CALL 'II:) ORDER Pursuant to due call and notice thereof, Mayor Sather called the meeting to order at 6:30 p.m. ROLL CALL 'Ihe roll being called the following members were present: Mayor 'Ihomas Sather, CouncilInembers Nancy Hansen, Paul Malone and JoIInn Growe. Absent: O:luncilmember 'Ihomas Mahowald. Also present: Engineers Terry Maurer and Mark Graham, Attorney Jerry Filla, Planner John Bergly, Park Director John Buckley, Public Works Superintendent Dan Winkel, Clerk Adntinistrator Gal:y Berger and Deputy Clerk Catherine Iago. VALENTINE AVENUE; Council was referred to a JDeI\lOrarxluIn from the Clerk PUB. SAFEI'Y CXlNCE:RNS Administrator dated 6-21-91 and a letter from Engineers Terry Maurer and Mark Graham dated 6-18-91, relative to Valentine Avenue safety issues previously discussed with area residents. Mayor Sather introduced Commander Jerry Bergeron and Deputy Gal:y Gibbs, representing the Ramsey County Sheriff's Deparbnent, Ramsey County Engineer Dan Solar, and City Engineers Terry Maurer and Mark Graham. Sather reported that John Ostlund was invited to attend the meeting, to represent the Mounds view School District, however, due to a conflict in scheduling, he was unable to attend. . Engineer Graham rep:Jrted on the traffic COIlllt and speed analysis recently conducted on Valentine Avenue, between County Road F and Old Highway 10. He advised that traffic counts were taken at three separate locations along Valentine Avenue and in separate two day segments, in order to detennine both weekday and weekend traffic volumes and speed. GrahaJn reviewed the peak traffic periods and the times of =ence during the weekdays while school was still in session, during the weekdays when school was not in session and during the weekends. He also reviewed the speed analysis on both eastbound and westbound traffic directions on both the weekdays and weekend periods. Graham reported the average vehicular speed, as calculated, is below 30 mph for vehicles traveling in either direction on the road. . Engineer GrahaJn explained that based on traffic engineering principles and the number of vehicle trips a home produces per day, the traffic counts on the road are fairly low and it appears that a stop sign is not warranted on Valentine Avenue at its intersection with Valentine Court. He further advised that the speed analysis does not support the sp<>eding concerns expressed by residents, since the average speed is below 30 mph. Graham explained that the geometries of Valentine Avenue and the close proximity of the homes to the roadway may give the appearance of vehicles traveling at a higher speed. Mayor Sather asked the Engineer the highest speed recorded on Valentine Avenue. Engineer Graham reported one vehicle traveling at 41 mph and the vehicle speed was recorded at 5 p.m.; indicated it is conceivable that the data may be incorrect if two vehicles were crossing the speed registers at the same t:iroe. Engineer Maurer advised the vast majority of vehicles registered an approxilnate speed of 25 mph. He discussed the use of stop signs and warrants which should be met prior to installation of a stop sign. Maurer explained that stop signs are not intended to control speed; studies tend to indicate IlIOre problems may exist when a "non-warranted" stop sign is installed. . . . Minutes of the Arden Hills Regular Council Meeting, 6-24-91 Page 2 SAFETY (Cont'd) Ergineer Maurer statal he is not advocating the removal of the stop signs at this time, merely offerin;J observations based on the traffic counts and speed data conplied. He suggestal the vegetation in the area is overgrown and trilmning the plantings would increase visibility . Maurer suggested the width of the street does not appear to be a problem, based on the number of vehicles traveling during peak hours. He explained that most studies inlicate that speed violatm's are usually persons living in the area, rather than persons unfamiliar with a roadway. May= Sather asked Commander Bergeron and Deputy Gibl::s f= COlIUlIents relative to traffic patterns during patrol of this area. Commander Bergeron explained the problem appears to be vehicles not stopping f= the stop signs, rather than speed. Deputy Gibl::s suggested that removal of the stop signs may assist his efforts to control sp=r1PTS in the area. He agreed that the vegetation should be trinnned for better visibility. Gibl::s discussed the traffic problem f= vehicles traveling eastbound on County Road F to Old Highway 10 and atterrpting to make a right or left turn onto Snellin;Ji this contrib.ites to the traffic "shortcut" through the Valentine Avenue area. He inlicatal the road appears to be na=ower at the area close to County Road F and then widens as vehicles awroach Old Highway 10. May= Sather questioned the width of the street easement on Valentine Avenue and suggestal staff trim the vegetation in the road easement. Ergineer Maurer statal there is a 66 foot easement alon::J the road. Mayor Sather briefly reviewed the traffic problems on County Road F which contrib.1te to increased traffic on Valentine Avenue during peak hours. Ramsey County Ergineer Dan Solar, recalled