Roll Call Present - Mayor Henry J. Crepeau, Jr., Councilmen Charles Crichton, Wil I lam Feyereisen, Robert Woodburn. Absent - Councilman James Winger~ Also Present - Treasurer Donald lamb, Attorney James Lynden, Police Chief Pat Sexton, Clerk Administrator Charlotte McNlesh, Deputy Clerk Dorothy Zehm. Approval of Minutes Feyereisen moved, seconded by Crichton, that the Minutes of Special Counci I Meeting of May 24, 1976, and the Regular Council Meeting of June I, 1976, be approved as amended. Motion carried unanimously. REPORT OF POLICE CHIEF PAT SEXTON Ordinance No. 193 Sexton reported that Sheriff Kermit Hedman met him at Tony Schmidt Park last weekend; noted that park looks better than It has for some time; praised Village Ordinance No. 193. Council concurred with Sexton that signs should be instal led in the park advising of Ordinance provisions. Reserve Unit Rules and Regulations Sexton advised of policing Incidents in the Village over the weekend requiring "back-up" from other police departments; noted Increaslng need for assistance to officer on duty, which can in most Instances be a reserve officer riding in the car. Sexton referred the Council to his memo of 6/12/76, and attached Arden Hi lis Pol ice Reserve Unit Rules and Regulations. The fol lowing changes were ~: Page Delete D. Rejection of Applications, in Its entirety; re-Ietter accordingly. Page 2 - D. Minimum Application Requirements Add: 4. . Page 3 - Applicants shall pass a suitable psychological test for police aptitude. 5. Applicants shall pass training course given by a recoqnized pol ice school or academy. Delete heading CONSTITUTION AND BY-lAWS. Chan~e Article I to F. NAME AND PURPOSE. Delete ;'Sec." before numbers I, :2 and 3. Add No. 19. (Sec. 13.G. from page 4.), . In discussion of th~.~~osed Reserve Unit, Council concurred that badges for Reserve officers4 e ~urchased and owned by the Village. Council ac- tion re Reserve Unit was deferred to Council Meeting of 6/21/76. (McNlesh was requested to check insurance coverage re reserve officers and Sexton was requested to arrange for psychological testing of the two Arden Hi I Is Reserve applicants; cost of testing to be paid by the V i I lage,) REPORT OF VILLAGE ATTORNEY JAMES LYNDEN Ordinance No. 194 Lynden referred Council to his letter of 5/31/76, and attached draft of proposed 6rdinance after which he read the ordinance in Its entirety. After discussion, Woodburn moved, seconded by Crichton, that Council adopt Ordinance No. 194, AN ORDINANCE AMENDiNG ORD. NO. 94 BY STRIKING PROVISION REQUIR~NG LICENSING OF RESiDENTIAL SEWER INSTALLERS AND AMEND- ING ORD, NO. 49 BY CLARiFYING TO WHOM SEWER CONNECTION PERMITS MAY BE ISSUED, as read. Motion carried unanimously. Crichton moved, seconded by Woodburn, that Counci I authorize McNlesh to send letters to licensed sewer installers advising that City licensing of s~~Ar in~Tallars is no lonaer permissible, and that license fee, pro-rated for last one-half (of 1976, will be refunded, Motion carried unanimously. Resolution Vacating Portions of Connelly Avenue and Road Easement Lynden referred Counci I to his letter of 6/14/76 re Resolution Vacating PortJons of Connelly Avenue and Road Easement, noting that some park- Ing stal Is may (according to formerly proposed landscape plan) be located within the 55' wide road easement. !n discussion, it was noted that approval of Flaherty's parking plans is pending approval of grading and landscape plans. Council was in general agreement that action on Resolution Vacating Portions of Connelly Avenue and Road Easement be deferred unti I Flaherty's grading and land- scape plans have bee1 approved. . Proposed Zoning Ordinance Lynden referred Council to his letter of 6/14/76 re Proposed Zoning Ordinance, suggesting the following fo~ Council's consideration: I. Definitions of "Basement" and "Cellar". Recommends that these dEli'initions be the same as those contained in the Building Code. (Definitions on pages 1-3 and 1-5 of Proposed Zoning Ordinance to remain .as written), .2. Aesthetics . Suggested that, since the construction of single family dwel- lings daBs not fall within the purview of th~ Zoning Ordi- nance, perhaps the Subdivision Ordinance (Ord. No. 98) be amended to require subdividers to furnish, along with other documentation required, an Instrument placing architectural and aesthetic controls upon the types of structures to be constructed in his subdivision. 