Case 05-19: Brvson Woods, 1978 Thorn Drive - Final Plat . Mr. Johnson stated Richard Kotoski and Kim Bryson d/b/a Bryson Woods have submitted the Final Plat for the subdivision of the property at 1978 Thorn Drive. The property, originally platted as Lot #20 under the Rholdeder's Home and Garden Acres Plat of ] 938, into three single-family lots. All of the property lots comply with the minimum lot areas for the R-2: Single and Two Family Residential Zoning District. Mr. Johnson reviewed the Final Plat and recommended after making a finding that the proposed plat is consistent with previous approvalsJor Plat and is subjcct to the following conditions: A. Recording at Ramsey County. The developer shall Ramsey County Recorder and provide the City with a B. Compliance with City Code. Commissioner Larson stated on Lot I at the last meeting, they had requested the house being proposed have no variances. He asked if this was what the proposal was. Mr. Richard Kotoski, applicant, responded the south boundary was considered the back of the lot and the house shown would fit within thc sctbacks and no variances would be requested. Commissioner McClung asked if the existing structure could be removed as a part ofthe conditions of approval. Mr. Kotoski responded they would prefer it not being rcquired to be removed prior to the building pem1its being issued. Chair Sand asked whcn they would be starting construction. Mr. Kotoski responded the Final Plat would be filed first. Commissioner Larson moved, seconded by Commissioner Thompson to recommend approval of Planning Case No. 05-19, Bryson Woods, 1978 Thorn Drive, Final Plat after finding the proposed plat is consistent with previous approvals for the Preliminary Plat and subject to the six conditions as outlined in 2, 2005 report, modifying condition E. to read: Removal of is required to remove the existing structures prior to the City's permit, unless a surety is posted with the City to ensure removal a reasonable timeframe. Background 1. Overview of Request: The applicants own a 2.37 acre property at 4038 Valentine Court that was consolidated under one tax identification number from an original three platted lot. The applicant is requesting that the property be subdivided back into three properties with one modification to the original plat that would shift the proposed lot line between Lot A and Lot B ten feet to the south. Subdivision Ordinance - Meets Requirement with proposed conditions Section 1150.04 of the City Code lists the requirements for subdividing and/or consolidating previously platted property. Requirements that must be evaluated listed under Scction 1 ] 50.04 include I. Survey: A survey showing the existing and proposed lots, 2. Zoning Compliance: The parccls or tracts rcsulting from thc division or consolidation, as depicted in the surveyor registered land survey, shall not have an arca, dimensions or setbacks which are less than the minimum requirements specified for the zoning district in which the parcels or tracts are located in the zoning ordinance. 3. Public W clfarc: It is determined that the proposed division or consolidation will not be dctrimental to the public welfare or injurious to adjacent tracts in the area in which the subdivision tract is located. Conformity with the rest of the Subdivision Ordinance: The proposed division or consolidation shall confoIDl to all requirements of the subdivision Ordinance unless . given an exemption by the Planning Commission and City Council. 5. Fees: All filing fees must be paid. Staff has reviewed these criteria and offers thc following findings offact: 1. The submitted survey was prepared by a registered land surveyor and meets City requirements. 2. As noted above, the proposed lots meet all requirements ofthc underlying R-l Zone. 3. The proposed subdivision is unlikely to have any negative affect on the public welfare. The proposed lots are comparable to and compatible with neighboring lots within the subdivision. Moreover, if dwcllings are constructed on the lots, they will contribute to thc local tax base without significantly taxing the existing infrastructurc. 4. The applicant has not met all the applicable requirements of the Subdivision Ordinance. The Subdivision Ordinance requircs a twelve foot utility easement centered on fear and other lot lines (Section 1130.05 Subd. 1.). A condition has been included to resolve this minor issue. All other provisions of the Subdivision Ordinance are met. The proposed lots havc access to a public road, have adcquate buildable areas, and meet the requirements of the R-l Zone. 5. All required application fees have been paid. This subdivision does result in the creation of two new residential lot. Under Section 1130.08 of the Subdivision Ordinance, the park dedication fee would apply to this case. The Recreation and . Conservation portion (Subd. 2) requires that all subdivisions dedicate a portion of their land for recreation and conservation purposes or, as deemed comparable value by thc City Council, pay a park dedication fee in place of a land dcdication. Although the applicant is not proposing a land dedication, a subdivision resulting in one new residcntiallot would require a land dedication of six percent, which would be .14 acres or about 6,194 square feet. Given thc small size of the potential land dedication and the availability of other ncarby park facilities, a park dcdication fee may be more appropriate then a land dcdication. In lieu of the land dedication, the City Council may require the applicant to pay, as an equivalent contribution, an amount in cash equal to the percentage of the land required to bc dedicated, multiplied by the fair market value oflhe property at thc time of the final approval of the subdivision. Should a fee be accepted in lieu of a land dedication, thc park dedication fee would he six percent of the land value of the property at thc time of final approval of thc subdivision. The 2006 market value according to Ramsey County records is $199,000. This valuc would result in a park dedication fee of$11,940. Staff Recommendation In