Mr. Lehnhaff statcd applicants were requesting a minor subdivision to split a ,70 acre
(approximately 30,500 square feet) parcel into two properties in the R-2 Single and Two-
Family Residential Zone, The applicant is alsa requesting a variance for propased Parcel
B to be 81 feet wide, which is less than the minimum 85-foat width for interiar lats in the
R-2 Zone. The applications are contingent upon approval .of each other. The applicant
has submitted a letter stating the reasan for the hard~pJ:l!;nd subsequent variance, He
reviewed his analysis and stated staff recammend~"Faenlaj .of the variance and minor

not acceptable,
Chair Sand asked what the square footage was of the current home, Mr. Kotoski
responded he was estimating the square footage was approximately 1,500 to 1,600 square
feet.
Mr. Torkildson stated he did not want to look at a side of a home and he believed this was
a "bizarre" design, He expressed concern that the road was not wide enough to park in
the street.
Mr. Kotoski stated his preference was to turn the homes to. face Mr. Torkildson's
property, but Mr. Torkildson's wife had stated she did not wantthehomes facing them.
He indicated he did not have a preference as to which way the homes faced,
Chair Sand asked if the floor plans would fit either direction. Mr. KotOskiTrespondcd

LAKE JOHANNA BOULEVARD .
Mr. Lehnhoff stated the applicant was requesting a variance to construct an addition to
the dwelling that encroaches on the southern side yard sethack. The applicant is also
requesting a variance to construct an addition to the accessory structure that encroaches
on the southern side yard setback and is entirely within the front yard setback, The
variances arc not contingent upon each other and can be reviewed separately or together.
He presented his analysis and indicated should the Planning Commission wish to make
separate recommendations for approval or denial, the recommerded conditions have been
separated into Planning Case No, 06-006a for the principahst{llcture variance and
Planning Case No, 06-006b for the accessory structure varians~,ii'iiilr Planning Case No,

included the expanded driveway, Mr. Lehnoff responded it did include the expanded

Chair Sand invited anyone for or against the request to come forward and make
comment.
David Carlson, 3355 Lake Johanna Blvd" stated the applicant was a friend of his and did
excellent work, but he had a concem about the height of the garage, He asked if the
garage height could be lowered, He noted the garage would be the highest structure on
Lake Johanna Blvd,
Nancy Hanson, 3368 Lake JohaIma Blvd., stated she was in favqt:;'i;?f the proposals, She
indicated the buildings on Lake Johanna started out as cabin$<ailli~'1JJaking ChaIlges to
these homes were difficult, She noted she was against variances ge~~lially, bIJt in this
case, the lot was very small and there were few options for improverilel1t,.l)he noted
storage was limited in the home because of little or no basements, so she'<tindilrstood the
need for a larger garage, She stated a larger parking pad would be nice so people did not
need to park on the street. She noted where the garage was located was the only option
the applicant had and she believed the design of the development fit into the
neighborhood, She indicated she has spoken with the neighbors and none of them had
any cone ems with the proposal. She stated she stood in favor of the garage as presented,
Chair Sand noted the height ofth~mgitrage was approximately 21.9 feet and the dwelling
. was 30.4 feet. Mr. Lehnhoff llotC"cF'!he eurrentheight of the home was 30.4 feet and the

Dan Westlu.nd,applicant, stated n~;~IllJ1ned on taking off the ceiling of the main floor on
the existing home and go up to a fttl~~1!II~<stories, which would bring the height of the
home up to 30.4 feet. He stated he b6ljved the current structure was approximately 25
or26 feet. The garage was 16 feet now"lUld it would go up to 21 feet.
Mr. Lehnhoff stated that the height of the home would indeed increase with the
remodelij1g, The current height of the home is less than 30 feet to the peak,
Commissioner Larson asked what the space above the garage would be used lor. Mr.
Westlund responded the home had a 16 x 20 basement, which was insufficient storage,
He stated he would not be living in the home, but he believed the area above the garage
could be used for storage, office, craft room, etc.
Commissioner Larson asked if the space above the garage could be used as an office,
Mr. Lehnhoffresponded he did not believe there was any reason why the space could not
be used as an office, but he would check into this,
Chair Sand noted there would not be any plumbing to the garage, so the space could not
be used as living space, but an office or storage would not be considered living space,
. Mr. Westlund agreed and noted plumbing would not be added,

