HomeMy WebLinkAbout289 STATE OF MINNESOTA . COUNTY OF RAMSEY CITY OF ARDEN HILLS ORDINANCE NO. 289 AN ORDINANCE RELATING TO RESIDENTIAL RECYCLING FEES. The Arden Hills City Council hereby ordains that Article IV, Sections 11-31 of the Arden Hills City Code is hereby amended to read as follows: IV. Residential Recycling Service Fee. 11-31. Imposition of Fee. Except as herein provided, a residential recycling service fee is hereby imposed on the owners of all residentially occupied property within the City. The owners of multiple family dwellings and the owner of the manufactured home park may be exempt from such fee upon furnishing proof, in a manner satisfactory to the City Administrator, that such owners have contracted for the collection of recyclable materials. Proof of such alternate service shall be submitted no later than July 15, 1992, and shall indicate that a contract has been entered into for the succeeding calendar year. The total number of residential dwelling units less the total number of exempt residential dwelling uni ts, shall hereinafter be referred to as the total number of assessable residential dwelling units. . Effective Date. This ordinance shall become effective on July 29, 1992 . Adoption Date. (672) 228•1753 June 25, 1992 Catherine Iago City Administrator City of Arden Hills 1450 West Highway 96 Arden Hills, MN 55112 RE: Residential Recycling Fee Proposed Ordinance Amendment Our File No.: 10450/900002 Cathy: It has corne to my attention that I may have incorrectly drafted a portion of the Ordinance which was recently adopted by the City relating to the Residential Recycling Fee. The Ordinance as originally prepared and as adopted includes a statement which seems to prohibit the City's recycling contractor from bidding on contracts to collect recyclable materials from multiple family dwellings or from the manufactured home park. This was not my intent. I am not sure if it was the intent of the City Council. I am enclosing a proposed amendment to the Ordinance which would correct the error by eliminating the last portion of the second sentence of Section 11-31. Prior to this proposed amendment, that sentence read as follows: The owners of multiple family dwellings and the owner of the manufactured home park may be exempt from such fee upon furnishing proof, in a manner satisfactory to the City Administrator, that such owners have contracted for a collection of recyclable materials by a collector other than the City designated collector. If the City's designated collector is also the contractor for the collection of recyclable materials from multiple family dwellings and/or from the manufactured home park, we should ensure that there are sufficient reporting procedures to enable the City to verify that the tonnage collected from multiple family dwellings andJor from the manufactured home park are not included in the tonnage slip submitted to the City for reimbursement pursuant to the City's contract.