3. Parking on Boulevards Suggested that 3. on page 3-12 be deleted in Its entirety from this ordinance and that regulations re public property be adopted in another ordinance; Zoning Ordinance regulates private property. . if determined that a regulation is needed in the Zoning Ordinance, Lynden proposed that following substitution be made at bottom of page 3-12, 3. "No motor vehicles shall be parked upon any portion of a pub- lic str'eet right..of-way which is not designed, Intended and constructed for vehicular travel. A driveway providIng Ingress and egress to a commercial site, however, may be located within such portIon of a publ Ie street right-of-way." 4. Street ClassifIcations. Lynden recommended that the Zoning Ordinance definitions of the various street classifications be consIstent with the Subdivision Ord. (No. 98) and the ComprehensIve Plan defini- tions; suggested that these definitions be both functional and technical and recommended that the terms "minor street", "collector street", "minor arterial", "major arterial" and "expressway ramp" be defined in the Zoning Ordinance; same definitions be inserted in Sec. 4 of Ord. 98 (except "express- way ramp" which does not appear In Ord. 98); references in Ord. 98 to "thoroughfare" and "ma.rglnal access street" be changed accordingly. Lynden suggested that the actual classification of City streets be done by the City Engineer or Planner. In discussion, it was noted that probably a street map should be prepared Indicating designated classification of all streets In the Village. 5. Effectuation Lynden said he prefers to complet3 this provision at the time he makes his comprehensive review of the proposed ordinance. 6. Numbering of Houses Recommends that requirements for ~ouse numbering be embodied in a separate ordinance; treated separately in the City's forth- com i n g C cd e . . (Council referred matter of house numbering to the Public Safety and Public Works Committees for in-put respeciflca- tions recommendations.) OTHER BUSINESS . Case No. 76-11, SpecialjL:;e Permit - Thoma~; Hor::.!.t.. Council reviewed the plans submiTted and the Planning Commission recom- mendations, and Mr. Horty described the proposed enclosure. Crichton moved, seconded by Feyereisen, that Council approve the Issu- ance of a Special Use Permit for swimming pool enclosure at 3420 Glenarden Road in accordance with plans submitted (dated 5/13/76). Mo- tion carried unani~ously. Case No. 76-10, Variance - Brian Irvi~ Counci I reviewed the Board of Appeals and Planning Commission recom- mendations and sketch of site presented wi1h application. Woodburn moved, seconded by Feyereisen, that Council approve the I' sldeyard setback variance and aggregate 4' sideyard setback variance at 1858 Beckman Avenue. Motion carried unanimously. -3- Minutes of Regular Counei I Meeting Paga four June 14, 1976 Human Rights Comm'Eion Brochure Feyerelsen moved, seconded by Crichton, that Counci I authorize the enclosure of the Human Rights brochure ~/ii"h the next utility mailing. Motion carried unanimously. (It was suggested that enclosure with the next Town Crier might be an alternate possibility.) . Finance Committee Recommendations A. Insurance Consultant Council reviewed recommendations of Finance Committee (6/10/76). and after discussion, requested McNiesh to contact William Peet Co. re cost of preparing Vi Ilage Insurance specifications for advertisement for bids. B. Authorities and Procedures for Purchasing Council reviewed Finance Committee recommendations (6/10/76). In discussion, concern was expressed that all department heads have a clear understanding of purchasing authority. Crichton agreed to draw some guidelines for Council's consideration. Letter re Residential Construction in Arden Hills Deferred to later Council Meeting. REPORT OF VILLAGE PARKS DIRECTOR JOHN BUCKLEY Garden Lease Agreement Buckley referred Council to the Garden Lease Agreement with United Power and Land Company, advising that agreement Is identical to N.S.P. Garden Lease Agreement, except that requirement to mow area when not used by Village, was deleted. Woodburn moved, seconded by Crichton, that Counci I approve the Garden Lease agreement between United POWer and Land Company and the City of Arden Hills, and authorized Its execution oy the Mayor and Clerk Administrator. Motion carried unanimously. CETA Title VI Emploxe~ Buckley referred Council to his memo of 6/9/76 re CETA Employee Fred Bell. ..After.disc.usslon, Crichton moved, seconded by Woodburn,.that authorize the continued employment of Fred Bell as a regular employee starting August I, 1976, for balance of this year. carried unanimOUSly. Tennis Instructors Crichton moved, seconded by Woodburn, that Counei I authorize the con- tinued hiring of Margarita Rlchenberg and Scott Hogberg as Tennis Instructors for th~ Intermediate Tennis Program at $6.00/hour. Motion carried unanimously. 