Chair Sand called the meeting to order at 7:08 p.m.

HELD ON JULY 6. 2005.
Commissioner Larson moved, seconded by Commissioner Thompson to approve the July
e 6, 2005 minutes as amended.

A. PLANNING CASE 05-18: WILLIAM MITCHELL, 3568 RIDGEWOOD COURT,
ARDEN HILLS, MN 55112; MINOR SUBDIVISION AND LOT
CONSOLIDATION
ML Hellegers stated applicant was requesting a Minor Subdivision and Lot Consolidation. He
reviewed his analysis and recommended the Commission approve the Minor Subdivision/Lot
Consolidation William Mitchell, after making a finding that the proposed subdivision meets City
standards and will not have an adverse impact on the surrounding properties or on the
eommunity as a whole; subject to the following condition:
L Rccording with Ramsey County, The applicant shall file the minor subdivision and
lot consolidation with the Ramsey County recorder and shall provide the city with a
e recorded copy.
Commissioner Larson asked why the lot was divided in this manner because it created a diffieult
property description whereas if it was cut in half there would be an easier property description.

Mr. Hellegers replied this was done because of the driveway location and to preserve the site
line. .
Chair Saud asked if there was anything in the topography itself that ereated this triangle. He
asked ifthere were trees in the site line, so the trees could be taken down to improve the site line.
Mr. Hellegers responded the owner of these properties was looking to sell and would sell this as
one lot and the owner to the north would enjoy the same site line. In terms of existing
topography, the area to the west had a steep slope with retaining walls on the south comer. He
noted currently as the property sits, the way the subdivision was configured would create a lot
more spaee for the house to the north and leave plenty of space for Mr. Mitchell's property.
Also, because of the subdivision adding space the house to the north would go from
nonconforming to having plenty of a setback cushion.
Commissioner McClung asked if there was anything in the Code to handle this issue
administratively because it was a minor issue. Mr. Hellegers stated there was not
Commissioner McClung suggested they discuss at some future point issues sueh as this being
approved administratively instead of having to come to the Phnming Commission and Council.
Commissioner Larson moved, seconded by Commissioner Modesette to approve Planning Case
#05-18, William Mitchell, 3568 Ridgewood Court, Minor Subdivision/Lot Consolidation, along
with moving the finding that the proposed subdivision meets the City standards and will not have
an adverse impact on the surrounding properties or the community as a whole, and subject to the
condition as noted in staff s August 3, 2005 report. e
The motion carried unanimously (5-0).

All of the proposed lots would meet the minimum area for lots in the R-2: Single and Two
Family Residential Zoning District
. Preliminarv Plat Review
1. Lots. Lots 1,2, and 3 exceed code rcquirements in terms oflot width, depth, and area
with the exception of the rear dimension of Lot 3 and thc depth at the point of triangular
Lot I.
2. Minimum Lot Depth. The Zoning Ordinance in Section Y, F, 3, states that the
minimum lot dcpth in the R-2: Single and Two Family Residential Zoning District shall
be at least 120 feet The depth of Lot I is 0 feet at the point of this triangular Jot
However, this difference can be attributed to the City Code contemplating mostly
rectangular lots for requircd dimensions, those standard requircd dimensions eause
triangular lots to require variances.

3. Minimum Lot Width. The Zoning Ordinance in Section Y, F, 3, states that the

. be at least 85 feet The rear of Lot 3 narrows to 47.96 feet with a frontage of22533 feet
However with the lots shaped this way thc property lines are perpendicular to Thorn
Drive which would make thc building cnvelopcs more consistent with the typical
arrangement of propcrty throughout the City.

4. Setbacks. It appcars that all of the lots will have adcquate space to construct within the
eonfines of the City's setback regulations_ The most diftlcult lot from a setback
perspcctive is Lot 1 which has a nanow buildable area due to the triangular configuration
of the lot Setbacks f()r principle buildings are shown on the attached drawings (marked
as SBL [setback line] on the drawing)_
S. Easements. City subdivision regulations rcquire easements at least twelve (12) feet wide
centered on lot lines for utilities and shall be dedicated to the City_ Additionally,
drainage and utility easements are also provided on the plat In particular, the area at the

