Public Input None. New Business a. Review Communications Update Director Mitchell stated in May, Goff Public worked with Ramsey County and the City of Arden Hills on additional inquiries from Star Tribune reporter Matt McKinney for his article about the Outlot A groundbreaking and sustainable design guidelines, which ran on May 10: Green, but not green enough? First building at former TCAAP site misses efficiency targets. Goff Public also worked with project staff to issue a special update to the Rice Creek Commons newsletter list on May 7: Construction underway on first development at Rice Creek Commons. Also in May, the American Institute of Architects Minnesota published an article in the annual ENTER magazine focused on carbon-neutral development at both Rice Creek Commons and the Heights: New Developments in Carbon Neutrality in Minnesota. Director Mitchell explained in June, Goff Public worked with JDA Chair Wicklund, Ramsey County and the City of Arden Hills on a statement about the outcome of the June 25 special JDA meeting regarding the request by Alatus for an extension to the preliminary development agreement. Star Tribune reporter Matt McKinney covered the meeting and decision by the JDA to take no action on the request: Rice Creek Commons board to part with TCAAP site developer citing sluggish pace. The next quarterly Rice Creek Commons newsletter is currently planned for August. There have been nine recent inquiries through the Rice Creek Commons microsite contact portal regarding housing, sustainability, wildlife, and requests for more information about the project. Staff responded to each inquiry directly. Commissioner McGuire thanked staff for their efforts to let the public know what’s going on. Chair Wicklund requested staff provide him with information on how many people are visiting the Rice Creek Commons website. Director Mitchell stated she would pass this information along to the JDA members. b. Review of Prior JDA Development Solicitation Processes Director Mitchell stated the JDA has undertaken two solicitation processes for development partners in the past. The primary documents for these two solicitation processes were presented to the JDA in detail for review and discussion. Commissioner Jebens-Singh questioned who did the evaluating of the proposals. Director Mitchell explained an evaluation subcommittee was formed to complete this task for both solicitation processes. Chair Wicklund stated back in 2016, the City Council was finalizing the TRC as a developer was being selected which allowed for conversations with the developer as the code was being finalized. Commissioner Jebens-Singh commented on the differences between the 2016 and 2023 solicitation processes. She asked what drove the differences. Director Mitchell stated she does not have a really great answer for this, noting she was not part of the 2016 process. She commented on how the scope of the project changes from 2016 to 2023. Commissioner McGuire questioned how many proposals the County received for each solicitation process. Director Mitchell stated the County received four proposals in 2016 and in 2023 the County received six. Commissioner Monson asked why the feedback on the proposals was submitted anonymously in 2023. Director Mitchell indicated she thought this was done at the advice of one of the attorneys. Commissioner Monson commented she would like to avoid an anonymous feedback process. She believed this process was incredibly limiting and she received a great deal of feedback from the public about the approval process because the JDA relied heavily on staff for recommendations. Commissioner Jebens-Singh supported holding the negotiations in a closed session in order to protect conversations and matters that are discussed. Attorney Tierney stated this was a complicated instance because the County owns the property and the JDA was not directly negotiating the sale of the land. She was uncertain that a closed session for the JDA would be necessary. Commissioner Jebens-Singh questioned if there were any common themes as to the barriers, concerns or questions to completing the vision for this project. Director Mitchell explained this was something she could explore and bring back to the JDA. Chair Wicklund stated this was a great question for the JDA to consider. Commissioner McGuire indicated she was sympathetic to both sides of the anonymous feedback process given how these were public meetings. She explained she would like to see a copy of the scoring rubric. Staff provided further information regarding the rubric that was followed in 2023 for the evaluation process. Commissioner Monson asked if the JDA would have a discussion on the want or need for a master developer. She indicated she wanted to learn more about the developer landscape and if a master developer was possible for this project. She stated the financing, mass grading and strategy of this project may have to be further considered. Chair Wicklund believed this would be an important conversation for the JDA to have. He explained he would not be in attendance at the August 4 JDA meeting. It was noted the September JDA meeting would be moved to Tuesday, September 9. Commissioner Weber stated whatever has changed in the development culture from 2016 and 2023 would have to be considered by the JDA. Chair Wicklund stated the TRC may have to be reviewed. Commissioner McGuire stated it was difficult to be back at square one, but it was also exciting to be able to begin this process anew. She hoped the JDA would not be limited in its thinking going forward, but rather that the group would be creative in order to move this development forward. Commissioner Jebens-Singh stated the JDA would have to consider what it knows now that could be built on and what course adjustments could be made. She indicated there may be new technologies or adjustments in the way developers were operating. She commented on how sound judgement has to be used in order to find a path forward for this development. Chair Wicklund suggested the Commissioners write down their thoughts and suggestions for improvements on the evaluation process and pass this information along to staff. c. Review Road Map Director Mitchell reviewed the Road Map with the JDA. Commissioner Monson stated it appears the community event planned for September would not be held. Director Mitchell indicated this event could be further discussed by the JDA in August. Commissioner Monson supported staff proposing an event in order to give the JDA something to react to. She believed now would be a great time to provide the public with an update. Commissioner Jebens-Singh requested staff investigate how changes at the federal level would impact the green energy initiatives for the Rice Creek Commons development. Chair Wicklund recommended staff begin entering 2026 meeting dates. Administrative Director’s Report Director Mitchell provided the JDA with an update on the spine road design plans. Commissioner Monson asked if staff an update on district energy. Director Mitchell reported the County was planning to use a portion of the geothermal planning grant to do an early district energy study in order to align with the spine road design plans. Commissioner Weber asked if staff had an update on the NGIA grant application process. Director Mitchell explained a letter of support was submitted and this grant was not quite at the application process, but was at a site selection process. Development Director’s Report Director Jagoe stated she had no update for the JDA. Commissioner Updates Commissioner McGuire encouraged staff to meet with Peter Lindstrom with the Met Council. Commissioner Weber stated he appreciated the discussion that was held at this meeting and he looked forward to the August 4 JDA meeting. Commissioner Monson asked if staff had