Business from the Floor None REPORT OF VILLAGE ENGINEEF DONALD CHFISTOFFERSEN Resolution No. 80 - ~ 6 , Awarding Bid for Improvement No. 80-2 , Kenna Addition to Arden Hills Council was referred to tabulation of six bids received. Christoffersen recommended that the bid be awarded to the low bidder, F. F. Jedlicki, In c. , Mound, Minnesota. McNiesh reported that a Ie t te r has been received from John Kenna authorizing the Ci ty to award the bid to the lowest responsib Ie bidder. Wingert moved, seconded by Hanson, tha t Council award the bid to F.F. Jedlicki, In c. in the amount of $11,095.00. Motion carried unanimous ly. RCWD Proposed Changes Council was referred to Ie t te r from Lynden (11-6-80) regarding Rice C re e k Wa te rshe d District Amendments to Rule s and Regulations. IIfte r discussion; it was the general con cens us of Council to re- lay its objections to the amended Pules and Regulations to the Rice Creek Watershed Board of Hanage rs. Woodburn moved, seconded by Hans on, tha t Council adopt Resolution No. 80-57, expressing Council's concerns and req ues ting contin- uance of the pub Ii c hearing. 110tion carried unanimously. REPORT OF VILLACE PLANNER ORLYN }'ILLER (lib s e n t) Case No. 80-40. Sideyard Variance - 1347 Eide Circle . Council was referred to sketch of lots 1 f. 2, Eide Terrace show- ing existing h ous e on lot 2 and proposed house on 10 t 1. Wingert explained that a two-foot side setback is requested for a portion of the h 0 us e as sited. Noted tha t the north portiOn of the lot is marsh with an NSP e as e me n t ; e as t side of lot has an NSP easement; Ordinance 213 requires a 40' setback from both s t re e t s . 1 twas noted tha t the house on lot 2 is setback 18 ' from the common 10 t line; houses, therefore, will be 26 ' apart. ) . . , l Hinutes of Re gu lar Coun ci 1 Meeting November 10, 1980 c Af te r discussion, Wingert moved, seconded by Hanson, that Coun ci 1 gran t the two-foot side setback variance as reouested b as e d on the lot configuration, easements and marEh area. In further discussion I it was note d that the common 10 t line could be re-loca ted to put both houses into con f 0 rman ce (lot split and consolidation) . It was, however, the general con- sensus of Counci 1 tha t th is paper work would not warrant the costs involved, and the final effect would be unchanged. Motion carried unanimous ly. Case No. 80-41, Corner Lot Setback Variance Lot 5, Block 4 , Karth Lake South Council was re fe rred to Certificate of Survey of lot 5, block . 4, Karth Lake South showing proposed location of house at 30 ' setback from Wynridge Drive (40 ' from Wyncrest Lane) requiring a 10 I + setback variance (Ord. 213) . Wingert reviewed the Planning Commission recommendations. (l1inutes of 11-5-80) noted that the lot slopes from northeast to southwest and is apparently appropri ate for the walkout home as proposed. It was noted tha t the 10 t is slightly un de r size at 13,551 sq. ft. , that o rd. 213 requires a 40 ' setback from bo th streets (Ord. 99 had required a 20' setback from the side street) Ord. 99 was in effect when lot was platted. In discussion, it was noted th at if the h 0 us e were rotated on the 10 t, it co u 1 d probably mee t the setback requirements of Ord. 213. Winge rt reported tha t facing the h 0 us e on \-.'ynridge n-rive was considered by the developer, but th is is not desired by the home owner. Home owne r fce 1 s house is consistent wi th the neighborhood as proposed, and walkout area as sited is more desirable. In further dis cuss ion, it was suggested tha t the lot is appar- ently too small for the house proposed. It was the gene reI con- s ens us that the re are op tions that could work within the ordin- ance confines. Wingert move d that Council deny the 10 ' sideyard variance be- cause a sufficient hardship has not been indicated. Motion was seconded by Crichton. Crichton moved, seconded by Wingert, to table the motion to the next Council me e tin g . pending exploration of apparent options by the developer. Motion carried unanimously. Comprehensive Plan Status Report Wingert reported tha t the Planning Commission has gene rally con- curred with the revised Housing Element which is designed to meet the spirit of the Metro Council f ratnewo rk; reported th at the Land Use Plan is being prepared by Hiller, with input from Christoffersen regarding utilities plan (exis ting as well as impact of arsenal sewer, should this area devclop in the future) . . Winge rt reported tha t the Planning Commission anticipates com- pletion of the revised Comprehensive Plan by December 1980. Hr. .0'Connor re po r te d that Bill Thompson, Ramsey County Sheriff's office, interprets IICasino Night" as not gambling. McNiesh re- po r te d that John Daniels, Attorney Gen;ral's office, interprets the operation as gambling un de r the statutes, and the re fore is prohibited. Woodburn's conversation wi th Prose cu ting Attorney Fi lla indicated the activity is considered gambling. Af te r dis- cussion, Council expressed re 1 uc tan ce to app rove the operation bas e d on the information received. O'Connor sa i d he would for- ward copies of Attorney General opinions which find that the operation is not gambling, for Council's consideration prior to . scheduling any future Casino night e ve n t B . Motion carried unanimously. Annual Parks and Recreation Conference Council was referred to memo from Buck ley dated 11-7-80. Hanson move d, seconded by Crichton, that Council authorize Buckley's at tendance at the conference at a cos t of $68.50. Mo t i on carried unanimously. Le t te r of Resignation - Thomas Lynch Coun ci I was referred to Ie t te r from Planning Commission Chair- man Thomas Lynch advising tha t he is resigning from the Planning Commiasion at the end of this year. Council e xp res se d its appreciation for Lynch's many years of se rvi ce to the Ci ty as a valuable member of the Planning Com- mission.
