Agenda Items a. Public Hearing - Old Hie:hway 10 Watermain The Council is asked to adopt Resolution #96-35, Ordering the Improvement and I Preparation of Plans and Specifications in the Matter of the Old Highway 10 Watermain Improvement of 1996. At the April 29, 1996 meeting, the public hearing related to this project was held. The response from affected property I owners was favorable to the project. The concerns identified by the residents related to this project were the pedestrian trail, impact on landscaping and .. assessments. This project is proposed to be handled slightly different than typical projects in that the assessment hearing is proposed to be held after the project has been started. I b. Public Hearine: - 1996 Street Improvement Proiect The Council is asked to adopt Resolutions #96-34 and #96-36, Adopting the Final I Assessment Roll for the Term of 5 and 8 Years as part of the 1996 Street Improvement Project. Staff has met with and talked to a number of residents about the proposed assessments. As a result of this additional review, Staff has I recommended several changes to the assessment roll. Several letters of objection are enclosed for Council review. I c. Approval of Minutes The Council is asked to approve the minutes of the May 13, 1996 Regular Council and May 20,1996 Council Worksession Meetings. I d. Consent Calendar I. Committee Appointments I The Mayor may have a recommendation in regards to the appointment of two individuals to the Finance Committee. I 2. 1995 Audit .. The Council is asked to receive the 1995 External Audit Report prepared by Abdo Abdo & Eick. I I Admin. Comments for May 28, 1996 Regular Council Meeting I Page 2 .. 3. Claims and Payroll The Council is asked to approve claims and payroll in the amount of I $114,259.86 forthe most recent period just ended. e. Unfinished and New Business I 1. Resolution #96-29 The Council is asked to adopt Resolution #96-29, Accepting Bids and Authorizing Execution of Contract in the Matter of the 1996 Street I Improvements. This Resolution accepts the bid and awards the contract for the 1996 Street Project to T.A. Shifsky & Sons. This action is subject to Council approval of Resolutions #96-34 and #96-36. I 2. Planning Case #96-04. Bethel College The Planning Commission has recommended approval of the Site Plan and I SUP Amendment at Bethel College. The Planning Commission also encouraged Council to direct Bethel to revise its Master Plan prior to submitting any future site improvements for City review. I 3. Planning Case #96-01. Amble The Planning Commission has unanimously recommended approval of the .. Amble Final Plat and Variance. Park dedication has not been resolved as of Friday. I I I I I I I .. MEMORANDUM DATE: May 24,1996 I TO: Mayor and City Council Brian Fritsinger, City Administrato@) I FROM: SUBJECT: Old Highway 10 Watermain Project I Background I On April 29, 1996 the Arden Hills City Council held an informational meeting and subsequently discussed the Old Highway 10 Watermain Project at its regularly scheduled meeting. At this meeting the City Council received the feasibility report and ordered a public hearing for May 28, I 1996. A number of questions were raised at this initial meeting and several concerns were identified by I affected property owners. Specifically, the concerns related to the future bike trail, method of assessments and the projects impact on existing landscaping. At the conclusion of this meeting, the property owners and Council supported moving ahead with the project. Ie The purpose of this public hearing is to allow for additional input from the property owners and to make a decision as to the ordering of the project. Staff has not received any additional I feedback from the property owners over the past several weeks. The assessment hearing is proposed to be held at a later date, upon completion of the project. I Rccommendation Staff recommends the City Council adopt Resolution #96-35, Ordering the improvement and I preparation of plans and specifications in the matter of the Old Highway 10 Watermain Improvement of 1996. CITY OF ARDEN HILLS RESOLUTION #96-35 A RESOLUTION ORDERING THE IMPROVEMENT AND I PREPARATION OF PLANS AND SPECIFICATIONS IN THE MATTER OF THE OLD HIGHWAY 10 WATERMAIN IMPROVEMENT I OF 1996 WHEREAS a Public Hearing relating to the Old Highway 10 Watermain Improvement was I held before the Arden Hills City Council after ten days mailed notice and two I weeks published notice of the hearing was given; and WHEREAS the City Council has duly considered the Feasibility Report and those matters I presented at the Public Hearing by those persons desiring to be heard on the matter; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Arden Hills, I Minnesota: I. The Old Highway 10 Watermain Improvement is hereby ordered as recommended in the eI Feasibility Report dated April 1996. 