Call to Order at 7:03 pm. 2. Roll Call a. Members Present: Aaron Frederickson, Mark Kelliher, Chuck Mertensotto, Ray McGraw, Charles Stoddard and Clayton Zimmerman b. Also Present: Councilrnember Lois Rem, Terry Post and Dwayne Stafford c. Guests: Steve Perra from Ace Solid Waste, Rich Hazledine and Gary Bogum from Waste Management and George Walter from Walter's 3. Old Business a. Garbage collection 1) Chairman Kelliher asked for feedback from the guests representing the refuse hauler industry. Kelliher said that that committee/City Council was concerned about aesthetics, hazards caused by trash cans and recycling within the city of Arden Hills 2) The guests gave the committee feedback• a) George Walter sad that his company picks up roughly 60%of the stops on Wednesday and 40%of the stops on Thursdays. He said that he currently has about 700-1000 residential stops within the city. George said that he would like to haul garbage two days a week in Arden Hills instead of one day. b) Waste Management said that they have about 400-500 stops on Arden Hills. Most of their stops are on Tuesday and there are a few on Thursday. They also talked about several difference methods of refuse collection in various communities in the Twin Cities. c) Ace does about 90% of their stops on,Tuesday and about 10%on Friday. Steve also mentioned that there is a little boy in the city of New Brighton that likes to wave at the garbageman(refuting a certain committee member's assertion that people are not emotionally attached to their garbageman). 4) Methods of collection. (i) "One hauler city" Generally the customer pays more. This is because of city administrative fees. (ii) "Limited collection days.,keaseak degree, this may cut down on garbage truck traffic. efi l crease the community aesthetics. (iii)"Consortium plan" May hurt the customer. Lack of redress on collection problems. They are locked into that hauler with no ability to switch. O JUN. 5.2000 12:43PM MN LIFE REIN NO.960 P.2 e) The guests mainly agreed that they would be capable of handling one to • two (preferably two) days of garbage collection within the city of Arden Hills. They also agreed that if any changes were to take place, they would like no fewer than 60 and preferably 90 days notice. This would allow them to reallocate their manpower and equipment. f) Dwayne Stafford gave the guests maps of the cities. The companies will be dividing the city according to their collection. These maps can be used to divide the city into sections for garbage collection. Dwayne will also be sending out a questionnaire to all companies with a city-hauling permit. g) Chairman Kelliher thanked the guests for, attending the meeting. b. Metricom 1) The committee examined the proposed contract between the City of Arden Hills and Metricom per Joe Lynch's request. a) Under the proposed contract, Metricom would provide wireless WWW access to city residents. Metricom would need to install boxes roughly the 10 size of a shoebox on utility poles in strategic locations around the city, oQg(bA-rkikva. v acts The City of Arden Hills would receive a.eift plus a monthly royalty of 1%. Further, Metticom would pay the city of Arden Hills up to $1,000 for its legal fees. b) The committee discussed the proposals. In its discussion, the committee listed several concerns. c) Chairman Kelliher moved a recommendation that was seconded. • "The committee recommends that the city council consider the contract but not be limited to: 1. The environmental impact of the devices; 2. That the city be assured that there is not an appliance interference with cordless telephones, radios, televisions, garage doors, pacemakers, etc.; 3. The contract have a sunset clause to allow for renegotiation on a regular basis (every three or five years); 4. Royalties be translated into annual fees to avoid ambiguity of a fixed percentage; 5, The city inquire of the Association of Metropolitan Municipalities(AMIvl) as to what other cites are doing regarding wireless WWW connection; 6, The city has a clause asking for"right-of-way" restoration reimbursement(to cover the costs of damages done by Metricom during installation)." Dwayne Stafford—Public Works 1) Ingerson Street committee. a) The committee is making some progress. They decided they might like "rain gardent(a.k.a. ditches), b) Because the Ingerson Street project will not take place this summer, the city is doubling up on seal coating projects. The city is using a type of gravel(similar to the kind nari''a ririlnixayanol used in the city of New Brighton). This type of gravel is supposed to work better than the type that is currently in use. 2) The public works department is also working on other projects 3) Spray painting on water tower. Approximately 200-300 cars were damaged due to paint from the spray painting. This was because of a private company and not the city. 4) Communications tower b. Terry Post 1) C3OG Grants. The city is using the money to finish improvements to the city a) Arden Manor park—$40,000 b) Hwy. 10 water main.