Coun- cil concurred, and au th 0 ri ze d Attorney to prepare same. RCWD ~Ieeting - November 26th Lynden recommended that the affected cities multilaterally re- que s t an Attorney Gene ral' s opinion; noted th at Attorney General's op in ion is advisory only; can file a declaratory judgement if opinion is not satisfactory to the city. Council authorized Lynden's attendance at the November 26th meet- . ing; requested th at he de te rmi ne whether other cities are asking for an Attorney General's opinion, and if not, to proceed wi th re- que s t on behalf of Arden Hills . . OTHER BUSINESS Case No. 80-41 . Side Yard Variance - Lo t 5, Block 4 , Ka rth Lake South. Mar'eel Eibens teiner, developer, explained tha t they purchased the plat unde r Hyn ri dge Addition; adjusted the lots to create la rge r lots and filed the Karth Lake South p la t as approved. Eibensteiner explained tha t corne r lot sideyard setbacks were 20' when plat was proposed; Lot 5 , Block 4 was sold for a 44' wide walkout with a 20' ga rage facing e as t - an ideal lot for this house. Note d that sewe r and water is stubbed on the e as t side of tbe 10 t. S ewe r may not be deep enough in the s t re e t to face the house to the sou th . Noted tha t there are o th e r homes in the area constructed wi th a 20' setback from the side street. In discussion, it was noted that if the lot were not substandard in size, Council would be more inclined towards granting a variance; Noted that it was Council's unde ra tanding that va r i an ce s would not be needed on the substandard-sized lots when plat was approved. Hanson moved, seconded by Woodburn, that Council approve a 10 ' sideyard se tback variance from Wynridge Drive on Lo t 5 , Block 4, Karth Lake Sou th, bas e d on the contour of the land. Motion carried (Hanson, Crichton, Crepeau voting in favor of the motion; Woodburn voting in opposition). It was noted that Council is aware that some platted corner lots pose problems in siting houses wi th the required 40' se tb ack from both streets (Ordinance 213) , but granting a variance from th is requi remen t is not automatic. Developer was requested to obtain variance approval before selling and/or building henceforth. Request to Temp 0 ra ri 1 y Store Aggregate on Lot 2 7 , Rohleder Home and Garden Acre s - William Milton . Milton referred Council to his letter of 11-21-80 requesting the temporary storage of aggregate on his property by Shafer Contract- ing Company fo r 2 ye a rs wi th an option for an additional year if needed. Milton explained tha t placement of aggregate as proposed will improve soil compaction of the site sufi icien tly to enable con- struction. 2 , Hinutes of Regular Council Meeting November 24, 1980 Mr. Robe rt Rudy, Shafer Con t rac ting C (~ . , explained that the material would be IIclass 5 type"; stockpile would be 250 ft. x 300 ft. by 14 feet high; entrance to the s tor age area would be from Cleveland Avenue; noted that the en tire operation would be bonded. ~li 1 ton explained tha t the proposed stockpile site is screened from any residential view. Hilton described his property owner- ship in this area and indicated the area of the site which has been pre vi ous 1 y filled. Counci 1 asked if the proposed aggregate stockpile will interfere with RCWD plans in this area. Nilton said he is aware of the RCWD plans; the stockpiling will not interfere; proposed s to ck- pile area is not in the drainage area. . Rudy explained th a t the aggregate is a recycled concrete product which will be stockpiled for future use for abase for roadways; feels the Milton property lends itself to th is type of storage area. Rudy said he checked the traffic coun t on Cleveland with Mr. Arcand, Ramsey County Engineer's office. Traffic c:oun t is low. Rudy said- they are reques ting two years; hope to remove in one year; th i rd year option is requested if it c.an f t be re nlove d in 2 yea rs . Rudy said the re is no supply of aggregate in this area of the ci ty at present. In discussion, it was queried whether the ten'porary stockpiling would be cons ide red an industrial or commerical operation; area proposed fo r stockpiling is in an R-2 residential district. It was noted th a t a Special Use Permit is required by City Code for deposition of over 400 cubic yards of ear th materials on a site. Applicants were requested to make application for a Special Use Pe rmi t if they desire to pursue the stockpiling