Planning Case #06-001, staffrecommends approval of the Minor Subdivision after making a finding that the proposed subdivision meets City standards and will not have an advcrse impact on the surrounding properties or on the community as a whole; subject to the following six conditions: 1. The applicant shall provide thc City with a copy of the right-of-way permit granted by Ramsey County for Parcel C's access to Old Highwy 10 before any building pcrmits are issued for Parcel C. 2. Thc applicant shall file the minor subdivision with the Ramsey County recorder and shall provide the City with a recorded copy within three months of the final approval date. 3. The applicant shall provide a 12 foot drainage and utility easement on thc common lot lines and 5 foot drainage and utility easements 4. The applicant shall pay a park dcdication fce before filing the subdivision with Ramsey County. The dcdication fee shall be detenllined by the City Council. 5. Any extension of City services for the ncw lot shall bc subjcct to approval by the City Enginccr and all associated costs shall be the responsibility of the applicant. 6. Thc applicant shall comply with applicable provisions of the City Code and rclatcd . ordinances. The undersigned acknowledges that shelhe understands that before this request can be considered, all required information and fees (including all deposits) must be paid to the City in advance. If additional fees are required to cover costs incurred. by the City, the City Planner has the right to require additional payment from one or more of the undersigned, who shall be jointly liable for such fees. True and accurate representation of the requirements outlined in the procedural form for the specified type of request is the responsibility of the applicant. Complete/Incomplete Applications An incomplete application will delay the processing of land use requests. The application approval time commences and an application is considered officially filed when the City Planner has received and - examined the application and determined that the application is complete. A decision on whether the l application is complete or incomplete shall be made within fifteen (15) days following the submittal of the application. When the application is deemed to be "complete" it shaH be placed on the agenda of the first possible Planning Commission meeting occurring at least thirty (30) days from the dale of official submission of the application. - Page 2 of3 Notice of Meetina Attendance . In order for the Planning Commission and the City Council to consider any application, the applicant or a designated representative must be present at the scheduled meeting. If not, the matter will be tabled until the next available agenda. Aaenda Deadline and Meetina Schedule The deadline for submittal of land use applications is required according to the schedule outlined below. There are no exceptions. All Planning Commission meetings are held on the first Wednesday of each month at 7:00 PM. City Council meelings are held the last Monday of the same month at 7;00 PM. Meetings are held in the Council Chambers at the City of Arden Hills, 1245 West Highway 96, Arden Hills, Minnesota 55112, unless otherwise stated. The applicmts are also requesting a variance to allow the existing structure on the property to remain, which would . encroach on the side yard setback of the new property line between thc two proposcd lots. The variance application is contingent upon approval of the minor subdivision application. Back!!round l. Overview of Request The applicant owns a .81 acre parcel at 1401 Skiles Lane and proposes to subdivide the property into two rcsidential properties. The western parcel with the existing dwelling is proposed to be approximately 100'xI82' with a total area of 18,237 squarc fcet and a vacant eastern parcel that would be approximately 95'x182' with a total area of 17,280 square feet. The existing dwclling currently crosses the proposed boundary line between the two lots. The applicant plans to remove a room from the existing dwelling and has requested a variance to allow the rest of the structure to rcmain. Oncc thc room is removed, the structure would be approximately four feet from the ncw propcrty line. The side setback in the R-l zone is a minimum often feet. As stated above, the existing dwclling on the proposed western lot would encroach on the new propcrty line dividing thc two lots by six feet. The proposed new eastern lot would be able to have a structure that meets all rcquired setbacks. The existing dwelling does cncroach on the 40 foot front yard setback by approximately eight feet. Any future additions to this structure would be required to meet all sctbacks. 2. Subdivision Ordinance - Meets requirement with proposed conditions Scction 1150.04 ofthe City Codc lists the requirements for subdividing previously plattcd property. Requirements that must be evaluatcd listcd under Section 1150.04 include: 1. Survey: A survey showing the cxisting and proposed lots, 2. Public Welfare: It is determined that the proposed division or consolidation will not be detrimental to the public welfare or injurious to adjacent tracts in the area in which the subdivision tract is located. 4. Conformity with the rest of the Subdivision Ordinance: The proposed division or consolidation shall conform to all requirements of the subdivision Ordinance unless given an exemption by the Planning Commission and City Council. 5. Fees: All filing fees must be paid. Staff has reviewcd these criteria and oilers the following findings of fact: I. The submitted survey was prepared by a registered land survcyor and meets pertinent City requirements. 2. As noted above, the proposed lots meet the area and dimensional rcquircments of the R-l Zone. Howcver, an existing dwclling cncroaches six feet on the proposed new property linc. The applicant has submitted a variance application to allow this encroachmcnt to remain. 