ORDINANCE NO. 353
AN ORDINANCE ADOPTING THE MINNESOTA STATE FIRE CODE
An ordinance of the City of Arden Hills adopting the Minnesota State Fire Code. This
ordinance shall perpetually include the most current edition of the Minnesota State Fire
Code, regulating and governing the safe-guarding of life and property from fire and
explosion hazards arising from the storage, handling, and use of hazardous substances,
materials, and devices, and from conditions hazardous to life or property in occupancy of
buildings and premises in the City of Arden Hills; providing for the issuance of permits
for hazardous uses or operations; repealing 900.06 and 900.07 of the City ordinances
adopted December 17, 2001, and all other ordinances and parts of the ordinances in
conflict therewith.
. The City Council of the City of Arden Hills does ordain as follows:
Section 1. That a certain document, two (2) copies of which are on file in the office of
the Building Official of the City of Arden Hills, being marked and designated as the
International Fire Code, including Appendix Chapter H, Fires or Barbeques on Balconies
or Patios, (see International Fire Code Section 101.2.1, 2000 Edition), as published by
the International Code Council and amended by the State of Minnesota, be and is hereby
adopted as the code of the City of Arden Hills for regulating and governing the
safeguarding of life and property from fire and explosion hazards arising from the
storage, handling, and use of hazardous substances, materials, and devices, and from
conditions hazardous to life or property in the occupancy of buildings and premises in the
City of Arden Hills and providing for the issuance of permits for hazardous uses or
operations; and each and all of the regulations, provisions, conditions and terms of the
Minnesota State Fire Code, on file in the office of the Building Official of the City of
Arden Hills are hereby referred to, adopted and made a part thereof as if fully set out in
this ordinance.
Section 2. That the geographic limits referred to in certain sections of the Minnesota
State Fire Code are hereby established as follows;
Section 3204.3.1.1. The storage of flammable cryogenic fluids in stationary
containers is prohibited in zoning districts R-I, R-2, R-3, and R-4.
. Section 3404.2.9.5.1. The storage of Class 1 and Class II liquids in above-ground
tanks is prohibited in all districts except 1-2.

Section 3804.2. The storage of bulk liquefied petroleum gas is restricted for the
. protection of heavily populated or congested areas in all zoning districts as
follows: R-l, R-2, R-3, R-4, B-1, B-2, and NTS Neighborhood Business.
Section 3. That Ordinance # 900.06 and 900.07 of the City ordinances adopted
December 17, 200 l, and all other ordinances or parts 0 f ordinances in conflict herewith
are hereby repealed.
Section 4. That if any section, subsection, sentence, clause, or phrase of this ordinance
is, for any reason, held to be unconstitutional, such decision shall not affect the validity of
the remaining portions of this ordinance. The City Council hereby declares that it would
have passed this ordinance, and each section, subsection, clause, or phrase thereof,
irrespective of the fact that anyone or morc sections, subsections, sentcnces, clauses, and
phrases be declared unconstitutional.
Section 5. That the Deputy Clerk is hereby ordered and directed to cause this ordinance
to be published.
Section 6. That this ordinance and the rules, regulations, provIsions. requirements,
orders, and matters cstablished and adopted hereby shall take effect and be in full force
and effect the date of its final passage and adoption.
