REPORT OF VILLAGE ATTORNEY JAMES LYNDEN Ordinance No. 219 Wingert moved, seconded by Hollenborst, tbat Council suapend the rulea and consider tbia the firat and final reading of Ordinance No. 219. Motion carried unanimoualy. Johnaon moved, seconded by Wingert, tbat Council adopt Ordinance No. 219, AN ORDINANCE AMENDING SECTION 19-58 OF THE ARDEN HILLS CITY CODE RELATING TO VACATION 'RATE OF ACCRUAL, AS AMENDED. Motion carried unanimoualy. Reaolution No. 81-39 Lynden explained tbat the vacation proceedings are being initiated by tbe City Council after determining that it is in the public interest; could alao have been initiated by the developer (Ron Christianaen) . After discussion, it waa moved by Wingert that Council approve Resolution No. 81-39, INITIATING VACATION PROCEEDINGS AS TO SERVICE ROAD LYING ADJACENT TO HAMLINE AVENUE NORTH AND SOUTH OF WESTERLY TERMINUS OF TILLER LANE. Motion was aeconded by Hollenhorat and carried uaanimoualy. Lynden noted that in the case of a variance, two findings are to be aade: 1. An undue hardship, topographical in nature exists, and 2, The variance will not be detrimental to the general welfare of the public. Lynden noted that the reason or baais for the findings, either pro or con, should be given. . Dave Shannon (Aaerican Sign and Indicator Corporation) asked that Council reconsider the request for variance based OD the original variance for the existing sign- location of trees; wants to replace this sign; reason for variance is still there; noted that the bank needs a sign'to tell the public the bank is there; sign aeets ordinance require.ents; reason for original variance still exists. A diagre. indicating existing trees on the site waa reviewed in- dicating that 7 trees remain ~in the proposed sign location, only two of whicb essentially are living; it was noted that there conaequently is soae question as to whether the basis for tbe variance still exists. Donovan (Roseville State Bank) said the dead trees vill be re.oved; noted that at the required)5' setback, sian will be on the exist- ing sidewalk. The following analysis was .e.e: 1. Logic of the proposed sign is to a) avoid the neceasity of two signs, and b) identify tbe bank. 2. The "ground sign" was not lighted and was not conspicious. 3. Difficulty now is that the proposed sign is not inconspicious, and the concern is its relation- ship to the site, and its close proxi.ity to the proposed expanded Lexington Avenue. " In discussion, it vas Doted that one tree may have to be removed to locate the sign at the required 25' setback. Concern was expressed re granting s variance which would require relocation of tbe sign should the trees die (requested basis for granting tbe variance). Woodburn moved to reconsider the previous Council action. Motion was seconded by Wingert and carried unanimously. Wingert aoved, seconded by Hollenhorst, that Council deny tbe setback variance based on failure to establish a "hardship"; aotion carried unanimoualy. . Case No. 81-14, Lot Split and Consolidation - 3279 N. Snelling and 1479 Buaaard Court Council vas, referred to a transparency of the two lots which are the subject of this application. Miller noted that the applicant proposes to split 20' from the east side of Lot B (Bussard Court) and consolidate it with Lot A (Snelling Avenue); providing e 20' wide access to the house on Lot A (should this lot at some time be split into tvo building sites); noted that this is not requested or contemplated at this time. -2- Kinutea of Regular Council Keeting June 8, 1981 Kr. Kotion carried unaniaously. . Case No. 81-18, Lakesbore Setback Variance - Lot 40, Block 1. Kartb Lake Estates Council vas referred to a survey of Lot 40, Block 1, Kartb Lake Estates. Killer noted tbat a front setback variance vaa approved on tbis lot previously because of tbe steep terrain; lot vas platted under tbe former Zoning Ordinance requiring a 40' aetback from tbe bigb vater mark; existing Ordinanca (1213) requires a 75' lake aetback. Applicant, Karcel Eibenateiner, explained tbat a 50' setback (measured froa tbelake survey aonuments) is naeded for an eartb- abeltered bouse being designed for tbis lot; noted tbat tbe survey monuments are 12'-14' from tbe edge of the lake. Eibensteiner ssid be is not building tbe bouse, does not