The Arden Hills City Council hereby ordains that Article III, Sections ll-22 to ll-25 and their subdivisions are hereby added to the Arden Hills City Code to read as follows: III. Unauthorized Collection of Recyclable Materials. 11-22. Purpose. The City of Arden Hills has contracted with a service provider for the collection of recyclable materials and has otherwise implemented a recycling program within the City. The City's ability to maintain favorable contracts depends, in part, upon the volume of recyclable materials which are placed on curbside by Arden Hills residents. The unauthorized collection or "scavenging" of recyclable materials will reduce the volume available for collection as part of the designated recycling program. Scavenging also causes confusion among participating residents and thereby disrupts the publicity and educational processes of an authorized program. The purpose of this article is . to ensure that a designated recycling program will be implemented in an orderly fashion to avoid adverse effects on the public health, welfare, safety and environment. 11-23. Definitions. (a) "Authorized or Designated Recycling Program" shall mean a program for the collection and recycling of the recyclable materials which is instituted, sponsored and/or approved by the City of Arden Hills. (b) "Recyclable Materials" shall mean items of refuse which are part of an authorized recycling program of which are intended for transportation, processing, and manufacturing or re-use, including but not limited to, paper, glass, aluminum, and other metal cans and containers. (c) "Scavenging" shall mean the unauthorized collection of recyclable materials that have been set out by residents of the City specifically for collection as part of an authorized or designated recycling program. 11-24. Ownership. Ownership of recyclable materials set out for the purpose of participating in a curbside recycling program shall remain in the person or household from which the materials . originated until collected by an authorized collector. It shall be unlawful for any person who is not authorized by the City to take or collect recyclable materials set out for an authorized or designated recycling program within the City. Effective Date. This ordinance shall become effective on 10th day of June, 1992 . Adoption Date. The Arden Hills City Council approved a recycling fee ordinance last week which puts the charge on residents' property tax bills. Tfie fee is necessary since the county stopped reimbursing the city for its recycling hauling chatges last year, said Arden Hills City Accountant Terrance Post. The council also approved an ordinance prohibiGng the scavenging of recyclables.
