I The City Council, Administrator, and Department Heads may have an update on various
activities undertaken over the past month,

The Councilor staff may have an update on any education, training or policy committee
activities undertaken recently.
I 3. Citv Issues - Short Term
a. Review PermitlLicense Fees
.. Staff would like to briefly review the current fees which have been adopted by the
City Council, and discuss any changes being considered for 1997,
I b. 1997 Street Improvements
Staff will have available at the meeting information detailing the following:
. Street Maintenance History
I . 5-year Pavement Management Program
. Maps Highlighting Proposed Program
I Staff would like to review both the 1997 and future programs. The program is
fairly aggressive, and as suggested by one Councilmember, includes additional
I work in 1997.
1997 Budget
c.
I The Council will be reviewing the line item budget, which will be available at the
meeting. Staff is still attempting to refine a number of the issues discussed last
week. I have enclosed a revised General Fund budget detailing an increase of
I $34,000 for the 1997 PMP. This results in a 1,95% levy increase,
d. Sheehy Tennis Court - Lease A~reement
I Enclosed the Council will find a proposed lease agreement with Arden Hills #3
Association, This agreement would allow the Association to
~ upgrade/maintain/use the old tennis court located on the Sheehy property,

I Attached, the City Council will find several of the fees charged by Arden Hills for various
services and licenses, The Council may wish to discuss any changes it finds appropriate for
I 1997.
I I have highlighted those items which are new or have suggested fee changes. I have not provided
any of the current fees associated with building, water, sewer, electrical, etc, permits, As these
items have all been adjusted over the past few years. I would recommend no change,
I The establishment of fees for the various licenses and permits is allowed by the Arden Hills
Municipal Code. The Council should adopt a resolution prior to 1997 detailing all fees and
.. charges.
Specifically, the Council may wish to consider the adoption of new fees in the areas of: Courtesy
I Benches, Sign Ordinance, Impound, Christmas Tree Sales, Beauty Shops, and Annual vs,
Quarterly Liquor.

SUBJECT: Expanded PMP Scope and 1.95% Levy Increase
I As a follow-up to the Budget Worksession meeting of August 12, 1996, attached find a revised
I General Fund Proposed 1997 Budget which incorporates "Alternate No.3,"
Specifically, this alternate incorporates a 1.95% net levy increase to expand the scope of 1997
I Pavement Management Program (PMP) activities in the Street Maintenance department by
$34,000,
I Another change in this alternate is to reduce the planned operating transfer out to the
Capital Equipment Sinking Fund by $28,5.00 and to also reduce "Other Financing Uses"
(revenue representing an operating transfer in from the Capital Equipment Sinking Fund) by
.. $28,500. This use of the operating transfers has no impact on the projected deficit ($1,793), but
reduces total revenues and total expenditures by $28,500.
I It is anticipated that this alternative will generate some discussion at the August 19,1996
Council Budget Worksession,

I The tennis court, which is located in the Southwest corner of the land Mr. Sheehy donated, is in
very poor condition. The City Council and staff had previously agreed to remove this court area,
due to the unstable soil conditions that would create a high maintenance area for the City,
I The Arden Hills #3 Homeowners Association contacted the City in July of 1995 to inquire if the
City would let the association maintain and use the tennis court, After talking to the City
I Council and staff about a possible lease agreement, the association president held a meeting with
the members to discuss whether the association wanted to spend money to maintain the court,

I The association members are interested in maintaining the tennis court located on Ridgewood
Road as a multi-use recreational site, mainly for tennis and basketball. The attached letter from
Todd Albertson, the association president, outlines the proposal from the association. The
I following are the main points:
1. Five (5) year term lease.
I 2. Lease would automatically renew unless either party gives written notice of cancellation
at least 12 months prior to end of five (5) year term.
3. A token amount would be paid by Arden Hills #3 for the lease. The intent of which is to
I transfer liability from the City of Arden Hills to AH #3,
4. AH #3 will improve and maintain the leased property as required for recreational use by
AH #3 members only,
I 5. In addition, AH #3 will maintain the approach area to the tennis court,
6. AH #3 will maintain appropriate insurance on this property.

