Present - Acting Mayor Dale Hicks, Councilmembers Nancy Hansen, Thomas Mulcahy, Kathleen Rauenhorst Absent - Mayor Robert Woodburn Also Present - Planner Orlyn Miller, Treasurer Donald Lamb, Clerk . Administrator Charlotte McNiesh, Deputy Clerk Dorothy Zehm Approval of Minutes . Rauenhorst moved, seconded by Mulcahy, that the Minutes of Novemher 8th and November 19th be approved as amended. Motion carried unani mous 1 y. (4-0) 8usiness from the Floor Hicks introduced Robert Raddatz, Arden Hills' new Public Works Supervisor and welcomed him to Arden Hills. REPORT OF VILLAGE PLANNER ORLYN MILLER Status Report - Amended Srecial Use Permit - presb*terian Homes Council was referred to M ller's letter of 10/17/8 to Presbyterian Homes which listed the following apparent violations to the . conditions of Special Use Permit 75-17A, after Council discussion on October 15th: 1. Truck delivery at a location other than the location identified on the approved site plan; 2. Truck delivery occuring before 7:00 a.m., specifically prohibited by the Special Use Permit; and CU\IMCIL 1II1NUlE';:' ..ttD - 3. Use of northeast parking lot for non-resident parking. This lot was identified on the approved revised parking plan as being for "residents only". Presbyterian Home~ letter, addressing these items, was also referred to Council (11/16/84). Miller noted that the primary issue before Council is the use of the "kitchen dock" and parking area northeast of the Lakeside building; options are: . - allow the use of the "kitchen dock" for delivery-of perishables, and screen it from residential area to . the north - determine it's not a problem, and leave it as it is . - eliminate utility vehicle storage; or allow it and screen it from view In discussion, the number of deliveries to this dock, per week, was queried. Answer was about IS/week to the kitchen dock; gen- , erally 2 on Saturday and the balance during the week. Mr. Dan Bolhouse, Director of Johanna Shores, explained that they provide 1600 meals/day; use fresh fruits and vegetables as much as possible; have used this door for delivery of perishables fo! about 22 years - it is not new. -..--..------ - - ----------- . -.0. Minutes of Regular Council Meeting Village of Arden Hills Monday, December 3, 1984 Page Two Jim Guest, Sandeen Road, said that when the McKnight Center was proposed, this kitchen delivery dock was to be eliminated, including all parking in this area; explained that these deliveries are the ones that draw attention to the neighborhood and cause the problem; . semi trucks come in this area; explained that if the trucks all went to the main loading dock, it would be less noticeable and less noisy for the neighborhood. Guest said he feels vendors can deliver to the main loading area; feels the delivery problem can be resolved; suggested Presbyterian Homes talk with their architect, and not . harm the neighborhood with noise and visibility impact. Guest said he has lived on Sandeen Road for 12,years; hopes parking will be removed from this area since it was promised. Dennis Bu'ssard said he lives across the street from the main .dock . area; asked if anyone has made a count of traffic on Sandeen Road. Reply from Presbyterian Homes representative was there are 24 parking spaces; about 17 cars/day are parked in this area. Bussard said he estimates 100+ cars/trucks a day. Guest was asked if he can see the kitchen dock and parking area from his house. Guest said that the noise, in summer, is his concern. Jim Day, 3242 Sandeen Road, said he cannot see why the time element to get the perishables to the refrigerator area is so essential - we all get perishables from the grocery stores to our refrigerators with no problems. Day said vans making deliveries of day care people to and from this area cause a noise problem. Jim Guest reported that when the McKnight addition was proposed, the parking area was to be eliminated; area was to be all grass; . noted that in a revised plan, fire protection required the hard surface, but not a parking lot. Miller said he can understand the neighbor~ dislike for parking, but this is not at issue, parking was approved in this area; loading is the issue, as he sees it; noted that the parking should be for. residents, as per the Special Use Permit. Day said he prefers resident parking to employee parking. Hans Laaerstrom, Sandeen Road, said that Miller and Ed Reed (Pres. omes) stood on his deck and Reed said he was ashamed at what they had to look at. Rauenhorst, after obtaining assurance from Pres. Homes representatives that the berming and landscaping to screen this area is still in the plan, moved that Council modify the Special Use Permit to allow ~ery of perishables ~1tChen dock", and to allow parking instead of. parking in the northeast parking are. Motion was