knov tbe amoun t of a arth ahelter proposed; only request at tbis time is for tbe satback variance. ~ After reviev of tbe Planning Co.mission recommendationa, and dis- cussion, Councilman Hollenborat moved, seconded by Wingart, that tbe Council approve tbe lake setback variance of l3t feet from tbe bigb vater mark on Lot 40, Block 1, Kartb Lake Estates, based on tbe hardsbips noted in tbe Planning Commission Kinutes (6-3-81). Kotion carried unanimously. Case No. 81-15, Preliminary Plat- Resubdivision of Janet Estatea Killer explained tbat tbe resubdivision of Janet Estates is proposed in order to provide tvo lots sufficient in aize to accommodate a tvo-family atructure on each. Killar said s previous requast for five tvo-family hoaes in tbis development vas denied becauae lota were inadequate in size snd tha concentration of two-family hoaas vas considered inappropriate. Killer said be suggested, at tbat time, a resubdivision to provide some lots vhicb vould meet the required lot area for tvo-family structures. Killer explained that a Special Use Permit for tbe two-family homes is a part of the application, but is dependent upon Council acceptance or rejection of tbe reaubdivision Prelim- inary Plat; action on tbe Special Use Permit sbould be withheld until Final Plat, aite and building permit approval, if the Pre- liminary Plat is considered to be acceptable. . Hiller noted tbat a slight line adjustment of the common 5/6 lot line, vill make both lots tbe required 95' width at the setback line. In diSCUSSion, Peter Hurlowski (developer) explained that the tvo-family structures vill be similar to tbe single family structures in tbe subdivision; parpose of the mix is to stimulate sales; reaction of potential purcbasers bas been unwillingness to buy because of tbe area itself, tbe vacant property; feels the addition of doubles will generate new activity; intent is to maintain tbe same quality of construction; feels there is a strong market for tvo-family homes. ' -3- Minutes of Regular Council Meeting June 8, 1981 Miller said the proposed resubdivision ~eets the criteria established for the few two-family ho~es which have been approved in recent years in Arden Hills; access to the lots requires the use of a single family residential street; off street parking will be looked at when site and building plans are reviewed. , McAllister moved"seconded II.Y ,Wingert, that Council approve the Preliminary Plat of the resubdivision of Janet Estates, providing two lots for two-family dwellings, subject to adjustment of the lot line between Lota '5 and 6 so both Iota will meet the required 95' width at the 40' setback line. Motion carried (McAllister, Wingert, Hollenhorst, Woodburn voting in favor of the motion; . Johnson voting in opposition). Case No. 81-16, Preliminary Plat - Arden Hills Corporate Center Council waa referred to a transparency of the proposed Preliminary Plat of the six-lot Arden Hilla Corporate Center at Hamline Avenue and Highway 96 (5.81 acres). In review of the development plan proposed, Miller noted that the proposed lots exceed the minimum ar.a and dimensional requirements of the B-1 District; primary concerns are aite access and circulation; noted that he and the City Engin- eer recommend only one access point on Highway 96 (two propoaed), allowing circulation from the Hamline Avenue access to the Highway 96 access across the lots by means of easements. Steve Hage showed an alternste development plan providing thru- traffic within the site, Vith two access points on Highway 96; said they propose to develop the west end first and will need an accesa for thia and the second building; propose a second access when the third building is built, if necessary. Hage displayed a rendering of the proposed buildings which are one-story brick with cedar roof shakes; colors are to be earth tones; buildings are residential in flavor to harmonize with the neighborhood. In diSCUSSion, it was noted that MN DOT has indicated it will accept the two accesses onto Highway 96 as proposed, with the easterly access at least 400 feet fro. the Hamline Avenue inter- section. Miller noted that a Highway 96 median crosa-over at the Highway 96 access point and thru-traffic on the site would be preferred, but the provision of an additional medisn