northeast corner of Lot 3 includes some wetland that is within a drainage and utility
easement. However, it should be noted that the City will not assume responsibility for
. maintenance of these areas. Rather, the easements will allow access if it is ever
necessary to enter these areas.
6. Grading. The property eUITently has a much higher elevation at the western end, near
the tip of proposed Lot 1, and slopes downward to the east. The thirty foot grade change
would likely result in some fill or grading for development of the properties. Grading
would also be evaluated in conjunction with any future building permits for the property.
7. Utilities. Utilities would be brought in to the propel1ies through the drainage and utility
easements. Our Operations and Maintenanec department has noted that the water and
sewer mains will havc to bc tapped to supply service to thc extra lots. TIle developer is
responsible for the cost and installation of utilities to the propeJ1ies. Work on utilities
within the City right-of~way will require approval from the City.s Operations and
Maintenance department.
8. Access I Street Design. The property is served by the existing Thom Drive. New
driveway aecesses would be required for all three properties. Since this is a
ncighborhood street with minimal traffic, the accesses should not be a problem.
9. Park Dedication. Since the property was previously platted as one lot, and the
subdivision of the property would create three lots, park dedication would be required.
The City Codc discusses subdivision ohesidential properties of two to three units per
. acre at a park dedication figure of approximately 7% of the filir market value of the
property. A condition is included in the recommendation requiring the applicant to
satisfy the park dedication requirement as approved by the City Council.
10. Existing Structures. The existing housc, garage, and drivcway would need to be
removed or demolished prior to any new development of the property. Demolition work
would require the issuance of a City Demolition Permit.
11. Subdivision Variances. ll1e Subdivision chapter of the City Code allows the City
Council to approve variances from the regulations of that chapter based on a finding that
the following conditions exist:
. The hardship is not a mere ineonvenienee;
. The condition or conditions upon which the request is based are unique and not
generally applieable to other property;
. The granting of a variance will not bc substantially dctrimental to the public welfare
and is in accord with the purposc and intcnt of the chapter, the zoning ordinance and
the comprehensive plan.

In making these findings, the City Council shall consider the naturc of the proposed use
of land and the existing use ofIand in the vicinity, the number of persons to reside or
. work in the proposed subdivision and the probable effect of the proposed snbdivision
upon traffic conditions in the vicinity. In granting a variance as provided in this section,
the Couneil shall prescribe only such conditions that it determines dcsirable or necessary
to the pub lie interest (Scction 1150.01).
12. Additional Plan Review Comments - Plan review comments receivedfrom City staff,
and the City Engineer
A. Our Operations and Maintenance department has noted that the water and sewer
mains will have to be tapped to supply serviee to the extra lots. The dcvelopcr is
responsible for the cost and installation of utilities to the properties. Work on utilities
within the City right-of-way will require approval from the City's Operations and
Maintenance department.
Staff Recommendation
In Planning Case #05-19 staff recommends approval of the Preliminary Plat for the Bryson
Woods development, after making a finding that the proposed variances are not merely
inconveniences, the conditions upon which the variances are based are unique to the property,
and the variances will not be substantially detrimental to the public welfare and are in concert
with City regulations; subject to the following conditions:
. A. Recording with Ramsey County. The applicant shall file the Final Plat with the
Ramsey County recorder and shall provide the City with a recorded copy.
B. Compliancc with the City Code. The applicant shall comply with applicable provisions
of the City Code and related ordinanccs.
C. Park Dedication. Satisfaction of thc park dedication rcquirement as approved by the
City Council.
D. Necessary Approvals from Other Agencies. The applicant shall obtain all necessary
permits from the Riee Creek Watershed District, Ramsey County, the State of Minnesota
Departmcnt of Natural Resources and any other governing agencies where applicable.

3. Recommend denial with reasons for denial. If the City denies the petitioners request,
"...it must state in writing the reasons for the denial at the time it denies the request!'

The City of Arden Hills received the completed application for this request on August 8, 2005
Pursuant to Minnesota State Statue, the City must act on this request by October 7, 2005 (60
. days), unless the city provides the petitioner with written reasons for and additional 60 day
review period. The City may with the petitioners' consent extcnd the review period beyond the
120 days.

Wetland Conservation Act I
Replacement Plan Application Processing
Note that the processing of wetland replacement plan applications operates separately from the Rice
Creek Watershed District permit processing due to State regulations. Projects requiring the approval of
a wetland replacement plan applieation will generaJly require more time for processing due to the
notieing requirements. Applicants are strongly encouraged to submit wetland delineation reports prior
to applying for a permit Permit application proeessing delays can occur if wetland delineations are not
approved prior to submittal. The foJlowing procedures will befoJlowed by the Rice Creek Watershed
District for all applications involving a wetland replacement plan application.
, . Wetland replacement plan applieations will be reviewed for eompleteness and noticed to the
required ageneies within 10 working days of receipt Applicants will be informed within 10
working days if the application is not eomplete enough for proeessing.
. The eomment period for the replacement plan application wiJl run for 20 days after mailing of
the notice unless an extension is granted' due to a request by a member of the Technical
Evaluation Panel or the applicant
. After the comment period ends, the Technieal Evaluation Panel recommendations (if any) will
be incorporated into Engineer's Report for the Rice Creek Watershed District permit
application and will be considered at the next applicable Board of Manager's meeting in
aecordance with the dDistrict's permit processing procedures. I

