HomeMy WebLinkAboutCC 01-22-1990 .- M'.''lUTES OF THE ARDEN HILLS COUNClL \VORKSESSION MEETING MONDAY, JANUARY 22, 1990, 4:30 P.M. - CITY HALL CALL TO ORDER Pursuant to due call and notice thereof, Mayor Sather called the meeting to order at 4:30 p.m. ROLL CALL The roll being called the following members were present: Mayor Thomas Sather. Councilmembers Nancy Hansen, Paul Absent: Councilmember Thomas Mahowald. Also present: Dan Winkel, Clerk Administrator Gary Berger and Deputy . Malone and JoAnn Growe, Public Works Supervisor Clerk Catherine Iago. EASEMENT ENCROACHMENT Council was referred to a report from Public Works Supervisor Winkel dated 1-18-90, regarding a survey conducted along Katie Lane and Stowe Avenue to identify easements by landscaping and fencing, encroachments on City Winkel displayed pictures of the 20 ft. sewer utility easement located along the north property line on Katie Lane properties and the southerly property line of Stowe Avenue. He explained with the current encroachments located on the easement it is difficult and in some cases impossible to maneuver the Jetter truck along the easement to repair sewer line problems or perform routine maintenance. The Public Works Supervisor noted that it appears the fencing along the southerly property line for the Stowe Avenue residences is located 2 ft. into the Katie Lane easement and not on the actual property line. He stated this may have occurred because the first resident to place a fence along this property line incorrectly located the fence and future fencing was also incorrectly located. After discussion, Council concurred that it would be appropriate to begin establishing some criteria for elimination of easement encroachments in the area identified along Katie Lane and Stowe Avenue. Council requested staff review any permits issued for fences located in this area to determine if persons were allowed to construct encroachments within the easement areas and submit the findings to Council on Friday, January 26, Council also noted that a process should be established to insure easement areas are clearly identified for residents seeking building permits in the future and that staff identify and notify persons applying for the permits of any such easements. It was the consensus of the Council to discuss the materials submitted by staff at a future worksession meeting; it was suggested that after review and establishment of criteria for elimination of easement encroachments, a meeting be scheduled with the residents of the Katie Lane/Stowe Avenue area to discuss the easement problems. . Attorney Filla commented there may be circumstances arising in some encroachment cases that are unique and Council may consider such cases on an individual basis. YAnutes of the Arden Hills Council Worksession, January 22, 1990 Page 2 PARKING/SNOWPLOWING ORDINANCE Public Works Supervisor Winkel discussed problems the staff is experiencing relative to lfSnowbirdll vehicles parking on City streets during snowplowing operations. Winkel indicated the current Ordinance prohibits vehicles from parking on any City street after a 2" snowfall, until plowing is completed, He noted the existing Ordinance has provision for towing vehicles and issuing citations, however, previous Councilmembers did not favor strict enforcement. . The Public Works Supervisor suggested more specific language be included in the Ordinance which restricts parking on the street during evening/early morning hours to allow the crews to complete the snowplowing. There was discussion relative to a ItWinter Parking Ban" which would prohibit parking during the winter months only for certain hours and more stringent enforcement of the existing ordinance. Council concurred that the City Attorney draft an amendment to the Arden Hills parking ordinance, Section 26.3 Parking after snow accumulation, to include language which prohibits vehicle parking on the street from October 15 thru April 15, during the hours of 11:00 p.m, to 6:00 a,m. NOTIFICATION TO RESIDENTS; PLANNING COMM. APPLICATIONS Council was referred to a memorandum from Deputy Clerk Clerk Iago dated 1-19-90, recommending that notification be provided to residents on planning cases which do not require a Public Hearing. Iag9 explained the notification could be sent to residents wit"in a 150 ft, radius of. the site or just to adjacent property o~mers; notificatio~ would consist of a brief explanation of the application and a map of the site, She stated in either case the names of the property owners would be provided by the applicant and mailed by staff, . Council concurred it would be preferable to notify property owners