an update on Building 116. Director Mitchell stated she would bring information back on this building for the August meeting. Chair Wicklund recommended Building 116 be added to the solicitation process because this was an issue that had to be solved. Commissioner Jebens-Singh explained she visited The Heights earlier today and stated she was inspired by the sustainability guidelines that were followed for this development. Public Input Lynn Diaz, 1143 Ingerson Road, commented on the language that requires all buildings to have solar panels and asked if this applied to all single-family homes. She indicated she was concerned with the fact the government tax credits would go to the development and not the individual installing the solar panels. She recommended that some sort of backup energy source be considered in the event the solar panels failed. Lyle Salmela, 1480 Arden Vista Court, commented on the LEED certification that has been developed. He explained he would like to speak with Rick regarding the recommendations for this project, noting he had suggestions that could get this project over 90 points. New Business a. Review Website Statistics Director Mitchell stated at the July meeting, the JDA requested statistics on the Rice Creek Commons webpage, RiceCreekCommons.com. The following information is provided for the period August 1, 2024, through July 31, 2025. It was noted the site has had 5,505 active users, 21,630 views, 3.93 views per active user with an average time per user being 1 minute and 50 seconds. She provided further information regarding the most viewed pages on the website. Commissioner Weber asked if the number of visits have increased in the last several months. Director Mitchell explained she could speak with her staff and would report back to the JDA with this information. Commissioner Monson indicated she would like to see a full document library on the Rice Creek Commons website. In addition, she wanted to see the JDA answering questions in a more timely manner for residents versus putting information on the website. Director Mitchell stated questions are responded to within the FAQ portion of the website, unless staff provides an answer at a JDA meeting. Commissioner Weber supported giving residents an answer to their questions, with the understanding not all questions can be answered on the spot. b. Review Sustainability Updates Director Mitchell stated the Energy Advisory Committee (EAC) met on July 23 to discuss sustainability and clean energy work updates. An overview of the items discussed was as follows: • LEED for Communities: precertification process • Sustainability Design Guidelines o Proposed revisions o Documentation package • Federal legislation impacts • Xcel pilot project coordination • Geothermal planning grant Rick Carter, LHB, commented on the LEED for Communities process that was being pursued. He noted he was at the point where he would be submitting for precertification. He stated he was at 83 points at this time. He indicated he was most proud of the fact the entire project was all electric and carbon neutral. He reported there was only one other platinum level community in the United States, which was in Florida. Commissioner McGuire thanked Mr. Carter for sharing all of his expertise with the JDA. She stated she appreciated all of his explanations and learning that this type of community was doable. Commissioner Weber explained he also appreciated the sustainability guidelines and learning that the proposed goals were achievable. Director Mitchell reported once the County applies for precertification, the certifying body would review the work and re-evaluation may be required. Commissioner Monson asked if staff had an update from Met Council. Director Mitchell stated she did not have any updates, but noted it was her understanding the Met Council had put a line on their map. Commissioner Weber recommended the Met Council be invited to a future worksession meeting to discuss the future line. Commissioner McGuire supported this recommendation. Further discussion ensued regarding the changes that were made to the electric vehicle terminology. Mr. Carter explained developers would be required to maximize rooftops on residential buildings. He reported federal regulations could change this story in the future and noted tax credits would flow to the project developer. He stated backup energy would be provided by the electrical grid. He indicated onsite battery storage may also be an option in the future. Commissioner McGuire asked if it would be too onerous to require properties to have a backup energy source. Mr. Carter stated he was uncertain if this could be regulated by the JDA or City. Commissioner Monson discussed how all of the power lines would be buried underground which meant it would be less likely there would be power outages. Vice Chair Jebens-Singh reported during the conversations with Ryan Companies, it did not appear there was anything onerous within the proposed sustainability guidelines. Commissioner Weber explained this appears to be the case, noting there were only minor code items that were brought up by Ryan Companies. Mr. Carter commented the only feedback he received was regarding the methodology for confirming the 50% better than code. He then discussed the changes that were made at a federal level that could impact the development of Rice Creek Commons. Vice Chair Jebens-Singh stated she appreciated the fact the door remained open for the proposed sustainability efforts for this project. She recommended the JDA remain conscience of the costs and funding mechanisms going forward. Commissioner Monson reported residential solar took the biggest hit from the federal government. Mr. Carter reported this was the case. Commissioner Monson discussed the potential challenges going forward for batteries given how 90% of battery anodes were made in China. She anticipated a developer would benefit economically from pursuing residential solar versus a district geothermal system. Commissioner Weber stated this would depend on what rebates are being offered from Xcel Energy. He reported in order to meet the LEED certification the JDA may have to consider a district system. Mr. Carter commented the best thing for the development would be to meet the guidelines and he was hoping to see a developer pursuing ground sourced energy through all electric and heat pumps in the buildings. Director Mitchell indicated she was still meeting regularly with Xcel Energy regarding the thermal energy pilot program to better understand their goals. Commissioner Monson asked if staff was coordinating with the Army on this. Director Mitchell stated she has not begun working with the Army on this process noting geothermal was allowed in the deed. Commissioner Weber inquired if staff had spoken with the Army about using the current water system. Director Mitchell stated she had not broached this subject with the Army, but needs to be advanced at some point. c. Discuss Development Solicitation Questions Director Mitchell commented on the process that was followed in the past within the development solicitation process. She reviewed the role and value of having a developer in place. She requested direction from the JDA regarding questions that should be considered within the future development solicitation process. Commissioner McGuire asked if there were examples where the County has been the lead developer in a project of this size. Director Mitchell stated there were no examples, given the size of this property. Commissioner Monson discussed the project that was completed by the St. Paul Port Authority and the commitments they had within The Heights development. She stated it would be important to hear from the County Board as to the appropriate risk profile they were considering for the land sale. Vice