3. The proposed subdivision is un likely to have any negative affcct on the public welfare with the appropriate conditions. While thc other properties on the same block as the subjcct property tend to be larger, the subject property is comparable to other lots within this subdivision. The average size lot in this subdivision is .43 acres, and the other lots in the subdivision range from .26 acres to .86 acres. The proposed western property would be approximately .4 acres, and the proposed eastem property would be approximately .41 acres. The properties immcdiately . across the strect from the subject property have similar lot widths as the subject property. Finally, if a new dwelling is constmcted on thc eastcrly lot, that will contribute to the local tax basc without significantly taxing the existing infrastructure. 4. The applicant has met all other applicable requirements of thc Subdivision Ordinance. The proposed lots have access to a public road, have adequate buildablc areas, and meet the requirements of the R-l Zone. 5. All rcquired application fees have bccn paid. This subdivision docs rcsult in the creation of two ncw residential lot. Under Section 1130.08 ofthc Subdivision Ordinance, thc park dedication fee would apply to this case. The Recreation and Conservation portion (Subd. 2) requires that all subdivisions dedicate a portion of their land for recreation and conservation purposes or, as deemed comparable value by the City Council, pay a park dedication fee in place of a land dedication. Although the applicant is not proposing a land dedication, a subdivision rcsulting in one new residcntial lot would rcquire a land dedication of six percent, which would be .049 acres or about 2, I 43 square feet. In licu of thc land dcdication, thc City Council may require the applicant to pay, as an equivalent contribution, an . amount in cash equal to the percentage of the land required to be dedicated, multiplied by the fair markct value ofthc property at the time of the final approval of thc subdivision. Should a fee bc acccpted in lieu of a land dcdication, the park dcdication fce would be six percent of the land value of the property at the time of final approval of the subdivision. The 2006 market value according to Ramsey County records is $164,300. This value would rcsuIt in a park dcdication fce of $9,858. Thc Planning Commission may recommend a course of action to the City Council regarding a land dedication or park dedication fee. 3. Granting a Variance for a Subdivision - Findings Required Section 1150.01 of the Subdivision Ordinance allows the City to grant a variance for a subdivision ifthe following conditions exist: 1. The hardship is not a mere inconvenience; 2. The condition or conditions upon which the request is based are unique and not gencrally applicable to other property; 3. The granting of a variance will not bc substantially detrimental to the public welfare and is in accord with thc purpose and intent ofthis chapter, the zoning ordinance and . comprehensivc plan. Staff has rcviewed the variance criteria and otTers the following findings: 1. The hardship may be considercd an inconvenience. Since it is possible for the dwelling to be moved and thcreby meet all setbacks, a hardship may not exist. The applicant has indicated that it is possible to move the structure without adding significant cost. If the structure is moved, the need for a variancc would be eliminated. However, preserving mature trees is important for thc character of the propcrty and the neighborhood. Trecs, particularly mature trees, and open spaces are intcgralto the character ofthc lots, neighborhood, and the City. 2. The conditions are not cntirely unique to this property. lt is not unique topographical, lot size, or lot dimensions that are making the variance necessary. Although the property docs have a number of mature trees that add to thc value and character of the neighborhood, there is sufficient spacc on the proposed western property to place a conforming structure. While thc mature trees may pre-date the currently landowner, mcaning he or she did not create the perceived hardship, the Ordinance does not cIcarly state that protccting trees meets the hardship requircments of a variance. 3. The development on the properties will be similar in style to other properties within the subdivision. While the existing structure will encroach on . the side setback, the easement will help the properties meet the spirit of the ordinance with approximately 25 feet separatc thc cxisting structure and any future structures on thc cast em lot. Staff Recommendation In Planning Case #06-001, staff recommends approval of the Minor Subdivision without the Variancc after making a finding that the proposed subdivision meets City standards and will not have an adverse impact on the surrounding properties or on the community as a whole. The recommcndation for approval is subject to the following seven conditions: 1. The applicant shall file the minor subdivision with the Ramsey County recorder and shall provide the City with a recorded copy within sixty days of the final approval date. 2. The applicant shall file the 21 foot drainage and utility easement with the Ramsey County and shall provide thc City with a recorded copy within sixty days of the final approval date. The restrictive easement may be incorporated with the deed for the land or submitted as a scparate recordable document. 3. The applicant shall pay a park dedication fcc of six pcrccnt of the market value of the land at the time of the final approval of the subdivision. 4. The structure on the western lot shall be moved to a location that meets all requircd setbacks of the R-l Zone, including the front lot setback of 40 feet from the right-of~ . way. 5. Thc structure on the wcstem lot shall be moved into a location that meets all required setbacks before any building permits arc issued for any new structures on either lot except for any permits needed to move the structure into a conforming location. 6 Any extension of City serviccs for the new lot shall be subject to approval by the City Enginecr and all associated costs shall be the responsibility of the applicant. 