HomeMy WebLinkAbout288 STATE OF MINNESOTA . COUNTY OF RAMSEY CITY OF ARDEN HILLS ORDINANCE NO. 288 AN ORDINANCE ESTABLISHING A CITYWIDE DEVELOPMENT MORATORIUM. The Arden Hills City Council ordains that Section XIV(B) is hereby added to Appendix A of the Arden Hills City Code to read as follows: Section B. Citywide Development Moratorium l. The City of Arden Hills is conducting studies and will hold public hearings for the purpose of considering comprehensive amendments to its zoning regulations. 2. Pending the completion of public hearings and the adoption of amendments to its zoning regulations, the Arden Hills City Council has determined that it would be in the public's interest to impose a Development Moratorium on all property within the City of Arden Hills. 3. There is hereby imposed a Development Moratorium pursuant . to the revisions of MS 462.355, Subd. 4, on all property within the City of Arden Hills. During the period of the Moratorium, the development of property shall be restricted as follows: a. property shall not be subdivided. b. new structures shall not be constructed on property. c. building additions to existing structures and expansions of existing uses on property shall not be allowed unless the addition or expansion is in compliance with the proposed amendments to the City's zoning regulations as determined by the City Council. d. a construction activity within an existing structure, which would not otherwise require City Council review, will be allowed provided that such improvements are undertaken in compliance with the current zoning regulations and the proposed amendments thereto. 4. The City has the authority to halt development until it completes its review of the zoning regulations. In order to implement a development moratorium, it would be necessary for the City to adopt an Ordinance which specifies that the City is conducting studies and/or is scheduling public hearings to consider amendments to its comprehensive plan or official controls and that a development moratorium is necessary in order to protect the planning process and the health, safety and welfare of ' the citizens of the City of Arden Hills. The Ordinance may halt development for one year and may be extended for up to eighteen additional months. ~ The Ordinance would become effective following the date of publication. However, the Ordinance cannot delay subdivi.sions which preliminary approval has been given prior to the effective date of the znterim Ordinance.
