Minnesota. was duly held in the City Ball. 1450 West Biqhway 96. in ..id city on Monday. the 21st day of April. 1975. at 8:00 o'clock p. m. The following r.tembers were present: Crepeau,Crichton, Feyerelsen, Wingert, woodburn and the following' were absent: None Councilman Crichton introduced the following resolution and moved its adoption: RESOLUTION 1:ro. ~O RESOLT1l'ION RELATING TO NURSERY BILL PLAT IMPROVEMENT OF 1974 DECLARING COST TO B3 ASSESSED AND ORDERING PREPARATION OF PROPOSED ASSESSMENT WHEREAS pursuant to M.S. 429.031, Subd. 3. the owner of the real property abutting proposed NUrsery Lane and the platting' of the following described property: The south four-tenths of the Southwest Quarter of the Northwest Quarter of the Northeast Quarter of Section 22. Township 30. Range 23 except tho North 95 feet of the West one-third thereof, also except the south one foot thereof subject to easements over the west thirty-three feet thereof for Hamline J\venue, and . the east two-thirds of the Southwest Quarter of the North six-tenths of the Southwest Quarter of the Northwest Quarter of the Northeast Quarter of Section 22. Township 30. Range 23. subject to easements of record. if any. (Also known as NUrsery Hill Plat) . petitioned the Council for approval of the plat and the con- struction of sanitary sewer. watermain and street construction in connection with said plat and to assess the entire cost against the property included in said plat as above described and WHEREAS the Council, without a public feasibility hearing. based on said petition and pursuant to M. S. 429.031, Subd. 3. did ascertain said facts and ordered the improvement and the platting of said property in connection with said improvement and WHEREAS said platting and the construction of said improve- ment was with the petition and consent of all of the owners of the property therein, and WHEREAS pursuant to the petition and consent of all of said owners, contracts have been let for Nursery Hill Plat Improve- ment of 1974 by the City of Arden Hills in the area above de- scribed and the contract price awarded for said improvement was $36,700 and other expenses incurred or to be incurred in the making of said improvement amount to $10.002, and WHEREAS pursuant to M. S. 429.051 the city may reimburse itself for all or any portion of the cost of certain improvements previously made in connection with Consolidated Sanitary Sewer Improvements Nos. 12 and 13 upon the properties described herein put which had not previously been assessed for said Consolidated Sanitary Sewer Improvements Nos. 12 and 13, and the cost of $1,311,30 of said improvements is now to be included as a portion of the cost of said ~Tursery Hill Plat Improvement of 1974 SO that the total cost of said improvement will be $48,013,30 which is to be assessed, and of this cost the city will pay $ - 0 - as its share of th~ cost, NOW THEREFORE BE IT RESOLVED by the city c01Jn<::i.l of the City of Arden Hills, Minnesota as follows: 1. The cost of such improvement to be specially assessed is hereby declared to be $48,013.'0 which includes Sl,3ll.30 as the cost of improvements previously made but not assessed. . The City Clerk Administrator, together with the assistance of the City consulting engineer and fiscal consultant, shall forthwith calculate the proper amount to be specially assessed . for such improvement against eve~y assessable lot, piece or parcel of land within the district affected, without regard ~o cash valuation. as provided by law, and she shall file a copy of such proposed assessment in her office for public inspection. The city Clerk Administrator may arrange for the assistance of Data Processing of the county of Ramsey in the preparation of the proposed assessment roll. 3. The City Clerk Administrator shall, upon completion of such proposed assessment, notify the Council thereof for th~ir further action and for their setting of an assessment hearing therefor. The motion for the adoption of the foregoing resolution was duly seconded by Councilman WinQArt , and upon vote being taken thereon, the following voted in favor "-hereof: Crepeau, Crichton, Feyereisen, Wingert, Woodburn and the following voted against the same: None Whereupon said resolution was declared duly passed and adopted. /?~ .