Chair Jebens-Singh reported this project had multiple paths forward and the County would have to consider if the project included the mass grading and if it was tied to the land sale. She indicated the JDA would also have to consider if a lead developer should be in place or should there be multiple developers in place. She questioned what needed to be done to get the ball rolling for the next steps for this project. Commissioner Monson stated from the City’s perspective, it was the County’s role to sell the land, but there would be financial implications on the City, depending on how the land was sold. She asked that staff participate in this process in order to better understand the revenue impacts for the City. Vice Chair Jebens-Singh explained she appreciated the fact the JDA was taking a pause in order to better consider how to move this project forward. Commissioner McGuire indicated she agreed with all of the comments that have been made and stated she supported staff investigating this matter further. Commissioner Monson inquired if the JDA should have a procurement policy in place. Director Mitchell stated in the past Ramsey County’s policy has been used as a model in the past, but noted Commissioner Monson was correct, that the JDA did not have a procurement policy in place. She noted she could look into this further with legal counsel. Rachel Tierney, Kennedy & Graven, explained the deferment to Ramsey County was because the County was the fiscal agent and their staff was performing the work. She indicated she could look further into the policies that should be in place for the JDA as this could inform decision making in the future. Vice Chair Jebens-Singh supported this being further investigated by staff and legal counsel. Director Mitchell discussed the changes that have occurred to the housing and office market since 2016. Vice Chair Jebens-Singh recommended staff provide the JDA with further information on the pros and cons of having a lead developer for this project. Commissioner Weber supported staff investigating this topic further. Commissioner Monson agreed and discussed how developers were pulling in multiple developers to complete larger projects. She recommended the RFI go to the Timberwolves organization for consideration. She inquired if the zoning should be looked at in a higher manner versus being so prescriptive. Commissioner Weber asked if the mass grading should be completed prior to pursuing an RFI. Commissioner Monson indicated she was proposing the JDA seek feedback from developers on what their vision for the site would be. Commissioner Weber commented he would be open to this. Director Jagoe discussed how the RFI might help better inform the recommendations for residential and commercial uses. Commissioner McGuire explained she agreed with Commissioner Monson and stated she was curious to see what developers might want to do. Vice Chair Jebens-Singh indicated she did not want the JDA to lead the conversations or expectations but rather hoped the RFI would bring about the highest and best use for this property, while still meeting the JDA’s goals. She hoped the RFI would help developers consider both the challenges and opportunities within the project. Commissioner Monson asked if staff should be directed to reach out to the Timberwolves. Commissioners Weber and McGuire were open to this. Vice Chair Jebens-Singh stated she was uncertain how a Timberwolves stadium would fit into the housing goals proposed for this development. Commissioner Monson indicated this was an opportunity that was not available in 2016 or 2023 and should be kept on the table for further consideration. d. Discuss Community Event Considerations Director Mitchell stated the JDA requested information for a discussion about a potential fall community event. She asked that the JDA consider the goals of a community event and what a successful community event would look like. Commissioner Weber recommended information be presented on the clean energy/ sustainability guidelines and the progress that was being made on the first development within Rice Creek Commons. He also suggested the need for more affordable housing be addressed. Commissioner McGuire suggested a status update be provided on the RFI process. She proposed the County host an online event/zoom meeting because this would be a cost effective way to address the public. Commissioner Monson stated she would like to see an open house event that addressed clean energy and sustainability. She noted a virtual series/webinar could be held in the future in order to educate the public on this project. She recommended the virtual videos be robust in order to properly educate the public. Vice Chair Jebens-Singh supported providing residents with detailed information in more than one manner. Director Mitchell indicated she could brainstorm how to hold an open house and virtual event. e. Review Road Map Director Mitchell reviewed the Road Map with the JDA. Page 1 AGENDA ITEM – 7a MEMORANDUM DATE: September 9, 2025 TO: Joint Development Authority Board of Commissioners FROM: Jessica Jagoe, Development Director SUBJECT: Preliminary Plat and Final Plat - Outlot C, Rice Creek Commons Second Addition Commissioners Should Consider Motions to approve, table, or deny the following: • Planning Case JDA 25-003 and the adoption of Joint Development Authority Resolution 25-002 for a Preliminary Plat and Final Plat for Rice Creek Commons Second Addition. Background Ramsey County (“Applicant”) has requested approval of a Preliminary Plat and Final Plat to subdivide Outlot C (“Subject Property”), often referred to as the “California Parcel”, of the TCAAP Plat for Rice Creek Commons. The Rice Creek Commons site is in the northwest corner of the city located to the east of U.S. Highway 10 and I-35W, north of Highway 96, west of the Arden Hills Army Training Site, and south of County Road I. On April 9, 2018, the City of Arden Hills approved the TCAAP Plat for Rice Creek Commons. This subdivision created five parcels called Outlots. The following is a description of the Outlots in the TCAAP Plat: • Outlot A: 40.10 acres o This parcel was subdivided in 2025 and replatted as Rice Creek Commons plat. This parcel will be further subdivided in the future as part of the Rice Creek Commons development. • Outlot B: 2.89 acres o This parcel was dedicated to Ramsey County Parks and Recreation for the Rice Creek North Regional Trail corridor and the remeander of Rice Creek. Joint Development Authority TCAAP Redevelopment Project Page 2 • Outlot C: 372.05 acres o Subject Property of JDA application review. In 2018, this parcel was noted to be further subdivided and developed in the future as part of the Rice Creek Commons development. • Outlot D: 1.00 acres o This parcel was dedicated to Ramsey County Parks and Recreation for the Rice Creek North Regional Trail corridor along the eastern boundary of the Rice Creek Commons site. • Outlot E: 1.83 acres o This parcel was a piece of land west of CSAH 13 for an existing retention pond. The purpose of this platting process is for dedication of the public road right-of-way for the Spine Road. Two large Outlots would be created as part of the plat for the future Rice Creek Commons development. These Outlots would be further subdivided and replatted at the time of the future development. The current platting process is not associated with any specific development on the site. A copy of the proposed Preliminary and Final Plat named “Rice Creek Commons Second Addition” are provided in Attachments C and D. The following is a description of the proposed Outlots and right-of-way dedication on the plat: • Outlot A = 93.25 acres (4,062,028 s.f.) o This parcel will be further subdivided and developed in the future as part of the Rice Creek Commons development. • Outlot B = 252.88 