Crepeau, Jr., Counci Imen Wi II lam Feyerelsen, James Wingert, Charles Crichton, Robert Woodburn. Absent - None. Also Present - Treasurer Donald lamb, Police Chief Pat Sexton, Clerk Administrator Charlotte McNiesh, Deputy Clerk Dorothy Zehm. APPROVAL OF MINUTES . Special Counci I Meetinp - January 2, 1976 Crichton moved, seconded by Wingert, that the Minutes of the Counc! I Meeting of January 2, 1976 be approved as submitted. carried unanimously. Special Motion . Regular Counci I Meetln~ - December 29, 1975 Wingert moved, seconded by Crichton, that the Minutes of the Council Meeting of December 29, 1975 be approved as amended. carried unanimously. Regular Motion BUSINESS FROM THE FLOOR None. REPORT OF POLICE CHIEF PAT SEXTON Pollee Reserve Training Program Sexton reported that five persons were accepted In the Arden Hills Reserve Training Program; three of the five actually started the 16-week course on Janu~ry 7th (Herb Tetley, Paul Hustings and Oennls Lundholm) . (Council noted that the Ru-'es and Regulat'ions for the Arden Hi lis Program should be resolved by Councl I and Chief Sexton prior to completion of the 16-week course.) Squad Car Leasing Sexton reported that the possibi tities of "closed-end leasing" of squad cars is being st~dled by the Police Department; both squad cars are presently within 10,000 miles of each other at about 65,000 mi les. Sexton was requested to include lease of "unmarked car" in leasing study, as wet t as the two squad cars, and to obtain Information re Vi Ilage maintenance of le3sed cars. REPORT OF CLERK ADMINISTRATOR CHARLOTTE ~CNIESH MTC Request for Approval of Proposed Express Route An Image of the proposed express route was shown, and McNiesh reported that bus stop locations will be establ iS1ed after route is approved. . Wingert no~ed that the Route Ridership Committee had originally pro- posed a route extending along County Roa~ E2 to Old Highway 10 to Bethel College. After discussion, McNiesh was requested to inquire whether the loop in Arden Hi lis could be extended east along County Road E2 to Old Highway 10 (Bethel College); also to suggest that route then possibly continue south on Old Highway 10 to lake Johanna Boulevard and west on County Road D to 35W (serving more Arjen Hi I Is residents). McNiesh was also requested to obtain MTC projections as to when Route 38 wll I be self-sustaining. Councl I action re route approval was deferred pending receipt of requested information. -1- Minutes of Regular Council MeE>ting Page two January 12, 1976 Resolution No. 76-4 - Suburban Rate Authority Crepeau designated Councilman Feyereisen as Director and Councl'man Wingert to serve as Alternate Director of the Suburban Rate Authority. Crichton moved, seconded by Wingert, that Counci I adopt Resolution No. 76-4, RESOLUTION DESIGNATING DIRECTOR AND ALTERNATE DIRECTOR TO SUBURBAN RATE AUTHORITY. Motion carried unanimously. License Approvals After review of list of ten (10) 1976 License Applications, Feyerelsen moved, seconded by Crichton, that Council approve the Issuance of licenses, as listed; rubbish hauler I iconse approvals are subJect to approval of the Health Officer. Motion carried unanimously. . Cla'.s and Payroll Crichton moved, seconded by Feyerelsen, that Council approve the Claims and Payrol I as submitted. Motion carried unanimously. . Acting Treasurer Crichton noted the added cost of bonding an Acting Treasurer, as wel I as Treasurer. After discussion re necessity of Acting Treasurer and Treasurer, Councl I and Treasurer Lamb concurred that appointment of Acting Treasurer be rescinded; Treasurer signature stamp be used In lieu of Treasurer's signature, in his absence; two actual signatures be required on each check. McNlesh was requested to prepare amended resolutions and to obtain new signature cards to reflect Council's action and to obtain a credit for cancelling bond of Acting Treasurer. Special Use Permit - Time Limit McNlesh referred Council to her memo of 1-9-76 re the six-month ex- piration provision for Special Use Permits, and noted that the TCCH Special Use Permit was dated August 25, 1975 and the Presbyterian Homes Special Use Permit was dated September 8, 1975. Councl I requested McNiesh to advise TCCH and Presbyterian Homes of the Special Use Permit expiration provisions and to ask each for a "good" estimate of anticipated construction starting date. Case No. 72-35, Pemtom, Inc. - Townhous.