seconded by Mulcahy. . . Miller explained that a Special Use Permit amendment requires a . public hearing to effect a change, if Council determines that the change is "significant". Hansen asked if the proposed screening will reduce the sound. Miller. responded that it is difficult to do a good job of screening because of the topography; can't completely hide the view of cars by . berming; trees and berm will help to disperse sound, but not elim- inate the sound. Mr. Day - asked why Council would amend the Special Use Permit in favor of Presbyterian Homes vs. the neighborhood. Presbyterian Homes representative said they have fulfilled the original berming plan; the proposed berming now under discussion is additional. Miller explained that the planting was also done in accordance with the approved plan; additional planting now proposed -, . Mulcahy suggested an amendment to the motion to add that the Council . finds that the delivery of fresh produce and frozen food to the kitchen door location is a practical necessity, and is in substantial compliance with the delivery requirements of the Special Use Permit previously approved by the Council. The amendment to the motion was accepted by Rauenhorst. Motion did not carry (Rauenhorst, . Mulcahy votin~ in favor of the motion; Hicks, Hansen voting in opposition). 2-2) Rauenhorst moved, seconded by Mulcahy, that Council schedule a Public He~ring before the Planning Commission, after receipt of . required documentation, and adequate time for publication and mailing of notice. Motion carried unanimously. (4-0) Guest said that nothing has been accomplished since the neighbor- hood meeting with Reed, and the second screening plan was worked out; feels it won't be done because it'll cost a little money to effectuate. Response from Presbyterian Homes representative was that the Terrace Place project is "on hold"; additional berming was proposed to be accomplished at the time of the Terrace project (south side of Pres. Homes site) construction. It was noted that the deliveries to the kitchen door is not a condition of the Special Use Permit, it occurred there originally. It was noted that nothing has been done on the Terrace Place project; they will be back on this development. . Hansen asked Mr. Day and Mr. Guest if elimination of van parking in this area would help eliminate their concerns. Guest said it would eliminate much of the traffic volume which represents a lot of the activity. Tom Sather said he works for a food service company; noted that produce items will or can be destroyed if there is a delay between delivery and refrigeration; most trucks carry about 26 separate drops; feels it should be clarified just what is considered to be perishable; noted that the trucks used are usually not semi trucks. Day said if they are concerned about time, the underground main dock is closer; said there was a semi at the kitchen dock on Saturday; feels they could eliminate storage of maintenance vehicles from this area. Guest said he does not understand how this would restrict Pres- byterian Homes. . Status Report - Contingencies of Special Use Permit for Mounds . View High School - John Ostlund Council was referred to the three contingencies of approval of the Mounds View High School Special Use Permit (First Amendment): . l. Review and approval of a landscape plan by the City Planner. 2. Occupancy of the gymnasium to be contingent upon a satisfactory progress report concerning adequate water availability for fire protection. 3. Approval of the boiler room access b.y the Fire Chief. A transparency of the site plan/landscape plan was shown. Ostlund indicated the location of the gymnasium addition, the link to the high school, and the location of a future link to a future locker room addition; pointed out the proposed location of an on-site .. ---- ------ . Minutes of Regular Council Meeting Village of Arden Hills Monday, December 3, 1984 Page Four fire hydrant at the rear of the gymnasium and the location of the Gramsie Road connection to the City water main, to provide a looped water system, as recommended by the City Engineer. Ostlund reported they hope to negotiate an easement this month with the affected . property owners, and subsequently let the bid for the water line in Harch/April, 1985. Ostlund said completion of the fire road around the building will be completed at this time also. Ostlund reported that the arcade link to the boiler room has been . completed, and on access window and door have been installed for use by the Fire Department; they have not received a letter from the Fire Chief to date relative to boiler room access approval. (McNiesh to check on this with Chief Koch). . Ostlund reported that the second arcade link to the locker rooms is proposed in 1-2 years. In review of the landscape