acres (11,015,634 s.f.) o This parcel will be further subdivided and developed in the future as part of the Rice Creek Commons development • Rice Creek Boulevard Right-of-Way = 25.92 acres (1,128,912 s.f.) Overall Subject Property Platted Area = 372.04 acres Future further subdivisions of the newly created Outlot A and Outlot B within the Rice Creek Commons development area would be brought forward for review by the Joint Development Authority (JDA) in accordance with the TCAAP Redevelopment Code (TRC). Proposed Conditions – Preliminary and Final Plat The TRC incorporates by reference Chapter 11 of the Arden Hills City Code (AHC) for plat approval for the purpose of design review, subject to the requirements for public infrastructure per the TRC. This process includes City approval of grading/erosion control plans and utilities plans. Fees or charges for public infrastructure or facilities established by or applicable to subdivisions processed under the AHC shall be applied to subdivisions processed under the TRC. Plan Evaluation AHC Chapter 11, Subdivisions 1. Preliminary Plat AHC Section 1130.01 - Conformity with City Plan – Meets Requirements Page 3 Section 1130.01 states that the proposed subdivision shall conform with the City plan. As noted in the background, the proposed plat is consistent with the Comprehensive Plan and meets the standards of the TRC. AHC Section 1130.03 and 1130.02 - Street Plan and Streets – Meets Requirements Section 1130.02 addresses the arrangement, character, extent, width, grade and location of all streets, however the TRC includes standards regarding the same standards and supersedes the standards in 1130.02. The plat is for the dedication of the public road right-of-way for the Spine Road. The Spine Road will be through the Subject Property to connect Outlot A, also known as the “Thumb parcel”, and County Road H to County State Aid Highway 96. The proposed public right-of- way for the Spine Road is consistent with the Street Network as shown in Attachment 5 - TCAAP Street Type Plan of the TRC. The two Outlots that are proposed to be created would not hinder the eventual extension of streets and utility services to the Rice Creek Commons development. The proposed public right- of-way includes the roadway intersections for future development. AHC Section 1130.05 – Meets Requirements No additional public easements are required to be dedicated at this time. The need for drainage, utility, and other public easements will be determined at the time Outlot A and Outlot B are subdivided for future development. AHC Section 1130.07 – Lots – Meets Requirements The proposed plat would create Outlot A and Outlot B which will be further subdivided at the time of future development. The lot standards included in the Subdivision Ordinance and TCAAP Redevelopment Code would be evaluated at that time. City Code does require for location, all lots shall abut by their full frontage on a publicly dedicated street or a street that has received legal status as such or will receive such status upon approval of the subject plat. For size, the lot dimensions in subdivisions shall not be less than the minimum dimensions required to secure the minimum lot area specified in the zoning ordinance of the City. The TRC does not establish minimum standards for lots. There are no standards established in the AHC that would apply as those standards are only relevant in the zoning districts established in the AHC. Page 4 Figure 1 Preliminary Plat 2. Final Plat The Applicant is proposing to plat the Subject Property to dedicate the public right-of-way necessary for the Spine Road and create two Outlots. A Final Plat is the final map, drawing or chart indicating the final layout for JDA approval. The Final Plat includes the detailed survey description for each lot in the plat plus notes and dedication, recording and approval statements. The Final Plat is the “recorded document” submitted to the County register and must conform to all state laws. Public Use Dedication Public Use Dedication requirements for the Rice Creek Commons development will be determined at the time Outlot A and Outlot B are subdivided for future development. Public Use Dedication is not required as part of the current platting process. Chapter 13, Zoning Regulations Review The current platting process is not associated with any specific development proposals. Future subdivision and replatting of Outlot A and Outlot B for the Rice Creek Commons development will be evaluated based on the Arden Hills Zoning Code and the TCAAP Redevelopment Code. Additional Review Comments Public Works/City Engineer The Public Works Director/City Engineer has reviewed the plat plans. A memorandum has been prepared by the consultant for the Public Works Director/City Engineer and the Applicant as a recommended condition of approval shall be required to comply with the memorandum dated September 2, 2025 (Attachment E) prior to recording of the Final Plat. Page 5 Rice Creek Watershed District Rice Creek Watershed District (RCWD) has reviewed the plats and has no additional comments on the plans. Comments were provided related to the construction of public infrastructure and future development which were shared with the Applicant. MnDOT MnDOT has reviewed the plat plans and provided comments on future transit and permitting requirements which were shared with the Applicant. Ramsey County Ramsey County Public Works has reviewed the plans and have no additional comments at this time. The Applicant has provided a response letter to the agency review comments received which has been included as Attachment F. Findings of Fact The Joint Development Authority must make a finding as to whether or not the proposed application would adversely affect the surrounding neighborhood or the community as a whole based on the aforementioned factors. Staff offers the following five findings for consideration: • The former Twin Cities Army Ammunitions Plant (TCAAP) site is in the northwest corner of the city located to the east of U.S. Highway 10 and I-35W, north of Highway 96, west of the Arden Hills Army Training Site, and south of County Road I. • Ramsey County has requested a Preliminary Plat and Final Plat of the TCAAP, Outlot C site in order to subdivide the parcel for delineation and dedication of the public right-of- way for the Spine Road. • The current platting process is not associated with any specific development on the site. • The future subdivision and replatting of Outlots A & B - Rice Creek Commons Second Addition for the Rice Creek Commons development would be evaluated at that time based on all applicable provisions and regulations in the City Code and the TCAAP Redevelopment Code. • The proposed Preliminary Plat and Final Plat are consistent with the Arden Hills Zoning Map, TCAAP Regulating Plan, and the 2040 Comprehensive Plan. Options and Motion Language The following are motion language options for the Joint Development Authority Board to consider. • Approval with Conditions: Motion to approve JDA Planning Case 25-003 and adopt Resolution 2025-002 for a Preliminary Plat and Final Plat of Outlot C a 372.04 acre parcel within Rice Creek Commons, based on the findings of fact and the submitted plans, as amended by the conditions in the September 9, 2025 Report to the Joint Development Authority Board: Page 6 1. The Applicant shall record the Final Plat with Ramsey County within sixty (60) days of the JDA’s approval and a copy of the recorded plat shall be provided to the City. 2. All items identified in the September 2, 2025, City PW/Engineering Division memo shall be addressed prior to the recording of the Final Plat. All comments shall be adopted herein by reference. • Approval as Submitted: Motion to approve JDA Planning Case 25-003 and adopt Resolution 2025-002 for a Preliminary Plat and