2. MSA, Consulting Engineers is hereby designated as Project Engineer for this I improvement. Also attached are several letters of objection received by the City. I Resolution #96-34 relates to the assessment roll for properties to be assessed for less than $3,500.00. This includes all of the properties included as overlay projects and a number of the I properties which are being rehabilitated or reconstructed. These assessments are proposed to be spread over five (5) years. Ie Resolution #96-36 relates to the assessment roll for properties to be assessed for more than $3,500.00. These assessments are proposed to be spread over eight (8) years. I Two of the assessments included in Resolution #96-34 have been adjusted after additional review by Staff. The assessments detailed on Page 1 of 6, Parcel Count #11 and Page 4 of 6, Parcel I Count #10 have been revised after a review of concerns identified by property owners. Several other lots are still being reviewed by the City Engineer with recommendations pending. I Recommendation Staff recommends the Council adopt Resolution #96-34 adopting final assessment roll - 5 years and Resolution #96-36 adopting final assessment roll - 8 years. I I I I " Council\resolut\9634hear I I' STATE OF MINNESOTA I COUNTY OF RAMSEY CITY OF ARDEN HILLS ~ RESOLUTION #96-36 A RESOLUTION FOR THE CITY OF ARDEN HILLS I A RESOLUTION ADOPTING FINAL ASSESSMENT ROLL-8 YEARS I WHEREAS, upon due notice properly made as required by law, the Arden Hills City Council has met and heard and passed upon all objections to the proposed assessment for the 1996 Street Improvement and has determined the amount to be assessed I against each individual property as the Council deems just; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Arden Hills, I Minnesota: 1. Final assessment roll, a copy of which is attached hereto and incorporated herein by this I reference, is hereby accepted and adopted and shall constitute the special assessment against the lands therein named. Each such tract of land in the assessment roll is hereby found to be benefitted by the improvement in an amount not less than the amount of the I assessment levied against it. 2. Such assessment shall be payable in equal annual installments, including both principal .. and interest, amortized in such amount annually as is required to pay the principal with interest as 8% over a period of eight years. I 3. The owner of any property so assessed, may, at any time prior to certification to the County Auditor of the assessment or the first installment thereof, pay to the City I Treasurer the whole of the assessment on such property, with interest accrued to the date of payment; except that no interest shall be charged if the entire assessment is paid within 30 days after the adoption of this Resolution. Prepayment may also be made after the I certification of the assessment or first installment thereof by paying to the City Treasurer/Auditor the entire amount of the assessment remaining unpaid with interest. In the case of a payment made before November 15, interest will be calculated through I December 31 of the next succeeding year. 4. The City Administrator shall transmit to the County Auditor a certified duplicate of the I attached assessment roll to be extended on the property tax lists of the County. Dear Mr. Fritsinger: I Thank you for your assistance recently regarding the 1996 Street Improvement assessment on my property located at 1469 Arden Oaks Drive which is described as Arden Oaks Lot 2, Block 2.As per the requirements of your letter dated May 9, 1996, I am writing this" protest" to the . assessment value you have placed on my property. I am not opposed to repairing the street, but I am opposed to the assessed value placed on my property. I As you can see by the attached letter, I am being assessed for 142.13' of frontage with a fee of $ 770.34. I believe this is very excessive considering the fact that I have a watershed easement running along the south and west ends of my property. .. After conversations with Mr. Stonehouse and yourself, I believe we are all in agreement that a new assessment needs to be calculated on my property taking the watershed easements into . account. According to Mr. Stonehouse, this will substantially reduce my assessment. You have both informed me that you will bring this up at the meeting and that a reduction will be determined. . Due to other commitments, I cannot be present at the May 28th meeting. I would appreciate your assistance in pointing out this situation to the Council at the meeting for me. As I stated earlier, I . am more than happy to pay my share of the