plan, Miller noted the existing ash and oak trees along County Road F are of good size; reported that pines, about 12' high, have now been planted between these trees; noted that the approximate 800' long parking lot is still visible to the residential area across the street and from County Road F; explained that the problem is to block visibility without also creating a security problem for the school. Ostlund said they do want to spruce up the grounds; would like to accomplish this and not obscure the parking lot; said a hedge is a possibility, but not their choice, because of the difficult maintenance so far from the building. After discussion, Hicks stated that Council recognizes that Mounds . View High School has met the contingency of the Amended Special Use Permit concerning adequate water availability for fire protection, and grants occupancy of the gymnasium. Ordinance No. 235, Amending Appendix A - Zoning Ordinance, Chaper 14 - Mobile Homes and Chapter 8 - Excavation of the City Code - Introduce by Title Rauenhorst moved, seconded by Hansen, that Council introduce Ordinance No. 235 by title. Hotion carried unanimously. (4-0) Commissioners' Final Report of Damages - Reiling Condemnation Council was referred to Attorney Lynden's letter of 11/20/84 re City of Arden Hills vs. George J. Reiling -- Commissioners' Final Report of Damages. McNiesh reported that the attorney recommends no appeal of the $33,500.00 decision; reported that she has not contacted Eibensteiner;. explained that the cost will be charged against the project and pro-rated to both properties at the time of assessment. . Rauenhorst moved, seconded by Hansen, that Council concur with Lynden's recommendation and not appeal the decision. Motion carried unanimously. (4-0) . Policy/Procedural Memorandum - Industrial or Commercial Revenue Financing After discussion, Rauenhorst moved, seconded by Mulcahy, that Council approve the City of Arden Hills Industrial or Commercial Revenue Financing Policy/Procedural Memorandum as submitted. Motion carried unanimously. (4-0) ------- - . Rauenhorst moved, seconded by Hansen, that Council approves the MTC Bus turnaround at County Road I and 35W on MN Dot property, as proposed (letter of 11/6/84 from pro~ressive Consulting Engineers, . Inc.). Motion carried unanimously. 4-0) Approval of 1985 Liquor Licenses Rauenhorst moved, seconded by Hansen, that Council approves the . following 1985 liquor licenses, SUbject to compliance with contingencies listed in Lynden's letter of 11/28/84 re 1985 Liquor License Applications: 1. Investment 11/26/84 - $424,507.01 for 6 months @ 9.50% interest at First Federal, maturing 5/20/85. . Mulcahy moved, seconded by Rauenhorst, to ratify the Treasurer's investment. Motion carried unanimously. (4-0) In discussion, opposition was expressed by Rauenhorst and Mulcahy relative to light installations that do not follow the guide- lines established by Resolution. " . ~ Minutes of Regular Council Meeting Village of Arden Hills Monday, December 3, 1984 Page Six Timm, Public Safety Committee chairman, said there are exceptions to all rules; noted that 950ut of 96 residents is pretty good evidence that the intersections are dark; noted that Committee members reported they could not find the streets. Timm said he . cannot see, for a cost of $100/year, why the City does not install these lights; said he supports the installation of these lights. It was noted that only 4 members of the 7 member Committee were present at the meeting, and only 3 of the 4 favored the installation. ~ It was suggested that the Resolution be referred to the Committee for its review, and possible amendment recommendations, for Council's consideration. Mr. Perry Lippert said he met with the Committee; explained that . this is not an ordinary set of circumstances - - Lexington is a busy street - there are two residential streets accessing onto Lexington - intersections are very dark Lippert said he talked to the Shoreview Council and they requested the lighting of these intersections by Arden Hills for the safety of Shoreview residents. After discussion, Council concurred to pursue a traffic count in this area prior to the Dec. 17th Council meeting, and to obtain cost estimate for the light installations. (McNiesh to contact SEH relative to counter availability.) . It was suggested by Mulcahy that a traffic count on Sandeen Road, at Presbyterian Homes, be conducted, after the count at Lexington/ Amble Drive and Lexington/Pleasant Circle. Third Fire Station - Status Report Council was referred to Hansen's memo of 11/29/84 and to Minutes of the Joint Fire 80ard Meeting of 10/16/84. . It was the general consensus of Council that the City continue to support the 3rd station, and current plan with firemen earning . equity @ 5% - 7%, a year.