September 8- Permit Applieation Deadline. All application materials are due to the
District Office by 4:30 pm.
September 16- Draft Engineer's Report with staff recommendation to the District Board
of Managers faxed to applicants and eonsultants.
September 19 - Revised plans and/or additional information aceepted by District
Engineer (Emmons & Olivier Resources) until 5pm at their office for
Engineer's Reports receiving an incomplete status.
September 23- Final Engineer's Report with staffreeommendation to the District
Board of Managers faxed to applicants and eonsultants.
September 28- Board of Managers Meeting for consideration of all permit applications
that are deemed complete by the Engineer's Report.
Notes:
. Engineer's Report will recommend approval, conditional approval pending
~ receipt of changes (CAPROC), denial, or will be deemed incomplete. .
Applications deemed incomplete in the final Engineer's Report before the Board
Meeting will not be considered at that meeting.
. For applications with a CAPROC status following the Board Meeting, Applicants
have 90 days to submit the required non-administrative item(s) and six months to
submit the required administrative items. After this time, the application reverts
to a denial and a new application will need to be submitted.
. For applications involving wetland impacts, the above schedule will not apply
because of noticing requirements of the Milll1esota Wetland Conservation Act
(WCA). Any project application involving a WCA wetland replacement plan will
be considered incomplete until the WCA noticing period is eompleted (see
attached page on Wetland Conservation Aet processing).

This is the detailed description of our intentions and use of 1978 Thom

The plan for this property is to divide the 1.39 acre lot into three
buildable parcels.
On each lot we will be building mid to high end single family homes
approximately $400,000 and above. Providence Homes will be the
builder on this whole project.
. The structure currently on the land will be moved to another location or
demolished.
We will be putting up one spec home and marketing the other two lots
as pre-solds so people are able to come in with their custom plan or
choose one of ours. Spring is currently our target timeframe for
completion of at least one build.

. The applicant is proposing to remove the existing I-car garage and replace it with a slightly
larger I-car garage in approximately the same location,

The existing garage was built both too close to the west (side) property line, Staff advised the
applicant that the side setback for accessory structures will likely change to five feet when the
Zoning Ordinance revisions are contemplated by the Planning Commission and City Council.
The application contemplates placing the new, slightly larger (16 x 26 [416 sf]) garage in
approximately the same location as the previous garage, just shifted slightly to the north to allow
an addition and a deck which are being added to the principal structure. It appears that there
should be the 6 feet of separate that is required by the Firc Codc.
2. Lot Coverage - Meets Code Requirement.
. The requirement for all residential districts is a maximum 01'25%, The principal structure and
detached garage would constitute 20 % lot coverage,
3. Landscape Lot Area ~ Meets Code Requirement,
The requirement for all residential districts is a Minimum Landscape Lot Area of 65%.
Construction of the new garage would leave approximately 89% of the lot as landscape area.
Variance Critcria
A. State Requirements
Minnesota State Statue in Chapter 462.357, Subdivision 6, (2), defines "undue hardship"
as:

property not created by the landowner, and the variance, if granted, will not alter the essential
character of the locality. Economic considerations alone shall not constitute an undue hardship if
. reasonable use of the property exists under the terms of the ordinance","
B. City Requirements
Scction VIII, D, 4, c and d, of the City's Zoning Ordinancc state that,
"Adherence to the provisions of this ordinance is required, except for special cases which arise
because of the configuration of a particular parcel. The condition shall not have been created by
the landowner. A variance or variances may be granted from specific provisions of this ordinance
because such land factors as length of a side of a lot, the shape of the lot or the unusual terrain
prohibit reasonable development equivalent to that which would be permitted without variance on
a similar size lot located in the same district, but which lot has no unusual configuration.
Economic conditions alone shall not be grounds for a variance. In no case shall the granting of a
variance impair the health, safety, comfort and general welfare oftlie public, nor will it bc
contrary to the intent and purpose of the Comprehensive Plan, the official map or this or any other
ordinance ofthc City."
Variance Findin2s
. Minnesota State Stature 462,357, subd. 6, rcquires that Cities consider Ihe following five matters
when hearing requests for zoning ordinance variances.
1. Are the circumstances for which the variance is requested unique to the property?
(YES) A limited number of properties, those properties in the southwest quadrant of
Arden Hills could claim a hardship due to the lot dimensions; most of these lots predate
Arden Hills becoming a City and the creation of Arden lIil1s' zoning, Thc applicant has
a very narrow lot (65 feet wide) which also limits the applicant's ability to relocate the
garage behind the principal structure and still have rcasonable access to the garage and
provides little or no opportunity to attach a garage to the principal structure.
2. Would granting thc variance be in keeping with the spirit and inteut of the City's
Zoning Ordinance?
The stated Purpose and Intent of the City's Zoning Ordinance includes thirteen purposes,
of those the following statements appear to be applicable:

The stated purpose of the R-2 Single and Two Family Residential District is as follows
(Section 5,D,2):
L To establish areas for the development of single and two family housing at a
maximum density of approximately five units per net acre.

5. To take advantage of municipal utilities.

(YES) The variance requested appears to comply with the stated Purpose and Intent of
the City's Zoning Ordinance and of the purpose of the R-2: Single and Two Family
Residential District. Due to the narrow lots which are unique to this small portion of the
City it would not be reasonable to force the property owners to place their garages to
comply with the 10 foot side yard accessory setback and basically sever the rear yard or
to have the locate the garages especially far behind the principal structures, In addition,
principal structures which should be considered a more intense use can be located as
close as 5 feet from the side yard property line.
. 3. Could the property in qucstion be put to a reasonable use without the granting of
the variance?
(NO) The applicant could continue to use the existing garage in its present location;
however, due to the age of the garage replacement would be necessary sometime in the
very near future. Without a variance the applicant would have to place the garage either
in the middle of the back yard or excessively far away from the principal structure, where
the garage would still be in the middle of the back yard. Single and Two-car garages
have consistently been considered reasonable uses if the applicant has no other option
than to apply for a variance for the construction of such a garage, Furthermore, the City
has approved variances for similar variance requests in this neighborhood where the
applicant is replacing an existing garage,
4. Was the hardship created by the owner?
(NO) The small one-car garage appears to be the original garage from when the house
was constructed and predates the City's Zoning Ordinance. In addition, the lot was
created prior to the City's Zoning Ordinance, The structure is small, in poor repair, and

would not accommodate today's vehicle sizes, The proposed garage is still a one-car
garage but would be slightly wider so that this and future property owners would actually
. be able to utilize the garage,
5. Would granting the variance alter the essential character of the neighborhood?
(NO) The new garage would give the property a functional garage that would
accommodate modern vehicles. As previously stated, the surrounding area has many
garages that are already sited five feet from the side property lines or less. The variance
would allow the garage to remain consistent with this neighborhood norm while staying
in tine with where setbacks will likely be changed when the Zoning Ordinance is revised.
Plan Review Comments
A Building Permit Plans shall be submitted to the Building Official a minimum of two (2)
wceks before the planned start of construction,
B. No construction shall begin bcfore plans and Building Permits are approved by the City
of Arden Hills' Building Official.
Staff Recommendation
. In Planning Case 1105-20, staffrccommends that the request for a 5-foot side yard setback
accessory setback variance be approved to allow for the construction of a new garage in
approximately the same location as the existing garage after making the findings that the
variance meets the hardship criteria and would not have an adverse impact on surrounding
properties or the City as a whole.

. Arden Hills Planning Commission,
I'm requesting a variance on the 10ft. limit on placement of a
garage near the property line. The present garage is in serious
disrepair and must be replaced. Currently, it is 5 ft. from the
property line as can be seen on the survey. I would like to site a
new 16 ft. wide by 26 ft. deep garage, 5 ft. from the property line.
At this point I would like to address the conditions of the
property that support my request:
#1) The property is unique in that there are many mature trees
and gardens on the property. At least one of the trees could
threaten the structure if it is sited to closely to it and possibly
jeapordize the tree itself. If the variance is not granted, then the
garage corner closest to this tree would be approx. 22 ft. away.
The tree's canopy is approx. 42 ft. in diameter, so the tree limbs
would come within a foot of the garage and the root system may
be disturbed by the concrete slab for the garage. Also, one
. mature garden bed would be 7 ft. the side of the garage.
#2) The granting of the variance is in keeping with the spirit of
the City's Zoning Code as the placement of the new garage will
not adversly affect the neighboring property because there are
no existing structures in close proximity to it. Also, the
livability and appearance of my property would be enhanced.
#3) It would be difficult to reasonably use the property without
the variance. The rooms at the back of the house are quite
small, therefore, I'm planning on adding a small extension to
make them more liveable for myself and any future families.
Siting the garage without the variance would crowd it to the
house.
#4) The hardship was not created by anything the family has
done. The backyard is only 65 ft. wide, siting a new 16 ft. wide
garage 10 ft. into the property would visually cut the yard in half.
#5) The variance will not alter the character of the
neighborhood. In fact, the variance I'm requesting would
actually be in keeping with the character of the neighborhood as
many of the garages rest well within the 10 ft. requirement.
. This home has been in my family since 1951, so I'm very familiar
u.
. with how the house lives and the positives of the property, such
as the mature trees and gardens, the close-knit neighbors and
the homey feeling of the community. For these and many other
reasons, I'm hoping to make this my new home for many years
to come. This variance would make the property much more
useable for myself, as well as those of future residents.

