AN ORDINANCE REGULATING
M01ORBOATS ON LAKE JOSEPHINE
The Arden Hills City Council ordains that

C. No person shall operate a motorboat or
be towed on water skis or on a similar device

AN ORDINANCE REGULATING MOTORBOATS ON LAKE JOSEPHINE.
The Arden Hills City Council ordains that Article III is hereby added to Chapter 12 of the
Ardeu Hills City Code to read as follows:
ARTICLE III. LAKE JOSEPHINE.
Section 12-33. Purpose, Intent and Application. Portions of Lake Josephine are located within the
City of Arden Hills and within the City ofRoseville. The City Councils for the cities of Arden Hills
and Roseville, by adoption of a Joint Powers Agreement, have determined that it is in the public's
interest and in the interests of those people who reside on property adjacent to Lake Josephine to
consistently regulate the surface use of Lake Josephine. The following regulations shall apply to the
surface use of Lake Josephine:
A. The definitions contained in Minnesota Statutes 86B.005 are hereby incorporated as

B. Motorboat speed on Lake Josephine shall not exceed 40 mph. which speed shall be

. JOINT POWERS AGREEMENT
LAKE JOSEPHINE
WATER SURFACE USE
1.0 Parties. This Agreement is made and entered into by and between the City of Arden
Hills, a municipal corporation and political subdivision of the State of Minnesota (herein "Arden
Hills") and the City ofRoseville, a municipal corporation and political subdivision of the State of
Minnesota (herein "Roseville").
2.0 Recitals. Lake Josephine is located within the corporation boundaries of Arden Hills
and Roseville and has a large public access for boats. The waters of Lake Josephine are used
extensively by the public for boating, fishing and other recreational purposes.
Regulation of boating traffic on Lake Josephine is necessary in order to protect the health,
safety and welfare of the residents of Arden Hills and Roseville who reside on properties
surrounding Lake Josephine and of those people who use Lake Josephine for recreational purposes.
By means of this Joint Powers Agreement adopted pursuant to Minn. Stat. 99459.20 and 471.59,
Arden Hills and Roseville will establish guidelines applicable to the adoption of ordinances by each
. City restricting the speed and use of motorboats on Lake Josephine.
3.0 Terms and Conditions. In consideration of the mutual undertakings herein
expressed, Arden Hills and Roseville agree as follows:
A. Each City shall adopt an ordinance which incorporates the following guidelines.
I. Adopts the definitions of Minn. Stat. 986B.005.
2. Motorboat speed on Lake Josephine shall not exceed forty miles per hour (40
mph) which speed limit shall be in effect 24 hours per day.
3. No person shall operate a motorboat or be towed on water skis or a similar
device at greater than a slow no wake speed within 150 feet of shore.
Launching or landing a skier by the most direct route to open water shall be
exempt from this provision.
4. All motorboats shall travel and be operated in a counter-clockwise direction
around Lake Josephine except when operating at a slow-no wake speed.

. 5. Persons operating a motorboat, and those being towed on water skis or a
similar device shall, at all times, maintain an adequate distance (considering
speed and conditions) from other watercraft, swimmers, swim rafts and
docks, so as to avoid an accident. When a swimmer is present, motorboats
or persons being towed on water skis or a similar device, shall not pass
between a swim raft and the nearest shore.
Exemptions. Parties which would be exempt from complying with the terms
of the Ordinance:
a. Authorized resource management emergency and enforcement
personnel, when acting in the performance of their duties, shall be
exempt from the provisions of this ordinance.
b. A temporary exemption from these restrictions for a special event
may be granted upon approval by tlle City Councils and the issuance
of a permit by the Ramsey County Sheriff's Department.
B. Each City shall be responsible for informing the public, posting notification at all
public accesses and marking or buoying areas affected by the ordinance as necessary
to give reasonable notice of the restrictions of the ordinance.

C. Each City shall advise the owners of properties surrounding Lake Josephine who
reside in the respective City that motorboat speed and use regulations have been
adopted.
D. Each City shall request the appropriate law enforcement agency to enforce the
provisions of such ordinance and will notify the other party when such request is
made.
E. Neither City shall change or amend its ordinance relating to motorboat regulations
and speed limits on Lake Josephine without consultation with the other.

. F. This Agreement supersedes all prior agreements between the parties dealing with the
subject matter of this Agreement.
