RESOLUTION NO. 75-47

RESOLUTION DENYING ON SALE AND OFF SALE
LIQUOR LICENSE APPLICATIONS OF MMIR, INC.
WHEREAS, MMIR, Inc., a Minnesota corporation, has
made application to the City Councl I of the City of Arden Hi I Is
for the Issuance of Sunday On Sale, On Sale, and Off Sale
Intoxicating Liquor Licenses for premises on which said
corporation controls and operates a bar, restaurant and motel,
known as "McGuire's and located at 1201 West County Road E,
Arden Hills, Minnesota 55112, said licenses to be for a term
of one year from the first day of January, 1976, and
WHEREAS, the Applications and Certifications for
said Intoxicating Liquor Licenses which MMIR, Inc. has filed
with the City of Arden Hills have been properly completed and
executed, and the surety bonds accompanying the same meet the
requirements of Section 3, Subdivision 3 of Ordinance No. 92
an~ are properly executed, and
WHEREAS, MMIR, inc. has disclosed in said Applications
that it has not paid real estate taxes and Installments of special
assessments due and payable In the year 1975 against the premises
for which It seeks said Intoxicating Liquor Licenses, and
WHEREAS, Section 7, Subdivision 2 of Ordinance No. 92
provides that no Intoxicating Liquor License shall be granted
for operation on any premises on which taxes, assessments or
other financial claims of the City of Arden Hills are delinquent
and unpaid, and
WHEREAS, MMIR, Inc. has offered to pay directly to the
City the City's portion of 1975 real estate taxes due against
the subject premises, and in addition installments of special
assessments payable therewith, in order to comply with the afore-
said requirement in Section 7, Subdivision 2 of Ordinance No. 92,

WHEREAS, Section 276.02 of Minnesota Statutes, as
amended, provides that taxes levied by the various taxing districts
In a county shal I be collected exclusively by the treasurer of
such county, and

WHEREAS, although the City Council of the City of
Arden Hills desires to see "McGuire's" bar, restaurant and
motel operation continue as a viable enterprise, the City Counci I
is constrained to comply with its own Ordinance requirements and
the statutory requirements of the State of Minnesota,
NOW, THEREFORE, BE IT HEREBY RESOLVED, by the City
Council of the City of Arden Hills, a quorum thereof beIng

present, .that the aforesaid offer of MMIR, Inc. to pay directly
to the City of Arden Hills, the City's portion of the delinquent
real estate taxes and installments of special assessments due
in the year 1975 against the subject premises is hereby rejected.
BE IT FURTHER RESOLVED, that MMIR, Inc.'s Applications
for Sunday On Sale, On Sale and Off Sale Intoxicating Liquor
Licenses are hereby denied. .