that County Road F was reconfigured in the area of the T-intersection at Old Highway 10, to allow roam to sort traffic into two lanes for right and left turns. He agreed the site distance is limital along Valentine Avenue due to overgrown vegetation and the curve in the roadway. Engineer Solar indicatal the problem which exists on Valentine relates directly to the delay f= vehicles traveling eastbound on County Road F, attempting to turn onto Old Highway 10. He also discussed the warrants f= a stop sign at Old Highway 10 and County Road F and statal a traffic study would have to be conducted at this intersection. A resident suggested that signs be placed on County Road F, prohibitin;J left turns onto Valentine Avenue and at Old Highway 10, prohibiting right turns onto Valentine, during peak hours. It was also recommended that a traffic study be conducted for Old Highway 10 and County Road F while school is in session, rather than during the summer m:mths. A resident asked if the County has any plans for llnprovement of Old Highway 10. Solar statal the County has no plans f= capacity llnprovement of Old Highway 10 and that the road may be scheduled for maintenance in the future. . . . Minutes of the Arden Hills Regular Council Meeting, 6-24-91 Page 3 SAFEl'Y (Cent'd) Mayor Sather questioned if it is possible for the County to restripe County Road F to identify a right turn lane, from Valentine Avenue to the intersection of Old Highway 10, prior to the reopening of school. He also questioned the feasibility of posting signs which prd1ibit turns from County Road F and Old Highway 10 onto Valentine Avenue during certain hours of the day. Engineer Solar advised the County would be willing to restripe County Road F with a double yellow line and provide solid right line to indicate a right turn lane, with aIrOWS for both right and left turns onto Highway 10. Solar stated the placement of signs, prohibiting turns onto Valentine Avenue, would :impact County Road F or Old Highway 10 and would be at the discretion of the City. He indicated the City would be responsible to provide the signage. Council questionErl if the Sheriff's Deparbnent would have a problem with enforcement. Camnander Bergeron explained that a violation tag may be issued if the Deputy witnesses the vehicle turn onto Valentine Avenue. He questionErl if Mounds view School Officials have been contacted to request a discussion of the traffic problems with students; suggested students be advised at the begirming of the 1991-92 school year . Mayor Sather advised he has discussed the issues with several School Board Members. In summary, the Mayor reconunended the following items for Council consideration: 1. staff be directed to mark the right-of-way on Valentine Avenue and remove foliage to clear site lines for vehicular traffic. 2. A request be forwarded to the Ramsey County Engineer for restriping of County Road F for two lanes eastbound, between Valentine Avenue and Old Highway 10, with a right turn lane clearly indicated with arr-ows at Old Highway 10. 3. Posting of signs on County Road F and Old Highway 10, prohibiting turns onto Valentine Avenue, during peak traffic hours. 4. Contacting Mounds view School to request a student educational fonnn, relating to the safety issues diSCIlSsed and proposed solutions to eliminate the problems experienced by residents of Valentine Avenue. 5. Possible removal of the stop signs on Valentine Avenue, based on infonnation provided by the Engineer and Deputy. Mayor Sather indicated his preference for attenpting to resolve the safety issues through utilization of the above mentioned solutions, rather than constructing two cul-de-sacs or changing the configuration of the street. other items briefly discussed relating to this matter: - Possible reduction of speed limit. It was noted that the speed limit is determined by State Statute and reduction of speed would require identifying certain =iteria which wa=ants a lower/advisory speed sign. - Placement of "Slow - Children at Play" signs. It was noted that the signs give residents a false sense of security and motorists tend to overlook such signs. - Reconfiguration of the curve in Valentine Avenue for an inproved site line. Mayor Sather suggested a coordinated effort between City staff, Ramsey County Engineerin,J and Sheriff's Deparbnent and Moun::ls view School Officials be planned for fall to aocamplish the items as recommended. A resident suggested that if Council determines the stop signs should be renoved fram Valentine Avenue, another traffic study be corx:iucted to detennine if removal of the signs helps to reduce problems in the area. Public Works SUpervisor Winkel reported the stop signs on Valentine Avenue are replaced on a =ntinuous basis. Mayor Sather asked if Ramsey County needs a fonnal request fram the city for restripin,J County Road F. Engineer Dan Solar irxlicated a copy of the Council minutes outlining the request for restripin,J would be sufficient for the County purposes. Council thanked Ramsey County representatives and residents for attending the meetin,J . . ADOPl' AGElIDA Malone moved, seconded by Growe, to