Staff would recommend the City Council continue working with the "Focus News" as the 1996 official newspaper. 3. I have decided to hold off on the discussion and [mal action of this Plan until after I have been able to discuss the ramifications of its approval with Karen Olsen. Dear Mr. Fritsinger: Metropolitan Inspection Service Inc. has provided excellent service for electrical . inspections for the City of Arden Hills the past years and we would like to continue this service in 1996. I~ Our office has two competent and knowledgeable electrical inspectors, Richard Nelson and myself. We both carry a Master Electrician's license and both have many years experience as Inspectors. I am also a State Certified Building Official The Electrical . Code is a part of the State Building Code. It is of great advantage to be knowledgeable about the entire Building Code, including the state laws and roles that govern the amnmio<tration of the total Building Code. . Since we employ two full-time Inspectors, inspections are guaranteed every day, regardless of the absence of an Inspector due to illness or vacation. Electrical Inspectors . are in the offICe each weekday morning from 7:30 to 9:00 A.M. to answer code questions and take inspection requests. . We also employ two full-time secretaries who are both very competent and knowledge- able. La V onne has been with the company 9 years and is able to answer many questions . from callers during the day. The office staff can reach the Inspectors throughout the day, whether on a job site or driving to the next job, since both Mr. Nelson and I carry a walkie-talkie. We both have a mobile phone and can return calls. Often we ma,ke . "- arrangements with homeowners to call them at their place of employment while enroute so they can meet us at their home to let us in. . .- I -- -- --- ------------ --------------- . .. - ~ . Brian Fritsinger City Aclm;n;!<1rator . Page 2 To assist homeowners doing their own wiring. we provide a handout sheet at the city . office covering the basic wiring code requirements. We also print and supply the city with permit forms for homeowners. Fee schedules are printed by our office and mailed to . the contractors. When code violations are found. we telephone the contractorlhomeowner and mail a . written notice called a Correction Order. IfIwhen violations are not corrected within a timely manner, a follow-up letter(s) is mailed. Our records are very complete. including date of rough-in and fmal inspections, dates of . reinspections, code violations, and signed copies of returned Correction Orders confirming that code violations have been corrected. Each permit is recorded into our . computers and each permit me is alphabetically rued by the street name and address. When doing the final inspection for a new home, the Inspector notes the number of ~I circuits in the panel, the status of the wiring in unfinished basements and garages, and if wiring has been installed for a dryer, range or air conditioner. This is done to prevent the city and us from becoming liable for wiring that has been installed without a permit or inspection. . The office staff can be reached from 7:30 A.M. until 3:30 P.M. each day. Letters are mailed to contractors and homeowners as a reminder that their permit is about to or has . expired. When additional fees are due, a Pay Order is mailed. The fee for our services is based on eighty percent (80%) of the permit fee. A monthly . bill is calculated and mailed to the city. STATEMENT OF PURPOSE I The Bureau of Indian Affairs (BIA), the Environmental Protection Agency (EPA), the Federal Emergency Management Agency (FEMA) , the Indian Health Service (illS), the NPS Archaeological Assistance Division (NPS), the Nuclear Regulatory Commission (NRC), the U.S. I Fish and Wildlife Service (USFWS), General Services Administration (GSA), U.S. Army Corps of Engineers (COE) and other federal entities all have responsibilities and interests in protecting the environment, human health, cultural resources, and property interests of the Prairie Island .- Dakota Community under the doctrine of trust responsibility. This principle is based on the spirit of President Clinton's Executive Order dated April 11, 1994, and the President's Memorandum, dated April 29, 1994. Further, there a National-Level MOU between the BIA, . USEPA, ms, USGS and HUD that sets a National-level framework for this specific MOU. A counterpart regional 5 Agency MOU Work Group exists that can be used as a forum to discuss and resolve issues of mutual interest between the federal agencies. Each participating agency . and any Indian tribe in the Great Lakes area is invited to direct issues to the Regional 5 Agency MOU Work Group. I It is therefore the purpose of this Memorandum of Understanding (MOU) to identify areas of mutual interest and responsibilities among the federal agencies, and coordinate the respective activities of the agencies and tribal government to promote the most efficient and integrated use I of resources in consultation and coordination with the Tribe to provide the stated need to ensure protection of the health and safety of the citizens of the Prairie Island Dakota Community, a federally recognized Indian tribe, their cultural and natural resources, and related property and I property interests in relation to the operation (including spent nuclear fuel storage) of the Northern States Power (NSP) Nuclear Utility Plant, within immediate and adjacent _proximity to the Prairie Island Dakota Community and other environmental health risks. The primary . objective of this MOU centers on protecting the human health, environment and trust resources of the Prairie Island Dakota Community from risks imposed by forces outside the control or meaningful participation by the government and members of the community. The Prairie Island I .e . I -- Community is also interested in identifying options to relocate community members wishing to - do so and other acceptable options to reduce known environmental health risks. .