STATE OF MINNESOTA COUNTY OF RAMSEY CITY OF ARDEN HILLS ORDINANCE NO. 372 A MORATORIUM RELATED TO THE PLACEMENT OF SIGNS The Arden Hills City Council Ordains: 372.01 Recitals. A. The City of Arden Hills ("City") is in the process ofreviewing its regulations regarding new permanent signs and temporary signs in the City. B. As used herein, "Sign" means any nan1e, identification, description, display, logo, illustration or device which is affixed to, painted or rcpresented directly or indirectly upon a building or other surface or piece ofland, and which directs attention to an object, product, place, activity, person, institution, organization or business. C. The cxisting Sign Ordinance is incompatible with City goals and may . allow undesirable sign types and sizes. D. The City anticipates that there will be additional submittals for the construction of new pernlanent signs in the City. E. In order to permit the City Council to review and evaluate changes to the City's current regulations and to preserve the integrity of the planning process, the Arden Hills City Council hereby detern1ines that a sign moratorium for new permanent signs temporary is appropriate. 372.02 Exceptions. The City hereby adopts a sign moratorium applicable to the construction or installation of new signs in the City except for the following: A. Construction of signs in residential sign district 1 and district 2 (Figure 1) shall be allowed without a permit, provided that they are six square feet or less in size, are less than eight feet in height, maintain the structure setbacks ofthe underlying zone, and are not illuminated in any form. B. The sign face on an existing wall, frecstanding, monument, or pole sign may be replaced with a sign permit provided that the new sign face does not exceed the dimensions of the sign face before the adoption ofthis Moratorium. C. Temporary signs may be permitted with a sign pern1it for a total of 90 days per calendar year or upon termination ofthe Moratorium, whichever is earlier, provided that the temporary sign does not require any new construction or structural modifications and is in accordance with the sign area, height, and lighting restrictions listed in Table 1. - D. Off-site signs and billboards shall be prohibited in all sign districts in Table 1. 1 __. _.._._____n_ _ ____.._____ . . . . . E. Official public notices or warning signs required by local, state or federal law, including but not limited to traffic control and other regnlatory purpose signs may be posted without a sign permit. 372.03 Duration of Moratorium. The sign moratorium will commence on the effective date of this ordinance and will continue for one year thereafter unless otherwise terminated or extended by action of the City Council. 372.04 Enforcement. The City may enforce any provision of this ordinance by mandamus, injunction, or any other appropriate civil remedy in any court of competent jurisdiction. 372.05 Separabilitv. Every section, provision, or part of this ordinance is declared separable from every other section, provision or part ofthis ordinance. If any section, provision, or part of this ordinance is adjudged to be invalid by a court of competent jurisdiction, such judgment shall not invalidate any other section, provision, or part of this ordinance. Effective Date. This Ordinance shall be effective the day following its publication or on the day following the publication of an Ordinance Summary - approved by the Arden Hills City Council. CITY OF ARDEN HILLS COUNTY OF RAMSEY STATE OF MINNESOTA ORDINANCE NO. 372 A MORATORIUM RELATED TO THE PLACEMENT OF SIGNS On the 13th day of March, 2006, the Arden Hills City Council adopted Ordinance #343, and by five affirmative votes pursuant to Minn. Stat. S412.l91, Subd. 4, directed that a summary of the Ordinance be published. The Ordinance prohibits placing permanent signs within the City pending a review of the City's Comprehensive Plan, Sign Ordinance, and Zoning Maps. The Sign Moratorium will expire on the 13th day of March, 2007, unless further extended or modified by the City Council. The adoption of Arden Hills Ordinance #372 will become effective the day following publication of the Ordinance Summary. A copy of the Ordinance is available for inspection by any person during regular business hours at the office of the City Administrator, 1425 Highway 96, Arden Hills, Minnesota 55112. . .