I've presented in my request.

Considering Adding Ncw Language to the Front Porch Ordinance
RCQuested Action
Discuss and consider Ordinance #366 which would amend section 6.C.2.d of the Zoning
Ordinance by inserting new subsection 6.C.2.d.3 into the Zoning Ordinance, allowing for front
porches of up to ten feet and with a minimum setback of25 feet from the front or side-yard
corner property lines, which mcet design standards to be allowed subject to staffreview and
approval in areas where the plats were created with setbacks less than 40 feet
. Overview
The Planning Commission reviewed thc original Covered Front Porch Ordinance and
recommended approval (5-0) at their March 2, 2005 meeting. Subsequent to the PImming
Commission meeting there were rcvisions made to address thc concerns of the City Council to
create the ordinance in its current formal. The City Council approved to the revised Covered
Front Porch Ordinance at their May 9, 2005 meeting.
Since the language has gone into effect we have had two proposals for covered front porches
under the new language. A third homeowner utilized the additional allowance for uncovered
decks of up to six feet Of the two proposals for covered front porch exceptions, one was just
recently received and has not been processed; the other was for a homc in the Chatham
neighborhood which staff could not approve due to an existing front setback of approximately 33
feet
Under the existing language the resident could have constructed a 3-fi)ot covered front porch but
that would not havc lell much room to work with. The design appeared consistent with other
homes throughout the neighborhood that had originally been constructed with some form of a
front porch. After a windshield survcy of the neighborhood, it became dear that there is demand

for front porches as there were approximately twenty homes that had chairs, benches or other
features outside of the front doors where a front porch might be.
. Staff has published today's meeting as a public hearing in the event that Commissioncrs are
comfortable with the language and would like to have the City Council consider the matter at
their September 26th meeting. In this case the Plarming Commission should take a vote to either
approve or deny draft Ordinance #366 and have the Council reccive such recommendations at
the September 26th mccting. I f Commissioners fcel that addition discussion or review is
ncccssary then this item could be scheduled for a second public hearing at the October 5th
Planning Commission meeting.
If thc Planning Commission is comfortable with Draft Ordinance #366 as is or with certain
changes, staff will forward the ordinance on to the City Council.
Staff Recommendation
Since it was not anlicipated that whole neighborhoods had different setbacks that the Zoning
District standards the idea of a different allowance for covered front porches in such
neighborhoods seems to be fair. Therefore staff rccommends approval of Ordinance #366,

Arden Hills City Planner & Council:
We suggest that Chatham residents have a special provision allowed them regarding the
new front porch ordinance.
Due to the fact that setbacks in the Chatham neighborhood are less than the assumed 40
feet, it is necessary for Chatham residents to have special allowances made in regards to
the setback regulations.
Front porches would add to the quality and socialization of our neighborhood as well as
improving security and the tax base. The porches would follow the design requirements
specified by the city.
In the spirit of the intent of the new porch rules a provision is needed to enable this
opportunity for properties not conforming to the zoning ordinances.

Dear city planner, mayor, and council members,
My family was delighted with the possibility of adding a new covered front porch to our
home as allowed by the new porch ordinance. However, when we applicd for a building
permit we were informed that the Chatham neighborhood has less than the 40 foot
setback required by the building code, and the porch could not be built closer than 30 feet
from the Iront property line.
1 am writing to request that the porch ordinance be revised to allow the 10 foot cxtension
of the porch into the setback allowed when the house was built. The porch would follow
the side setback and design requirements specified by the city.
When the new porch ordinance was adopted 1 believe the intent was to build community
spirit with attractive gathcring places on the street-side of Arden Hills homes. Our
. proposcd porch is attractive, fits the layout and stylc of our neighborhood, and is
welcomed by our ncighbors.

