer spends on dog nuisance calls.
4. warning Is given at first offense of ordinance violation
(assuming dog is licensed); second offense, a citation Is
issued.
5. a New Brighton veterinarian acts as the "dog pound" where
dog owners pay costs (shots required, room and board, etc.)
6. Community service officer also works on Operation 10, en-
forcement of sprinkling ban, etc.
Wingert reported that New Brighton's program has reduced the number
of dogs running at large; same veterinarian would also serve Arden
Hills, if requested. Wingert said that Dick Wedell is presenting
a similar ~rogram to Shoreview; suggested possibly pursuing program
on a joint basis with Shoreview, and asked Council to consider a pro-
gram of this nature.
Councl I did not take any action on the proposal.
Mounds View HI~h School Kiln Enclosure
Council referred to memo from Building Inspector Squires (7-9-76)
and concurred that Building Permit for replacement of the kiln
enclosure be Issued, if plans for proposed structure meets State
Code.
Steak Inn - Revised Landscape Plan .
Wingert described the landscaping changes proposed on the Amended
Landscape Plan which includes considerable substitution of species.
After discussion, Council concurred that CouncIl accept the Amended
Landscape Plan (Revised June 1976); Steak Inn to inform City when
plantlngs have been completed for Inspection and certification by
Landscape Inspector.

Federal Revenue Sharing Actual Use Report
McNlesh referred Council to the Federal Revenue Sharing Actual Use
Report prepared as per Councl I approval, and requested Council to
designate boxes to be checked.
After discussion, it was the concensus of the Council that one box
be checked Indicating that Federal Revenue Sharing Funds have preven-
ted Increased taxes.

Utility and Rate StUdy Committee Request for Banister Engineering
Evaluation of Uti Ilty Faci Ilties and Replacement Costs
McNlesh was requested to obtain an evaluation from Banister Engineer-
Ing of estimate of size of this project and a rough idea of costs
entailed.
