A. South on Highway 10 to 1-694, then west paral lei and adjacent to 1-694. B. South to east/west property line between two undeveloped areas, then west to 35W (providing additional front footage) Christoffersen displayed a transparency of the Lift Station No. 10, sewer area north of 1-694 (outlined In orange); noted that LIft Station No. 10 will be el imlnated, and these mains wi II be diverted to the Interceptor In New BrIghton, Instead of to the south. Christoffersen noted that the sewer mains south of 1-694 were not sized to serve the area to the north; properties north of 1-694 were not assessed for the larger mains needed In Rosevllle to provide sewer service to Arden Hills; properties south of 1-694 were assessed for the larger trunk sewer. Christoffersen explained that the north area was, at that time, proposed to eventually be served with sanitary sewer through the arsenal system. Bond Counsel Tom Deans explained alternative ways of financing the project: - General taxes - City funds - Spec I a I assessments Deans explaIned that the amount of special assessments for the Improvement cannot exceed the amount of Increase In benefit to the property; If no, or very little, benefit can be realized, the assessment wi I I probably be chal langed. Deans explained that an area, larger than that whIch Is Intended to be assessed, can be Included In the assessment area; those properties outside this area cannot later be assessed for the Improvement, unless a new public hearing Is held. , -- Minutes of Regular Council MeetIng Monday, February 27, 1984 Page Two Christoffersen explained that certain of the north area properties were assessed under Sewer Improvement 12 and 13: referred Council to his letter re fInancing Ideas, based on the 1971 City polley for sewer assessment: - Front footage - Area - Combination of front footage and area. Christoffersen explained that separate Improvements recently have been assessed on a unIt basis. Deans said he has found no authority for a sanitary sewer district assessment (applies to storm drainage only). Deans referred to a ~ Duluth case; noted that It was determined that If there Is an In- place sanitary sewer Improvement, then the property Is not subject to an assessment for a new sanitary sewer Improvement; noted that If a property already has sanitary sewer, It Is difficult to show benefit - can only assess to an amount the Improvement will Increase the market value. In discussion, Christoffersen explained that the 11ft stations are currently over-taxed; with additional development In the north, ~ lift No. 10 either needs to be up-graded to accommodate the Increased needs, or the lines diverted to the New Brighton Interceptor, which was found to be the less costly approach. ~d~caPaClty Is Improved In the north, the people in the south are just as benefitted as the north; both are present- ly served by sanitary sewer; the whole system Is over-used. It was noted that assessments cannot be Imposed on the arsenal (federal property) unless they agree - arsenal Is sewered, pumping directly to Mlnneapol Is. McNlesh noted that an alternative to assessment would be to con- tinue to levy for the Improvement for about 4 years, and pay for the entire cost out of taxes, If benefit cannot be shown to the properties; noted that another alternative Is to Increase sewer rates (which are already quite high), McNlesh noted that tax- exempt properties would participate In the cost of the Improvement If the sewer rates are raised or assessme~ts levied, but not If pa I d by genera I taxes. Deans noted that If the whole City Is benefitted, can assess the whole City, IncludIng tax exempt, except federal properties: mailed notices would be sent to all property owners; If put on general taxes, no mailed notice Is required. Rauenhorst moved, seconded by Mulcahy, that CouncIl authorize that notices be sent to all property owners wIthin the NC District which Is tributary to No. 10 Pumping Station (IndIcated In orange on the transparency and located north of 1-694, between 35W and lexlngton Avenue). Motion carried (Rauenhorst, Woodburn, Mulcahy voting In favor of the motion; ChristIansen votIng In opposition). (3-1 ) Rauenhorst moved, seconded by ~1ulcahy, that CouncIl adopt ResolutIon No. 84-7, ACCEPTING THE FEASIBiliTY STUDY AND SCHEDULING THE PUBLIC HEARING FOR IMPROVEMENT 55-83-6. Motion carried (Rauenhorst, Mulcahy, Woodburn voting In favor of the motion; ChrIstiansen voting In opposItion>. (3-1) Rauenhorst moved, seconded by Mulcahy, that McNlesh be authorized to Insert date of hearing In the Resolution when date Is confIrmed. Motion carried unanimously. Christoffersen explaIned that the draInage plan Is part of the feasIbIlIty study; Arden Hills North Central Drainage Study, as approved, wi I I need some revIsion to accommodate the plat layout; developer requests a limited feasIbility study re storm water storage prior to his preparation of the revised PrelimInary Plat. Mulcahy moved, seconded by ChrIstIansen, that Councl I authorize the limIted feasibIlity study for storm water storage for the Royal HIlls North Plat. MotIon carried unanimously. ChrIstoffersen said the arsenal system has water storage capacity of 1,300,000 gallons. City booster pump would have to be Increased; Rosevllle and St. Paul would have to be notified of the Increased water