crosa-over is not likely; the possibility of a combined City/corporate office center median cross-over was suggested, but was not considered a practical solution. Miller explained that the Hamline Avenue access will be provided as proposed on the site plan when the site plan comes in and the development proceeds. Two 'concerns.... noted regarding the Ha.1ine Avenue access were that it should be wide and as far from the Highway 96 intersection as possible. In discussion regarding park de,dication and the City's deaire to landscape along its east property line, Miller suggested thst the City determine whether or not additional land is needed by . the City; noted that if B-1 District land is purchaaed or dedi- cated to the City, the building setback requirement for the west office building is 20'; if the City does not acquire additional land, the building setback requirement is 75' because the site will abut a residential zoning district. Hage noted tbat the alternate plan, presented tonight, is intended to ainiaize parking in tbe rear of the site; Hage aaid the proposed landscape plan provides tbe needed screening in the 50' to 60' area between the west building and property line. In discussion of land needed for City aaneuvering rooa and aain- tenance, it was noted that 20't ia indicated by Johan.en, if the alope between the properties is miniaized. Hage said 20' would not inpact on the six-lot developaent. It was noted that a landscape buffer is required between resid~~~~l.and co..ercial districts. A 20' land "swap" waa suggested,:i'fil~afflfaction of the park dedica- tion requirement, providing a 20' buffer between the B-1 and R-l; developer wou~d be responsible for the buffer area unless this responsibility is waived by tbe City; landscaping of the buffer to be in accordance witb an approved landscape plan. Council action regarding the Preliainary Plat was tabled until the nextLaeeting, pending tbe developer'. reaction to tbe auggested 20' wide buffer dedication and reaponse to traffic concerna. Case No. 81-17, A.ended Special Use Perait for Bethel ColleRe Killer explained that Betbel College haa re-atudied and aade ao.e changea in its proposed aouth ca.pus plan; since the campua ia currently under a Special Use Permit, an amendaent to thia per.it will be necessary to incorporate the up-dated Caapus Kaster Plan. Killer noted that basic approval of building locstions and usea is requested at tonigbt's .eeting; no building or grading plan approval at tbia time. . Dave Lissner (Bethel College) noted one change in tbe north campua portion of the plan, changing the propoaed expansion of the library; now propose two smaller additions (one library and one non-library). Lisaner explained that the roadway loop in the soutb campus is .ore precisely located than on the previous plan; all buildings were sbown before, but are now more precisely located. Lissner noted that the Betbel property west of Old Higbway 10 (approximately 7 acres) is not a part of the Special Use Permit; uaes shown on the previous plan were residential/atbletic fields; now propose atbletic field use (probably not reaidential); suggeated this would provide less impact on tbe City's park ayatem. Lisaner aaid tbe approximate 5-acre Betbel property (northwest corner of Old Highway 10 and County Road E2) probably will never be developed; want tbis for open apace. -5- Kinutes of Regular Council Keeting June 8, 1981 Barry Warner (Barton Aschaan Associates) described the basis of the study and the concerns involved to accoamodate the aulti-uses in the south campus, and retain the natural festures - existing vega- tation, wetlands, slopes, etc. Architect Dick Cottle showed a rendering of the proposed field house which will be earth-sheltered on the esst (high side) function- ing as a transition between the two plateaus (about a 20' grsde dange). The 50,000 sq. ft. bUildin~l?