Absent - Councilman Maurice Johnson Also Present - Treasurer Donald Lamb, Planner Orlyn Miller, Clerk Administrator Charlotte McNiesh, Deputy Clerk Dorothy Zehm Approval of Minutes Wingert moved, seconded by Hel lenhorst, that the Minutes of the Regular Council Meeting of July 27th be approved as amended. Motion carried unani- mously. Business from the Floor None REPORT OF VILLAGE PLANNER ORLYN MILLER Proposed Public Access - Lake Josephine Council was referred to Planning memo (7-22-81) and to the Planning Commission minutes of 8-5-81. Miller reported that Ramsey County has scheduled an Informational meeting at the Roseville Village Hal I on Monday, August 17th at 7:30 p.m. relative to this proposal. Miller explained that the City of Rosevil Ie can approve or disapprove the project since the proposed access is In Rosevill~; noted that In-put from Arden HII Is has been invited. Miller reported that the Planning Commission recommends approval of the pro- posed access; feels al I lakes are a publ ic resource and the publ ic should have the right to use the lakes; noted that the Commission stressed very strongly that surface control regulations should be in effect Immediately If public boat access Is provided. Miller referred Council to an excerpt from the Ramsey County Comprehensive Plan In which future development Included access to the lake for boating, fishing and canoeing; also proposing establishment of a lake surface use ordinance In conjunction with the development plan. . In discussion, Dr. Kennedy, 1280 Ingerson Road, asked when the publ ic beach became official on Lake Josephine, and asked who Is Instigating the boat access. Miller said that Ramsey County Parks and Recreation made appl 1- cation for the Lawcon funding; apparently are looking for additional recrea- tional areas; probably have had requests to add a public access. Miller said he did not know when the public beach was establ ished. Kennedy commented that other lakes (Como and Phalen) do not have boat access. Carrie Wasley explained that Ramsey County Is not pursuing the access; is reacting to a possible need and Is requesting municipality in-put relative to the proposa I . Harold Riley, 1270 Ingerson Road, asked if the County wil I feel any continu- Ing responsibll ity for the access if it is installed. It was explained that the County has the responslbil ity of control, which Is not proposed at this time. It was noted that the County has patrol equipment, but it's not there at all times. Gloria Kennedy asked the proposed location of the publ ic access whiCh Miller Indicated on a sketch of the proposed impr.ovement. Minutes of Regular Council Meeting August 10, 1981 ." Mrs. Krlvit said she lives on the north shore of lake Josephine; recal Is that when the public beach was put In, there was a stipulation that there would not be a boat access - the lake Is too sma I I. Mrs. Krlvlt said it was an unsafe situation then and would be an unsafe situation now. Judy (Inaudible) asked if studies have been made relative to pollution or traffic Increase, with the addition of a boat ramp. Miller said he was not aware of any such study; no specific projections have been made except that It Is considered unlikely that al I boat trailer parking spaces would be utilized at the same time. Some of the comments from the floor were: I. If more than three skiers are on the lake at one time, they're in serious trouble. 2. Rule establ ished ~ow by lake residents Is that skiers circle the lake counter-clockwise; publ ic would not know of this rule. 3. Situation Is almost unsafe the way It Is now; probably should permit only canoes and sail boats, which probably cannot be done - If one type of boat Is al lowed, you must al low al I types. . Bruce Fehr said the lake is border I Ine now for safety because of too many boats; there are more boats now than the lake can handle. AI Olen, corner of Hamllne and Ingerson, said that If big power boats are per- mitted, a real danger would be created. After discussion, McAllister moved, seconded by Wingert, that Council authorize preparation of a resolution opposing the proposed plan for development of a public boat access on lake Josephine. Motion carried unanimously. (4-0) (Copies of Resolution to be sent to Commissioner Orth, Bernie Edmonds (Ramsey County Parks Department) and to the City of Rosevllle). Clarifications Relative to Amended Permanent Special Use Permit - Bethel Colle e Miller explained that the percentage of 15 does not Include the athletic com- plex; upon closer check, existing coverage (buildings, drives, parking, etc.) is closer to 12%; with the athletic complex, coverage it is 15%+; Miller ex- plained that 25% coverage was considered appropriate f$r full development; noted that 25% pertains to land area and is not considered extensive. After discussion, Councl I concurred with the Amended Special Use Permit as drafted. Other Business Reconsideration of Resolution No. 81-52, Ordering Preparation of Proposed Assessment, P-80-I, County Road E Woodburn moved, seconded by Wingert, that Council reconsider the motion approving Resolution No. 81-52, In part. Motion carried unanimously. (4-0) After discussion, Council