David Westlund, 2599 Lexington Avenue North, Roseville, stated he had lived in the area .
for 23 years, He noted he was in favor of his brother Dan's proposaL He indicated Dan
was an excellent builder and he loved to take old buildings and make them better. He
stated Dan had a good reputation and they had been working for 50 years in this area with
their father. He stated this project would be a benefit to the neighborhood, He indicated
this area was evolving and he believed it would continue to evolve. He stated this area
had a lot going for it and soon the lake would be ringed by million dollar homes, He
stated the existing home was not built as a home, but a cabin that had been added onto,
He stated the existing structure was not up to building codes of today, He noted the new
home would look like a new home that fit into the ~~!~~~rhood, He stated the space
above the garage was needed for storage and this s,J?a'c'~' {vouldserve as substitute for a
basement. ""

submit a letter from Rice Creek Watershed stating. whether a p~ITnit was needed and
applicant shall provide a copy of the permits before construction;

Commissioner Larson moved, scconded by Commissioner Thompson to recommend
denial of Planning Casc No, 06-006b, Variance for the accessory structure - Westlund,
3352 Lake Johanna Boulevard, because this was a non-conforming structure and the
zoning regulations specifically prohibit the expansion of a non-conforming use and this
would also sct a precedence,
The motion failed (3-3-1), (Commissioner McClung, Modesette, and Chair Sand
opposed, Commissioner Bezdicek abstained). .

. Chair Sand stated if applicant was not asking for the additional storage in the garage, the
Commissioners could approve this and the issue was not the height of the garage,
Commissioner Larson responded that was correct.
Commissioner McClung asked if applicant would accept that condition, Dan Westlund
responded he could not regulate what the owner would use that space for.
Mr. Lehnhoff noted applicant could go up, but not out. He indicated should there be an
adverse impact due to the height; the height could be limited as a condition, He statcd in
looking through section 6(a) of the Ordinance, he didqgt'see anything that would limit
the usc ofthe second floor of the garage, ',',

and they needed to either completely deny this or an affirmative vote in favor.
Chair Sand moved, seconded by Commissioner McClung to recommend approval of
Planning Case No. 06-006b, Variance accessory stmcture - Westlund, 3352 Lake
Johanna Boulevard, subject to the conditions as noted in staffs February 21, 2006, report
and adding a condition for review and approval by the Rice Creek Watershed District
shall be provided prior to the issuance of a building permit.

Motion failed, (3-3-1) (Commissioners Thompson, Larson, and Zimmerman opposed.
Commissioner Bczdicek abstained),
Mr. Lehnhoff recommended they go with the tie vote and bring this to the CounciL He
noted there was no need for additional information at this point.
Commissioner McClung asked if they should have a motion to Council making no
recommendation. Commissioner Larson agreed,
Commissioner Larson moved, seconded by Commissioner McClun.g to recommend the
Planning Case be sent to the Council witb no recommendation from the Planning
Commission,

Lehnhoff responded this was defined by the Rice Creek Watershed District and other

Commissioner McClung asked if the best praetices.should by the City
Attorney or the City Code Officials, Mr. Lehnhoff would need to be
approved by the City Engineer.
Commissioner Thompson stated she wanted to add 6 that
this be approved by the City Engineer.
Commissioner Thompson asked if they could add a time limit to Condition 7, Mr.
Lehnhoff responded they could be more He suggested they could add an
amendment saying the erosion control be removed until ground cover
was established,

this time in the position to state when the "arm" would go in.
Chair Sand asked if the "arm" was a condition of approval. Mr. Lehnhoff responded it
was not and he did not see the need for them to come back before the Commission for the

require a background check, which will be processed upon completion of the Special Use
Permit application, Staff presented its analysis and recommended approval of the Special

1. Overview of Request
The applicant proposes to construct a 1,224 square foot 34'x36' accessory structure (garage)
at 1889 Grant Road. Although the proposed garage would replace an existing 484 square
foot 22'x22' structure, a portion of the foundation of the existing structure would be retained
for the new structure, In the R-2 Zone, propcrties are allowed up to 1,456 square feet of
accessory structure space; however, the Ordinance requires the 1,456 square feet to be
divided into no more than two structures that do not exceed 728 square feet each (Section
6,A of the Zoning Ordinance),
According to the applicant, there was an attempt to formulate a design to attach the proposed
garage to the existing dwelling. However, a design that attached the garage to the dwelling
would have required a variance to encroach on the front lot line setback, a variance to
encroach on the side setback, or significant changes to the existing structure on the lot. If it
were possible to attach the proposed garage to the dwelling, the 728 square foot limit for an
accessory structure would not apply,