7. Thc applicant shall comply with applicable provisions of the City Code and related ordinances. It is open to interpretation if a true hardship exists in this case. Protecting trees and green space is important for the charactcr of the lot and neighborhood. While it is a worthwhile cause to protect mature trees, the trees are in a location on the lot that could be uscd for future construction purposes (e.g. a garage expansion or other structural cxpansion). If the trees are removed for future construction purposes, then thc rcason for the perceived hardship in this variance application would havc been eliminated. Without specific conditions for protection, there is no guarantee the trees will be preserved for perpctuity. However, if the variance is approved with the minor subdivision, Staff proposes this alternate set of nine conditions: . 1. The applicant shall file the minor subdivision with the Ramsey County recorder and shall provide the City with a recorded copy within sixty days of the final approval date. 2. The applicant shall file the 21 foot drainage and utility easement with thc Ramsey County and shall provide the City with a recorded copy within sixty days of the final approval date. 3. The portion of the existing structure that is designated for removal on the submitted survey shall be removed before any new building permits are issued for any structures on either lot exccpt for any permits need cd to remove the required portion of the existing dwelling. 4. Any additions to the existing dwelling on the western lot shall meet all setback requirements. 5. Any new structurcs on the western Jot shall not encroach any cIoscr than 21 feet to thc wcstern lot line to preserve a total of 25 feet of side lot setback as required in the R-l Zone. 6. The six pine trees, two oak trecs, and onc elm tree between the western edge of the existing structure and thc western lot line shall not bc rcmovcd without approval of thc City Council (The trees and their locations are identified on the Site Development Plan for 1401 Skiles Lane). If thc trccs are determined by the City to be dead or dying, the trees may be removcd and shall bc rcplaced in accordance with the Design Requirement of the Landscapc Plan provisions of Appcndix A, Proccdural Manual, of the City of Arden Hills Zoning Ordinance. . 7. The applicant shall pay a park dedication fee before filing thc subdivision with Ramsey County. The dedication fee shall be determined by the City Council. 8. Any cxtcnsion of City services for the new lot shall be subject to approval by the City Engineer and all associated costs shall be the responsibility of the applicant. 9. This is a rcquest for a minor subdivision of a property at 1401 Skiles Lane. The current property is 35,527 sq. ft. and is approximately 195' x 182'. We propose to create two lots out of the existing lot, thc east lot will be 95' x 182' and the west lot will be 100' x 182. There is an existing house that sits moslly on the west side of the lot. We bought the property at the end of November, 2005 and lovc the neighborhood, the location and the lot. The lot is covered with oak trees and a number of other varieties of trees. The zoning in this arca is R-l, with a minimum lot width of 95' and a minimum lot area of approximately 14,500 sq. ft. The current lot is 195' x approximately 182' with an existing house that is mostly on the west 100' of thc lot. The area of thc current lot is 35,527 sq. ft. We would like to subdivide the lot and create one vacant lot (on the east side) that is 95' x 182' (17,280 sq. . ft.) and a second lot with the existing house that is 100' x 182 (18,237 sq. ft.) on the west side of the 101. Our plans are to rehab the cxisting house and sell it and then build a ncw house for ourselves on the new lot.. A portion of the existing house straddles what will be the new property line. We plan to rcmove the portion of the house (approximately] 50 sq. ft.) that straddles the new property line. Our ovcrall goal is to minimize disturbance to the property. We bought the property because we like the house and the property and like the character of the neighborhood. We want to do evcrything we can to respect the character of thc lot and of the neighborhood while rehabbing the old house and building a new house. Oak trees are very sensitive to root disturbance and . compaction, so we are hoping to do as much site work and cxcavation as possible in the winter while the ground is frozen, which would minimize the site disturbance and soil compaction. -- . . We will place a restrictive covenant on the new lot to the ea~t prohibiting any permanent building . on the west 21' of thc lot. The applicable statutes from the Zoning Ordinance in rclation to this special use permit amendment request are listed below with findings. 1. Screening/Landscaping The Gateway Business District does not have specific screcning rcquircmcnts; however, Section 6 Subd. E(j) states: (j) Screening of Mechanical Operating Equipment: Screening shall also be provided where mechanical equipment is located on the ground or on the roof of the premises; such screening shall be constructed and located so as to prevent direct view of said equipment. Mechanical operating equipment shall include all exterior devices used to service the building or its occupants, including but not limited to electrical, HVAC, plumbing, communications (including telephone and dish antennae) and storage tanks. The applicant proposcs to install a 15 foot high fcnce that extends approximately 70 feet from the building and is approximately 60 feet wide. The fence would match a fence that cncloses an existing storage area to the east of the proposed air handling units. The fence is expected to provide about 67 pcrccnt opacity. An existing berm and stand of smaller evergreen trccs would augment the fencing to provide additional screening, which would bring total opacity to an estimated 75 percent once the trees are mature, according to the applicant. . Simulations of the fence and screening are included with the submittals from the applicant. 