RESOLUTION NO. 7.1"-.51

RESOLUTION INITIATING VACATION OF PORTION
OF CONNELLY AVENUE PURSUANT TO SECTION
412.851 OF MINNESOTA STATUTES, AS AMENDED
WHEREAS, Section 412.851 of Minnesota Statutes,
as amended, permits a municipal council to initiate a
proceeding to vacate any street, alley, public grounds,
public way, or any part thereof, and
WHEREAS, the City Council of the City of
Arden Hills desires to determine whether it would be in
the public interest to vacate that portion of Connelly
Avenue (and the cul-de-sac at the end thereof) which runs
in a northwesterly direction from the west right-of-way
line of that portion of Connelly Avenue which intersects
with and is perpendicular to County Road E and in addition
to vacate a portion of the cul-de-sac at the end of that
portion of Connelly Avenue which runs in a southeasterly
direction from that portion thereof which intersects and
is perpendicular to County Road E,
NOW, THEREFORE, BE IT RESOLVED, by the City
Council of the City of Arden Hills, a quorum thereof being
present,/~h~~oceeding pursuant to Section 412.851 of
Minnesota Statutes, as amended, be and it hereby is
initiated in order to determine whether it would be in the
public interest to vacate those portions of Connelly Avenue
generally described in the second recital hereof.
BE IT FURTHER RESOLVED, that the City Engineer
be and he hereby is authorized and directed forthwith to
prepare the necessary legal descriptions of those portions
of Connelly Avenue which the City Council desires to
determine would be in the public interest to vacate.

BE IT FURTHER RESOLVED, that the Clerk-Administrator
and the City Attorney, after the City Attorney's receipt of
the aforesaid legal descriptions from the City Engineer, be
and they hereby are authorized to cause a notice of a public
hearing to determine the public interest in said vacation
to be published in the New Brighton Bulletin and to be posted
in at least three (3) of the most public places in the City,
for at least two (2) weeks prior to the date of said public
hearing, all in accordance with the provisions of Section
412.851 of Minnesota Statutes, as amended.
BE IT FURTHER RESOLVED, that the Clerk-Administrator
be and she hereby is authorized and directed to cause
certified copies of this Resolution to be served upon those

owners of properties abutting those portions of Connelly
Avenue which the City Council desires to determine would
be in the public interest to vacate.

Arden Hills this 25th day of August, 1975.