expense, but I do believe my assessment was improperly arrived at and should be recalculated with the current information in place. Mr. Stonehouse stated I of the amount earned to date, ten percent is being retained, leaving a recommended payment amount of $34,353.00. Mr. Stonehouse stated 80 percent of the work is complete, with the bituminous bike trail near I Ramline Avenue to be completed by the end of the week, and all the work completed by the end of May, 1996. I Mayor Probst inquired ifthe actual contract amount will be within the expected range. Mr. Stonehouse stated he expects the final amount will be slightly under the original contract. I Mr. Fritsinger explained that within the two resolutions are statements scheduling the time, date, and location for the t,vo public hearings related to these projects. He stated that Staff has clarified the location for the May 28, 1996 meeting must be changed to the New Brighton Family I Services Center, because of the conflict of the New Brighton City Council using their chambers for a New Brighton City Council Meeting at that time. . Mr. Fritsinger stated the City Attorney, Jerry Filla, has recommended the Council first move to amend Council action taken at the April 29, 1996, meeting to approve the resolution, then move I to adopt the revised resolutions, stating the correct time and location of the public hearings. Mayor Probst clarified that the public hearing notices sent contain the correct date, time, and I location. Supportin~ CooDerative Participation in the North Metro 35W Corridor Coalition I Mr. Fritsinger stated that City Staff has been meeting with representatives of the cities of Shoreview, New Brighton, Mounds View and Roseville, for the purpose of discussing issues I which affect each community and considering alternatives for creating a strategic alliance to address the issues of the 35W Corridor. I Mr. Fritsinger stated the issues related to transportation, housing, polluted site clean-up, and commercial and industrial development. He continued that other topics included GIS, lobbying, financial assistance, and CDBG funding, and may include broader subjects such as marketing I development opportunities within the corridor, and the Livable Communities Act. f' Mr. Fritsinger stated there is no financial commitment to participate in the coalition, and that the benefit to participating in the coalition is the strength in numbers it provides. Mayor Probst stated that he has spoken with the mayors of the corridor cities except Roseville, I and all are very interested in pursuing the coalition. He stated that the transportation issues on 35W will be significant, as it is going to impact all the cities along the corridor. Adopt Resolution #96-31. Acccptinl! Donation of Property at 1400 Indian Oaks Court I Kevin Ringwald, Community Development Director, reviewed for the Council that Ms. Sandra I Welton, 1409 Indian Oaks Court, is requesting the City to accept her donation of property at 1400 Indian Oaks Court. He stated the property contains a pond which services the drainage needs of the general neighborhood. He stated Ms. Welton resides on a separate lot which is .. directly south of the subject property, and will not be affected by the proposed donation with respect to setbacks, lot size, etc. Mr. Ringwald stated Ms. Welton is requesting the City to accept her donation, as the general . public benefits by the surface water management and aesthetic qualities provided by the pond. He stated Ms. Welton will be responsible for the taxes which may be due prior to the Warranty I Deed being recorded. Mayor Probst inquired how the pond was planned on a private lot, and not platted as an outlot. I Mr. Ringwald stated the plat originally showed the parcel as an outlot, and that he was unsure of why or when it was changed to a lot. He stated the land is obviously undevelopable, and should . have remained an outlot. Councilmember Hicks inquired of the depth ofthe pond. Mr. Ringwald stated he did not know I the depth ofthe pond. Councilmember Hicks inquired if fencing or other means of safety measures would need to be I installed, as the City may have a legal responsibility to protect children from the entering the pond. Minor Subdivision. 