Final Plat of Outlot C a 372.04 acre parcel within Rice Creek Commons, based on the findings of fact and the submitted plans in the September 9, 2025 Report to the Joint Development Authority Board. • Denial: Motion to deny JDA Planning Case 25-003 for a Preliminary Plat and Final Plat of Outlot C a 372.04 acre parcel within Rice Creek Commons, based on the following findings: findings to deny should specifically reference the reasons for denial and why those reasons cannot be mitigated. • Table: Motion to table JDA Planning Case 25-003 for a Preliminary Plat and Final Plat of Outlot C a 372.04 acre parcel within Rice Creek Commons: a specific reason and information request should be included with a motion to table. Public Notice Notice of the public hearing for the Preliminary Plat and Final Plat was published in the Pioneer Press on August 29, 2025, and mailed to all properties within 1,000 feet of the Subject Property. Staff has not received any public comments regarding this application. Deadline for Agency Actions The City of Arden Hills received the completed application for this request on August 15, 2025. The permit applicant shall demonstrate that the off-site runoff entering MnDOT drainage system(s) and/or right of way will not increase. The drainage permit application, including the information below, should be submitted online to: https://olpa.dot.state.mn.us/OLPA/. Please upload this letter with the drainage permit application. County understands the Drainage Permit requirement. - The following information must be submitted with the drainage permit application: 1. Grading plans, drainage plans, and hydraulic calculations demonstrating that proposed flows to MnDOT right of way remain the same as existing conditions or are reduced. County understands this requirement. Rice Creek Watershed District - This area includes a portion of the Rice Creek Water Trail, which is heavily used. Please consider this usage when designing the roadway crossing so that it is not dangerous or inaccessible for paddlers. County will include this request in our design package, and review with Watershed at the 90% complete level. - A sign at the bridge indicating “Rice Creek” would be nice! County will include this signage in the final design plans. - Rice Creek approved the Rice Creek Commons Comprehensive Stormwater Management Plan (CSMP) in 2015 and was last updated in 2016. The CSMP provides an alternative means for meeting the water quality treatment and peak rate runoff control requirements of the RCWD stormwater management rule. The plan essentially envisions two stages of development, the interim condition where the spine road and associated infrastructure is constructed and then the full build-out condition. Will the associated stormwater and wetland mitigation areas be further platted into outlots as development occurs, or will they be part of private property and placed under easement? County will discuss this with the JDA at the time of future subdivision. Ownership and maintenance responsibilities of subsequent stormwater facilities will likely be determined as part of a Developers’ Agreement with subsequent developers. - As part of the County Road H roundabout construction, portions of Rice Creek were re- meandered in 2015 to facilitate the improvements. This project included wetland mitigation along Rice Creek which has been protected with a Declaration of Restrictions and Covenants. Please ensure that the plat will not affect the mitigation area. Subject to Document Number 4585028, Outlot B - TCAAP remains protected under the Wetland Conservation Act Declaration of Restrictions and Covenants. The proposed final plat shows Outlot B - TCAAP as unaltered and outside of the proposed plat. Future subdivision of Rice Creek Commons 2nd Addition cannot include Outlot B of the TCAAP Plat as it is outside the 2nd Addition’s’ boundary. City of Arden Hills Final Plat 1. The RW along the edge of Outlot B could be shown either as a parcel line or RW as it is both. 2. Label the widths of all adjoining existing right-of-way, if width varies, indicate so. This only seems to be a concern on page 3 as the dimensions or the phrase “width varies” exist on all other sheets. 505.021, Sub. 6 requires the width to be shown only “if known.” This portion of 35W is so wide and crosses into the next section to the west that we really don’t know the width at any given point. Purpose. The purpose of the Sustainability Design Guidelines (SDG) is to advance the TCAAP Joint Development Authority’s (JDA’s) mission to advance sustainable development, reduce energy use and carbon dioxide emissions, and thereby mitigate the impacts of climate change from the Rice Creek Commons development. These guidelines establish the sustainability standards for development on the site and serve to implement the Green Energy Vision and Clean Energy Policy, which has the goal of an all-electric, carbon-free development. These guidelines also support the JDA’s pursuit of LEED for Communities (Leadership in Energy and Environmental Design v4.1 for Communities: Plan + Design) certification. It is the goal of the JDA that each building and parcel in Rice Creek Commons shall comply with the SDG. The JDA will apply these guidelines within the Rice Creek Commons development through Development Agreements that are subject to JDA approval 2. Guidelines 2.1. Sustainability Certification. Each building and tenant improvement shall achieve LEED BD+C New Construction certification at the silver level or above using the newest version available at the time of registration. The LEED boundary for each improved parcel of land within the Development shall be the same as the boundary of that parcel. Other certification systems will be considered for one- to four-unit residential buildings, including the DOE’s Zero Energy Ready Home (ZERH) program and Phius Passive House standards. 2.2. Building Decarbonization. 2.2.1. Energy Efficiency. All buildings and tenant improvements shall achieve: 50% better energy efficiency than the applicable Minnesota Energy Code, certification from the DOE’s Zero Energy Ready Home (ZERH) program, or Phius CORE certification as a Passive House. 2.2.2. Electrification. Except as otherwise expressly provided herein, all buildings shall be all- electric and shall not use any fossil fuels. Any waivers of this provision will be restricted to systems or devices for which an equivalent all-electric system or design is unavailable, impractical, or is determined to present an equity gap, as reasonably determined by JDA. In the event of a waiver, buildings the JDA allows to use any fossil fuels must offset an equivalent amount of carbon emissions each year. 2.2.3. Renewable Energy. All buildings in the Development must install photovoltaic (PV) systems that either: 2.2.3.1. generate, on an annual basis, enough electricity to meet one hundred twenty percent (120%) of the building's anticipated energy use; or 2.2.3.2. include a rooftop array with a rated capacity of not less than 10.75 watts per gross square foot of roof area and a covered parking array for all parking lots containing twenty or more parking spaces -- including the top level of multi-level parking structures – with a rated capacity of not less than 7.5 watts per gross square foot of parking area. Updated 9/5/2025 All panels used in PV systems must be rated as Tier 1 panels and, if applicable, qualify under the Inflation Reduction Act for the Investment Tax Credit. Any renewable energy certificates (RECs) generated from PV systems in the Development shall be credited to the Development as a whole. Additionally, all purchased electricity must come from a green power purchase program and include bundled RECs. 2.3. District Energy. If a District Energy System is available, all buildings shall connect to the District Energy System for heating and cooling. 