CALL TO ORDER
Pursuant to due call and notice thereof, Mayor Crepeau called the
meetin~ to order at 7:30 p.m.

ROLL CALL
Present - Mayor Henry J. Crepeau, Jr., Councilmen Charles Crichton,
James Wingert, Robert Woodburn, Wi " lam Feyereisen.
Absent - None.
Also Present - Treasurer Donald Lamb, Police Chief Pat Sexton,
Officer James LaValle, Clerk Administrator Charlotte
McNiesh, Deputy Clerk Dorothy Zehm.
APPROVAL OF MINUTES
Wingert moved, seconded by Crichton, that Counci I approve the
Minutes of the Special Council Meeting of May 17, 1976, as
amended. Motion carried unanimously.
Skyline Builders Request to Stockpi Ie Clean Fi II .
Mr. Bill Keefer, President of Skyline Builders advised CounCil of
his proposed 21 lot single-fami fy plat for area west of Houle
Addition, between 1-694 and County Road F and asked Counci lIs
permission to al low him to stockpi Ie 15,000 to 20,000 cubic yards
of Class 5 material and white sand on a portion of the proposed plat
site, pending approval of the plaT.
After review of proposed plat, conTour maps of the area, previous
correspondence from Rice Creek Watershed re previous proposals for
development of this site, and memo re telephone report from Engineer
Lund, Crichton moved, seconded by Crepeau, that Council authorize
the temporary stockpi lIng of Class 5 material and a small amount of
whiTe sand, by The City of Minneapol is, in area covering propOSed
lots 4-1 I and on proposed north/south roadway from County Road F
(Sketch received 6/1/76), for 6 months (to Dec. I, 1976); propOSed
roadway from County Road F to be ingress and egress for fi I I operation;
Skyline Builders, Inc. be reQuired tc remove fill at conclusiqn of
6-month period unless an acceptable plat has been fl led at that time.
Motion carried (Crichton, Crepeau, Wingert voting in favor of the
motIon; Feyereisen abstaining; Woodburn voting in opposition.)
(Council remInded Mr. Keefer that approval of The fill proposal
should also be ob1-ained from Rice Creek Watershed District.)
REPORT OF POLICE CHIEF PAT SEXTON

Tony Schmidt Park
Sexton referred Counci I to his letter to Bernard Edmounds, Director
of Recreation, Ramsey County, describing the numerous pol icing
problems encountered at Tony Schmidt Park. Sexton stated that years
ago beer, wine etc. were not permitted in this park, and POlicing
')roblems wel-e negligible; since Cities of St. Paul and ~1inneapolls
have prohibited all alcoholic beverages in parks within the Cii'ies,
problems in this park and other Ramsey County suburban parks have
increased Ithere alcoholic beverages are permiTted; main troubles
seem to be with large beer drinking groups - as soon as one trouble-
Some group is removed from the park, another moves in; use of park
for fami IV picnics has diminished noticeably in recent years, which
he attributes to The frequency of unruly drinking groups.
.In di~cussion, Council expreSsed concern re the illegal and uncontrolled
behaVior at Tony Schmidt Park; questioned whether trouble is attrib-
utable to drinking or unlawful activity - if other laws are not
obeyed, law prohibiting liquor would probably also not .be obeyed.
Sex:on and LaValle felt that enforcement of a non-alcuholic beverage
ordInance would not be as difficult as enforcement of other behavior
violations - difficult to determine actual vandalism violators in a
large group etc.

Feyerelsen moved, seconded by Crepeau, that the Counci I give AN
ORDINANCE PROHIBITING USE OF ALCOHOLIC AND INTOXICATING BEVERAGES
IN ALL PUBLIC PARKS LOCATED IN THE CITY OF ARDEN HILLS, its second
and final reading; read the ordinance aloud In its entirety; moved
Councl I adoption of the ordinance as read; authorizing Its publication
and execution by Mayor and Clerk Administrator. Motion carried
(Feyereisen, Crepeau, Crichton voting in favor of the motion;
Woodburn abstaining; Wingert voting in opposiTion).