- Within the overall objective of federal assistance and cooperation with the Prairie Island Community, there are many specific goals and activities that are identified in a separate action _ plan. No single federal agency nor the Community's tribal government has the authority or I resourCes to address all of the specific goals and activities that are nec-<,~""ry to achieve the overall objective of this MOU. Thus, there is a need for a creative and innovative coalition of . tribal government and federal agency resources to address the common overall objective. Further, it is understood that each agency's specific participation under this general MOU must be accomplished in accordance with explicit Congressional authorization and budget for that I agency. If any new authority or modified existing authority is made available to an agency, it is understood that the agency will explore with the others how that new or changed authority might be used to address the general objective. . It is anticipated that the Area Director of the Bureau of Indian Affairs, Minneapolis Area Office, will take the lead and the initiative to work closely and coordinate with the local, regional and I headquarters offices of the respective signatory agencies to develop a more detailed and specific approach pursuant to the general agreements established in this document. n. FINDINGS I A. Scone of Resoective Authorities - All of the federal agencies involved have an interest in the effects federally licensed or federal -. ' regulated projects have on human health, the environment, and safety responsibilities to federally recognized Indian Tribes. While the administrative oversight of trust lands has been assigned to the Secretary of the Interior, all federal agencies are bound individually by the federal fiduciary relationship. U. S. v Eberhardt 789 F .2d 1354, 1363 (9th circuit). - The Prairie Island Dakota Community Council, the governing body of the Prairie Island Dakota . Community, has invoked the trust responsibility of the federal government to protect their health, safety, natural and cultural resources, and property and business interests from hazardous radiation and emissions caused by the operation of the NSP Nuclear Utility Plant, the location - of the high power electrical lines adjacent to the residential area of the reservation, and the storage of spent nuclear fuel in both, water cooled storage pools and in above-ground dry cask storage units. There is also concern about the health and environmental risks imposed by the I railroad, federal navigation channel, flood damages, leaking underground storage tanks, changing air and water quality and other environmental health risks yet to be recOgnized. As a result, each respective agency's area of responsibility summarized in this document in I regards to the health, safety, economic, and environmental interests of the Prairie Island Dakota Community will be coordinated by the Area Director of the Minneapolis Area Office, Bureau I of Indian Affairs, to ensure a complete and comprehensive coverage of the tasks and allocation of resources. . -. - I As a starting point to ensure complete and comprehensive coverage of the tasks and allocation of resources, the following tasks and responsibilities of each respective agency will be I. coordinated by the Area Director, Bureau of Indian Affairs. - The initiation of baseline studies performed by independent researchers, on the health effects ~ I to citizens of the Prairie Island Dakota Community from the operation, generation of the NSP nuclear utility, and storage of spent nuclear fuel, or provide the tribe with resources I to hire independent contractors to perform the research. - The initiation of an epidemiological survey of the Prairie Island Dakota Community and the I surrounding area for potential cancer, immunological, and neurological illnesses which may be associated with the operation, generation of the NSP nuclear utility, and storage of radioactive spent fuel and its byproducts in the water, air, and soil in the affected area. I - Tribal treaty search regarding research of historic and traditional areas, and documentation on development of contemporary boundaries and establishment of private, state, and federal , facilities within the treaty boundaries. - The initiation of comprehensive environmental baseline studies on Prairie Island by I independent researches, or provide the tribe with resources to hire independent contractors. Assessments would include a radiological contamination component. This baseline would include plant, wildlife, and