The City Attorney, Jerry Filla, has drafted a lease agreement for your review, He has
I incorporated the points from the association. The lease holds the Arden Hills #3 Association
responsible for the ongoing maintenance of the court.

City Assistance in Resurfacinl! the Court .
I received a price quote of $2300 to make the present court surface playable and safe. This price -.
involves crack sealing and resurfacing the court. The association has found a contractor who
would perform the job for less money, but not as thoroughly. If the Council is supportive of
entering into a lease agreement, they should direct staff to negotiate the lease. The Council
should consider one of two options. .
1. The first is to partially fund the initial resurfacing work to guarantee that the court is
brought up to City standards. .
2. The second is to finalize the lease agreement and allow the association to deal with the
initial resurfacing and future ongoing maintenance. .

" Arden Hills City Council,
I Arden Hills #3 Association (AH #3) is an association serving a 65 home community that
currently has approximately 37 children/teens and 140 young adults/adults. Presently
1 there are no recreational facilities or parks that this community can access without
crossing or traveling on Snelling Avenue. For this reason AH #3 is interested in
maintaining the City of Arden Hills owned tennis court property located on Ridgewood
1 Road as a multi-use recreational site (tennis, basketball, handball etc..).
Based on discussion with the city council at a work session last fall we are under the
I assumption that selling the tennis court property to AH #3 is not an option at this time.
Therefore, this correspondence will state Arden Hills #3 Association's intent to lease
1 from the City of Arden Hills the tennis court on Ridgewood Road that is part of an 8'/.
acre plot (the majority of which is marshland) that was donated to the City of Arden
Hills.
I The following are proposed points for incorporation into a lease agreement:
.. 1. 5 year term of lease.

1.0 Parties. This Agreement is dated the day of
I , 1996, and is entered into by and
between the City of Arden Hills, a Minnesota municipal
corporation ( .C1t:y" ) and the Arden Hills Association, a
I Minnesota non-profit corporation herein ("ASsociation").
2.0 Recitals.
I A. The City is the fee owner of the following described
property situated in Ramsey County, Minnesota to-wit:
1 Lot 3, Block 8, Arden Hills NO.3, except that
part described as follows; Beginning at the
Northeast corner of said Lot 3; thence West
along the North line of said Lot 3 for 300
1 feet; thence South at right angles for 300
feet; thence East parallel to the North line
of said Lot 3 for 270 feet, more or less, to
1 the East line of said Lot 3' thence North

along the East line of said Lot 3 to the point
of beginning (herein the .Subject. Propert.y").
I B. The City does not have a short term use for the property.
C. The Association wishes to lease a portion of the Subject
.. Property for a tennis court and related facilities.
D. The City ~s willing to allow an interim Use of the
Subject Property pursuant to the terms of this Lease
I Agreement.
3.0 Terms and Conditions. NOW, THEREFORE, in consideration of the
1 mutual undertakings herein expressed, the City and Association
agree as follows:
A. PrODertv Subiect to Lease. The City hereby leases to the
I Association that portion of the Subject Property
described on Exhibit A attached hereto, subject to any
and all existing easements.
I 1. Tennis Court Area. (Legal to be included.)
2. Access Area. (Legal to be inclUded.)
I B. Rent. As consideration for this Lease, the Association
shall pay the City annual rent in the amount of $
I 1 . In addition, the Association shall pay the
City any taxes or payments in lieu of taxes required as
a result of this Lease including any such taxes payable
the year following the termination of this LeaSe if such
1 tax payments cannot be abated.