2. Parking Cclestica currently has 408 on-sitc parking spaccs. If approvcd, thc two air handling units will result in the loss of at least cight parking spaccs lcaving only 400 spaccs. They have indicated that there is inadequate parking on the site. To . compensate for the inadequatc parking, Celestica has a privatc agrecmcnt to allow employees to use approximately 20 parking spaces in an adjacent parking lot that is on land under thc samc ownership as the Celestica building. In order to resolve the parking issucs, Cclestica applicd for spccial use permit amendment to increase parking on thc site. Planning Case 01-12a and 01-12b was approved to increase parking by 65 parking spaces for a total of 473 parking spaces. However, since Ce1estica did not act on these approvals within thc rcquired timeframe, thcsc amcndment approvals have expired. lfthc prcviously approved parking expansion had been implemented, Celestica would have cxceeded the parking requirement by 25 spaces for a total of 465 parking spaces (once the eight spaccs for the air handling units arc removed). Celestica is requesting to maintain thc current arrangcmcnt for off-site parking. As long as the off-site parking is meeting Ce1estica's and the tenants of the other buildings needs, it is unlikely that allowing the current parking situation to continuc would have a detrimental affect on the property or neighborhood. Sincc there is a contingency plan available to provide sufficicnt on-sitc parking should the off-site parking arrangement end, staff does not believe that the parking situation is a barrier to installing the air handling units. However, in ordcr to implemcnt thc contingency plan, the applicants would be required to rcsubmit an application for a special use pennit amendmcnt to reinstate the expircd permits to expand parking. 3. Environmental Pollution - Noise . Scction 6 Subd. G(5) states: 5. Environmental Pollution: Emission or crcation of noise, odors, vibrations, dust, smoke, heat and toxic or noxious fiunes shall conform to such standards as are from time to time established by the Minnesota Pollution Control Agency. None of these shall bc at a level that is objectionable to surrounding properties. Based on the information submitted by thc applicant, the air handlers will produce a sound level 73 Decibels at 30 feet from thc air handling unit. At this level, the air handling unit does slightly exceed thc Minnesota Pollution Control Agency limits of 65 (L50) decibels and 70 (L 1 0) Decibels. However, the property line is approximately 200 feet to the west and 150 feet to thc south of the proposed air handling units. At the property linc, it is unlikely that the sound from the air handlers would have any noticcable impact on ncighhoring properties and would not exceed MPCA guidelines. The Arden Hills City Council approved the use of the property for an office, production, and warchousing building through Special Use Pcrmit #96-12 on July 2,1996. For amcndments, the Planning Commission should review the proposal and determine if the proposed amendment is compatible and complementary with existing uses, the use mix, and the location. Section 8 Subd. D (3b) of the Arden Hills Zoning Ordinancc lists the critcria for evaluating a Special Use Permit and subscquent amendments. The Planning Commission and City Council shall consider the effect of the proposed use upon the health, safety, conveniencc and general wclfare of the owners and occupants ofthc surrounding land, in particular, and the community as a whole, in general, including but not limited to the following factors: I. Existing and anticipated traffic and parking conditions; 2. Noise, glare, odors, vibration, smoke, dust, air pollution, heat, liquid or solid waste, and othcr nuisance characteristics; 3. Drainagc; 4. Population density; 5. Visual and land use compatibility with uscs and structures on surrounding land; adjoining land values; 6. Park dedications wherc applicable, and the 7. Orderly developmcnt of the neighborhood and the City within the gcncral purpose and intcnt of this ordinance and thc Comprchcnsive Development Plan for the City. . Thc Planning Commission must make a finding as to whether or not the proposed amcndment to the Spccial Use Permit would adversely affect thc surrounding ncighborhood and largcr community as per the aforementioned factors. Staff offers the following findings Jor consideration: 1. Thc number of cmTent parking spaces is noncompliant with the Ordinancc. At lcast 440 spaces are needed for the existing uses. The property will lose eight parking spaccs, for a total of 400 spaces, once the air handlers are installed. The applicant was approved to expand off-site parking up under Planning Casc 0l-12a and 01- I 2b. These permits have since expired but can be resubmittcd for review. If re-approved, the property would have 465 parking spaces, which exceeds the minimum requircment. The proposed use will have no affect on traffic. 2. The proposed usc is estimated to create 73 decibels of sound at 30 feet from the unit, which cxcccds MPCA regulations. At the propcrty line; however, the decibels would likely be below MPCA regulations. 3. The proposcd use will have no affect on drainagc or population density. 4. The applicant proposes to screen the air handlers with a 15 foot high fencc and existing vegetation. With the existing bcrm and a fence that closely matchcs the color of the building, the air handlers are unlikely to have a detrimental affect on City of Arden Hills . Resident Comments Staff has not received any letters, e-mails, or telephone calls from property owncrs or occupants in regard to this planning case. Staff Recommendation In Planning Case #06-003 staff recommends approval of the Special Use Pcrmit Amendment subject to the following conditions: 1. The applicant shall continue to abide by thc conditions of approval listed in Special Use Permit #96-12,97-23,00-40,01-08,02-33, and any other approved permits. (Pcrmits 01- l2a and 01-12b have cxpired and do not apply.) 2. The applicant shall be required to obtain all necessary building permits before construction begins. . 