2.4. Embodied Carbon. Except as otherwise expressly provided herein, all buildings shall conduct a whole building life-cycle assessment and achieve at least a 10% reduction in global warming potential, using the calculation methods established in LEED BD+C: New Construction. This Section does not apply to single family homes or tenant improvements within commercial buildings. 2.5. Electric Vehicle Infrastructure. The Development shall include infrastructure to support electric vehicles (EV) – as defined by the International Building Code – as follows: 2.5.1. Provide electric vehicle supply equipment (EVSE) in a minimum of two percent (2%) of all public parking spaces. Clearly identify and reserve these spaces for the sole use by plug-in electric vehicles. 2.5.2. For non-residential parcels where four or more vehicle parking spaces are provided, not less than 4% of the total number of parking spaces or not less than 8% of designated employee- only parking spaces shall be EV-ready spaces or EV-installed spaces. Not less than 30% of the total number of parking spaces shall be EV-capable spaces, EV-ready spaces, or EV- installed spaces. 2.5.3. For residential parcels, not less than 20% of the total number of parking spaces shall be EV- ready spaces or EV-installed spaces. Not less than 75% of the total number of parking spaces shall be EV-capable spaces, EV-ready spaces, or EV-installed spaces. 2.5.4. All EVSE shall meet the following requirements: Provide a Level 2 charging capacity (208- 240 volts) or greater. Comply with the relevant regional standard for electrical connectors, such as: SAE Surface Vehicle Recommended Practice J1772. Be capable of responding to time-of-use market signals (e.g., price). 2.5.5. Terminology guidance: Electric Vehicle Supply Equipment (EVSE): The conductors, including the ungrounded, grounded and equipment grounding conductors, and the EV connectors, attachment plugs, and all other fittings, devices, power outlets, or apparatuses installed specifically for the purpose of transferring energy between the premises wiring and the EV. 2.5.5.1. EV-installed: A designated parking space that has all the infrastructure and a charging station to charge an electric vehicle on the day the building permit is approved. The EVSE shall be Level 2 or greater. 2.5.5.2. EV-ready: A designated parking space which is provided with a minimum 40-amp, 208/240-volt, dedicated branch circuit for future dedicated Level 2 EVSE servicing EVs. The circuit shall terminate in a suitable point such as a receptacle, junction box, or an Updated 9/5/2025 EVSE, and be near the proposed location of the EV parking spaces. The circuit shall have no other outlets. The service panel shall include an over-current protective device and provide sufficient capacity and space to accommodate the circuit and over- current protective device and be near the proposed location of the EV parking spaces. For two adjacent EV-capable spaces, a single branch circuit is permitted. 2.5.5.3. EV-capable: A dedicated parking space which is provided with electrical panel capacity and space to support a minimum 40-amp, 208/240-volt branch circuit for each EV parking space, and the installation of raceways, both underground and surface mounted, to support the EVSE. For two adjacent EV-capable spaces, a single branch circuit is permitted. 1.1. Reporting. On an annual basis, all owners shall report monthly whole-building energy consumption, on-site energy generation, electrical demand, and water use to Energy Star Portfolio Manager and ensure this information is accessible to the JDA. Owners shall provide other building data upon the reasonable request of JDA. 2. Implementation and Compliance. Developers will comply with these guidelines by following the below approval and documentation processes concurrent with all other JDA review processes. 2.1. Approval Process. 2.1.1. Developer reviews Sustainability Design Guidelines and participates in kickoff meeting with sustainability consultant (LHB). Developer also participates in Energy Design Assistance (EDA) Program, a free energy consulting service, to understand energy efficiency options for their development and develop a whole building energy model (single-family homes exempted from EDA program). 2.1.2. Following the kickoff meeting and additional meetings as necessary, sustainability consultant provides summary memo of SDG compliance measures. 2.1.3. Upon agreement of the Developer and staff regarding compliance with the guidelines, or upon agreement with the JDA regarding the terms of a waiver, Staff incorporates SDG compliance measures into Development Agreement between JDA and Developer. 2.2. Waivers. If the Developer determines they cannot adhere to all items in the SDG, Developer must complete the Waiver Request Process. The measures in these guidelines may be modified for individual developments for reasons of hardship. Alternative strategies that show demonstrable and quantifiable progress towards the Green Energy Vision may be considered as alternative compliance. Developers will go through the following process to request waivers to the SDG. 2.2.1. Developer completes waiver request form, including justification for requested waivers. 2.2.2. Sustainability consultant reviews waiver request form and prepares memo for staff who will make a recommendation to the JDA. This memo includes discussion of the impacts of requested waivers on JDA sustainability goals, such as greenhouse gas emissions and LEED for Communities certification, and the reasonableness of the waiver request. Updated 9/5/2025 2.2.3. JDA reviews waiver request memo and approves, disapproves, or otherwise provides direction to the Developer on waivers and/or alternative acceptable SDG compliance measures. Developer may present to JDA on sustainability plans and waiver request. 2.2.4. Sustainability consultant incorporates acceptable SDG compliance measures into summary memo, for staff to incorporate into Development Agreement. 2.3. Documentation. Developers will work with consultants and staff to submit documentation of SDG compliance. 2.3.1. Sustainability Certification 2.3.1.1. Proof of registration with LEED (or other accepted certification). 2.3.1.2. Checklist of the planned certification credits to be achieved. 2.3.1.3. Within one year of building occupancy, provide documentation reporting the certification level and credits achieved. 2.3.2. Energy Efficiency 2.3.2.1. All buildings and tenant improvements: energy model report showing achievement of 50% better efficiency than the applicable Minnesota Energy Code, certification from the DOE’s Zero Energy Ready Home (ZERH) program, or Phius CORE certification as a Passive House. 2.3.3. The City of Arden Hills (City) and Ramsey County (County) are working together through the JDA to advance the development of the property, building on the existing vision for development and planning documents. This Request for Information (RFI) is solely informational. Responders will be notified of any future competitive solicitation(s) for development. 