—$2110,000 2) 2001 Budget. Staff planning. Looking at capital improvements, department • evaluations and city philosophy, c. Lois Rem 1) Highway 10/96 designs 2) Annual audit. The city received a clean opinion. 3) WWW site task force. The task force recently met. Members have looked at several city web sites and will be working to establish a city WWW site. They hope to be completed by the end of the summer. 6. Announcement from Chairman Kelliher a. Pleased with the progress of the committee b. Business for next meeting. (1) Street lights and speed limits (2) Other committee agenda items. 7. Approval of minutes from previous meeting. Minutes were approved. 8. Adjourn at 9:29 p.m. • ��•��y• � CITY OF ARDEN HILLS Pow 4364 WEST ROUND LAKE ROAD • ARDEN HILLS, MN 55112-5794 May 19, 2000 RE: Collection Days To Arden Hills Residential Refuse Haulers: The Arden Hills Operations and Finance Committee invited all licensed Refuse Haulers to attend their May 18, 2000, meeting held at the Arden Hills City Hall. Representatives of Ace Solid Waste, Waste Management of Blaine and Walter's Recycling &Refuse attended. The committee and refuse haulers discussed methods to implement a standardized single or two day residential pickup within Arden Hills, to eliminate garbage and haulers on city streets nearly every day of the week. The haulers attending were willing to work with the City to achieve that goal, and provided recommendations to help the process. The City asks residential haulers to review the enclosed map of the City and indicate their company name, number of stops made,number of trucks used, and the days of the week they are currently picking up in each area of the City. The City will use this information to implement a standard single or two-day pickup, which will cause the least amount of changes and disruption for the haulers and the residents. The City asks that each residential hauler return their map as soon as possible, as it will be to each haulers benefit to provide input. The information will then be evaluated at the June 15, 2000, Operations and Finance Committee Meeting, which you are welcome to attend. That meeting will be held at the Arden Hills City Hall, 4364 West Round Lake Road at 7:00 P.M. This document contains a variety of changes that were made to Metricom's standard Right-of-Way Permit and Facility Use Agreement in the course of negotiations with Metricomn officials. To date, Metricom has only accepted these changes in the City of Minneapolis. Metricom's logic is that Minneapolis is entitled to special treatment because of its size. All other cities Metricom has approached in the Twin Cities metropolitan area (with a few exceptions) are apparently expected to agree to Metricom's standard agreement (without modification). In our opinion, Metricom's negotiating position has been unreasonable, since the revisions we are advocating have nothing to do with the size of a municipality. For your convenience and information, the redlined version of the model Metricom agreement shows all of the changes that Metricom has agreed to in Minneapolis, but rejected elsewhere. • This language appears as bold and stricken text in the redlined document. The most significant revisions contained in the model agreement address the following subjects: -1- • ALSO ADMITTED IN WISCONSIN "ADMITTED IN MASSACHUSETTS AND THE DISTRICT OF COLUMBIA t ALSO CERTIFIED PUBLIC ACCOUNTANT • • • 1. Reimbursement of the City's Right-of-Way Management Costs. We negotiated language in Minneapolis that would include bad debt that is ultimately collected in the calculation of the right-of-way management reimbursement fee that would be paid to cities. This particular revision would maximize the reimbursement amount that is received by a particular jurisdiction, and would prevent Metricom from excluding revenues that should be included in fee calculations. We are also recommending that the annual fee paid to cities for the use of their poles be increased annually, rather than every five years, by any increase in the consumer price index. This would ensure that the annual fee paid to cities keeps pace with inflation, and does not decrease, as would happen under Metricom's proposal. Finally, we included language that would require Metricom to reimburse municipalities for the reasonable costs of an audit if the results of any audit show that Metricom underpaid the right-of-way management reimbursement fee by more than five percent. 