3. The appropriatc building pcrmits for the air handlcrs shall be obtained within onc year and construction shall be completed within two years or this pennit shall cxpire. The Council may extend the cxpiration date of this approval upon written application of the applicant. 4. The fencing shall be installed as proposed immediately after installation of the air handling units. 5. Any trees that havc died since the initial development of thc site must be replaced per landscape plans approved by staff no later than June], 2006. 6. Thc applicant shall be required to submit a noise mitigation plan in the future if the City receives complaints regarding noise generated by the unit and said complaints are validated by City Staff. 7. Should the off-site parking that Celestica's employccs are currently using become unavailable Of inadequate, Celestica shall rcapply lor a special use pefmit amendment to expand parking similar in nature to Planning Case 01-12a and Ol-12b. These applications shall require City review under the standard review process for a special usc pelmit amendment. 8. The air handling units shall be installed in accordance with the plans submitted. January 17, 2006 City Planner ARDEN HILLS 1245 West Highway 96 Arden Hills, Minnesota 55112 RE: CELESTICA Comm: 06-01 DESCRIPTION OF REOUEST SUPPORTING A SPECIAL USE PERMIT This application is for the installation of two ground mounted, exterior mechanical air handling units to be located at the loading docks of the existing Celestica building. The first unit is to be install this winter, 2006. The second unit is to be install at a later, undetermined date depending on operational needs. These units will be enclosed by a 15 foot high chain link fence with privacy slats. The privacy slats are to be the approximate color (tan) of the existing building and are expected to provide about 67% opacity. . Celestica, formerly Manufactures' Services, is located at 4300 W. Round Lake Road. (See drawing Tl). The location of the area to be occupied by the air handlers and privacy fence is highlighted in yellow on the Site Plan (See drawing C2.0). This location is well screened from public view by a sizeable berm and considerable landscaping (See drawing Cl). Unit Plan. Attached is a detailed plan showing the equipment location relative to the building, the size of the mechanical air handling unit and the location of the screening fence. The humidifiers are indoor, suspended from the ceiling joist. Computer Generated Image. Attached are two photos of the intended equipment location, as taken from Round Lake Road. The first photo shows existing conditions. Please note the existing nitrogen tank. It has a privacy fence similar to that proposed for the air handling units. As you can see, it offers considerable opacity. The second photo has been computer imaged to show the proposed installation of the air handling unites). As the air handlers will be painted either tan or gray and do not extend . above the height of the fence, they are very difficult to see. While the fencing is visible, it's complimentary color easily blends with the building making is relatively un-noticed. January 17, 2006 . City Planner CELESTICA SPECIAL USE PERMIT Page 2 It will further be screened as the existing landscaping matures. The combination of the existing berm and eventually mature evergreens should occlude over 75% of the fence. Parking Considerations. Celestica has 408 parking spaces. This installation will cause the loss of about 8 spaces, leaving a net of 400 parking spaces. (See drawing C2.0). Currently Celestica employs 240 persons in manufacturing/warehouse (this is a historically high level and varies with business level. For example the manufacturing/warehouse number in September of2005 was approximately 190.) And 153 persons are employed in the office, for a total of393 employees. This employment level varies throughout the year and is currently at a historically high level. Per our understanding of the city ordinance, it appears Ce1estica is non-compliant with the off street parking standards. . Office Space: 50,000 sf. x 4 spaces/IOOO sf. = 200 spaces Warehouse/Production 240 persons x 1 space/person = 240 spaces Total Spaces Required 440 spaces Off-Site Parking Although Celestica currently has 408 spaces for 393 employees, the dedication of some of the available spaces for handicapped and visitors generally leaves inadequate parking for employees. Celestica has therefore reached agreement with the adjoining facility immediately south, to allow Celestica employees to park on their property. Approximately 20 employees park off-site. This will be permitted to continue, as the adjacent property is under common ownership and is under utilizing it's existing parking. Proof of Parking Celestica has considered expanding their parking lot and can provide adequate parking spaces. In April 2001, they had prepared and submitted a request to expand parking in two phases, resulting in a net of 473 parking spaces. That request (Planning Case #01- 12b, PUD Amendment) was approved by the Arden Hills City Council (See attached letter). . That PUD Amendment plans to increase parking are attached. Drawing C2.2 shows the proposed parking increase, resulting in 473. That drawing has been highlighted in yellow to indicate the currently proposed mechanical equipment. . However their current arrangement of off-site parking is working well and seems to adequately address the shortage. As the employment numbers change, the situation may soon improve and parking may become ordinance compliant. (Odd Fellows) property at 1174 Edgewater Ave Nand consolidate those three platted lots into a singlc 14,973 square foot parcel. . Backl!round l. Overview of Request: Thc applicants own a 1.54 acrc propcrty at 1174 Edgewaler Ave N. On March 8, 2005, the City Council approved an amcndmenl (Case 05-03) to the Lodge's original Special Use Permit #70-36. The amendment allowcd the Lodge to reduce the size oftheir parking lot with the intent of selling three lots on the eastern edge of the property. The amendment was approved with scven conditions. Condition three is the