Motion carried unanimously. Business from the Floor None. !E2posed Zoning Ordinance and Zoning Map Council was referred to Proposed Zoning Ordinance as modified througt Januar:, 24, 1980, and to motion by Hanson, seconded by Crichton, to accept the Zoning Ordinance, as modified (1-24-80), which motion WOOdburn moved, seconded by Crichton, to table until February 25, 1980. Woodburn referred Council to Wingert's proposed amendment to the zoning ordinance, establishing an Educational District as an addi- tional zoning classification; ,suggested the following alternatives for CO'1ncil' s conside ra tion: 1. Adopt zoning ordinance as modified to date and refer pro- posed amendment thereof to the Planning Commiaafon for re- commendation prior to holding a public hearing, or 2. Defer adoption of the zoning ordinance pending possible incorporation of proposed amendment therein after receipt of Planning Commission, recommendations and Public Hearing. After discusaion, Hanaon referred Council to memo from Planner Miller (2-11-80) reeommending that the proposed zoning ordinance reflect a recent amendment to Minnesota Statutes designating that licensed day care facilities serving 10 or fewer persons is a per- mitted single-family use. Hanson moved that the Land Use Chart (page 2-4) be changed to reflect this change and to eliminate the upper limit of 16 in all Business and Industrial Districts. Motion was seconded by Wingert and carried unanimously. . Hanson modified the original motion to include the modification of the proposed zoning ord1nance(Ordinance No. 213) through February 25, 1930; Crichton accepted the modificatiOn and the motion passed (HansoD, Crichton, Woodburn, Crepeau voting in favor of the motion; Wingert voting in opposition). Council referred the zoning ordinance (Ordinance No. 213) and the proposed amendment thereof (Wingert memo of 2-21-80) to the Planning Commis9ion for consideration at its March 5th meeting. Wingert moved, seconded b~ Crichton, that Council schedule a public hearing before the Council, relative to the proposed amendment to Zoning Ordinance No. 213, on Monday, March 31, 1980, at 8:00 p.m. at the Village Hall. Motion carried unanimously. OT.HER BUSINESS Caae No. 79-40, Lot Split and Variances - Thomas Lynch Wingert referred Council to Planner's report (1-30-80), Board of Appeals report (2-25-80) and to Planning Commission minutes of 2-6-80; explained that the existing lot is 25,905 sq. ft. in area . . , ~inutes of Regular Council Meeting Page Tuo' Fehruary 25, 1980 which applicant proposes to split into 2 parcels: 1. a 14,000 sq. ft. lot for existing house, and 2. an 11,905 sq. ft. lot for proposed new bouse. Wingert explained that. health problem, produced by the existing home, is the hardship described by the applicant which cannot be resolved in the existing house; only alternative is for applicant to move or build a new home on the site. It was explained that the newly created lot is lesa than the required 14,000 sq. ft. area and is 90' instead of 95' wide at the building line. Wingert ex- plained that the applicant's attemptJ to purchase additional land have been refused by the County and adjacent neighbors. In discussion, Crepeau noted that the County has not been doing very much pumping in recent years; feels that, in time, the County- owned property (2,108 sq. ft.) will revert bac~, which will then eliminate the need for either an area or lot width variance. Wingert explained that, visually, it appears that the County pump property is part of proposed lpt; technically the lot is non- conforming; purpose of planning is to avoid crowding of houses and changing number of people/acre: if County had not taken the property (or if County had an easement for the pump) both lots would meet area requirements of 14,000 sq. ft. Hanson moved that Council grant the necessary variances and approve the lot aplit as requested. Motion was seconded by Crichton and carried. (Hanson, Wingert, Crepeau voting in favor of the motion; Crichton and Woodburn voting in opposition.) (CouDcil determined that the rear lot line of the proposed newly created lot is the line at the lake.) Case No. 79-4, Final Plat - Land 0' Lakes Mr. Roland Dant, Land 0' Lakes, reported an easement error on the proposed final plat and indicated its actual location which will be corrected. Wingert moved, seconded by Hanson, that Council approve the Final Plat of Land 0' Lakes with the following contingencies: a. Favorable title opinion by City Attorney, b. Satisfactory re-wording of the landscaping Letter of Credit, c. Re-draft of the Final Plat to correct utility easement. Motion carried unanimously. Wingert moved, seconded by Woodburn, that Council adopt Resolution No. 80-10, vacating two existing easements, documents numbered 483139 and 534317 (To be filed simultaneously with Final Plat.). Motion carried unanimously. Council concurred that the park dedication be resolved prior to building occupancy. Bid for IlIlpro\'ement 79-1, Arden Lake Knoll McNiesh read a letter from Mr. and Mrs. Sundberg requesting the City to proceed with the improvements and to award the bid to the low-bidder C. W. Houle. MeNiesh reported that application has been made to Rice Creek Watershed District by the Sundbergs; permit has not been approved to date;, noted that Engin.,er Christoffersen has 2 , Minutes of Regular Council Meeting F age Th ree February 25, 1980 suggested that tbe Sundbergs request a variance from implied need for a baffled weir, whicb he feels is Dot applicable to the Sundberg property. Cricbton moved, seconded by Wingert that Council authorize the execution of the Final Plat of Arden Lake Knoll on behalf of the City. Motion carried unanimously.