fish assessment, and water and air quality on and near Prairie . Island. - .Cultural resource assessment of the entire Prairie Island done by independent investigation, .. or provide the tribe with resources to hire independent contractors. The assessment would be done in consultation with and guided by tribal cultural resource practitioners from the Prairie Island Dakota Community. The BIA Area Archaeologist is available to lead the . assessment or accomplish it in prioritized phases. - The inclusion of the Prairie Island Dakota Community in the overall emergency , preparedness planning and exercises, including development of emergency response planning for the Prairie Island Dakota Community as a response organization. . - Documentation on past participation and consultation of specially affected communities, including the Prairie Island Dakota Community, in the environmental assessment (EA) and Environmental Impact Statement (EIS) phases of all NSP activities. , _ Ensuring meaningful participation of the community in future decision making for federal undertakings that affect risk imposed on the health, environment, and trust resources of the , Prairie Island Dakota Community. , - Independent testing of high voltage transmission lines immediately adjacent to the Prairie Island residential area, which includes a tribal day care center, regarding their effect on human health, utilizing the National Academy of Science reports on this issue. I ,e . -- n_ - _ The feasibility of relocating community members and their business enterprises . commensurate with their existing lifestyle expectations and living conditions in the owning , . and operation of a profitable and growing gaming enterprise. B. Summary of Al!encv Mission -. 1. The Bureau of Indian Affairs (BIA) programs and authorities are associated with Indian I trust responsibilities and include fiduciary responsibility toward the tribe and their health, safety, environmental and economic interests. The BrA has a trust responsibility toward the Tribe in the I area of environmental quality. The National Environmental Policy Act of 1969, which establishes procedures that are binding on all federal agencies requires that an Environmental Impact Statement (EIS) be prepared for every major federal action significantly affecting the . quality for the human environment. The BIA can provide resources to assess cultural, water fish and wildlife, forestry and other resources. I 2. The Environmental Protection Agency (USEPA) has regulatory and enforcement authority in Indian country, and authority to expend financial resources on Indian lands under various . environmental statutes. Statutes authorizing EP A actions in Indian country include the Clean . Air Act, Clean Water Act, the Emergency Planning and Community Right to Know Act, Safe Drinking Water Act, Resource Conservation and Recovery Act (RCRA), and the Comprehensive -. Environmental Response, Compensation and Liability Act (CERCLA). EPA's Indian Policy, was adopted in 1984 to foster the government to government relationship with tribes and to help tribes develop and manage environmental programs. The EPA Indian Policy's purpose includes I assuring that tribal concerns and interests are considered whenever EPA's actions and/or decisions may affect reservation environments; encouraging cooperation between tribal, state and local governments to resolve environmental problems of mutual concern; and, enlisting the I support of other federal agencies to clearly identify and delineate the roles, responsibilities of the agencies. I The USEP A, acting through its Environmental Radiation Ambient Monitoring System (ERAMS), has taken steps to provide the Community with technical resources to monitor current I xadiological conditions. National results from ERAMS can be compared to results at Prairie Island. Both ERAMS and Region 5 staff are available to design sampling strategies and to interpret results. A substantial baseline of infonnation of radiological conditions exists for the I vicinity of the Community. The USEP A can facilitate communications with the Community and NRC with regard to this information and ongoing monitoring. 3. The mission of the Federal Emergency Management Agency (FEMA) is to provide the I leadership and support to reduce the loss of life and property and protect our institutions through a comprehensive, risk-based, all-hazards emergency management program of mitigation, I -. - -o. I -,-- , 7. The U.S. FISh and Wildlife Service (USFWS) responsibility to help protect trust resources ,- on tribal lands has been established for fish and wildlife through reserved rights doctrines, Executive Orders, judicial mandates, and specific treaties. The Service c2n provide monitoring ,- and sampling of fisheries, water quality, and invertebrates, along with technical assistance. In addition, the Service is responsible for providing comments on Federally-funded projects or - permits/licenses. Comments are provided in accordance with Federal statutes and normally address project-related impacts to important habitats, Federal trust species, and those caused by I contaminants. The USFWS provides technical expertise for trust lands in cooperation with the BIA under the Circle of Flight Program. The USFWS laCrosse Fishery Resource Office is