reason for this minor subdivision application: 3. No construction shall occur on all or part of adjacent property owned by the Lodge (Lots 1, 2, or 3, Block 3, Lake Josephine Villas) prior to those properties being platted into one (l) residential lot which meets the minimum requirements for the R-2 (Single and Two Family Residential Zoning District). Subdivision Ordinance - Meets Requirement with proposed conditions Section 1150.04 of the City Code lists the requirements for subdividing and/or consolidating previously platted property. Requircments that must be evaluated listed . under Section 1150.04 include 1. Survcy: A survey showing the cxisting and proposed lots, 2. Zoning Compliance: The parccls or tracts resulting from the division or consolidation, as depicted in the surveyor registered land survey, shall not have an arca, dimensions or setbacks which are less than the minimum requircments spcci fied for the zoning district in which the parcels or tracts arc located in the zoning ordinancc. 3. Public Welfare: It is determined that thc proposed division or consolidation will not be detrimcntal to the public welfarc or injurious to adjacent tracts in the area in which the subdivision tract is located. 4. Conformity with the rest ofthe Subdivision Ordinance: The proposed division or consolidation shall conform to all requirements of the subdivision Ordinance unless given an exemption by the Planning Commission and City Council. 5. Fees: All filing fees must be paid. PC-doc Page 3 of 6 1. The submitted survcy was prepared by a registered land surveyor and meets City requirements. . L As noted above, the proposed lots meet all requirements ofthc undcrlying R-2 Zone. 3. The proposed subdivision and consolidation is unlikely to have any negative affcct on the public welfare. The previously plattcd lots wcre less than 5,000 square feet, which is below the 11,000 squarc foot minimum lot size. The consolidation will rcmove the potential that the originally platted 5,000 square foot lots would be developed individually. The proposed lots are comparable to and compatible with neighboring lots within the subdivision. Finally, if a dwelling is constructed on thc lot, it would contribute to thc local tax base without significantly taxing the existing infrastructure since the lot already has access to City infrastructurc. 4. The applicant has mct all other applicable requirements of thc Subdivision Ordinance. Thc applicant has providcd the necessary easements and access for the property. There is sufficient buildable space on the proposed lot for constmction without a variance. 5. All required application fees have bccn paid. This subdivision does result in the creation of onc new residential lot. Under Section 1130.08 of the Subdivision Ordinancc, the park dedication fee would apply to this case. The Rccrcation and Conscrvation portion (Subd. 2) requires that all subdivisions dcdicate a portion of thcir land for recreation and conservation purposes or, as dccmed comparable value by the City Council, pay a park dedication fcc in place of a land dedication. Although the applicant is not proposing a land dedication, a subdivision resulting in . onc new residential lot would require a land dcdication of six percent, which would be .09 acres or 4,025 square feet. Given the small size of the potential land dedication and the availability of other nearby park facilities, a park dedication fee may be morc appropriate thcn a land dedication. In lieu of thc land dedication, the City Council may requirc the applicant to pay, as an equivalcnt contribution, an amount in cash equal to the percentage ofthe land rcquired to be dedicated, multiplied by the fair market value of the property at the time of the final approval of the subdivision. Should a fee bc accepted in lieu of a land dedication, the park dedication fce would be six perccnt of the land value of the propel1y at the timc of final approval of the subdivision. The 2006 market value according to Ramscy County records is $606,500. This value would result in a park dedication fce of$36,390. The Planning Commission may recommend a course of action to the City Council rcgarding a land dcdication or park dedication fee. In Plmming Case #06-004, staff recommends approval of the Minor Subdivision and Consolidation after making a finding that thc proposed subdivision meets City standards and wilI not have an adverse impact on thc sUITOlmding propcrties or on the community as a whole; subject to thc following condition: 1. The applicant shall file the minor subdivision with the Ramsey County recorder and shall provide the City with a recorded copy within thrcc months of the final approval date. 2. The applicant shall pay a park dedication fcc before filing the subdivision and consolidation with Ramsey County. The dedication fee shall be dctcrmined by thc City Council. 3. The applicant shall sign a Declaration of Restrictive Covenants that is filed with the deed on thc propcrty. Thc City Attomcy shall rcvicw the covenants before the subdivision is filed with Ramsey County. The Declaration of Restrictive Covenants shalI include the following: a. The propcrty shall rcmain subject to thc conditions in Planning Case #70-36 and 05-03. b. Lots 1,2, and 3 of the Minor Subdivision and Consolidation in Planning Case #06-004 shall not be further subdivided or reverted back to their originally platted lots as required by Condition 3 of Planning Case #05-03. c. The applicant agrees that thc conditions of this Covenant and previous conditions placcd on thc property from Planning Case #70-36 and 05-03 . cannot bc changcd or removed without the written consent ofthc Ardcn Hills City Council. 4. Any extension of City services for the ncw lot shall be subject to approval by the City Engineer and all associated costs shall be thc rcsponsibility of thc applicant. 