1433 Forest Lane I Mr. Ringwald reviewed for the Council that the applicant is requesting approval of a final Registered Land Survey (RLS) consisting of three tracts on a 1.11 acre parcel zoned R-I Single I Family Residential District. He stated the Planning Commission recommended approval of the preliminary RLS on February 7, 1996, and was approved by the City Council on February 26, 1996. He stated the final RLS was recommended for approval by the Planning Commission on I April 3, 1996, subject to the following conditions: I) Provision of the appropriate utility and drainage easement documents for review .. by the City Attorney and approval by the City Council; 2) Recording of the utility and drainage easement documents with Ramsey County I with the RLS; 3) Provision of a temporary rock construction entrance, as described in Exhibit C of I the Staff memorandum (dated February 7,1996); 4) Compliance with the Zoning Ordinance, Section VI, G, 8, a and b; I 5) Modification of the silt fence, such that the trees to be preserved are wholly I located on one side of the silt fence and the area to be disturbed is located on the other side of the silt fence; I 6) Provision of snow fencing around all trees (including their drip lines) that fall outside of the proposed building area on Tracts Band C, as shown on Exhibit A, page I of2, of the Staff memorandum (dated February 7,1996); I 7) Payment of the appropriate park dedication fees; I 8) Removal of the brick retaining wall on Tracts A and B, prior to the issuance of any building permits or the transfer of title on Tracts A and B; and ~ I D;"?4Fr '. Mr. Ringwald stated that subsequent to the Planning Commission's recommendation, the I applicant has informed Staff that they will only be selling Tract C immediately. A family member (Geruth Buetow) is going to purchase and move into the existing home (1433 Forest Lane), and that Tracts A and B will be retained by Ms. Buetow into the foreseeable future. He I stated the wording of Conditions 8 and 9 should be reviewed, since these conditions may be not be enforced for a considerable period of time, and Staff is concerned about tracking these conditions over a decade or more of time. I Mr. Ringwald stated that Staff discussed with the applicant the possibility of withdrawing the RLS and just selling Lot 18 as platted, or modifying the final RLS by combining Tracts A and B I into a single Tract. He stated the applicant wishes to have the Council act on their original request. Mr. Ringwald stated that Cindy Walsh, Director of Parks and Recreation, has recommended a I park dedication fee of$8,085; $3,990 for Tract Band $4,095 for Tract C, with no fee for Tract .. A, since that Tract has an existing home already located on it. Mayor Probst inquired if Staff had a recommendation of the appropriate method for approval. I Mr. Ringwald stated the Council has several options, including covenants requiring removal of the retaining wall and purchase prior to building or occupying on Tract A or B. He stated Jerry I Filla, City Attorney, suggested a covenant, as other options explored aren't acceptable to either the applicant or the City. Mr. Fritsinger clarified that while Mr. Filla originally recommended a covenant for the property, . he needs to review the covenant option further before making that recommendation. Ms. Geruth Buetow, 1201 Dayton Avenue, St. Paul, stated she wanted to purchase the I property earlier, but health andfinancial considerations prevented her from doing so. She stated I the house and land have been in the family for almost 50 years, and holds family history as well as Arden Hills history, as it was one of the first homes built in the City. She stated that purchasing the home will address the neighborhood concerns of having two homes on the I property instead of three, and will be a better economic option to the City in park dedication fees, etc. Mayor Probst stated he has no issue with approving the final RLS if an acceptable means of I documentation is found. .. He inquired I if the RLS has any time limit before filing. Mr. Ringwald stated that once the RLS is approved, the applicant has 60 days to record the final RLS or the approval is void. I Councilmember Hicks inquired what concerns Mr. Filla has with the covenant option. Mr. Fritsinger stated Mr. Filla felt the covenant option would be simple, but may be difficult to track if the land stayed within the family. I Mayor Probst inquired if the deed would change upon purchase. Ms. Buetow verified it would. I Mayor Probst suggested placing restrictions on both lots. Mr. Ringwald stated that language could be linked to both lots. I Mayor Probst inquired if the RLS could be approved conditioned upon the City Attorney's approval. Mr. Fritsinger stated that could be done. I Councilmember Aplikowski inquired if the lot sizes were equal. Mr. Ringwald stated that Lot A was the largest, B the smallest, and C in between. Councilmember Aplikowski inquired if the lot Ie sizes could be changed. Mr. Ringwald stated they could not, as they would not meet lot width requirements. I Mayor Probst stated the RLS could be approved subject to the City Attorney approval, as it is not the City Council's function to decide on the mechanism. I Councilmember Hicks inquired what