within a 150 it, radius of the site on planning matters which do not require a public hearing. Deputy Clerk Iago was directed to prepare a memorandum for formal Council consideration at the 1-29-90 Regular Council meeting, under Consent Calendar. CITY HALL COMMITTEE; PROPOSED AGENDA/DATE Council reviewed the memorandum from Deputy Clerk Iago dated 1-19-90, which outlined staff recommendations for a tentative monthly meeting date and agenda items for the committee to study. There was discussion relative to the tentative agenda, meeting dates, possible expansion of City services in the area of police, fire, community service facilities, location of City facilities and future staffing needs. Council concurred that Department Heads and staff should begin preparation of a needs assessment which includes proposed space requirements for offices7 work areas, storage, conference facilities and areas used as community facilities; Council Chambers, employees cafeteria, etc. Mayor Sather suggested Councilmember Mahowald be contacted to determine his availability for the meeting date proposed at the next Regular Council meeting. . ~inutes of the Arden Hills Council Worksession, January 22, 1990 Pa~e 3 LEGAL SERVICES; RENDERING PLANT NEW BRIGHTON Council was referred to a memorandum from the Clerk Administrator dated 1-18-90, relative to billing statements from the City of New Brighton for 1989 legal services in conjunction with the rendering plants in both cities. . Mayor Sather reviewed his recent discussion with New Brighton Mayor Benke regarding Arden Hills lack of enthusiasm to continue participation in the legal costs relating to the rendering plant. Council discussed the joint court case which is scheduled for hearing in April 1990 and continued participation until such time as the hearing is completed, Council concurred to continue cost participation with the City of New Brighton in relation to their rendering plant until such time as the court hearing is completed and judgement received, at which time this matter will be reviewed and determination will be made as to continued participation. OTHER BUSINESS PROP'D ASSESSMENT POLICY Clerk Administrator Berger suggested proposed assessment policies be placed on the Council Worksession agenda in February. Mayor Sather stated it would be preferable to wait for Committee recommendations regarding assessment policies; suggested' this item be placed on the March Worksession Agenda. . Councilrnember Growe expressed concern ~elative to the newly-created Program Supervisor position; indicated she would like to review job descriptions for the new position and the current Park Director position as relates to overlapping tasks and general comparison purposes, PRODP~ SUPERVIsnR POSITION; PARK DIR. EVALUATION Mayor Sather reported on his recent discussion with Park Director Buckley as relates to his use of personal time as a salaried employee, in conjunction with the complaint received and communication to staff of his time away from the office whether personal or business. Sather explained that Buckley was notified the Council has imposed a 90 day probationary period and he has agreed to document his activities and prepare a time sheet for a 90 day period. The Mayor advised he would prepare a statement of facts and actions for retention in the Park Director's personnel file. Councilmember Hansen noted that some activities relative to the Park Director's position are seasonal and the 90 day period may not reflect all areas of the job description. Council agreed the data submitted will be reviewed after 90 days and it will be determined if the reporting period will be extended. Council concurred that Mayor Sather will draft a letter for retention in Buckley's personnel file regarding use of time, communication to staff when away from the office, use of City vehicles on personal time and requiring a written time sheet for a 90 day period, Council further agreed to schedule a performance appraisal for the Park Director and discuss a policy for use of personal time for salaried employees. . Council further concurred to schedule a review of the newly-created position job description with Park Director Buckley and to postpone the date of hire for the new position until April 1. . . , Minutes of the Arden Hills Council Worksession, January 22, 1990 Page 4 REPORT; LJVFD PENSION BD. MTG. Councilmember Malone reported on the LJVFD Pension Board meeting held 1-13-90 and submitted a report dated 1-20-90 summarizing the business conducted at the meeting. Malone also submitted a memorandum dated 1-20-90 listing LJVFD equipment and identifying ownership of the vehicles.