A. State Criteria:
Minnesota State Statue in Chapter 462.357, Subdivision 6, (2), defines "undue
hardship" as:
"",means the property in question cannot be put to a reasonable use ifused under conditions
allowed by the official controls. the plight of the landowner is due to circumstance unique to
the property not created by the landowner, and the variance. if granted, will not alter the
essential character of the locality. Economic considerations alone shall not constitute an
undue hard, hip if reasonable use of the property exists under the terms of the ordinance,,, ..
Minnesota State Stature 462.357, Subd, 6, requires that Cities consider the folJowing
five matters when hearing requests for zoning ordinance variances;
I. Are the circumstances for which the variance is requested unique to the property?
2, Would granting the variance be in keeping with the spirit and intent of the City's
Zoning Ordinance?
3. Could the property in question be put to a reasonable use without the granting of
the variance? .
4, Was the hardship created by the owner?
5, Would granting the variance alter the essential character of the neighborhood?
B. Local Criteria:
Section 8,D.4.c of the Arden Hills Zoning Ordinance states:
Adherence to this provisions of this [zoning} ordinance is required except for special
cases, which arise because the configuration of a particular parcel. The condition
shall not have been created by the landowner, A variance or variances may be
granted from specific provisions of this ordinance because such land factors as length
of a side of a lot, the shape of the lot or the unusual terrain prohibit reasonable
development equivalent to that which would be permitted without variance on a
similar size lot located in the same district, but which lot has no unusual
configuration, Economic conditions alone shall not be grounds for a variance,

. Zoning Ordinance Findings:
1. The proposed garage meets all required setbacks of the R-2 Zone. With the proposed
garage, the building coverage would increase from 8.5 to 11.8 percent of the lot and
the total landscaped area would decrease from 80.9 to 77.1 percent, both of which
meet the requirements of the R-2 Zone.
2. The proposed 1,224 square feet garage exceeds the maximum 728 square feet for a
single accessory structure in the R-2 Zone, which is the purpose of the variance
request. With conditions, the accessory structure meets all other requirements of
Section 6.A of the Zoning Ordinance.
Variance Findings:
3. The circumstances arc unique to the property. The narrowing of the lot toward Grant
Road would makc it difficult to place and access an additional garage at the rear
portion of thc lot with an automobile. It is also difficult to meet all required
accessory structure setbacks without a difference variance if the garage were attached
to the existing dwelling due to the location of the dwelling and the shape ofthe lot.
4. Granting this Valiance would be in keeping with the spirit and intent of the Zoning
Ordinance. For the lot as a whole, the proposed accessory structure size (1,224
square feet) does not exceed the total accessory structure square footage permitted for
a lot in the R-2 Zone (1,456 square feet).
5. The applicant currently has reasonable use of the property with the existing dwelling
and accessory structure without the proposed addition. However, the unique
. circumstances relating to the shape of the property limit its use compared to other
properties of similar size in the R-2 Zone. While it would be possible to construct an
additional accessory structure in the rear of the lot, it would be difficult to access the
structure with an automobile due to the narrowing of the lot near the right-of-way and
the existing structures blocking access to the rear of the lot. Nevertheless, it is
possible to increase the size of the existing detached garage to 728 square feet from
the current 484 square feet without a variance. Attaching a larger garage to the
dwelling would likely require a variance to encroach on the front or side setbacks.
6. The hardship was not created by the owner. The lot lines follow the original plat,
which was created before the current Zoning Ordinance was in place. Although the
existing dwelling, which encroaches on the front yard setback, is a legal non-
conforming use, the location of the dwelling makes it difficult to attach a conforming
garage of a reasonable size that meets all required setbacks.
7. Granting the variance would not alter the essential character of the neighborhood.
Most lots in this neighborhood have an accessory structure that is visible from the
street. While building two adjacent garages in the same location or two garages that
are visible from the street that do not exceed the square foot limit may be possible,
such an arrangement would likely be more out of character with the neighborhood
than allowing a single structure. There are instances of garages on at least two
properties being constructed in this neighborhood that al'e larger than 728 square feet;

unfortunately, the City does not have a variance for these properties on file (1888
County Road E, which is directly behind tbe subject property, has an accessory
structure that is about 1, 100 square feet and 1880 Grant Road, which is directly across .
from the subject property, has an accessory structure that is about 1,000 square feet).
8. The variance is not based on economic considerations. The shape of the lot and the
location of the existing structures built by a prcvious owner limit thc placcment of an
accessible accessory structure.
Staff Recommendation
Based on the eight findings of fact, Staff recommends approval of the variance to exceed the 728
square foot limit for an accessory structure in the R-2 Zone subject to the following five
conditions:
1. The project shall be completcd in accordance with the plans submitted as part of the
Variance application. Any significant changes to these plans, as determined by the
City Planner, shall require review and approval by the Planning Commission.
2. The variance shall automatically expirc and become void one (1) year from and after
the date on which the Council granted such approval if work on the project has not
begun within that time period.
3. The accessory structure shall match the architecture and color scheme of the principal
structure,
4. The accessory stmcture shall not exceed the height of the principal structure,
5. Total accessory structure square footage on the lot shall not exceed 1,456 square feet.