the cost of the RLS was, and if another RLS could be done, keeping Tract A and B together. Ms. Buetow stated the RLS was approximately $2,000. She stated she felt it unlikely the family would sell Tract B, but wanted to keep the economic option I available. Councilmember Keirn inquired ifthe family could do nothing and sell Lot 18. Mr. Fritsinger I stated that future councils would be faced with the issue, and was concerned about future regulations. I MOTION: Hicks moved and Aplikowski seconded a motion to approve Planning Case #95- 23, Bart Buetow, Minor Subdivision, 1433 Forest Lane, subject to the conditions I outlined in the Staffrecommendations, with Conditions 8 and 9 revised once protected by either a covenant or other mechanism acceptable to the City Attorney. The motion carried unanimously (5-0). I Councilmember Hicks clarified that the park dedication proposed by Ms. Walsh would still be ~ appropriate if the current RLS is filed, outlining the three lots. I ! DRAft '. Mr. Fritsinger stated that the repairs needed to the swimming pool at Arden Manor will be I completed, and the pool will open around June I, 1996, subject to the weather. Mr. Fritsinger stated the drainage and access issues to the other park facilities still continue until I such time that the property owner makes additional site improvements. Mayor Probst inquired of the status of Perry Park. Mr. Fritsinger stated it is going well, with an I additional donation from Land 0' Lakes of between $5,000 to $10,000. Mr. Fritsinger stated the estimated 1997 HACA report projects a $3,000 increase for 1997. He I stated the Local Performance Aid Program, will add additional funding estimated at $10,500, should the City apply. I COUNCIL COMMENTS Councilmember Hicks stated he was pleased to hear the pool was being repaired at Arden Manor. .. Councilmember Malone clarified that the 1996 HACA amount was $87,000. I Councilmember Aplikowski stated she will be attending the entire League of Minnesota Cities I upcoming session. Mayor Probst noted he will be attending one day ofthe session. Councilmember Aplikowski inquired if anyone would be attending the upcoming G.I.S. I workshop. Councilmember Aplikowski stated she may attend if her schedule permits. Councilmember Aplikowski stated a raccoon is living under her shed, and inquired if animal I control can assist her in removing the animal. Mr. Ringwald stated he will contact her to assist. Councilmember Aplikowski stated the treasurer of the Northwest Youth and Family Services I (NYFS) has requested to speak to the Council regarding increasing funding for program efforts. Mayor Probst suggested adding this as an agenda item at the next worksession. I Mr. Fritsinger inquired ifNYFS has received any further information regarding Community Development Block Grant (CDBG) funds, as he understands that Housing and Urban I Development (HUD) has been reviewing the use of these funds by NYFS. City Issues - Short Term/Audit Findinl!:s I As a means of reducing the wait of the Abdo Abdo & Eick (AA&E) representative in attendance, Steve McDonald, Mayor Probst dealt with this agenda first. I Mr. McDonald highlighted various items in the Draft Annual Financial Report for the year ended December 31, 1995 and responded to Council questions. He noted that most of his comments .. were also contained in the Management Letter. He specifically commended the City on its strong financial position relative to the other I municipal audit clients of AA&E. Arden Hills is also unique when compared to other cities, in that it has the financial strength to finance projects without incurring debt. He also encouraged the City to be more demanding in requiring consultants to provide more detail in support of their I billings. Roundtable Discussion I a. Committee Reports/Council Comments Councilmember Hicks discussed traffic control issues by Mounds View High School and I asked other Councilmembers their thoughts on trying a pilot project for the rest of the 95- 96 school year to expand deputy patrol by two overtime hours per day during peak parking lot traffic conditions. I Mr. Fritsinger also commented on a meeting held with school officials and the Sheriffs department to discuss the same issue. One of the suggestions that came out of that I meeting was to link the loss of parking lot permit privileges with moving vehicle violations. ~ . Mr. Hicks also advised the Council of a current year Northwest Youth's Family Services (NYFS) current year operating deficit and the likelihood ofNYFS approaching the City for donation support. De{.lartment Head Reports Mr. Post updated Council on 1995 MSA construction project receipts received in May, the option of securing County Road F Sidewalk/Trail Funding before the project is I