ORDINANCE NO. 346
AN INTERIM ORDINANCE EXTENDING
THE DEVELOPMENT MORATORIUM RELATING TO THE
CONSTRUCTION OF BOATHOUSES WITHIN THE CITY OF ARDEN HILLS
THE ARDEN HILLS CITY COUNCIL ORDAINS:
1.0 Recitals.
A. On the 12th day of August, 2002 the Arden Hills City Council adopted
Ordinance No. 341, which implemented a development moratorium
relating to the construction of hoathouses and which will expire on the
16th day of October, 2003.
. B. The City of Arden Hills is in the process of revising its Zoning and
Shoreland Regulations.
C. Additional time will be required in order to coordinate the proposed
changes to boathouse regulations with the proposed changes to the
Zoning and Shoreland Regulations.
D. In order to protect the integrity of its eomprehensive plan, the planning
process, and the health, safety and welfare ofthe citizens ofthe City of
Arden Hills, the City Council has determined that the development
moratorium relating to the construction of boathouses needs to be
extended.
2.0 Development Moratorium. No boathouse shall be constructed, nor shall
alterations be made to existing boathouses during the term of the
moratorium.
3.0 Duration of Moratorium. The development moratorium originally adopted
by Ordinance No. 341 shall be extended for six (6) months commencing on
October 15, 2003 and terminating on April 15, 2004.
4.0 Enforcement. The City may enforce any provision of this ordinance by
. mandamus, injunction or any other appropriate civil remedy in any court of
competent jurisdiction.

5.0 Separabilitv. Every section, provision or other part of this ordinanee is
declared separable from every other section, provision or part of this
ordinance. If any section, provision or part of this ordinance is adjudged to
be invalid by a court of competition jurisdiction, such judgment shall not
invalidate any other section, provision or part of this ordinance.
Effective Date. This ordinance shall be effective the day following its publication or
on the day following the publication of any Ordinance Summary approved by the
City Council.
Adoption Date. Passed by the City Council on the 29th day of September, 2003.