4It Council noted that one tennis net is broken at the Mounds View High School courts; s'Jggested interim ,-epair of net to ma~:e court usable, pending net replacement or major repair. Summer Transportation Needs Buckley referred Councl I to his memo of 6/11/76 re Transportation fo. Summer Employees. After review of The several options suggested, and discussion, Crichton ~ moved, seconded by Woodb'urn, that Council authorize the rental of '75 Century from Buerkle Leasing Co. at $160.00/month for three months. Motion carried unanimOUSly. (McNiesh was requested to add I~ased car to Village Onsurance polley for three months.> -4.. Minutes of Regular Council Meeting Page five June 14, 1976 ~ul Iding Coordinator Costs Buckley reported that Building Coordinator costs have been substan- tiated; Arden Hil Is received its budget figure from the Community Education Department; therefore, recommends Vi Ilage pay the amount bud- geted. Buckley was requested to submit copies of Arden Hills Building Coordinator costs to Council for its consideration. . Ordinance No. 193 Buckley reported that there are situations when beer drinking may be desirable in the Village parks (e.g. after slo-pitch games, family unit picnics, etc.); Parks Committee requests that matters involving park usage be referred to it for its recommendations, prior to Council action. Council advised that Ordinance No. 193 was adopted to try to solve a "very real problem" at one park; considered it necessary to have same regulations In all parks within the Village for enforcement purposes. Buckley said he will send copies of Ord. No. 193 to team managers and request their cooperation,and comments. Dutch Elm Buckley reported that Dutch Elm disease is very prevalent in Arden HII Is this year, particularly in the Lake Josephine area; citizens have been most cooperative - really want to do what is best to eliminate spread of the disease; this year wi I I probably be the peak year - should experience a reduction of Dutch Elm disease next year. Cummings Park Plan Proposals Buckley reported that concept plans for Cummings Park are completed and will be considered by the Parks Committee at its next meeting. REPORT OF VILLAGE CLERK ADMINISTRATOR On-sale Liquor License Fee - Arden Hills Club Counci I was referred to memo from Larry SqUYres dat~d 6/4/76 and to letter from Arden Hills Club requesting the reduced liquor license fee. After discussion, Feyerelsen moved, seconded by Woodburn, that Council approve the $3500 annual on-sale liquor license fee, based on report from Larry Squires dated 6/4/76; Motion carried unanimously. McNlesh was requested to advise Arden Hills Club of Council's action wh I ch is based on areas noted I n report of Bu i I ding Inspector; liquor will no longer be consumed at poolside etc. Federal Revenue Sharin Planned Use Re ort McNlesh referred Council to her memo of 4/76 re suggested "Planned Expenditures" for Federal Revenue Sharing 1th Entitlement Period. After discussion, Woodburn moved, seconded by Crichton, that Councl I publish the Planned Use Report for the 7th Entitlement Period as fol lows: . Audit Fee and Publishing, Fed. Application for Payment No.2, Indian Oaks II - C. W. Houle Landscaping Company, I nc. McNiesh referred Counci I to Application for Payment No.2 to C. W. Houle Landscaping Co.; noted that $21,006.54 does not include 10% retainage. Woodburn moved, seconded by Crichton, that Counci I approve application for Payment No.2, authorizing payment of $21,006.54. Feyereisen moved, seconded by Woodburn, that Counci I approve the Claims and both Payrolls (regular and CETA) as submitted. Motion carried unanimouSly. Zoning Ordinance Review Deferred to Councl I Meeting of June 21, 1976. . Letter from McFarland re Lake Johanna Weed Control Council was referred to letter from Mr. McFarland requesting Vii lage participation in weed control of Lake Johanna. After discussion, Council referred matter to Parks and Recreation Committee for its recommendations for future years; not budgeted this year.