2. Management of Public Rights-of-Way and Public Property. In several areas, Metricom's standard agreement does not make clear that Metricom's rights are subject to a municipality's power to maintain its public rights-of-way and public facilities. We have rectified this deficiency in the model agreement by expressly stating that Metricom's operations are subject to a city's right to maintain its public rights-of-way and municipal facilities. We also included a change which states that Metricom cannot interfere in any manner with the operation, installation, maintenance, construction and reconstruction of all public rights-of-way and public facilities. In addition, our revisions make clear that Metricom will not obtain any property interest in municipal facilities (e.g., poles) and public rights-of-way. Lastly, we added language to Metricom's agreement which would require Metricom to notify a municipality, in writing, whenever it removes or relocates its radios. 3. Scope of Authorization. Our revisions expressly provide that Metricom is only authorized to use municipal facilities for the sole purpose of operating its system and providing mobile digital data services. Metricom is not authorized to provide telephone or cable television service. The specific language we added ensures that Metricom cannot expand its service offerings without obtaining a separate authorization from a municipality. 4. Reimbursement of Municipal Project Review Expenses. Metricom's standard agreement specifies that Metricom will reimburse cities for reasonable attorney's fees and other expenses up to a maximum amount of$1,000. Since this is a small amount that likely would not cover our clients' actual expenses, we increased the amount of the reimbursement to $2,000. This amount is fairly arbitrary and was increased to reflect greater expenses in Minneapolis. Your jurisdiction or member cities should feel free to reduce the reimbursement back to $1,000 if they make that policy decision. 5. Most-Favored Municipality Clause. We revised Metricom's "most-favored -9- • municipality" clause, so that our clients could benefit from'improvements negotiated into • any Metricom agreement in the seven-county Minneapolis/St. Paul area, not just agreements negotiated with identically- or smaller-sized municipalities. 6. Abandonment and Removal of Radios. Metricom's standard agreement does not contain any provisions which address the abandonment of its facilities or the removal of its facilities at the expiration of or termination of a facility use agreement. We therefore added language which gives a city the right to remove facilities that have been abandoned for six months or more, at Metricom's expense. This same right would apply to the expiration or termination of a use agreement. Without this language, it would be possible for Metricom to leave useless clutter on a city's facilities. 7. Performance Bond. Metricom's standard agreement does not require Metricom to furnish a bond securing its performance under the facility use agreement. The model agreement, which, as stated above, was agreed to by Metricom in the City of Minneapolis, rectifies this omission by establishing a performance bond requirement that guarantees Metricom's faithful performance of work. 8. Transfer or Assignment of Rights Under the Facility Use Agreement. Metricom's original assignment language would permit it to transfer or assign the facility use agreement to virtually anyone, without regard to the transferee's or assignee's ability to perform or willingness to be bound by the terms of the use agreement. Our revisions ensure that a transfer or assignment of rights cannot occur unless certain criteria concerning the proposed transferee's or assignee's qualifications are satisfied. If you and/or your member cities have not adopted Metricom's standard agreement, we recommend that you place the attached model agreement before your cable commission and/or City Council(s) for consideration, since further negotiations with Metricom seem pointless. In our opinion, the model strikes a reasonable balance between a city's interest in managing its property and public rights-of-way, and Metricom's interest in efficiently operating a business. The reasonableness of the model agreement is underscored by the fact that it has been accepted by Metricom, in its entirety, in the City of Minneapolis. The present speed limit of 40mph, and the fact that the road curves does not permit the residents to see approaching traffic and there have been a number of near collisions. 2). I live in the Wyncrest Lane and Wynridge street area near Cummings Park. There are approximately 50 houses in this area. We have only 1 light in the entire area, which is in the culdesac near the park. Recently, there have been many cars broken into in our neighborhood repeatedly. Our daughter's car has been targeted 2 times in the past month! I do not believe these crimes are bringing committed by teen-age kids because they have occurred on Wed. and Sunday nights. They seem to have professional tools to break into the vehicles. We would like the city to address the needs of our neighborhood to light up the night. I have informed the entire neighborhood about these break-ins so that we can all become more aware • of suspicious behavior.