~l~ccomaodate five tennis courts, four racke t b all courts, a " track, 10cke r and chang- ing rooas, ticket rooa; also will be use for physical ed classes. The building ie proposed to be constructed in two phases and will . be of "Bethel brick" faced aasonry walls, steel joints and insul- ated aetal panels in earth tones. Shelley Johnson, Traffic Engineer (Barton Aschaan Assoc.) described the roadway plans as adequate with the two existing access points; an access north of the lake is not considered advisable, at least not at this tiae. In review of parking needs, Johnson said that 871 spaces exist; estiaates sn sdditional 120 spaces will be needed; proposes an additional 170 spaces in the south campus; noted thst the existing parking areas could provide several aore spaces by reducing the space widths (are now 9 ft. wide). Lissner explained the order of construction priority: ~ library/non-library additions - fall of 1981 1st phase, field house - 1982 grading of fields - 83/84 bleachers, etc. - 8'/85 auditoriua - '85 acience/fine arts/pool - no schedule to date. In review of the up-dated p1ens, Lissner noted that the location of the. "Scall.dia Church" is not accurately shown. Lissner said the existing house (Highway 51, north of Soo Line) is proposed to event~~lly accoa.odete aaintenance facility which ie now in the baseaeat of an acadeaic coaplex building. . Lissner explained that the proposed grading consists of flattening the plateaus and will not appreciably affect the rate of run-off; wetland drainage froa the parking lot is to the west and south; froa the football field is to the northeast and southwest. Lissner said the footbel1 field is a wetland area; it is unknown at thia ~ae how auch fill will be needed to construct the field; propose to place an excese of soil on the site for a year or so to deter- mine the needed a~ount. Council referred Lissner to a letter froa Soo Line requesting a fence along the Soo Line r-o-w. Barry Warner said the southeest portion of the site is the only area where there is not a signi- fican t grade change. In discussion regarding traffic impsct on Old Highway 10 during football gaaea, Shelly Johnson said the road is signed "No Parking"; propose to enhance the existing plant aaCerials between the road and the field; sight line will be very miniaa1; view of field for south-bound traffic will be addressed by adding plant aaterial. . In answer to inquiry regarding fire equipment access to the field house, Lissner said they have not discussed this with the Fire Chief; there is ad~quate space available for the required access. Wingert moved, secon~ed by Johnson, that Council approve the Amended Haster CampUS Plan and Aaend.ent of the Special Use Permit for Bethel Campus, Case No. 78-5, not including any grading, architect- ural or drainage plans. Hotion carried unanimously. -6- Minutes of Regular Council Meeting June 8, 1981 Comprehensive Plan Review - Status Report Miller briefly reviewed the Comprehensive Plan Critique by Metro Council; noted that the sewer element will be resolved by Christoffersen; housing element is inconsistent with Metro Council policy in that no high density zoned land (R-4) is avail- able today for development; also want some commitment to Section 8. Miller said that most other inconsistencies noted can be resolved by verification or by adding statistics requested. OTHER BUSINESS . Deposition of FilIon Red Fox Road - George ReilinR George Reiling explained that contractors have difficulty find- ing places to deposit fill; said he needed the fill and did not ask if the contrsctor had a permit - he didn't have one. Reiling said he graded the srea some yesrs ago; took fill from the Arden Plaza shopping area; also used fill from other construction jobs; didn't realize a permit was needed and no one ssid any_thing. Reiling said he did not know the amount of fill placed on this site; said he stopped filling when requested to stop. Woodburn explained that the reason for the permit requirement is to determine whether or not s site should be filled or not, e.g. drainage and ponding areas; noted that Council does not know what was done and whether it was good or bad; Council is committed to up-hold the law. Reiling said he caused no damage; did not increase water run-off; did not increaae or dectease the rate of flow; wanted the dirt and spread it out; said he will not accept any more fill in this area. In discussion, Council explained that it must know whether or not tbe fill placed on the site causes an obstruction for natural drainage; whicb is the reason for the Special Use Permit require- ment. Reiling said a 60-day wait for a permit is unreasonable; not done in other cities; can obtain a permit immediately in Rose- ville and Shoreview. Matter was deferred temporarily wbile Council considers the issue; will contact Reiling if a problem arises. Karth Lake South (Wynridge) - Approval of Final Payment and Acceptance of Improvements Wingert moved, seconded by Johnson, that Council accept the Karth Lake Soutb improvements and authorize Final Payment. Motion carried unanimously. 