MINUTES OF THE ARDEN HILLS COUNCIL WORKSESSION
MONDAY, OCTOBER 16, 1989, 4:30 P.M. - CITY HALL
CALL TO ORDER Pursuant to due call and notice thereof, Mayor Sather
called the meeting to order at 4:30 p.m.
. ROLL CALL The roll being called the following members were present:
Mayor Thomas Sather, Councilrnembers Nancy Hansen, Paul
Malone, and JoAnn Growe. Councilmember Mahowald and Attorney Jerry Filla arrived
at 4:40 p.m. Also present: Park Director John Buckley, Clerk Administrator Gary
Berger and Deputy Clerk Catherine Iago.
ADOPT REVISED Growe moved, seconded by Malone, to adopt the Agenda as
AGENDA revised to reflect the Approval of Specifications for
Tank Truck Purchase. Motion carried. (4-0)
APPROVE PURCH; Council was referred to a memorandum from Park Director
1990 BUDGETED Buckley dated 10-12-89, requesting authorization to
TANK TRUCK prepare specifications and advertisement for bids for
purchase of a 1990 tank truck.
Buckley explained the truck is scheduled for purchase in 1990 and to insure
delivery early in the year, it is necessary to order the truck and tank
attachment at this time. He indicated it will take approximately 45 to 60 days to
receive the equipment and prepare it for use by City personnel.
The Park Director noted request is being submitted a this time due to the fact
the current equipment being utilized by staff is unsafe and dangerous. He stated
the tank truck is shared between the Park and Public Works Departments and is
heavily utilized during the winter months for flooding skating rinks.
. There was discussion relative to the time-frame for bid advertisement and receipt
of bids for the truck prior to the next regular Council meeting date. It was
determined that the date and time for the bid opening be changed to Monday,
October 30, in order to meet publication notification deadlines.
Hansen moved, seconded by Growe, that Council authorize
preparation of specifications and an amended advertisement for bids for a truck
chassis and tank to be bid separately, as outlined in the Park Director's
memorandum dated 10-12-89. Motion carried unanimously. (4-0)
DRAFT PERSONNEL Council was referred to a memorandum from the Clerk
ORDINANCE Administrator dated 10-12-89, relative to the proposed
Arden Hills personnel ordinance.
Mayor Sather stated Council had directed staff to prepare a personnel ordinance
for City Employees at the Goals Session held in March of this year. He stated the
document was prepared by staff after surveying several other communities
ordinances and incorporating additional items deemed appropriate into the current
personnel ordinance.
The Clerk Administrator explained the draft document was forwarded to Karen Olsen
of Labor Relations Associates and Attorney Filla for their review and comments.
He stated the proposed ordinance is based on the City of Shoreview's current
personnel ordinance, which most closely reflects Council concerns.
. Attorney Filla discussed the following items:
-Section 19.6: Suggested some wording which allows flexibility when hiring
Department Heads and negotiating benefits could be included
in this section.