Police Res~rve Unit
Sexton reported That the two Arden Hi I Is Police Reserve applicants have
graduated; both did very well; are currently riding in squads with
Poi ice Officers - this is part of the Pol ice Reserve curriculum;
Rules and Regulations have been revised. Councl I noted that Rule.s
and Regulations for an Arden HI lis Police Reserve Unit have not
been approved to date; should have Counci I approval prior to permitting
their working with the Police Department; a Police Reserve Unit in
Arden Hills has not, as yet, been authorized.
(Copies of proposed Rules and Regulations, as amended, should be
given to Counci I for its consideration. Sexton said that theSe
revised and condensed Rules and Regulations are the ones used
throughout the Twin City area; had thought they had been senT to
Counc I I I ast week.)
Enforcement of Laws on County Open Space and Park Properties and
Other Private a~~ Semi-privaTe Properties
Sexton advised that the Police Department has agreements with Ramsey
County, School District, Bethel Col lege, Commercial properties etc.
to make arrests; do not have such an agreement with Northwestern
Col lege, which usual iy Is served by Roseville Police Department.
OTHER BUSINESS
Sitzmark Ski and Sai I - Wm. Weglaitner
Mr. Wegleitner introduced his store manager, Tim Nelson, and explained
that he had received notification from Larry Squires, that he Is In
violation of Ordinance 99 for outsIde storage of boats In his parking
lot, whIch reduces his parking lot capacity. Wegleitner presented
pictures of the SI.tzmark site, t3ken from the roof of McGuire's
Inn, and read letters from Carroll Furniture, McGulres, St. Paul
Book and Stationery in support of the outsi~e boat display which he
said is essential to the operation of this portion of his business;
some of the boats are too large to be adequately displayed indoors.
Wegleitner explained that he actually has two seasonal businesses
(Sail - April It,:>Sept.1 and Ski - Sept. I to April I). He
explained that during the summer months the reta; 1 sales portion of
the bui Iding is the Centel- portion only; two larger portions are
used for storage - In the winter months the reverse is true; therefore
his parking requiremenTs (Ore. 99) change - does not need the number
of parking stalls in the summer -rhat are required for his winter
business because retail sales area of bui Iding is greatly reduced.

Wegleitner explained that boat display in parking area is not a
"sales lot"; sales are made from within the bui Iding, where it is
impossIble to adequately show some of the large boats (tal I masts,
difficulT maneuverin~l space etc.) He explained he has about 12
diff-erent boat models; only the largel- of which are outside.

After discussion, Woodburn asked Mr. Wegleitner if he would actively
pursue an application tor Variance to permit the outdoor display of
12 - 15 boats for a specified length time, if Councl I rescinds Its
previous action requiring the removal of the boats which are stored
outdoors on The premises. WegleiTner agreed to make application for
such a variance.

Woodburn moved, seconded by Feyereisen, that Council suspend action
of last week (5/24/76) directing that boats be removed entirely from
the outdoor premises of Sitzmark Ski and Sail. Motion carried.

and Wingert voting in opposition.)

M.T.C. Bus Route #38
Crichton reported thaT he met with the General Mana!:rer of Operations
at M. T .C. and found that although M.T .C. had not actually priced out
alternative routes, subjeCTive evaluations of potential ridershi~,
etc. had been made.
McNlesh reported two cal Is from Arden Hi lis residents advising
Counci I of their desire that Route 38 be approved - would use this
express route to downtown Minneapolis.

June Counci I Meeting Schedule
Wingert moved, seconded by Feyereisen, that June Counci I Meetings be
scheduled on June 14,21 and 28 at 7:30 p.m. aT the Village Hall.
Motion carried unanimously.
1976 Elections - Precinct Boundaries and Foiling Places
McNiesh referred Counci I to her memo of 5/28/76 re proposed alternate
polling places for Precincts I and 2, and/or split of Precinct I,
tor Council consideration.
After discussion, Feyereisen moved that Councl I aUThorize changing
the Polling Place for PI-ecinct No. I to Valentine Hills Elementary
School. Motion was seconded by WingerT an~ carr1ed unanimously.