finalized, and submitting a matching grant application to the Metropolitan Council Environmental Services (MCES) Division to televise sanitary sewer lines in 1997. I Ms. Walsh updated Council on Perry Park playground equipment, efforts being made to encourage Ramsey County to give Tony Schmidt Park redevelopment higher funding and I priority, and status of the donated Sheehy property tennis court. Mr. Stafford updated Council on issues not moving forward through the recommendation . stage from Public Works/Safety Committee (i.e. trails plowing, garbage hauling and renaming County Road F), use of the rented crack sealing machine, need for a backup crew during emergency situations, and the shrinking of the north water tower service area I to accommodate off-peak requirements. c. Administrator Comments . Mr. Fritsinger asked direction from Council on the County Road F renaming issue. After discussion, Mayor Probst suggested that Staff should forward name candidates to Council for consideration. Mayor Probst reminded Council that this was no longer a County Road I and that a name change to reflect this fact would be appropriate. Education Update I Mr. Fritsinger briefed the Council on his observations from the recent attendance at the City Managers' Conference. He elaborated on the issue of committee structure versus specific task forces. . City Issues - Short Term/1997 Bud~et I Council gave general agreement to the proposed 1997 Budget Process Calendar. Council also gave general direction to Staff to strive for a zero percent levy increase for 1997. Councilmember Hicks suggested that Staff consider funding the Pavement Management Program I (PMP) at a higher level than prior years. .. Council member Malone suggested that the impact of a potential legislative property tax freeze be considered. The remainder of the Council concurred that the City should carefully evaluate the impact of a property freeze before finalizing any levy increase for 1997. He also requested Staff I I I. Community Survey Council gave direction to Staff to proceed with the budgeted Community Survey this I summer. A further recommendation from Council was to focus on just a few of the highest priorities from the earlier strategic off-site meeting. I b. Newsletter Committee Councilmember Aplikowski distributed a rough draft markup of a "ARDEN HILLS SCENE" newsletter for discussion. After discussion, two issues emerged: (1) it was I difficult to evaluate a document in non-final stage; and (2) of greater concern that the appearance of the newsletter was receiving the time commitment from volunteers to . ensure future issues of the publication. Staff was directed to prepare a final mock-up for Council review. I e. Use of Community Services Fund Council restated its philosophy of using the Community Services Fund for non-operating purposes in light of the uncertain future of licensed charitable gambling as a revenue I source. After reviewing how some neighboring communities distribute their gambling proceeds, Council indicated they were comfortable with the City's current distribution practices. Some of the more significant activities are described below. Revenue: I General property taxes - Actual revenue of $1,489,708 was $174,892 less than budget of $1,664,600. Petitions and abatements were held out of tax settlements and this caused revenue to be short. I Licenses and permits - An increase in unplanned permit activity resulted in an extra $106,479 coming in over budget. Actual revenue was $253,729 and I budget was $147,250. Expenditures: I Administrative - This department had actual expenditures of $260,690 offset . by a budget of $290,885 and this produced a favorable variance of $30,195. Staff turnover and some shifting of job duties among existing staff helped bring this variance. I Protective inspection - This department saw an unfavorable variance of $35,344. Actual expenditures were $103,674 and budget was $68,330. More work in this department was needed as the license and permit revenue . activity went up. Operating transfers out - There were $38,905 more in actual transfers than budgeted. I We believe the minimum fund balance for working capital for an entity your size should be approximately 40\ of current year expenditures. With I expenditures of approximately $1,900,000, your minimum fund balance should be around $760,000. Although your general fund balance is approximately 23\ of current year expenditures, this does not give the whole financial picture. The Permanent I Improvement Revolving Fund, with a fund balance of $4,218,525, and various reserve funds (Municipal Land and Buildings, Capital Equipment Sinking and Fire Equipment Sinking Funds) provide additional resources that help provide I working capital. Relative to cities your size, on an overall basis, the City is in excellent financial position and has the ability to finance many of its improvements. I It is important to maintain an adequate fund balance for the following reasons: I . 