Dear Arden Hills City Council Members:
We are writing you in regards to the front porch ordinance for
homes on non-conforming plotted lots of the Chatham subdivision
with less than 40 feet setbacks.
We feel that there are many positive aspects to allowing for
this provision. First, the adding of front porches benefits our
neighborhood by upgrading our community. All of the homes in
Chatham are approximately 25 years of age and are in need of
upgrades in order to maintain the charm that Arden Hills has been
known for and to keep it a desirable neighborhood and community
for prospective house hunters.
Secondly, there are many homes already existing in Chatham
that have a front overhanging porch, some with even less of a
setback, and we feel that it would not look out of place with the
overall look of the neighborhood.
We support allowing Phil and Joan Kramlinger a building
permit to allow them to add a front porch. Everything that the
. Kramlingers have ever done has been very tasteful and would not
distract from the charm of our neighborhood or our cuI de sac.

In the June issue of the Arden Hills Notes, 1 was interested to read that rules regarding
front porches were being relaxed. The intent, 1 believe, was to provide for flexibility.
However, I've now been made aware that in this particular subdivision (Chatham Circle),
the setbacks from the street are already not in compliance with current ordinances. It
seems the homes in this neighborhood will not be able to take advantage of recent rule
changes.
I am writing to you to encourage you to consider provisions to provide for an exception
to the required setback.

Dear Sirs:
It is our understanding that homes and/or additions in Arden Hills must be set back at
least lorty feet from the street. Most homes in our neighborhood, Chatham, have raised
entry slabs, and many of those homes have roofs built over those slabs. In some cases
there are roofs across the entire front of the home, making small 'porches.' We're sure
these slabs/porches are not set back forty feet as is now required in Arden Hills.
We have lived in Chatham since August 24,1979. Our house has the raised slab, but not
the roof over. We have many times wished our home had a porch in front. Now we
fmd that we cannot, even though many of our neighbors already have a similar porch.
. We really think this is unfair.
We would like to request an exception for the residents of the neighborhood known as
Chatham (Chatham Avenue, McCracken Lane, Chatham Court, Chatham Circle)_ We
would like to see the same rules used just for our neighborhood as were previously (late
1970's) used by the builder, BanCon Homes (now Hans Hagen Homes).

AN ORDINANCE RELATING TO COVERED ,FRONT PORCHES AS PERMITTED
ENCROACHMENTS FOR SINGLE-FAMILY DETACHED DWELLINGS
THE ARDEN HILLS CITY COUNCIL ORDAINS THAT SECTION 6(C)2(a) OF ARDEN
HILLS ORDINANCE 291 IS AMENDED; AND SECTION 6(C)2(d) IS ADDED TO
ARDEN HILLS ORDINANCE 291 TO READ AS FOLLOWS:
Section 6(C)2(a), Parts of the Principal Structure. Features which are part of a principal
structure, including but not limitcd to eaves, cantilevcred areas, cornices, canopies, awnings,
balconies, fire escapes and chimneys, may extend three (3) feet into the required front, side, and
rear setbacks but in no case shall these encroachments be less than six (6) feet from any lot line.
. Decks, uncovered porches, ramps, and steps may extend six (6) feet into the required front, side,
and rear sctbacks but in no case shall these encroachments be less than six (6) feet from any lot
line. Required steps per thc International Codes shall be pennitted cncroachments
Section 6(C)2(d). Covered Porches for Silll!le-Fami1v Detached Dwellin2s.
1. In requircd single-family residential front yard setbacks, covered porches attached to the
principal structure may extend no more than 10 feet into the required front setback;
provided that; the porch is no closer than 30 feet from the front lot line (excluding
required steps per the International Rcsidential Code), the porch complies with the side
yard interior setbacks, the design ofthc porch is consistent with the City's Porch Design
Guidelines, and the porch has been approved by the Community Development Director
or Development Director's designee. TIle Community Development Director or
Development Director's designee must make the following Ijndings to approve a porch
encroachmcnt of up to 10 feet:
(a) The exterior materials of the proposed porch are consistent or complementary in
color, texture, and quality with those visiblc at the front of the dwelling;
(b) The roof of the proposed porch is properly proportioned to and integrated with the
roof of the dwelling and has no less than a 3/12 slope;