Crichton moved, seconded by Feyereisen, that Counci I authorize
the hiring of the fourCETA empl~yeesat the rates liSTed in

Park Equipment Purchases
Crichton moved, seconded by Wingert, that Counci I authorize
the purchase of the Climbing Net for Ingerson Park at $650.

aT $185 (Sports Eouipment - #215), Motion carried unanimously.

Proposed Sprinkl in_g Ban.
McNiesh referred Cou'1cll to her memo of 6/1/76 re possible sprinkling
ban during Water Towt3r Painting. Crichton moved, seconded by
Feyereisen, that Council author'ize Village Engineer, Public Works
Sup8rviso~ and Clerk Administrator to Instioate the Sprinkling Ban

procedure outlined in memo, If the need for the ban is determined.
Motion carried unanimously.

McNamee Letter of 5/21/76
McNiesh was requested to refer matter TO Engineer Christoffersen
for his '''casual observation" as to what can be done, and rough
estimates of costs - not a full Engineering report; McNamee to be
invited to attend Jcne 21 Council Meeting when Engineer will be
present.
Hlqhway Department Letter of 5/6/76 Re Highway Easement Coverinq T.H. 51
McNlesh was requested to refer matter to Attorney Lynden to advise
state of Minnesota Department of Highways of Arden Hi lis desire to
acquire the easement area abutting Cummings Park and to request cost
of acquisition.
Letter Re Stowe Avenue - 5/26/76
McNlesh was requested to ask CounTY to re-name entire street Stowe
Avenue (New Brighton Road to Cleveland, and to notify New Brighton
of The request to see If this re-naming of the 4th Avenue section wi II
present any prOblems.
Lexinqton Avenue DrainaQe
Woodburn reported on meeting with County and state Highway Departments
re drainage on Lexington Avenue; if Village wants drainage study,
should be done now whi Ie funding Is available - suggested a joint
powers agreement with Shoreview would be necessary; County has
funds to wide~ Lexington (County Road E to Highway 96); County
requests '16i' easement and a to I tr-i ang I e at Grey Fox Road, adjacent
to Gould property.
Crepeau advised he was told by County to advise Goulds that there
would be no assessment If these easements are given to the County;
he has so advised Goulds.
McFarland Letter re Aquatic Weed Control
McNlesh was requested to send copies of tetter from Keith McFarland
to members of the Councl I.
Fireworks Display Permit
Feyereisen moved, seconded by Wingert, that Counci 1 approve Issuance
of a Fireworks Display Permit on July 4, 1976, to North Lake
Josephine Improvement Association. Motion carried. (Feyereisen,
Wingert, Crepeau, Crichton voting in favor of the motion; Woodburn
abstaining.)

Baseball Diamonds - Joint Powers Aqrecment
Woodburn moved, seconded by Feyereisen, that Council approve Joint
Powers Agreement Regarding Use of Independent School District No.
621 Bal I Fields, aa submitted; authorizing its execution by the
Mayor and Clerk Administrator. Mo1'ion carried unanimously.
ZonlnQ Ordinance Review
Council referred to memo of 5/27/76, ollti ining Pending Re-:,wrltes TO
Proposed Zoning Ordinance.
Crichton referred to page 4-27 O. Appeals and proposed that 0, Appeals
I. 2. and 3. be deleted from page 4-27, and proposed that C. Powers
(p. 4-24) be revised as follows:
Last two sentences of paragraph no. 2 be inserted as no. 4.
"The findings and determinations of the Board (delete~on
variancei) shal I be advisary ....".
(Paragraph I had previously been amended by deleting "and
decide" in first line, and by adding "and reporT its findings
and determinations to the Counci I for its action." to the end
of the sentence).
Council agreed to these changes as presented.

A single family dwelling and customary accessory buildings
may be erected in any distriCT In which single family
dwel lings are permitted on any single lot of record at
the effective date of adoption of or amendment to this
Ordinance. This provision applies to lots which do not
meet area requirements and/or do not meet width require-
ments, but meet other requirements of the district In
which the lot is located.