~ Villages at Arden Hills, Seventh Addition McNlesh referred Council to Attorney Lynden's letter (1-12-76) and attached Agreement waiving guarantee bond requirement re Townhouse Villages at Arden Hills, 7th Addition. After discussion, Woodburn moved, seconded by Wingert, that Council approve execution of the Agreement by the Mayor and Clerk Administrator, as submitted. Motion carried (Wnodburn, Wingert, Feyerelsen, Crepeau voting in favor of the motion; Crichton voting In opposItion). OTHER BUS I NESS . Human Rights Commission Resignation Feyereisen moved, seconded by Crichton, that Council accept the resignation of George Weiss from the Human Rights Commission. Motion carried unanimOUSly. Human Rights Commission Appointment Mayor Crepeau appointed R. W. Steele as a member of the Human Rights Commission through 1977, to fiil the unexpired term of George Weiss. Wingert moved, seconded by Crichton, th<lt Council approve the appoint- ment through 1977. Motion carried unanimOUSly. Temporary Permits McNlesh referred Council to Attorney Lynden's letter (1-12-76) re Refundable License Fees and Penalties, and to the recommendations of the Finance Committee re Resolution No. 72-57. -2- Minutes of Regular Council Meeting Poage th ,"ee January 12, 1976 . After discussion, Woodburn moved, seconded by Crichton, that Council approve the recommendations of the Finance Committee (Minutes of Finance Committee Meeting of 12/11/75), with the following changes: I. Modify #5, Flaa Markets, to include side-walk sales, etc. 2. De lete #9 an d 6 I I . 3. Include mobile vendors (popcorn wagons, etc. In 612 (Itin- erant vendors). Motion carried unanimously. McNiesh was requested to prepare a Resolution for Council considera- tion, rescinding Resolution No. 72-57 a~d Establishing Permit Re- quirements and a Schedule of Permit Fees for Certain Activities In Arden Hi I Is. . House Numbering Deferred. . Proposed Parks Expendi~ures Crichton described the status of the 1975 Parks and Recreation Depart- ment Budget re site improvements proposed at Perry, Floral and Inger- son parks: Perry Park - benches and bleachers Floral Park - climbing structure (now costing an estimated $1500) Ingerson Park - corgo net $850 $1300 $300 Crichton reviewed previous Counci I action authorizing these expendi- tures, provided that site improvement budget, as well as total Parks Budget, I s not exceeded (II -24-75) . After discussion, Crichton moved, seconded by Woodburn, that Council authorize the $850 expenditure for the benches and bleachers at Perry Park from the 1976 Park Fund (Fund No. 801). Motion carried (Crichton, Woodburn, Wingert, Crepeau voting in favor of the motion; Feyerelsen voting in opposition). Connelly Avenue Status Report McNlesh was requested to ask Attorney lynden for report re status of Connelly Avenue acquisition and dedication. Proposed Zoning Ordinance Review Wingert proJected an Overview of the Proposed Zoning Ordinance for Council consideration, and briefly described the four parts Into which the proposed zoning ordinance is divided, and the various application p rocedu res. Wingert moved, seconded by Woodburn, that Counci I introduce the ordinance by title, AN ORDINANCE AMENDING ARDEN HILLS ORDINANCE NUM- BER 99, THE ZONING ORDINANCE, IN ITS ENTIRETY BY CODIFYING PRIOR AMENDMENTS THERETO AND MAKING FURTHER AMENDMENTS TO THE PROVISIONS REGULATING THE USE OF LAND, THE LOCATION AND THE USE OF BUILDINGS AND THE ARRANGEMENT OF BUILDINGS ON LOTS IN THE CITY OF ARDEN HILLS, MINN- ESOTA; ADOPTING A ZONING MAP: ENACTING ADMINISTRATIVE PROCEDURE FOR ENFORCEMENT; REPEALING INCONSISTENT ORDI~ANCES; AND IMPOSING PENALTIES FOR VIOL~TION THEREOF. Motion carried unanimOUSly. . In review of the Proposed Zoning Ordinance (Dec. 30,1975), Council reviewed pages I through Definition No. 47 on page 7; noting the fo I low i n g: I-I No.9 - questioned meaning of "efficient". I-I No. 10 - are "public services" enumerated somewhere In the ordinance? 1-3 Definition No.2. Acre, Net was amended to read "One (I) acre of land, as finally built, minus the following:...". 1-3 and 1-5 "Basement" and "Cellar" definitions were confusing. 1-7 Definition No. 46 - questioned whether "basement" or "cellar" should be used in definition - considered definition to be cumbersome. 2-2 Land Use chart was amended to add Boarding House and insert- Ing and S in all residential zones. -3- . . . . , . February Counci I Meetinqs Crichton moved, seconded by Feyereisen, that Councl I schedule a Special Council Meeting at 7:30 p.m. on Monday, February 2. 1976, for Comprehensive Plan and Zoning Ordinance review, and Regular Counci I Meetings at 7:30 p.m. on Monday, February 9th and 23rd. Motion carried unanimously.