C. Term.. This Lease shall be for a term of five (5) years .1
commencing on the day of , 1996,
and shall be automatically renew for an additional five 1
(5) year term unless either party gives written notice of
cAncellation at least twelve (12) months prior to
termination of the initial five (5) year term.
D. Improvements. The Association shall pay for all costs I
relating to improvement of the tennis court or access
areas. Plans and specifications for improv~~ts~s~ll I
be reviewed and approved by the City PI fi(i(~ "" All
improvements constructed to the tennis court and access
areas shall become the property of the City.
E. Maintenance. All modifications to the tennis court area I
and the access areas and all improvements made for the
Association's benefit shall be at the Association's I
expense and such improvements shall be maintained in a
good state of repair.
F. Trespass. The Association shall ensure that its members I
and guests do not use the remaining portions of the City
property.
G. Insurance. The Association must maintain a comprehensive I
general liability coverage which shall include, but not
be limited to, bodily injury, property damage and
personal injury. The comprehensive general liability --
coverage shall be in an amount not less than $600,000 for
each occurrence and $600,000 for personal injuries.
These 11mi ts may be satisfied by the comprehensive
general liability coverage or in combination with an I
umbrella or excess liability policy, provided coverage
afforded by the umbrella or excess policy is no less than
the underlying comprehensive general liability coverage. I
The City shall be named as an additional insured on the
insurance policy.
The Association must keep in force during the term of I
this :Lease a policy covering damages to its property.
The amount of coverage shall be sufficient to replace the
damaged property, loss of use and comply with any other I
appropriate city ordinances or regulations.
Il. Hazardous Materials. The Association will be solely
responsible for and will defend, indemnify and hold the I
City, its agents and employees harmless from and against
any and all claims, costs, and liabilities including
attorney's fees and costs, arising out of or in
connection with the cleanup or restoration of the tennis I
court area and access area resulting from the
Association's use of hazardous materials. For purposes
of this Agreemant, "hazardous materials" shall be I
interpreted broadly and specifically includes, without

I limitation, asbestos, fuel, batteries. or any hazardous
~ substance, waste or materials as defined in any federal,
state or local environmental or safety law or regulations
including but not limited CERCLA. The City represents
that it has no knowledge of any hazardous materials on
the property.
II I. Indemnification. The Association agrees to defend,
indemnify and hold the City harmless from any and all
I costs, inCluding reasonable attorney's fees, and claims
of liability Or loss which arise out of the Association's
use and/or maintenance of the property except those which
arise from the negligence, willful misconduct or other
I fault of the City.
J. Compliance with Reaulations. The Association and its
II members shall use the tennis court and the access areas
in compliance with all of the City'S regulations and in
a manner that does not create a nuisance for adjoining
property owners.
II K. Default. A violation of terms of this Lease by the
Association or its members shall be an event of default.
If a default occurs, the City shall provide the
I Association with a ten (10) day notice to cure such
default. Failure to CUre the default within the
appropriate time shall result in an automatic termination
~ of the Lease.
.. L. Authority. Each party represents that they have been
authorized to enter into this Lease Agreement.
II M. Governina Law. This Lease shall be construed in
accordance with the laws of the State of Minnesota.
I N. Severabilitv. If any term of this Lease is found to be
void or invalid, such invalidity shall not affect the
remaining terms of this Lease, which shall continue in
I full force and effect.

I Attached, the Council will find the performance review form for consultant services. As a result
of the 1996 Council/Department Head retreat, staff was directed to begin an annual review of our
I existing consultants.
At that time, the Council also directed staff to consider seeking proposals from other firms to
I provide these services. After a review of these evaluations, the Council may wish to direct staff
to seek proposals for one or both of these areas. I would like to ask the City Council to complete
the evaluation forms on both the City Attorney and Consulting Engineer. You should be as
I specific as you can, and relate your evaluation to your experiences with each of these firms.
-. Once the Council and staff has completed its evaluations, I will prepare a final draft for review
.- by Council with any recommendations that I may have. Please return your evaluations to my
attention no later than August 30, 1996.
