CITY OF ARDEN HILLS COUNTY OF RAMSEY STATE OF MINNESOTA ORDINANCE NO. 320 A SUMMARY AN ORDINANCE AMENDING SECTION VI (I); ANTENNAS, SATELLITE DISH ANTENNAS AND TOWERS OF THE CITY OF THE ARDEN HILLS' ZONING ORDINANCE On the 10th day of October, 2000, the Arden Hills City Council adopted an amendment to Ordinance 291, Zoning Ordinance, and by five affirmative votes pursuant to Miun.. Stat. ~412.191, Subd. 4, directed that a summary of the Ordinance be published. The amendments to Arden Hills Ordinance No. 291 will become effective the day . following publication of the Ordinance Summary. These amendments include changes to height limitations, number of antennas or towers, screening, site requirements, and documentation to be submitted with application. A copy of the Ordinance Amendment is available for inspection by any person during regular business hours at the office of the City Administrator, 4364 W t Round Lake Road, Arden Hills, Minnesota 55112. ~ . CITY OF ARDEN HILLS COUNTY OF RAMSEY STATE OF MINNESOTA ORDINANCE NO. 320 AN ORDINANCE AMENDING "SECTION VI (I): ANTENNAS, SATELLITE DISH ANTENNAS AND TOWERS" OF THE CITY OF ARDEN HILLS' ZONING ORDINANCE The Arden Hills City Council hereby ordains that Section VI (I) of the City of Ardcn Hills' Zoning Ordinance is amended to read as follows: Section VI (l) #3: Heil!ht. The height of an antenna, dish antenna or tower shall be measured from the ground at the base of the antenna or tower to the highest point of the alltenna or towcr. No antelma, dish antenna or tower shall exceed the following height limitations: a. A dish antcnna shall not exceed fifteen (15) feet in height if ground or pole mounted and shall not extend more than twelve (12) feet above the roof if it is roof mounted. Regardless of these height limitations, the antenna shall be mounted as close to the ground or roof as practical. . b. No antenna or tower shall exceed a height of seventy-five feet (75'). c. No antenna or tower shall excccd a height equal to the distance from the base of thc tower to the nearest overhead electrical power line (except individual service drops), less five (5) feet. d. On City water towers, antennas placed on the top of the tower shall not exceed the height of the tallest existing antenna placed at that location at the time that this ordinance is amendment. Section VI (l) #5: Number of Antennas or Towers. a, In all residential districts, no more than one (1) exempted antenna and no more than one (1) antenna requiring a special use permit shall be allowed on one (1) lot or parcel. b. On City water towers, the number of antennas pernlitted on the structure and ground will be determined by the requirements outlines in Section V(F) of the Zoning Ordinance and is structurally allowable, Section VI (l) #6: Screeninl!. a. Screening shall be provided so as to prevent direct view of a dish antenna from any street or from a public or private property within six hundred (600) feet of the dish, as follows: i) Ground Mounted Dishes. Screening for ground mounted dishes shall consist of a fence, . wall, earth benll or lmldscaping, or a combination ofthesc devices. . . . ii) Roof or Wall Mounted Dishes. Screening for roof- or wall-mounted dishes shall be in accordance with VI, E, 4. b. Screening City water tower sites. i) Antennas attached to the water tower must be painted to match the color of the water tower. ii) Ground Mounted Structures. I) Red Fox Tower. The City will landscape the site to adequately screen the existing ground structures at the time of the amendment of this ordinance. All future applicants will conform to the City's landscaping plan of the lot. The City will construct a ground structure to house all future applicants requiring ground mounted structures following amendment of this ordinance. Applicants will lease space on the tower and within the ground mounted structure, as specified in the lease agreement. No additional ground mounted structures will be permitted on this site. 2) Femwood Tower. The City will constmct a ground structure to house all future applicants requiring grOlmd mounted structures following amendment of this ordinance. Applicants will lease space on the tower and within the ground mounted structure, as specified in the lease agreement. No additional ground structures will be permitted on this site. Section VI (I) #7: Special ReQuirements for Citv Water Tower Sites. The placement of licensed commercial wireless telecommunication servIces including cellular, personal communication services (PCS), specialized mobilized radio (SMR), enhanced mobilized radio . (ESMR), paging and similar services on water tower sites will be allowed only when the City is fully satisfied that the following requirements are met: a. The applicant's access to the facility will not increase the risks of contamination to the City's water supply; b. There is sufficient room on the structure and/or on the grounds to accommodate the applicant's facility; c. The presence of the facility will not increase the water tower or reservoir maintenance costs to the City; and d. The presence of the facility will not be harmful to the health of workers maintaining the water tower or reservoir. Section VI (I) #8: Documentation Required. Installation and operation of an antenna, dish antenna or tower shall be permitted only after application has been made and approval has been granted as defined in Section VIII for a Special Use Permit. The following documents shall be submitted with the application: a. Site Plan. The following information on the subject property shall be shown: (1) A plot plan drawn to scale. (2) Site and building dimensions. (3) Location of buildings on the site and on adjoining sites within one hundred feet (100'). . --------- ... . . . (4) Location of site improvements, including drives, parking lots or structures, landscape areas and any other site features that will aid the City in evaluating the application. (5) Location and height of proposed antenna, dish antenna or tower. (6) Elevation drawing of proposed antenna, dish antenna or tower. b. Site Elevation Drawings and/or Site Section Drawings. Drawings shall be provided that show how the screening will effectively be accomplished as defined in (6) above. Site lines should be illustrated both in plan and section showing vertical and horizontal relationships to neighboring properties. c. All applications for the City's water towers must include a signed report from a state registered engineer showing compliance with all applicable codes, standards and structural requirements of how the additional antennas will affect the water tower structure. A final inspection report from a state registered engineer showing work completed in compliance with previously approved plans shall also be required. d. A building permit shall be required for all applications except tbose as stated in Section VI (I) #1. . Effective Date. This ordinance shall become effective the day following its publication.
