Business From the Floor None REPORT OF VILLAGE ATTORNEY JMIES LYNDEN (Absent) Permanent Special Use Permit - Beth e 1 College McNiesh reported th at Dave Lissner, Bethel College, has re- viewed the proposed Permanent Special Use Per mi t - Bethel College and has ind! cated he has no problems wi th it; noted that Lissner unde rs tands tha t an ame n d me n twill be ne cess ary for addi tional development of the campus not indicated on the mas te r site plan. Crichton moved, seconded by Wingert, tha t Council approve the Pe rm anen t Special Use Permit - Case No. 78-5, as submitted. Motion carried unanimously, Jogging and N a t u re TraIl License - Be the I College Council was referred to proposed draft of I rrevocab Ie Li cense be tween Bethel College and Seminary and the City of Arden Hills. Woodb urn moved, seconded by Hanson, that Council approve the Irrevocable License. Motion carried unanimously. In discussion, con cern was e xp re sse d regarding where respon- sibility and liab i li ty lies. Als 0 queried was whether the park dedication has been satisfied if, at some future date, the agree- men t falls ap art. Th e s e questions were referred to Lynden for his response to Council. REPORT OF VILLAGE ENGINEER DONALD CHRISTOFFERSEN Resolution No. 80-55, App ro vi ng P I an s and Specifications and Ordering Advertisement for Bids, I mp rove me n t No. 80-2 , Kenna Addition to Arden Hills Christoffersen referred Council to the Plans and Sped fications and described the location of the utility lines as proposed. 1 I .. - Minutes of Regular Council Mee ting October 27, 1980 Wingert mo"ed, seconded by Hanson, tha t Council approve the Plan s and Specifications for Improvement No. 80-2, Kenna Add- ition to Arden Hills, and authorize advertisment for bids on October 30 th (New B r i gh ton Bulletin) and October 31s t (Con- struction Bulle tin). Motion carried unanimously. (Bid open ing was scheduled at 2:00 p.m. on November 10 th. Christoffersen reported that he has reques ted Hr. Kenna to pro- vide a 20 I wide utility easement on lots 1 and 2 (10 I on each side of COOllDon lot 11ne) and a 10 . wide utility easement, ab ou t 30 · in length, on west corn e r of lot 1 , prior to sale of lots. REPORT OF VILLAGE PLANNER ORLYN MILLER Case No. 80 - 35 , Building Pe r mi t - Eugene Coles tock Gene Coiestock referred Council to amended plan of e as t eleva- tion of the existing and proposed buildings, aligned and joined by a 200' .::t connecting passage. Architect Gene Brandstrom ex- plained that they intend to line up the two buildings and face both wi th horizontal and vertical b ri ck panels. Colestock said they are requesting a Build ing Permit fo r the new building,bridge connection as s.hown and re-face of the existing building. Note d tha t, in order to face the exis ting building, they will have to excavate snd build a shelf to support the brick veneer. Af te r review of the si te plan and discussion relative to parking, landscaping, sign age and exterior lighting requirements, i twas moved by Crichton, seconded by Woodburn, that Council authorize the Building Inspector to issue a Building P e rmi t for the ware- . house/manufacturing building, re-face of the pxisting building to the south and b rid ge connection, as per plan s sub mi t te d da ted approved 10/27/80, wi th a 20 ' ",ide landscaped area in f ron t of the new building; parking in front to be parallel instead of per- pendicular; app roval includes 5 ' parking variance on the south side of the site of the new building. It was the unde rs tanding of Council and Colestock tha t landscape, exterior lighting and signage plan approval by Planner must be obtained, and park dedication satisfactorily resolved, prior to occupancy of the new building. It was also note d that the trash removal area is not designated on the plan; this are a is required to be enclosed within the buildi1lg or screened from view. Bids for Grading Hazelnut Park Council was referred to bid tabulation of six bids received for the grading of Hazelnut Park. Mille r recommended accept ance of . the low bid. Hanson moved, seconded by Woodburn, that Council award the bid to C.W. Houle, Inc. in the ame un t of $14,500.00. Motion carried unanimously. (Miller reported that the contract documentation will be pre- pared and for",arded to Attorney Lynden.) 2 I ~ .. Council concurred wi th "Liability Waiver" which Park Director Buckley proposes to have s i gne d by pe rsons desiring to cut and remove fi rewood from Hazelnut Park. Request to Delay Sewe r Connection - Pilgrim IIouse , Al Po t te r Council was referred to Ie t te r from Alan E . Pot te r requesting a two-year de fe rmen t of the required sanitary sewer connection fo r Pilgrim House, pending possible sale of the property. Mr Po t t e r advised that they do not anticipate a I ong- te rm continu- ation of th e i r operation in this location. Motion carried unanimous ly. 1975 Dodge 4>:4 3/4 ton Pickup Council was referred to Buckley's memo of 10-24-80, recommend- ing the sale of the 1975 3/4 ton Do d ge pickup. Haze lnut Park - Trinity Lutheran Joint Ag reemen t Af te r discussion of Buckley's memo of 10-24-80 regarding l1a- b ili ty waiver to cover public parking at Trinity Lutheran Church parking lot for patrons of Hazelnut Park, Hanson moved, seconded by Wingert that Council au thorize attorney Lynden to prepare an appropriate parking agreement. Motion carried un ani mous ly. Protective Plantings - Pe rry and Ingerson Parks Council was referred to Buckley's memo of 10-24-80. 3 .. --.... .. In further discussion concern was expressed regarding need fo r city to fence residential properties at Pe r ry Park. REPORT OF VILLAGE TREASURER DONALD LAMB (Absent) Investments McNiesh reported the following investments by Treasurer Lamb: . 10-15-80 $225,000 @ 10.5% interest at Northwestern Bank to mature on 10-31-80. 10-24- 80 $146,000 at Northweste rn Bank at 13% interest to mature on 4-22-81. Motion carried unanimously. ~EPORT OF VlL LAGE CLERK ADMINISTRATOR CHARLOTTE Me NIESH Abatements - Chatham Pa rk Council was referred to several parcels in Chatham which were pl atted as parks and open space and to two parcels, out lots A and B,which were to be dedicated to Ramsey County and School District 621- McNiesh reported that Lynden advised that out lots A and B cannot be transferred by means of platting; therefore, must be trans fe rred by deed to Ramsey County and the School District. Additional Election Judges Woodburn moved, seconded by Wingert, that Council approve the list of election judge s as submitted. Motion carried unanimously. November Council Meeting Winge r t moved, seconded by Hanson, tha t Coun ci I schedule Regular Council Meetings on November 10 and 24 at 1:30 p.m. and a Special Council Meeting at 5: 30 p.m. on November 6. Rice Creek Wate rshed District Proposed Amendments to Rules and P,egulations Council briefly discussed the proposed changes and referred the matter to Attorney Lyndcn for his review regarding impact on the city.