(c) The base of the porch is not opcn; the base shall be either a masonry perimeter
. foundation (note: frost footings will be required for a building permit), or be
s~Teened by a solid fascia consistent with the front of the home or lattice with
openings no larger than 2 inches x 2 inches and painted to be consistent with the
front of the home.
(d) At least sixty five (65) percent of the exposed porch fayade (excluding the
foundation) is open or occupied by screens and/or screen doors; and the fayade
constitutes the area from the floor level of the porch to the porch ceiling; up to
thirty five (35) percent ofthc fayadc may be solid and may only be occupied by
columns, spindles, and railings; solid walls (even partial) are prohibited,
(e) Building Permits shall be required bcfore construction can begin.
2, In required single-family rcsidential side-yard corner setbacks, covered porches attached
to the front of a principal building facing the side yard corner setback may extend no
more than ten (10) feet into the required side-yard corncr setback, provided that; the
porch is no eloser than thiliy (30) fcct from thc side-yard comer lot line (exeluding
required steps per the International Residential Code), that the design of the porch is
consistent with the City's Porch Design Guidelines, and the porch has approved by thc
Community Dcvelopment Director or Development Director's designce. The
Community Dcvelopment Director or Development Director's designee must make the
findings requircd by Section 6.C.2.d.l, letters (a)-(e) as listed above in ordcr to approve a
. porch encroachment of up to ten (10) feet.
Effcctive Date. This Ordinance shall becomc cffcctive the 19th day of May, 2005.
Adoption Datc. Passed by the City Council of the City of Arden Hills the 9th day of
May, 2005.

RESOLUTION AMENDING APPENDIX A OF ZONING ORDINANCE NO. 291 TO

ENCROACHMENTS INTO FRONT AND SIDE YARD CORNER SETBACKS
WHEREAS: Arden Hills has adopted new regulations allowing front porches in front
and side-yard corner setback areas subject to certain conditions.
WHEREAS: These regulations include a specific procedure and design guidelines for
porches proposed to encroach in the front yard or side-yard corner setback
areas up ten feet but in no case leaving a setback of less than thirty feet from the
porch to the property lines.
NOW THEREFORE BE IT RESOLVED: That the Council of the City of Arden Hills
. directs staff to include in Zoning Ordinance No. 291, Appendix A, the design guidelines
and application procedure for porches which encroach into the front and side-yard
corner setback areas.

A. CITY REVIEW PROCEDURE
L Applicant reviews proposal with City Planner before plans are finalized.
2. Applicant submits application and submission documents to the City.
3. Community Development Director or their designee reviews application and
rcview the findings to detennine compliance with City rcgulations
4. The Community Development Dircctor or their designee provides a written
review of application to the City Building Official and the applicant.
5. If the Community Development Director or their designcc has approved the
porch addition the applicant may submit an application for a building permit.
B. SUBMISSION REOUlREMENTS
WRITTEN STATEMENT
L The applicant shall provide a written dcscription of the proposed covered front porch
encroachment including; the general style and form of the porch, roof materials,
exterior wall materials, floors and interior materials, ceiling materials, colwnn
. materials, spindle and railing materials, and base materials, to provide an accurate
description of the proposed covered front porch encroachment and demonstratc
compliance with the City's covered porch encroachment design guidelines.

SURVEY:
'lbe applicant shall provide the City with a survey showing the property lines, existing setbacks and
proposed setbacks so that City staff may detennine i I' the proposed covered porch encroachmcnt is
compliant with City Covered Front Porch Encroachment Design Guidelines and Zoning Ordinance
Regulations. Surveys shall include the following:
1. The date, north point, map scale, name and addrcss of the applicant, owner,
operator, surveyor, engineer and designer, including thcir license nwnbers and seals;
2. A correct boundary survey and legal dcscription of thc subject property made and
certified to by a registered Land Surveyor indicating total acreage of site;
3. Depiction of all watercourses, lakes, marshes, wooded areas, rock outcrops, power
transportation poles and lines, gas Iincs, single trces with a diameter of eight (8)

4. Delineation of topography of subject property with contour intervals of not more
than two (2) fcct and supplemental of one (I) foot in extremely flat areas, the data

5. The location, right-of-way width, dimensions and names of existing or dedicated
streets or other public lands, permanent buildings and structures, easements, section
and corporate Jines within the subject property and wjthin a distance of onc hundred
(100) feet from thc property boundaries;
6. Descriptions, reference ties and elevations of all benchmarks;
7. Location of all monuments existing at thc time of the survey, and those which the
surveyor shaH havc located at the comers of the subject property;
8. Rcfcrcnce to and relations of municipal, township, county or section lines to lines of
the subject property by distances, anglcs, radii, internal angles, points and
curvatures, tangent bearings and lengths of all arcs; and
9. Boundary lincs of adjoining property within one hundred (100) fect, idcntifying
owners.