5. The applicant shall comply with applicable provisions of the City Code and related ordinances. TO: Planning Commission FROM: Kathleen Nordine, City Planner DATE: Dccember 20, 2005 SUBJECT: Variance - Garfield Kachel, 1479 Arden Place INTRODUCTION Garfield Kachcl has submitted a variance application to construct an addition onto the front of his home at 1479 Arden Place. The proposed addition would accommodate the expansion of an existing master bedroom and bathroom for handicap accessibility. Accessibility to thc home would also be improved through thc construction of an inclined ramp at the front entryway. The proposal requires a variance to reduce the requircd 40- foot structurc setback from a street right-of-way to 28 feel. PROJECT DESCRIPTION The subject property is located in the RI - Single Family Residential District east of Lake Johanna. Thc property is a corner lot with frontage on Snelling Avenue and Arden . Place. The lot is approximately 9,000 square feet in sizc and varies in width due to its frontage on the two streets. The property has been developed with a single-family home with an attached garage. The applicant is proposing to construct a one-story addition onto the south side of the home lacing Arden Place. This proposed 8.5' x 13.5' addition would provide additional bedroom space and a bathroom that would be handicap accessible. The proposal also includes the construction of an incline ramp to improve acccssibility to the front entryway. The addition would setback 28 feet from the Arden Place street right-of-way; less than thc minimum 40-feet required, therefore, a variance is needed. DEVELOPMENT CODE REQUIREMENTS In the R-l District, the Zoning Ordinance specifies that a minimum front sctback of 40- feet is rcquired from a street right-of-way. The proposcd addition and incline ramp is located 28 feet from the lot line abutting Arden Place. A variance to reducc this setback is necessary for thc projcct to proceed as proposed. VARIANCE Variance Criteria When considering a Variance, the Commission must determine whether the conditions rcquired for a variance are prcsenl. Adhcrence to the provisions of the ordinance is . ] required exccpt for special cases, which arise because of the configuration of a particular . parcel. Thc condition shall not have been crcatcd by the landowncr. A variance or variances may be grantcd from specific provisions of this ordinance because such land factors as length of a side of a lot, the shape of the lot or the unusual terrain prohibit reasonable development equivalent to that which would be permitted without variance on a similar sizc lot located in thc same district, but which lot has no unusual configuration. Economic conditions aJonc shall not be grounds for a variance. In no case shall thc granting of a variance impair the hcalth, safety, comfort and genera] welfare of the public, nor will it be contrary to the intent and purpose of the Comprchcnsive Plan, the official map, or this or any other ordinance of the city. Applicant's Statement The applicants state that hardship is present due to thc lot characteristics, relationship with adjoining properties and that the proposal will meet the spirit and intent of thc ordinancc. The propcrty has a small lot area that is constrained by the lot shape and topography. Thcre is a slope on the west side of thc property, which presents some difficulty for construction of an addition on that side of the home. Furthermore, the setback of the homc at 1485 Arden Place, immediately to the west, is less than the minimum 40-foot sctback required. Granting the variance is in keeping with the spirit and intent of thc ordinance. STAFF REVIEW . The staff has revicwed this proposal in accordance with the variance criteria and believes hardship is prcsent. The applicant's proposal is reasonable due to the property's characteristics and character of the neighborhood. The construction of an addition onto thc existing home is limitcd due to the small lot size (less than thc minimum ]4,000 square feet required in thc R-l district), adjacency to two street rights-of ways, odd shape and topography. Thc development pattern on Arden Place is not typical of a residcntial subdivision due to thc street layout and lot shapes; there/ore, the setback reduction will not impact the charactcr of the neighborhood. In addition, a variance was granted for the property at 1485 Arden Place reducing thc required setback of the home from the strcet right-of-way. Another factor to consider is the location of the existing bedroom and bathroom insidc the homc. The proposed location of thc addition is logical because the existing bedroom and bathroom can be expanded and be remodeled for handicap accessibility without disrupting the other living areas in the home. PUBLIC COMMENT Propcrty owners within neighborhood were notified of the rcquest. One commcnt in support has been reccived. . 2 STAFF RECOMMENDA nON . The Staff has reviewed this proposal in accordance with the variance criteria and believes hardship is present. The proposal to construct on addition onto the south side of the home is reasonable due to the lot charactcristics, neighborhood and interior floor plan. The situation is unique due to the small lot area, frontage on two roadways, topography of the lot and character of thc neighborhood. Staff recommcnds that the Planning Commission recommend approval of the variance to the City Council subject to the following: 1. The projcct must be completed in accordance with the plans submittcd as part of the Variance application. Any significant changes to thesc plans, as determined by the City Planner, will require rcvicw and approval by the Planning Commission. 2. The variance shall automatically expire and become void one (1) year from and aftcr the date on which thc Council granted such approval if work on the project has not begun within that time period. OPTIONS I. Rccommend approval as submitted. 2. Recommend approval with conditions. , Recommend dcnial with reasons for denial. Ifthc City denies the petitioners ~. . request, "it must stale in writing thc rcasons for the denial at the timc it denies thc request". 4. Table for additional information. DEADLINE FOR AGENCY ACTION: February 2, 2006 The City of Ardcn Hills received the completcd application for this request on Deccmbcr 2, 2005.