0 Expenditures are incurred somewhat evenly throughout the year. However, property tax and state aid revenues are not received until the second half of the year. An adequate fund balance will provide the cash flow required to finance the General Fund expenditures. I This fund will provide for various needs in the community as determined by the Council. Park Fund I This fund had expenditures of $315,804 and revenue of $148,619. The result was a decrease in fund balance of $167,185 and the December 31 balance was I $471,755. This fund is used to finance park improvements. Cable TV Fund I The fund balance increased $20,398 to $141,618 at year end. Debt Service Funds I There is no long-term debt outstanding at year end. The remaining assets of the debt service funds may be used for any public purpose. The remaining balance in the Fire Equipment Certificate of Indebtedness Fund I and the Equipment Certificate of Indebtedness Fund were closed into the Permanent Improvement Revolving Fund at year end. . The Advance Refunding of 1985 has December 31 fund balance of $789,702. I It should be noted, however, that the City remains contingently liable for the 1977 G.O. Permanent Imorovement Revolvinq (PIR) Fund I The fund balance at year end was $4,218,525 of which $368,000 represents the amount of the unpaid advance for the Kern Milling TIF project. I DeveloD/RedeveloD TIF The advance from the PIR Fund was reduced $32,782 to $368,000 at year end. Tax increments, as collected, will be applied to the balance due to the PIR I Fund. It is not clear whether tax increment collections in the future will be sufficient to repay the entire PIR advance. The cash balances of each fund increased by similar amounts. I The Water and Sewer Funds have cash balances of $424,933 and $601,016, respectively. The cash balances of each fund should be analyzed to determine appropriate cash requirements for operations, repair and maintenance and I repayment of interfund loans. Recyclinq Fund I This fund has a cash balance of $33,937 and retained earnings of $28,938. Surface Water Manaqement Fund I This fund has a cash balance of $6/221 and retained earnings of $49,821 at year end. Other Items I During the audit, we noted some deficiencies in consultant billing. If a consultant uses time reports for billing, there should be detailed identification of work performed. We recommend the City determine the I . appropriate level of detail needed to verify the work performed and implement standards to be used by their consultants. CITY OF ARDEN HILLS RESOLUTION #96-29 I A RESOLUTION ACCEPTING BID AND AUTHORIZING EXECUTION OF CONTRACT IN THE MATTER OF THE I 1996 STREET IMPROVEMENTS WHEREAS, pursuant to Resolution #96-21, competitive bids were solicited and received for I the 1996 Street Improvements as set forth in the bid tabulation attached hereto and incoIJlorated herein by this reference; and I WHEREAS, the City Council has considered the amount of the bids and the responsibility of the bidders and determined that T.A. Shifsky &Sons is the lowest responsible I bidder; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Arden Hills, I Minnesota: l. The Mayor and City Administrator are authorized and directed to execute, on behalf of .. the City, such contract with T.A. Shifsky & Sons as is approved by the City Attorney for the completion of the 1996 Street Improvements according to the approved plans and . specifications designated in Resolution #96-2l. 2. The City Administrator is authorized and directed to forthwith return to all bidders the I deposits made with their bids upon execution of the contract above specified. I Background Bethel College is currently operating on a Special Use Permit (SUP) which was issued in March of 1978 in Planning Case 78-5. The Master Plan was last amended in September 8,1980 to .. allow site plan approval for those requests which were in conformance with the Master PIan. The current request is an amendment to the approved Master Plan. I Deadline for Al!ency Actions The City of Arden Hills received the complete application for this request on April 8, 1996. I Pursuant to Minnesota State Statute the City must act on this request by Friday, June 7, 1996 (60 days), unless the City provides the petitioner with written reasons for an additional 60 day review period. The additional review period would extend to Tuesday, August 6, 1996. The City may . with the petitioners consent extend the review period beyond the Tuesday, August 6, 1996 date. Lastly, if the City denies the petitioners