Village Hall Call to Order Pursuant to due call and notice thereof, Acting Mayor McAllister called the meeting to order at 7: 30 p.m. . ~11 Call Present - Acting Mayor Diane McAllister, Councilmen Thomas Mulcahy, Michael Christiansen, Dale hicks. . Absent - Mayor Robert Woodburn. Also P resen t - Attorney James Lynden, Treasurer Donald Lamb. Clerk Administrator Charlotte McNiesh, Deputy Clerk Dorothy Zehm. App roval of Minutes ilicks moved, seconded by Christiansen, that the Minutes of the Regular Council Meeting of October 31 be approved as amended. Motion carried unanimously. Regulations for Sump Pump Discharge Connections Council was referred to draft of Ordinance No. 231. Lynden noted that he discovered a few erroneous references in the Arden hills Code which he has corrected in this ordinanc e. Mulcahy moved, seconded by hicks, tha t Council introduce Ordinance No. 231 by title, AN ORDINANCE AMENDING SECTION 28-112 (a) OF THB ARDEN IiILLS CODE TO ChANGB ERRONBOUS REFERENCES TliEREIN AND ADDING A NEW SECTION 28-114 TO DIVISION 3 OF ARTICLE III OF CHAPTER 28 OF ThE ARDEN hILLS CODE REGULATING TIiE INSTALLATION OF SUMP PU~IP SYSTl:;MS. Christiansen moved, seconded by hicks, that Council introduce Ordinance No. 232 by title, AN ORDINANCE AMENDING THE SCliEUULES IN S;:;CTIONS 28-58(a) AND 28-128(a) OF ThE ARDEN HILLS COOl:; TO ChANGE Thl:; DELINQUENCY DATES ThEREIN. Motion carried unanimously. (4-0) . Proposed Woodbridge Properties Development Lynden reported that he has not contacted Woodbridge Properties to date relative to extension of sanitary sewer across their private property; recommends that the developer handle the maintenance of the lines by means of covenan ts for each parcel; noted tha t it is . his understanding tha t the City brings utilites to property lines; li ne s on private property are privately owned and maintained. ~tlroval of Semaphore Plans - S. (4-0) ~.oval of Arden Hills/Shoreview Joint Powers Agreement - Maintenance of Bike Path Systems on Lexington Avenue Council was referred to proposed Arden hills/Shore view Joint . Powers Agreement Relating to Maintenance of Bike Path Systerr.s on Lexington Avenue. McNiesh explained that the intent of the proposed agreement is . the same as previously approved by Council; noted that, as proposed by Shoreview. the agre.enlent is more formal and more specific. Mulcahy mOVe d. seconded by Christiansen, that Council app rove the Join t P owe rs Agreement between the City of Shoreview and the City of Arden hills relating to maintenance of the Lexington Avenue bike Path Systems, and authorize execution thereof by the Mayor and Clerk Adol1ni s t ra to r. Motion carried unanimously. (4-0) lliroval of Winter Park and Re c re a t i on Programs Council was referred to Arden llills Parks and Rec. Dept. Proposed Program Activities Winter: 1983-84. Mulcahy noted tha t the proposed new iterr,s are jointly sponsored; proposed program activities are recommended to Council for approval by the Parks and Re c rea t ion Committee. Hicks move d. seconded by Mulcahy, that Council app rove the 1983-84 Winter Program Activites as proposed. Motion carried unanimously. (4 -0) OTHER BUSINESS RCLLG meeting - Wednesday, November 16th hicks noted that Don Salverda will address the to pic "Improving A Council's J::ffectiveness": plans to attend the meeting. Grace Church - Letter of November 6 , 1983 Council was referred to Ie t t e r of 11-6-83 in fo rming Council of Grace Church's proposed use of facilites at Northwestern College, on a temporary b ss is , for Sunday mo rning and evening services. After discussion, it was the concensus of Council that it has no objection to the use of Northwestern College's Nazareth Hall and Fine Arts Building by Grace Church on a temporary b as is for Sunday morning and evening se rvi ces as prosposed. Patrick Flaherty's Letter of Novenlber 7, 1983 re License Fees Council was referred to Ie t t e r from Patrick Flaherty. McNiesh reported that she has advised Mr. Flaherty of Council's . referral of Councilman Mulcahy's Ii cens in g propossl to the Finance Committee for its consideration and recommendations to Council for 1985 licenSing. Cable TV McAllister reported that Group W e xp la1 ne d that they experienced . some delay because they could not find a sui table location fo r their studio; rep orted that the No rt h Suburban Cable Commission requested further information and has postponed its action for a month. McAllister said she will be out of town and cannot at ten d the Arden Hills Cable Communication Citizen Adviory Committee meeting on Tuesday, November 15th. .. Ninutes of Regular Council Neet in g Monday, Noven-ber 14, 1983 Page Three In discussion, concern was expressed that the delay of a month is setting bad precedent; it was further commented, that, if the re is a problem, the <:i t ie s should take a more active role in gettinl< it resolved. It was suggested that Attorney Creighton be askeo his views on the matter, ask for penalties, ask about remedies and courses of action by the Commission and request his re commenda ti ons on paper. . Hicks offered to at te nd the meeting on Tue sday and will relay Council's eonce rns to Chairman Bauer. . REPORT OF CLE RK ADMINISTRATOR CtiARLOTTl:: McN IE SI! Proposed Fence - Lexinl<ton Avenue IUiprovement Council was referred to proposed "dowelled rail and posts" fence, suggested by !lob Paine, Ramsey County Construction Engineer, which is suggested in lieu of the previously proposed chain-link fence at Cummings Park, separating the pathway from the steep embankment. It was no te d that the rails are about 1 ' apart; the 67" height is consioered to be high enough fo r safety; its,cost is within the budget and it enab les one to see through it. In discussion, Counci 1 concurred that the proposed fence, if structurally sound, is satisfactory. Christiansen moved., seconded by Mulcahy, that Council app rove the four-rail fence. (11-7-63) and Application for Payment No. 4 (Final) Nulcahy moved, seconded by Hicks, that Council accept the Hazelnut Park Addition improvement for ownership aud maintenance, and app rove the final payment. Hation carried unanimously. (4 -0) Claims and Payroll Council was referred to Claims and Payroll, and to additional list of checks totalling $20,641.88. Christiansen move d J seconded by Hicks, that Council app rove the Claims, Payroll and additioual che cks as presentea. Motion carried unanimously. (4-0) RCWD Nominee for Board of Managers Council was re fer r.. d to McN iesh' s memo of November 10th. After discussion, Council took no action. C han ge of Schedule - Park s Director . McNies h reported that Parks Director Buckley proposes to change his daily schedule from 8:00 - 4:30 to 7:30 - 4: 00. McNiesh reported that the Park s Maintenance etr.ployees currently work a 7:00 - 3:30 shift; no problems are forseen with the schedule change. .