adopt the June 24 Agenda as subnitted. Motion carried unanimously. (4-0) Council1nember Malone requested the followin,J amendments to the June 3 and 17 Council minutes: APPROVE MINUI'ES 6/3/91: 6/3/91: Page 2, paragraph 3: to read "... three streets in the area were measured; McClurg, Briarknoll and Royal Hills, and...." Page 2, paragraph 8, second sentence: Change to read "four years" rather than "forty years". Malone moved, seconded by Growe, to approve the Council Minutes of June 3 Special and June 17 Worksession meetin,J, as amended, and June 10 Regular meetin,J as subnitted. Motion carried unanimously. (4-0) o:::>NSENI' Council1nember Malone carnmented on item 4 (d), under the CALENDAR Consent CalenJar, relatin,J to the parking ban on North Snellin,J Avenue. He noted Council previously adopted a motion to restrict parking on the west side of North Snellin,J and this will supercede that motion. Malone indicated his preference would be to ban parking on the west side of the street, to aCClCl1ll11Odate patrons of the park and allow residents to park in front of their hanes. He E!}(!llained the purpose for refe:rencin,J this matter in the minutes is to make residents aware the parking restriction may be changed to the west side in the future. (4-0) PUBLIC CCMMENI'S KEI'IHSON DRIVE; ROAD/PONDING Mayor Sather asked if there were any camnerrts fram the floor regarding matters not listed on the Agenda. Rainer Rocheleau, 4503 Keithson Drive, questioned what is prq:x:>s€d for Keithson Drive relative to repair the road and the ponding problems. . Mayor Sather briefly reviewed the status of the pondin;J issues and noted the city is negotiatin;J with a property owner for an outlet fram the pond. He explained the street deterioration has been pru;p:Esdve over the last year and was identified in the pavement maintenance plan two years ago. '!he Mayor indicated the condition of the street will be discussed in the fall, durin;J the annual review of the pavement maintenance plan. eouncilInember Malone discussed the specifications for road construction associated with Keithson Drive. He advised the road specifications for Keithson Drive addressed the poor soil conditions in the area. Mayor Sather explained the City has taken an active role to identify and =ect the problems with the roadway and pond. eouncilInember Malone questioned if the curb which is deterioratin;J is scheduled for replacement in the near future. Public Works SUpervisor Winkel stated the curb replacement is scheduled as soon the area dries; due to wet conditions from a water service leak the area cannot be repaired at this time. CASE #91-04; ZONING ORD. J\MENa1IIENT & PUD CDNCEPI' PIAN, NW CDLLEGE Council was referred to the Plarmer's report and Planning Commission minutes dated 6/5/91 and a letter fram Northwestern College dated 6-21-91, addressin;J the concerns expressed at the public hearing. Plarmer Bergly reviewed the public hearin;J held April 4 to discuss the proposed chan;re in the Zoning Ordinance, which would allow Colleges and Universities to have a separate definition and to allow Colleges/Universities as permitted uses, under a Planned Unit Develq:ment, in the R-1 and R-2 Districts. . Bergly referred to the 6-21-91 letter fram Northwestern College, responding to the concerns expressed at the June 5 public hearin;J relatin;J to the PUD Concept Plan: 1. TENNIS CXlURI'S: The location of the termis courts was reviewed by the College, to detennine the feasibility of relocation to an area which maintains a larger buffer fram residential properties in Arden Hills and RoSeville. . Mirnrtes of the Arden Hills Regular Council Meeting, 6-24-91 Page 6 CASE #91-04 (Cont'd) Bergly explained the proposal to relocate the tennis courts to a parking area; it appears there would be a larger I::uffer between the courts and the residential PJ:ape:tties if this location is utilized. He inlicated the new location for the courts is a workable solution. 2. EROSION: since the Planning Carnnission meeting, the College has undertaken erosion controls near the lake, along the west side of the Roseville portion of the canpus and west of the proposed library site on the Arden Hills portion of the canpus. Bergly advised these areas are natural ravines and collect water; most of the erosion is sarrl and most likely would not cause severe damage. He stated the College has atte.npted to control the problem with the placement of the fencing. 3. SCREENING: TIle College has installed plantings on the west side of the canpus to eliminate the breaks in the residential I::uffer; all trees downed by the recent stems have been retOClVed. 4. ACCESS: TIle Planner noted that in addition to the screening issues in this area, the Plarming Canunission ni""",,,"=r1. the possibility of an additional access point f= emergency vehicles in this area. Bergly explained the Fire Ollef identified a sewer easement in the area which may be a reasonable point f= emergency vehicle access. He disCllSS'9d the possible problems if a=ess to the canpus is limited to the entrance at Lydia street. Bergly advised a gate would be installed in this area, with a lock-boX, and the keys to the gate would be in the possession of the Fire Chief. . Bergly noted that access fran Shorewood Drive, on the east side of the canpus, would not be feasible due to topography. 