need; second water tower would be needed. Christoffersen suggested that a charge be made to cover part of water tower costs and booster pump costs; suggested bll lIng the standard water charge, plus a percentage for additional costs for the system. It was noted that agreement would have to lImIt them to a certain gallonage maximum and contract would have to be long term (20+ years) to assure City of repayment for costs entaIled. Mulcahy saId he was not convinced that there Is any benefit to the CIty If arsenal connects to municIpal water. Christiansen said that new technology may, In the future, make purifying theIr wel I water more feasIble. After discussion, ChristIansen moved, seconded by Rauenhorst, that CouncIl authorize preparation of a prelIminary feasibility study, not to exceed cost of $500, re estimated cost to provIde the ser- vice to the arsenal. Motion carried (Rauenhorst, Christiansen, Woodburn voting In favor of the motIon; Mulcahy voting In opposi- tIon). (3-1) REPORT OF VILLAGE PARKS DIRECTOR JOHN BUCKLEY 1984 DIseased Tree Removal Contract COUlnc'I'w-aslr6felrred to Buckleyis-memo re 1984 Shade Tree Program (2-23-84), Buckley reported 260 dIseased trees In 1983, 15% of which were removed by the City's contractor at an average cost of $126.00. It was noted that the City's costs are mostly reimbursed by the property owners ($4,769 paid to contractor; $198.00 not reimbursed for trees on publIc property). Christiansen moved, seconded by advertisement for bids for 1984 as outlined In memo of 2-23-84. Rauehorst, that Councl I authorIze Tree and Stump Removal Contract, Motion carried unanImously. Christiansen moved, seconded by Rauenhorst, that Council approve the projects set forth In the memo for tennis courts/hard court area combinations and play structure. In discussion, concern was expressed relative to "Cost of structure wI! I be limited to $8,000 or less". Woodburn and Mulcahy concurred that It would seem more appropriate to determine the equipment needed, and request cost for same. It was noted that creativity Is what Is being sold; new things are emerging all the time. Rauenhorst and Christiansen concurred that this Is a competitive ~ way to purchase equipment In their experience (Valentine Hills School and Townhouse Village). Motion carried (Rauenhorst, Christiansen, Mulcahy voting In favor of the motion; Woodburn voting In opposition). Mulcahy moved, seconded by Christiansen, that Council approve the 1984 Spring Program as submitted. Motion carried unanimously. Buckley said he feels It will be of benefit to people In the North Suburban area; recommends the City's Involvement. After discussion, In which concerns were expressed re who wI! Christiansen moved, seconded by Rauenhorst, that Councl I approve the hIring of the four people listed In memo (2-24-84), and additional short-term substitutes at an hourly wage not to exceed $4.25/hour. Motion carried unanimously. (4-0) REPORT OF VILLAGE PUBLIC WORKS SUPERVISOR BUD JOHANSEN Council was referred to Johansen's memo of 2-23-84, and attach- ments thereto: 1984 Street Sweeping Contract - 198~ Johansen reported that the Public Works Committee recommends approval of the New Brighton Street Sweeping Contract for 1984; noted that It Is within the budget. . Mulcahy moved, seconded by Christiansen, that Councl I approve the 1984 Street Sweeping Agreement with the City of New Brighton, at the Increased cost of $35/hour, and authorized execution thereof by the Mayor and Clerk Administrator. Johansen reported that the Public Works Committee recommends the purchase of the Sui lair Model 125CFM; feels the 125CFM model Is worth the additional $350.00. After review of the three quotes received, Christiansen moved, seconded by Mulcahy, that Council approve the purchase of the Sui lair 125CFM Air Compressor from Hayden - Murphy Company at $7,842.00. Motion carried unanimously. Councl I concurred that the appropriate water system Is a determInation that should be made by the school dIstrict. Johansen reviewed the cost comparIson, attached to hIs memo; noted that the City cost would be about the same for the clothIng allowance, as for the uniform service; reported the employees prefer to do their own laundry; feel theIr uniforms will look better and last longer. After discussion, Councl I took no action; suggested that a recommendation be obtained from the Public Works Committee. (4-0.) o.THER BUSINESS Crime Watch Woodburn-r8ported that resIdents In the area of Snelling/County Road E/Arden Place have requested permissIon to Install 4 "Crime Watch" sIgns at entrances to theIr neIghborhood, In an effort to deter burglaries; reported that the neIghborhood has experIenced a number of burglaries recently. ChristIansen reported that a recent complaint from a resident, reporting that the Ramsey County DIspatcher would not give him information as to whom to cal I relative to a watermaln break during a weekend, was apparently Inaccurate. ChristIansen reported that the tape he listened to, of calls received by Ramsey County Dispatcher during the period of the alleged InquIry from the resident, disclosed that the resIdent called; DIspatcher explained that the Arden Hills PublIc Works Department Is closed at the time, but she would contact the water department for him If he needed assIstance; resident said "No", and hung up.