C. COVERED FRONT PORCH DESIGN GUIDEl.INES
. The follO\ving are general design guidelines and criteria that will help you in the planning, design, and constmction of your
porch addition. Porches that encroach into the front or side-yard comer setback areas shall he required to meet the following
design guidelines and shall require approval of the Community Development Director or their designee prior to any building
pcmlits being issued (per Section Cl.C.2.d of the Zoning Ordinance).
General Form
The fonn of your porch addition is the outcr shape created by the exterior walls and roof. The form
of thc addition should be appropriate and compatiblc to the form of your existing home.
Base of the Porch
Thc base of the porch is not open, the base shall be either a masonry perimeter foundation, providing
for proper drainage; or bc screened by a solid tascia consistcnt with the front of the home or lattice
with openings no larger than 2 inchcs by 2 inches and painted to be consistent with the front of the
home,
Ceiljngs
Open-air porches must have ceilings of durable grade materials such as beadboard or painted or
stained wood.
Columns
Structural columns should be clad in finish grade, wood trim or be a decorative shape that is
compatible with the design of the existing house, The columns should be expressed on the exterior of

Floors
Open-air porches must have 1100rs of durable exterior grade materials such as concrete, painted or
stained solid wood, high quality composite materials, or brick.
Railings
The height and spacing of railing must meet the requirements of the International Building Code.
Acceptable railing materials are painted or staincd wood, high quality composite materials, and
painted metal. The design ofthc railing assembly should be compatible with the details of the
existing house.
Roofs
The roof or your porch addition should be properly proportioned in shape and pitch to the rooflincs of
the existing house, Roofing materials should match as closely as possible to tbe materials of the
exis.ting home.
Landscaping
Integrating your porch addition into your yard is as important as its integration to your house, Plant
materials and landscape features should transition the porch into your yard, providing a visual hase.

FRONT PORCHES AS PERMITTED ENCROACHMENTS FOR SINGLE-FAMILY
DETACHED DWELLINGS
THE ARDEN HILLS CITY COUNCIL ORDAINS THAT SECTION 6(C)2(d)3 IS
ADDED and SECTION 6(C)2(d) OF ARDEN HILLS ORDINANCE 291 IS AMENDED
TO READ AS FOLLOWS:
Section 6(C)2(d), Covered Porches for Sin21e-Fami1v Detached Dwcllin2s.
. 1. In rcquired single-family residential front yard setbacks, covered porches attached to the
principal structure may extend no more than 10 feet into the required front setback;
provided that; the porch is no closer than 30 feet from the front lot line (excluding
required steps per the 1ntcrnational Residenlial Code), the porch complies with the side
yard interior setbacks, the design of the porch is consistent with the City's Porch Design
Guidelines, and the porch has been approved by the Community Development Director
or Developmcnt Director's designee. The Community Development Director or
Developmcnt Director's designee must make the following findings to approve a porch
encroachment of up to 10 feet:
(a) The exterior materials of the proposed porch are consistent or complementary in
color, texture, and quality with those visible at the front of the dwelling;
(b) The roof ofthc proposed porch is properly proportioned to and integrated with the
roof of the dwelling and has no less than a 3/12 slope;
(c) Thc base of the porch is not open; the base shall be either a masonry pcrimcter
foundation (note: frost footings will be required for a building permit), or be
screened by a solid fascia consistent with the front of the home or lattice with
openings no larger than 2 inches x 2 inches and painted to be consistent with the
front of the home.

(d) At least sixty five (65) percent of the exposed porch fayade (cxcluding the
. foundation) is open or occupied by screens and/or scrccn doors; and the fayade
constitutes the area from the floor level of the porch to the porch ceiling; up to
thirty five (35) perccnt of the fayade may be solid and may only be occupied by
columns, spindles, and railings; solid walls (even partial) are prohibited.
(e) Building Permits shall be required bcfore construction can begin.
2. In required single-family residential side-yard comer setbacks, covered porches attached
to the front of a principal building facing thc side yard comer setback may extend no
more than ten (10) feet into the required side-yard comer setback, provided that; thc
porch is no closcr than thirty (30) feet from the side-yard corner lot linc (cxcluding
required stcps per the Intemational Residential Code), that the dcsign of the porch is
consistent with the City's Porch Design Guidelincs, and the porch has approved by the
Community Development Director or Development Director's designee. Thc
Community Devclopmcnt Director or Development Director's designee must make the
findings requircd by Section 6.C.2.d.1, letters (a)-( e) as listed abovc in order to approve a
porch encroachment of up to ten (10) feet.