PERS. ORD. (Cont'd) -Compensation Time: Attorney did not see this issue
addressed in the proposed ordinance.
. Mayor Sather explained the City currently allows an employee to earn and utilize
compensation time within the same earned pay period; if the individual has not
utilized the compensation time during that pay period, they are automatically
paid for the time.
Council discussed several other areas in the draft document which included sick
leave, vacation, appeal process, service credits and accrual of benefits on a
prorated basis for part-time employees and authority of Council/Administrator.
Council concurred on the following policies to be included in the final document:
Vacations: Council concurred vacation cannot be utilized until completion of
one (1) year continuous service.
Sick Leave: Council concurred sick leave cannot be utilized until completion of
six (6) months probationary period.
Permanent Part Time Employees: Vacation, Sick Leave and Holiday benefits are
prorated. NOTE: It was determined that Sick Leave benefits are currently prorated
for permanent part-time employees.
Council: The language in the lines of authority should reflect the
Council/Clerk Administrator rather than the Council/City Manager form of
government and requested such terminology be inserted in the document where
necessary.
. Miscellaneous: Amendments included in Karen Olsen's memorandum be inserted into
the final draft of the personnel ordinance.
Compensation Time: The current City policy will not be changed.
Lunch Breaks: Specify and clarify city policy for employee lunch breaks in
similar language as the employee break periods.
Lay-off and Demotion: Language needs to be clarified and more specific and
reflect the Council/Clerk Administrator form of government.
Anniversary Date: Anniversary date for calculating and accrual of benefits is
the date of employment rather than based on the calendar year.
Council directed the Clerk Administrator and City Attorney to incorporate
amendments discussed and return the proposed Personnel Ordinance in proper legal
ordinance format.
KEM MILLING Attorney Filla reported on the Kem Milling purchase and
PURCHASE requested Council approval of the pro-rata share of taxes
on the property.
Malone moved, seconded by Mahowald, that Council approve
the expenditure for the City of Arden Hills pro-rata share of 1989 property taxes
. for the Kem Milling site purchase. Motion carried unanimously. (5-0)
Council directed the Clerk Administrator to contact Delta Environmental relative
to preparation of specifications for demolition and site clean-up and research if
funding is available for removal of the underground storage tanks; information
should be available for Council at their regular meeting held October 30, 1989.

KEM MILLING (Cont'd) Filla stated Tim Guzek has requested the Fire Chief and
Building Inspector meet with him at the site to determine
. any hazards which should be eliminated immediately.
ODOR PROBLEM; Attorney Filla reported on the correspondence relative
RAMLINE AVE. to the sewer odor problem on Hamline Avenue at the
Sawtell residence. He advised the City has not ignored
the situation and he will be forwarding a letter to the Sawtell's attorney which
indicates any actions the City has taken to date or will be taking in the near
future.
Council directed staff perform a IIsmoke test" at the Sawtell residence and report
back to Council on the test results.
OAK AVE Attorney Filla reported on the Oak Avenue easements;
advised that a document was recorded which grants an
easement to the City on the Hecht property. He noted the City paid a smaller
amount to obtain the easement from Hecht due to locating the document.
ANNUAL COMPENSATION Council was referred to a memorandum from Berger dated
REVIEW; CLK. ADMIN. 10-10-89, relative to an annual compensation review for
the Clerk Administrator.
Mayor Sather advised three alternatives were provided for adjustment in the Clerk
Administrator's salary and/or employee agreement, based on the 1989 Stanton
Survey information provided and a positive employee evaluation. He stated his
preference would be to adjust the Administrator's salary to the 85% level
. indicated in the Stanton Survey, retroactive to July 25, with the understanding a
cost of living increase would be considered in January 1990, and increase the car
allowance to $150.00 per month.
Council discussed if the methods utilized in adjusting the Administrator's salary
were followed for all City employees.
Berger eXplained currently there are no salary step plans or job descriptions for
any positions in the city; this year he has initiated the employee evaluation
process and job descriptions and the evaluation is performed on the employee's
anniversary date. He noted some positions are compensated in this fashion,
however, some employees have more years of service and their adjustments were
made through the Comparable Worth process.
Council requested the Clerk Administrator provide a graph which indicates all
positions in the City and how the position ranks in terms of salary.
Malone moved, seconded by Growe, that Council authorize a
salary increase to $40,874.00 annually for the Clerk Administrator, retroactive
to July 25, 1989, and increase car allowance to $150.00 per month. Motion carried
unanimously. (5-0)
Councilmember Hansen questioned if the Clerk Administrator keeps records on
mileage for his vehicle.
Berger advised he has not kept mileage records.

COUNCIL COMMENTS
MISCELLANEOUS Councilmember Mahowald advised he will be unable to
. attend the October 30, 1989 Regular Council Meeting.
ADJOURN Growe moved, seconded by Mahowald, that the meeting be