request. Coun ty Road n/Lexington Ave. Landscape Fequest Nr. Hsiao, 3131 Shoreline Lane, referred Council to Ie t te r to Famsey County Commi s s i one r Robert Orth (11-23-80) and attached Petition requesting that a berm be constructed and the area land- scaped at the So u thwes t co rnt: r of County Road D and Lexington Ave. Hsiao said the area residents want the a rea landscaped, to prevent unlawful parking, and restoration of the original berm along Lexington Ave. to block the traffic noise from the residential area to the wes t. Hsiao as ke d the Council's assistance in ge t- ting this accomplished. In discussion, Hsiao said the residents want the unimproved road from Co. Rd. D through th is area to remain. It was noted that the a rea of concern is in Roseville; not wi thi n Arden Hills ., jurisdication. Woodburn reported that Ramsey County Engineer Weltzin is~~~ndablY confused since the residents had p re- viously~ or the removal of the berm; material on the site is consequently being removed and will probably be all re- moved within a day or two. Council concurred that it is desirable to restore aesthetics of the co cn e r and authorized that thi s message be relayed to the Board of Commissioners from Arden 11 ills. Finance Commi t tee Recommendations - Plumbing, Heatinp. and Electric Permit Fees Woodb urn moved, se con ded by Crichton, that Council approve the fees as recommended by the Finance Committee an d authorize the City Attorney to prepare the necessary documen ts deleting plumb- ing and heating permit fees from the city code and providinl!: . that they be es tab lished by Resolution. Motion carried unanimously. Resolution No. 80-58, Approving 1981 Agreelt'.en t for Law Enforcemen t Services Woodburn m ov e d t seconded by IIanson, that Council adopt Resolu- tion No. .80-58, A RESOLUTION APPROVING ACREUTENT WITH COUNTY OF RAMSEY FOR LAW EN FO RCENENT SERVICES FOR THE YEAR 1981. }lotion carried unanimously. Pub 1 i c Sa f e ty Committee Pecommendation to Install S t re e t Lights at Old Highway 10 l!'cCrai,ken Lane and County Road E2/ Chatham Avenue Intersections Woodburn reported that the Public Safe ty Committee finds that these locations meet the previously recommended gui de line s est- ablished for street li gh t installations; reported tha t the Committee recoDlmends the installation of a 11 gh t at each of the intersections. Woodburn moved, seconded hy Cri ch ton, that Coun ci 1 authorize the installation of two street lights, one at County Road E2 and Chatham Ave. and one at McCracken Lane and Old Hi ghw ay 10; Motion carried unanimously. Water Ponding Problem - Co un t y Road 1'2 and Chatham Avenue Woodburn reported that water te n ds to pond on the south side of . the roadway at Co un ty Po ad E2 and Chatham Avenue. causing cars to slip off the road. The matter was referred to Johansen to remedy. Case No. 79-40, Request for One Year Time Extension of Variances for Construction of House - Thomas Lyn ch Council was referred to Ie t t e r from Thomas Lynch (11-10-80) . Woodburn moved tha t Council approve the one-year extension re- quested. Notion was seconded by Hanson and carried unanimously. Board of Appeals Resignation - Eu!!ene Engelbert. Council was referred to let te r of resignation from Eugene Engelbert Ch ai rman of Board of />.ppeals. Mayor Crepeau accepted the resij!nation on behalf of the Council and appointed Pe te r McCall to serve as Chai rman of the Board of . Appeals for the remainde r of 1980. Crichton moved to ratify the appoin tmen t made by the Mayor. Motion was se c on de d by Hanson ,and carried unanimously. Scholl's Request to Pe1ease Landscape Maintenance Bond Counci 1 was referred to McNiesh's memo of 11-21-80 regarding Scholl's Landscape Le t te r of Credit and to Scholl's Ie t te r of 9-29-80. 4 Minutes of ~egu1ar C o.un c i 1 Heeting November 24, 1980 Woodburn moved, seconded by Crichton, that Council authorize release of the Scholl's 1 an d s cap e maintenance bond. Motion carried unan i mous ly. (It was noted tha t the Main tenan"ce Bond runs from 3-31-80 to 3- 31-81). Council Meeting Schedule Crichton moved, seconded by Woodburn,that Council meetingS' be scheduled as follows: Regular Council Meetings on December 8th and 29 th , at 7:30 p.m. and on January 2nd at 5:00 p. m. Special Counci 1 Heeting on December 22nd, at 7:30 p. m. (Councilmen-Elect to be invited to attend the December 29 th meet- ing. ) .Motion carried unanimously.