2 Site Location and Background Rice Creek Commons (RCC) is located in Arden Hills, Minnesota, immediately east of Interstate 35W. The property is bound by County Road H and Rice Creek Regional Park on the north and by U.S. Highway 10 and County Road 96 on the south. RCC is conveniently located 10 freeway miles away from both downtown Minneapolis and downtown Saint Paul. The former Twin Cities Army Ammunition Plant (TCAAP) property once comprised over 2,300 acres of land in the City of Arden Hills used by the federal government for the manufacture of small arms ammunition during World War II. The TCAAP Site ceased manufacturing operations in 1976 and was largely decommissioned in the 1980’s. In 2013, Ramsey County purchased 427 acres of TCAAP property from the federal government to remediate, redevelop and reestablish the property as the economic engine it once was – this time with homes, businesses and retail. This portion of the former TCAAP property was then renamed Rice Creek Commons. The site is divided into two major parcels that are commonly referred to as the California Parcel (shown in green) and the Thumb Parcel or Outlot A (shown in red). The California Parcel is the primary Rice Creek Commons redevelopment area and is the focus of this RFI. It is a 372-acre parcel of land, roughly in the shape of the State of California, zoned for a broad range of land uses. The Thumb Parcel, also known as Outlot A, is a 40-acre parcel zoned for commercial/industrial use to the north of the main site. It is currently partially under development and contract. Outlot A is not the topic of this RFI. 3 TCAAP Joint Development Authority (JDA) The TCAAP Joint Development Authority (JDA) is chaired by a resident of the City of Arden Hills and consists of two elected officials each from the City of Arden Hills and Ramsey County. The JDA’s purpose is joint governance of economic development and redevelopment of the Rice Creek Commons property. The JDA reviews all development proposals for conformity with the TCAAP Redevelopment Code and Regulating Plan and has limited land use authority for such proposals. On February 6, 2023, the JDA adopted the following vision statement for Rice Creek Commons: The Joint Development Authority’s (JDA) vision for the Rice Creek Commons site is to create economic prosperity, build an inclusive economy, have a long-term sustainable development, and develop an energy forward community by providing much-needed housing at a variety of income levels – including affordable housing – and creating well-paying jobs. In addition to a vision for the site, key policy goals have been identified as development priorities. • At least 20% of the total housing units will be affordable at 60% area median income (AMI) or below. • At least 10% of the total for-sale housing units will be eligible for Ramsey County down payment assistance program (as of 2025, that means a maximum purchase price of $372,600). • Job creation is a key goal of the development. • Ramsey County’s prevailing wage ordinance will apply to development on the site. Planning Documents The Rice Creek Commons planning documents lay out a vision for the site that takes advantage of its location, builds on its assets, and introduces an exciting mix of new development. The primary planning documents are the TCAAP Redevelopment Code (TRC) and the TCAAP Regulating Plan. The City of Arden Hills 2040 Comprehensive Plan also includes important information related to Rice Creek Commons. These documents were created and amended based on public engagement over the course of many years. Rice Creek Commons will be a cohesive mix of residential and commercial neighborhoods surrounding a town center; a unique community where people can live, work and play. 4 Considering land designated for infrastructure, trails, and open space, Rice Creek Commons has approximately 300 acres of land planned for commercial and residential development. The site will feature four distinct neighborhoods with a wide range of housing types, ensuring that Rice Creek Commons will be a place for people in all walks of life. The Hill, Creek, and Southwest neighborhoods will be primarily residential, offering a mix of single- family homes, townhomes, and other housing options. The Town Center neighborhood, at the heart of Rice Creek Commons, will provide a walkable retail center with multifamily housing, public space, and commercial uses. The entire site will be connected by an internal network of parks and trails that will not only provide open space for all types of recreation but also perform important environmental functions such as stormwater management and natural habitat restoration. Open space throughout the site will connect to a larger regional system, with miles of linked trails, making active living easily accessible for future residents. The vision for the site includes the following land uses (see TCAAP Regulating Plan for full land use map): • Town center: The Town Center neighborhood is centered on approximately 17 acres of land that is envisioned to be a vibrant commercial and residential district that promotes walkability through its street design and mix of uses. Zoning for Town Center includes housing, office, retail, restaurant, and civic uses. Within this district, buildings can be up to five stories in some areas and up to 10 stories in others. • Neighborhood residential: Three distinct residential neighborhoods are planned. The Creek and Hill neighborhoods together consist of 118 acres of land zoned for low-density residential uses, such as single-family houses. The Southwest and Town Center North and South neighborhoods include about 60 acres of land zoned for low- to medium-density residential uses, such as townhouses or similar. • Mixed-use retail: This land use is concentrated in 28 acres of retail development at the northern gateway to the site served by an off-ramp from 35W. Additional areas for this land use are located at the southern entrance to the site and in the Town Center area. • Office Mixed Use: This land use allows for 20 acres of office space in buildings that can be built as high as five stories. • Flex business: Approximately 10 acres on the west-central portion of the site are zoned for flex business, which allows for office, technology and manufacturing uses. 5 The TRC does not allow businesses that primarily provide warehousing and distribution. The focus of this land use is to provide employment opportunities. • Parks, trails, and green space: Approximately 25 acres is reserved for parks and open space, spread throughout the development. There will be pedestrian and bicycle facilities in the neighborhoods, and a paved trail is planned to extend along the eastern edge of the site and will connect to the broader regional trail network. There are also plans for the surrounding area that will relate to RCC. In 2020, Ramsey County Parks & Recreation amended the Rice Creek North Regional Trail Master Plan which includes plans to build a bike and pedestrian trail and trailhead facility with all-season activities on 112 acres adjacent to RCC. With these facilities, RCC will connect to a regional system of over 240 miles of trails through the Twin Cities. Sustainability and Clean Energy Since its inception, the JDA has laid the groundwork for RCC to be a national model for innovative, sustainable development with a goal to be all-electric and carbon-free. The JDA created an Energy Advisory Committee to guide this work and adopted the following vision and guiding principles: Rice Creek Commons Energy Vision: Rice Creek Commons will be a vibrant and unique, climate-forward development that aligns with the goals outlined in the State of Minnesota’s Climate Action Framework: carbon neutrality, clean energy, climate resiliency, equity and innovation. Rice Creek Commons will attract investment and partnership that will create sustainable benefits for the community. Guiding Principles: • Develop a resilient community for energy and other utilities using clean energy technologies, reducing consumption, and reusing local resources onsite. • Implement infrastructure solutions that are flexible and scalable over 50 years, including developing the site to be adaptable to future technological needs. • Deliver a model of efficient energy and water usage that minimizes Rice Creek Commons’ impact on the environment. • Create an economically competitive and attractive environment for developers and businesses to create a vibrant community with multi-modal transportation options. 