generally concurred that it would be more appropriate to use the MSA monies as part of the City's share after the 50/50 split of the I~provement costs. ... Hol lenhorst moved, seconded by McAllister, that Council amend the ~tlon approv- ing Resolution No. 81-52, changing it to read that the assessments wlJ I apply to frontage and square footage as previously del ineated, and changing the fund- Ing spl it so that 50% is apportioned to assessments and 50% to the City, with available MSA funds to be appl led to the Village portion. Motion carried unani- mously. (4-0) Belair Builders Request for Time Extensions Council was referred to letters from BelaIr Builders, Inc. of 7-29-81 and 8-4-81 requesting an additional 90 days for final plat approval and an eighteen month extension for payment of the balance of park dedication for Janet Estates. -2- J Minutes of Regular Council Meeting August 10, 1981 After discussion, Wingert moved, seconded by McAllister, that Council grant an extension to December 8, 1981 for filing the final plat of the amended Janet Estates plat, as requested. Motion carried unanimously. (4-0) Wingert moved, seconded by Woodburn, that Council grant an extension for pay- ment of the balance of park dedication for Janet Estates to December 8, 1981. Motion carried unamously. (4-0) . Request to Amend Sunday On-Sale Liquor Ordinance Counci r was referred to letter from McGuire's Inn (8-4-81) requesting Council's consideration of recent legislation al lowing on-sale liquor sales on Sundays beginning at 10:00 a.m. In places where food is served. Wingert moved, seconded by McAllister, that Council Introduce Ordinance No. 220 by title, AN ORDINANCE AMENDING SECTION 3-16(c) OF THE ARDEN HILLS CITY CODE RELATING TO SUNDAY ON-SALE LIQUOR. Motion carried unanimously. (4-0) Parks Director Job Description Council was referred to memo from Councilman McAllister and attached description of the position of Parks Director for Council's consideration and In-put. In discussion, the fol lowing comments were made: I. Forester Is a separate title - not necessarily the Parks D I rector. 2. Second paragraph of Primary Objective of Position should be amended to read "To develop'and maintain an adequate park and trail system with the necessary facl I. itles according to the City's park plan". . 3. Under Major Areas of Accountabll ity, change No.8, second sentence, ta read' "Selects, trains and evaluates all department employees". 4. Extent of Supervision Provided - amend to read "Works under the general supervision of the Mayor and Council" (omit balance of sentence. 5. Queried the meaning of "Provides emergency cal I coverage as required" (Page 3 - Responsibility for Public Contact). 6. Supervision of Others - amended as follows: "Provides supervision for all personnel assigned to II Park Maintenance, Self-Sustaining Recreation Programs. McNlesh was requested to obtain some sample evaluation forms which might be appropriate for City use. Council concurred that the evaluation should be completed before the end of the year; tabled discussion pending consideration of forms at a later meeting. . REPORT OF CLERK ADMINISTRATOR CHARLOTTE McNIESH Resolution No. 81-54, Ordering Assessment Hearing for Improvement No. 55-W-80-2 (Kenna Addition) on Auqust 31st Wingert moved, seconded by Hol lenhorst, that Council adopt Resolution No. 81-54, ORDERING HEARING FOR iMPROVEMENT NO. 55-W-80-2 (KENNA ADDITION) ON AUGUST 31ST. Motion carried unanimously. (4-0) (It was noted that the Engineer has advised the developer of the 100% assessment.) Claims and Payroll Wingert moved, seconded by Hollenhorst, that Council approve the Claims and Payroll as submitted. Motion carried unanimously. (4-0) -3- \ Minutes of Regular Council Meeting August 10, 1981 Status Report - 1982 Proposed Budqet McNlesh reported the 1982 estimated expenditures in the General Fund are about 6.6% over the 1981 Budget; the estimated revenue is 60,000 less than last year due primarily to a change In formula. Council discussed various means of raising the needed additional revenue. No determinations were made. It was noted that the Finance Committee will meet with Council and staff, after review of the proposed Budget and then make its Budget recommendations, preferably without Council In-put. Transfer of Funds Council was referred to McNiesh's memo of 8-10-81 recommending transfer of ... funds effective July 31st. After discussion, Wingert moved, seconded by McAllister, that Council approve the permanent transfer of about $150,000 from the Sewer Sinking Fund 503 and the temporary transfer of about $50,000 from the Permanent Improvement Revolv- ing Fund 699, as outlined in McNlesh's memo. Motion carried unanimously. (4-0) Counc II Reports Council was reminded of the AugusT 19th Ramsey County League of Local Govern- ments meeting at 7:30 p.m. at the Rasevll Ie CITY Hall regarding Rosevll Ie's experience In the recent Tornado disaster. Letter from Attorney Lynden regarding Increased fees and estimaTed cost of Ramsey County SHeriff In 1982 were briefly discussed. McNlesh was requested to ask Shorevlew to share cost of energy for County Road F/Lexington semaphore with Arden Hills.