available to -provide technical assistance on fish management issues at the request of the , Community . This office can conduct fishery surveys and collect fish from tribal waters for contamination analysis. Training on fish and wildlife issues is available through the USFWS Office of Training and Education. Tribal members can request a waiver of tuition. The I USFWS Twin Cities Ecological Services Field Office provides comments on federally-funded, licensed or permitted projects and provides comments on federal environmental documents. , 8. The U.S. Geological Survey. (USGS) has authority to conduct investigations of water resources and geological characterization of the environment and trust resources of the Community. The USGS has a cost share program to conduct these investigations in cooperation I with the Community. A scope of work for specific USGS activities is contained in an cost- sharing agreement between the Community and USGS. USGS further summarized its action plan in \lletter dated March 27, 1995. The USGS is a recognized source of dependable water I resources data and analysis. .e 9. The U.S. Army Corps of Engineers (CaE), working through the St. Paul District Engineer has a number of authorities and areas of expertise of use to the MOU objectives. In his letter of April 19, 1995, the St. Paul District Engineer indicated that because significant "legal maneuvering" that would be necessary for the CaE to sign the MOU, he proposes that the CaE , informally participate in the coordination process and make their authoriZed resources available in that way. The CaE has the Section 22 Planning Assistance to States and Tribes Program for 50/50 matching of tribal funding, including 638 contract funding, to perform water resource and I related planning studies in a wide variety of disciplines. The CaE Planning Assistance Program can also be used to prepare a comprehensive water resource plan to map out a coordinated approach while enlisting the various agencies for implementation of individual components of I the water plan. . 10. The General Services Ailminio;tration (GSA) has responsibilities relating to disposition of surplus federal property and real properties. This is particularly pertinent for Department of Defense (DaD) properties that become surplus under the Base Realignment and Closure Act ~. (BRAe) and otherWise become surplus. The expected surplus status of individual parcels at the Twin Cities Army Ammunition Plant (TCAAP) property is of interest to the Prairie Island Community as a possible option for relocation of some of its membership. . The BIA, EP A, FEMA, IHS, NPS, USFWS, and the mc, will work cooperatively together . at the local, regional and headquarters levels, in consultation with the Prairie Island Dakota Community Council, to coordinate the environmental, health, safety, and business interests of . all jurisdictional activities affecting the tribe. Where applicable, and within the constraints of available resources each agency will: I -. . I a. Participate in headquarters, regional and local level infonnation exchanges to keep abreast of the other agencies' program activities and regulations and notify other agencies I . of its own program activities, regulations, proposed regulations, and- future plans. . b. Cooperate in providing program services to n-ibal governments. . c. Provide training and technical assistance to each other and to Tribal representative in the . I area of each agency's special expertise. d. Collaborate on overlapping responsibilities. e. Coordinate to the greatest extent possible and integrate where feasible, the provision of . funding assistance to tribal governments, where the funding authorities of the seven agencies are combined or complementary. . 2. BIA, EPA, IRS, NPS, USFWS, and the NRC will continue to identify and develop coordination in these areas of environmental protection. Supplemental agreements or I actions specific to program coordination in each of the above areas may be prepared, as appropriate. Potential overlap areas may be addressed at the arealregion or headquarters levels. I 3. BIA, EPA, illS, NPS, USFWS, and NRC will encourage and educate their staff, consultants and representatives in the existence, purpose and implementation of the terms of this MOU. Where applicable, tribal and or state agencies may be included as . signatories to supplemental agreements. . IV. Duration of Ae-reement .. This MOU shall continue in effect until BIA, EPA, FEMA, illS, NPS, USFWS, or NRC 'provide written notice of tennination. Notice shall be given to the other parties at least thirty (30) days in advance of thetennination date. This document may be updated and periodically I amended with the concurrence of all parties. This document does not supersede any previous MOUs or Agreements. I V. ReDorts I Additional meetings may be called as necessary by any signatory agency, particularly among the staff of the regional offices. Minutes will be taken and distributed. Where appropriate, BIA may also call quarterly meetings at the ArealRegionallevel where all parties in I agreement that such meetings would be beneficial. Minutes of those meetings will also be taken. Reports will be provided by the individual agencies, such as the Water Resources Investigation report (WRI) by the USGS.