6 The JDA is working toward U.S. Green Building Council’s LEED for Communities certification for the project, with the goal of achieving Platinum certification. This globally recognized standard establishes benchmarks for energy efficiency and sustainability. Achieving this certification will guide the project in meeting its ambitious energy and environmental goals while ensuring accountability through independent third-party verification. In January 2025, the JDA approved Sustainability Design Guidelines that will help shape the development of the full Rice Creek Commons site. The guidelines include several actionable standards that will further the site’s green energy vision and are based on a comprehensive analysis conducted in 2024 by renewable energy consultant Ever-Green Energy and architecture and engineering firm LHB. A community energy system has long been envisioned for the site. Through a grant from the Minnesota Department of Commerce awarded in April 2025, the JDA is currently working with project partners to continue to study the feasibility of a ground-source district energy system to serve the central portion of the site. Environmental History, Remediation and Current Status In 1983, the TCAAP property was placed on the federal and Minnesota Superfund lists. In 2013, Ramsey County acquired the 427-acre property now known as Rice Creek Commons from the U.S. Government. Demolition and site remediation occurred on the 427-acre TCAAP/Rice Creek Commons property, cleaning the soil to residential standards, as defined by the Minnesota Pollution Control Agency (MPCA). In 2016, the MPCA issued a Certificate of Completion of Response Actions for soil remediation. In 2019, the 427-acre TCAAP/Rice Creek Commons property soil and surface water was delisted by the U.S. Environmental Protection Agency (“EPA”) from the federal National Priority List (“federal Superfund”). In 2020, the MPCA also delisted the 427-acre TCAAP/Rice Creek Commons property from the state Permanent List of Priorities (“state Superfund”). As result of the above actions, the site was given unrestricted land use status and is ready to be developed. As development of the site proceeds, Ramsey County continues to partner with the Army, EPA, and MPCA to ensure the Army’s ongoing environmental obligations to treat deep groundwater contamination is met. More information about cleanup activities and environmental history can be found via the U.S. Environmental Protection Agency (EPA) and Minnesota Pollution Control Agency (MPCA) websites. 7 Site Infrastructure Over the past several years, Ramsey County has invested in improving roads and expanding the network surrounding Rice Creek Commons in anticipation of the development. Primary access to the Rice Creek Commons development will be from Highway 96 east of Highway 10 and County Road H near I-35W. A new county road, commonly referred to as the Spine Road to be named Rice Creek Boulevard, will serve as the main artery through the site. A roundabout built by Ramsey County at County Road H provides improved access to the 35W entrance and exit ramps, future Spine Road and Rice Creek Parkway. Roadways within Rice Creek Commons will be a combination of local city roads and private roads. Sidewalk and trail infrastructure will be prioritized within the development to ensure streets are pedestrian and bicycle friendly. In 2024, to prepare for private development, Ramsey County executed an engineering contract for final design of public infrastructure on the site. This design work includes grading, drainage, stormwater management features, mitigated wetlands and public utilities. The design contract also includes the final design of the Rice Creek Blvd (CSAH 13), which will provide primary access to future residential neighborhoods and commercial areas throughout the site, as well as a direct connection to Interstate 35W. Final design and engineering of the public infrastructure began in summer 2024 and is on track for completion in early 2026. This delivery will result in final construction documents for the county public infrastructure and is a critical step toward preparing the site for vertical construction. Existing Conditions Redevelopment of RCC will require future developers to be cognizant of the constraints associated with the site’s history. Elements of the site that may impact development include: • Ongoing on-site treatment of contaminated deep groundwater by the federal government will continue for several decades. The U.S. Army controls this groundwater treatment system (known as the TCAAP Groundwater Recovery System, or TGRS), and a portion of the mechanical for this system is contained in a building on the site to remain. • Although the soil has been remediated to residential standards, depending upon Minnesota Pollution Control Agency (MPCA) standards, areas of the site may require passive or active building venting systems to mitigate any potential vapor issues from shallow groundwater. MPCA standards have evolved over the past several 8 years. Exact standards may not be known until a specific development site plan is presented to the MPCA. • A district stormwater system for the vast majority of the site will be provided in the natural resources corridor. Additional stormwater ponds will need to be constructed on private land when development occurs. • Shallow groundwater exists in portions of the site and may require remedial action plans and construction contingency plans during construction • Land to the east of RCC (Arden Hills Army Training Site – AHATS) is owned by the federal government and operated by the Minnesota National Guard (MNG). Portions of MNG land have been used for low intensity training adjacent to residential neighborhoods for many decades. Current Development and Planning Status The County and City have planned and prepared for redevelopment for over a decade. Significant public and private accomplishments have already occurred in and around the site: • The County currently owns the 372 acres of the site known as the California Parcel and is finalizing plans to construct a new county road that will serve as the main arterial for the site. • The City last updated the TCAAP Redevelopment Code in April 2024. Its overall vision has remained consistent since it was first drafted. It allows for a maximum of 1,960 units of housing on the site. As part of this approval, there is a requirement that at least 20% of the units will be affordable at 60% area median income or below. • The Alternative Urban Areawide Review (AUAR) was updated by the City in 2024. It outlines environmental impacts and mitigation strategies for development of between 1,500-2,500 units of housing and 2.2-2.5 million square feet of commercial/retail uses at Rice Creek Commons. • Design plans for the new county road, Rice Creek Blvd. are nearing completion. Some of the advantages of an online format include more accessibility to residents, less time commitment for both residents and staff, and the ability to post the recording online for viewing at any time. After discussing with consultants, staff propose organizing a webinar focused on sustainability and clean energy that will include a presentation on the advances made over the past two years and time for questions and answers. This webinar could also include a review of how residents can learn more about the project and a request for topic suggestions for future info sessions. The webinar would be advertised on the project website and through the newsletter, and the recording would also posted on the website. If the webinar is successful, then the JDA may consider repeating this format on other topics. Staff have noted comments on the materials available on the project website and are working to strategize, within technical constraints, on how to ensure as much information is readily accessible as possible.