1981 Bituminous Sealcoating Project Johnson. moved, seconded by Hollenhorst, that Council authorize advertisement for bids for the 1981 Bituminous Sealcoating Pro- ject. Motion carried unanimously. . (Bid opening to be at 2:00 p.m. on June 25th) Public Works Department - Temporary Summer Employee Hollenhorst moved, seconded by Wingert, that Council approve the hiring of Tim Thompson at $6.00/hour as a temporary summer Public Works employee. Motion carried unanimously. Parks Summer Playground Stsff, Golf snd Tennis Instructors Council was ref~rred to Buckley's memo of 6-4-81 recommending leaders to be hired for the 1981 Summer Program. McAlliater moved, seconded by Johnson, that Council approve hi~ing tbe leaders as recommended. Motion carried unanimously. -7- Minutes of Regular Council Meeting June 8, 1981 Public Safety Committee Recommendations re Stop Signs in Chatham Area Johnson reported that the public Safety Committee recommends that "Stop" signs be installed at the intersections of Chatham Avenue and McCracken Lane snd Chatham Avenue and Chatham Court; noted that subsequent to the meeting with the residents, he received a phone call from spokesman Peter McCall that not all residents are in favor of a stop sign at Chatham Avenue and McCracken Lane because of the steep grade and resultant winter problems; appears there is no objection to the stop sign instal- lation at Chatham Court, which would help to slow traffic. After discussion, Council referred the letter relative to stop signs from Traffic Engineer Van Wormer to the Public Safety Committee. Council discussed whether "yield" signs would be an effective control of speed and issuance of "warning" tickets. . McAllister moved, seconded by Ho11enhorst, that Council deny the request for stop signs in the internal Chatham area based on Van Wormer's report of 6-8-81; a copy of which is to be forwarded to Pe te r McCall. Motion c4rried unanimously. REPORT OF VILLAGE CLERK ADMINISTRATOR CHARLOTTE MC NIESH Resolution No. 81-38, Apportionment of Assessments, Water Improvement No. 68-3 - Johnson/Palmquist Wingert moved, seconded by McAllister, that Council adopt Resol- ution No. 81-38 re appGrtionment of Improvement No. 68-3 water asseasments. Motion carried (Wingert, McAllister, Hol1enhorst, Woodburn voting in favor of the motion; Johnson abstained). Schedule Public Hearing re Proposed Request for Proposal for a Cable Communications Franchise Ho1lenhorst moved to schedule the public hearing at 8:30 p.m. at the Village Hall on June 22, 1981. Motion was seconded by Johnson and carried unanimously. Schedule Special Council Meeting - Breakfast Meeting with Business District Council concurred that a Special Council Breakfast Meeting ba scheduled at 7:00 a.m. at McGuires on Thursday, June 25th. Claims and Payroll Johnson moved, aeconded by Wingert. that Council approve the Claims and Payroll as submitted. Motion carried unanimously. Council Liaison Reports Jobnson referred to letter from Minnesota Pollution Control - McNiesb reported tbat the City's copy of the report has not been received to date. Jobnson reported that residents on Karth Lake Circle want the street posted as a "dead end"; matter was referred to the Public Sufety Committee for rec01DlDendations. . McAllister requested that someone substitute for her at the ThurSday, June 11th Finance Committee Meeting; noted that Treasurer Lamb would also be absent. Hollenhorst or Woodburn will attend. McAllister reported that the Parks Committee recommends that the park dandelions be sprayed this fall. McAllister referred to letter from Shakopee requesting support in its chs1lenge of the Fiscal Disparities Law. Council concurred to not join in the challenge. Hollenhorst reported that the Ramaey County League of Local Govern- .ents will have a picnic and tour of County parka and open space on June 17th to which Council membera are invited.