5. STORAGE TANKS: TIle College has requested the assistance of a contractor to work with the PCA regulations and the LJVFD to bring the tanks into oanpliance . 6. HEAVY:mu:IIMENr STORAGE: The College has inlicated that the heavy equipnent is scheduled f= relocation on campus and should not be visible to residents. Bergly advised no plans f= relocation have been subnitted at this time. TIle Planner advised the Plarming Carnnission reconnnended approval of the PUD Concept Plan, with the following conditions: a. Establish a maxi.m.nu of 1250 full-time student pop.liation on canpus. b. A written statement from the Fire Chief, relative to the need for additional access points for emergency vehicles. c. TIle awlicant IllUSt subnit an application f= site Plan Review f= J::uildings identified on the PUD Concept Plan, pri= to issuance of J::uilding permits. The Planner suggested an additional condition be inpJsed which requires the College to revise the existing PUD Concept Plan and incorporate all changes. recanunended by the Roseville Council in 1986; the revised plan should be filed, with the changes incorporated, prior to or as part of the first awlication subnitted f= site plan review. . President Donald Erickson advised that the plan subnitted does incorporate the changes recommended by the Roseville Council, with the exception of the tennis court location. Council1nember Malone questioned the PUD regulations, which outline the time-frame f= sul:Jnission of the General Plan as the next Ii1ase of the awlication process. . . . Minutes of the Arden Hills Regular Council Meeting, 6-24-91 Page 7 CASE #91-04 (Cent'd) 'lhe Planner explained the present PUD regulations identify the General Developnent Plan as the next phase of the process and the plan should contain all the detail necessary for constJ:uction of the b.llldings, grading, drainage, etc. He stated in this situation the fonnat has been revised somewhat; the site Plan would serve as the General Developnent Plan and would include review of individual b.lllding plans, as the b.llldings are constructed. Bergly stated the Zoning Ordinance study Committee is reviewing the current PUD Ordinance regulations and is suggesting a revised fonnat, which follows the site plan Review procedures as outlined. He noted the canp.IS type situation does not lend itself to the present Ordinance r€<JUlations. Councilmember Malone stated that the applicant would be require:l to adhere to the present PUD regulations. Attorney Filla explained that Council may take action to adopt sane controls that allow the consideration of this application as a PUD and agreed that the existing PUD regulations should be followed by the applicant. He indicated that the Council may postpone action on the Concept Plan, if a delay does not affect the developnent schedule for the College. He agreed that the city should have the recarmnended changes to the existing regulations in order prior to beginning the process. Filla advised that if favorable action is taken on the proposed Zoning Code Amendment language, a draft would be prepared for a consideration at future meeting; the PUD regulations amendment may also be considered at that t:i1ne. Councilmember Malone questioned the procedures which were followed during the review of Cardiac Pacemakers. Planner Bergly stated the PUD plan suhnitted by Cardiac Pacemakers has been delayed until suhnission of an FAW report and a traffic plan, which were conditions imposed with approval; no t:i1ne limitation was noted at the t:i1ne of approval. He stated the College is planning to construct the first b.lllding in 1991 or 1992; the ordinance has a six IOOIlth t:i1ne-frame for subnission of the first b.lllding plan and a six-month extension provision. Councilmember Malone favored amending the regulations. He further carmnented it is somewhat difficult to decipher on the Concept Plan what is "proposed" and what is "existing"; questioned if the parkin3' lot near the proposed emergency vehicle a~s point is existing or prcposed. Planner Bergly noted that all proposed b.llldings are shaded and the parkin3' lot in question is an existing area. Councilmember Malone questioned the rationale for limiting the Higher Etlucation Facilities to the R-1 District; originally it was proposed for both the R-1 and R-2 District. Bergly stated the main concern noted by Commission was to allow the Colleges which currently exist to continue; the intent was not to encourage another college facility in an R-2 District. He explained the Commission strongly favored rezoning the other existing college facility from B-2 to R-1 and requiring the facility to follow the PUD procedures for eJqXll1Sion or b.lllding modification. Councilmember Malone disagreed with the commission recammendation, based on the geographic location of the Bethel facility which lends itself to the B-2 zoning. . . . Minutes of the Arden Hills Regular Council Meeting, 6-24-91 Page 8 CASE #91-04 (cont'd) Counci1member Hansen suggested College representatives pranote the additional emergency access point, proposed on the west side of the carrp.lS, to the residents ab.1ting the carrp.lS border. Donald Erickson, President of the College, advised the College does not favor an access point at this location. He stated the City is requiring the access for emergency vehicles. There was discussion relative to the type of road to be constructed for the access of emergency vehicles at the location. Fire allef winkel stated sane options were with College representatives; 10-ton road, gravel and grass construction. He advised there may be problems with residents opposing the access at this location. Malone moved, seconded by Growe, to direct the City Attorney to develop an amendment to the appropriate sections of the Zoning Ordinance relating to use of land, to allow Colleges (Colleges to be defined as "accredited schools of higher learning") to exist in the R-1 District under the PUD regulations, and to draft additional language to amend the PUD Ordinance Regulations to provide that final PUD developnent plans for public institutions be sul:Jnitted to the city in stages/IiJasing as a site Plan Review, rather than specify a time limit for sul:Jnission as provided for non-public developnent. Motion carried unanimously. (4-0) Malone m:>ved, seconded by Growe, to accept the Plarmed unit Developnent Concept Plan for Northwestern College, Case #91-04, as sul:Jnitted, based on the rationale outlined in the Planner's :repo:rt and as indicated in the Planning Canmission Minutes dated 6-5-91, conditions upon: 1. '!he maximum full-time equivalent student enrollment on carrp.lS be limited to 1250 students. 2. 'Ihe applicant develop an emergency vehicle access in the Arden Hills No. 3 area on the east border of the carrp.lS, as approved by the Fire allef. 3. '!he applicant is reminded that sul:Jnission of a site Plan Review application is required for improvelOOl1ts to the site, and Wilding construction or modification. Attorney Filla suggested that publication of the ordinance adopting the proposed Zoning Code amendments be included as a condition of approval of the PUD. Counci1lllembers Malone and Growe accepted the following language as an amendment to the motion: 4. '!he approval to became effective upon adoption and publication of the appropriate ordinance amendments relating to this application. Motion carried unanimously. (4-0) Donald Erickson, President of Northwestern College, stated for the record the College is not requesting and does not want the additional emergency vehicle access fram Arden Hills No.3 area, on the east border of the carrp.lS. Iage reported on the meeting held with Mr. Hansen, Attorney Filla anj Planner Bergly, at which tiJne Hansen decide:1 to resuhnit an application for a Preliminary Plat of this property. She further reported that Gary Wink, General Manager of HCMard Jolmson's, had contacted her regarding the site Plan Review application anj advise the motel management has decided to resumri.t the request in the fall of this year. CASE #91-05 & CASE #91-07; MINOR SUBD. & SITE PIAN REVIEW Council acknowle:1ged receipt of the report on both planning applications. (4-0) SCHEDULE JULY IDRKSESSION Council:member Malone advised he is unable to attend if a Worksession meeting is schedule:1 f= July 15 or 22; suggeste:i postponing the meeting to August. . Council:member Malone indicate:i a willingness to serve anj suggested the Clerk Administrator serve as the alternate. PARKS <XMrrTrEE MEEI'ING Council:member Hansen advise:i she is unable to attend the Parks Committee Meeting. . INFO; CHIPPING Council:member Hansen thanke:1 the Park Director f= the SERVICE infonnation on the City hiring a =ntractor to provide a chipping service for residents. She questioned if the contractor requires a guaranteed fee amount anj if the City would be responsible f= costs to meet the guaranteed ancunt. The Park Director state:i the =ntractor has indicate:i it would be preferable to =llect brush at the site until such time as a sufficient pile is a=umulate:i to haul for chipping, rather than chip the brush on site as residents make deliveries. Council concurred to direct staff to prepare a detailed plan of procedures and pranotion of the site for review at a future meetirxJ. Public Works SUperintendent Winkel explained that Shoreview Engineer Chuck Ahl indicated the City of Sh=eview is evaluatirxJ the possible pumpirxJ of water fram st. Paul Water into the north end of Turtle Lake, to maintain an established lake level. Attorney Filla recommended Arden Hills f=ward concerns to st. Paul Water and the Department of Natural Resources re;Jarding the pumpirxJ of water into Turtle Lake and Snail Lake. Council concurred to direct the Clerk Administrator to forward a letter to the appropriate officials expressirxJ Arden Hills concerns relatirxJ to the proposed pumpirxJ of water fram st. Paul Water into Turtle and Snail lakes, which include depletion of water supply, control of the valve and same fann of guarantee that an appropriate water level for the city of Arden Hills is maintained. .