request, "... it must state in the writing the reasons for the I denial at the time that it denies the request." Recommendation I The Planning Commission recommends approval of the amendment to the Master Plan, in Planning Case 96-04, conditioned on: I 1. Modification of the parking lot design by eliminating the western most parking space on the southern row of parking; and 2. Provision of the parking spaces consistent with Exhibit A, page I of 1, as attached to Mr. I Ringwald's May 8,1996, supplemental memorandum. it 1 I "I Additional information _I The parking lot expansion caused several members of the Planning Commission to express their displeasure with Bethel College for choosing to amend their Master Plan and not update it. This displeasure is evidenced by the 4-3 vote (Carlson, Larson, and Piotrowski dissenting) of the I Planning Commission on Bethel College's request in this case. In response to this displeasure the Planning Commission unanimously passed the following resolution: I WHEREAS, the original Master Plan for Bethel College was generated in 1978; and WHEREAS, several amendments to the Master Plan have been requested by Bethel . College in the immediate past; and WHEREAS, as previously stated to the City of Arden Hills Planning Commission by I Bethel College, the student population has significantly changed since the original Master Plan was generated; I NOW THEREFORE, BE IT RESOLVED, that all future proposals will be reviewed in strict conformance with the Master Plan and the City should strongly encourage Bethel I College to update its Master Plan. Request The applicant is requesting approval of a final plat (Amble Subdivision) consisting of four (4) lots on a 2.99 acre parcel zoned R-l Single Family Residential District (Exhibit A). The request . also includes a variance to allow the use of a private drive rather than a public street. Back~round . The property under consideration in this request currently contains two single family homes on the property which are serviced by an existing private driveway off of the East end of West Amble Road. The applicant wishes to subdivide the property to place these two existing . structures on their own lots and create two additional lots for their other two children to construct homes on. The applicant proposes that all four of these lots would obtain access to West Amble Road via the existing private driveway. .. The Planning Commission recommended approval of tbe preliminary plat on March 6, 1996. I The preliminary plat was approved by the City Council on March 25,1996, based on the conditions recommended by the Planning Commission. The Planning Commission is recommending approval of the final plat subject to the following conditions: . 1. Provision of the required driveway easement prior to final plat approval; 2. Provision of adequate sediment and erosion control measures; I 3. Payrnent of the appropriate park dedication fee; 4. Provision of a driveway which is consistent with the requirements of the Fire Code; and 5. Provision of signage at the Southerly edge of the driveway (West Amble Road) which I identify the addresses located on the private driveway. Final Plat I The applicant has provided the City with the easement document for the private driveway as required by condition 1 (Exhibit B). Walsb, Parks & Recreation Director CS J I SUBJECT: Amble Park Dedication Backfl"round I According to Planning Case 96-01, the Ambles are splitting four lots. Since park dedication has never been paid on these lots, it appears that the applicant should do so during the lot split process. This case is similar to the Buetow lot split, Planning Case 95-23. I Park Dedication Fee Calculation Based on the Registered Land Survey, the four lots have a density of 1.33 dwelling units per . acre. According to the City of Arden Hills Public Use Dedication Ordinance Section 22-9, the park dedication fee will be based on six percent of the fair market value of the property. Fair market value was determined by the appraisal price of the property. 'JIlro. . -..... The property will be split into four lots. Since lots 2 and 4 have existing structures on them, staff I does not believe that they should pay a park dedication for either parcel. Lot I has a fair market value of $82,000, which means the park dedication fee will be $4,920. I Lot 3 has a fair market value of $65,000; thus, their park dedication fee will be $3,900. The total park dedication fee is $8,820. I Recommendation I recommend that the Amble Planning Case 96-01 pay a park dedication fee of $8,820 for 10ts 1 & 3 since these two parcels will have new homes on them. Because of the existing structures on I lots 2 & 4, I am not recommending that park dedication fees be paid for these two lots.