A notice was sent to all residents within 350 fcet of the subject property. The notice was printed
in the Shoreview-Arden Hills Bulletin.

Staff has not received any public comments rcgarding this application.

Fiiinq Requirements and Payment of Fees
The City requests that you make a pre-application meeting wilh the City Planner to discuss the
application process. requirements, and deadlines. The undersigned acknowledges that she/he
understands that before this request can be considered. all required information and fees (including all
deposits) must be paid to the City in advance. If additional fees are required to cover costs incurred by
the City, the City Planner has the right to require additional payment from one or more of the
undersigned, who shall be jointly liable for such fees, Such expenses may include (but are not limited to)
direct city payroll and overhead costs. fees paid to consultants and other professionals, and the cost of
printing. mailing, and supplies, The City may withhold final action on a land use application and/or .
rescind prior action until all miscellaneous fees have been paid. Applicants are advised that an escrow
deposit is required at the time of the submittal of the Land Use Application to offset costs associated with
the proposed project.
Required Submittal information
The City of Arden Hills requires the following submittals for all Land Use Applications:
. A certified land survey.
. Site plan(s) (for all development projects).
. ~ve (5) large scale copies, folded in sets no larger than 8 y," x 14" with the print side facing out.
.7.ft;r(50) copies of 11" x 17" reductions of ALL PLANS MUST BE 3-HOLE PUNCHED AND,~
FOLDED.
. Mailing labels of all properties within 350 feet of the property (this information may be obtained from
Ramsey County).
True and accurate representation of the requirements outlined in the procedural form for the specified
type of request is the responsibility of the applicant.
Completellncomplete Applications
An incomplete application will delay the processing of land use requests. The application approval time
commences and an application is considered officially filed when the City Planner has received and
examined the application and determined that the application is complete A decision on whether the
application is complete or incomplete shall be made within fifteen (15) days following the submittal of the .
application. When the application is deemed to be "complete" it shall be placed on the agenda of the first
possible Planning Commission meeting occurring at least thirty (30) days from the date of official
submission of the application.

Notice of MeetinQ Attendance
. In order for the Planning Commission and the City Council to consider any application, the applicant or a
designated representative must be present at the scheduled meeting. If not. the matter will be tabled until
the next available agenda.
Aqenda Deadline and Meetinq Schedule
The deadline for submittal of land use applications is required according to the schedule outlined below.
There are no exceptions, All Planning Commission meetings are held on the first Wednesday of each
month at 7:00 PM. City Council meetings are held the last Monday of the same month at 7:00 PM,
Meetings are held in the Council Chambers at the City of Arden Hills. 1245 West Highway 96. Arden Hills,
Minnesota 55112, unless otherwise stated. Applicants are advised that additional meetings and/or
workshops are scheduled when necessary upon approval of the Planning Commission.

To Whom It May Concern:
I am in the process of applying for a variance for zoning ordinance in order to enlarge my existing
garage. I have considered attaching the garage to the house, but am unable to do this because it
will not meet the sideline requirements for side set back because of the triangular shape of my lot.
The roof is caving in on the existing garage, so something needs to done with the building. The
walls are still sound, so I would like to add onto the existing garage, install new roof trusses, to
the size of36' long x 34' wide.
I was informed that I could build two separate buildings of 72)3 square feet each, but feel this
would be out of character with other buildings in the neighborhood, and is not economical. .
My neighbor directly behind me currently has a garage that is larger that what is allowed, so my
garage would not be out of character with other garages in my neighborhood. I talked with my
immediate neighbors and- none have a problem with what my intentions are.

Requested Action
Guidant Corporation has requested a Master Plan PUD (6th) Amendment to reconfigure parking
on Guidant Drive South and construct a new 157 stall parking lot south of Guidant Drive South,
. The request also includes a proposal to remove 60 parking stalls and access to Lexington Ave
from the Arden Woods office building to create a landscaped buffer along Lexington Ave.

1. Overview of Request
The applicant is requesting a Master Plan PUD (6th) Amendment and Site Plan Review to
complete the following projects:
. Construct a new 157 stall parking lot on the south side of Guidant Drive South;
. Remove a portion of the median on Guidant Drive South and replace the parallel
parking spaces with 90 degree parking spaces on the south side of the road, which
will increase the total number of parking space on Guidant Drive South from 88 to
99. The north side ofthe road would no longer have parking.
. Remove 66 parking spaces from the eastern side of the Arden Woods office building
parking lot (three additional spaces have been removed for a small modification,
which is described under number 4. Parking).
. Remove the access to Lexington Ave from the Arden Woods office building

The Arden Woods office building, which was purchased by a subsidiary of Guidant
Corporation, is not part of the Master Plan document prepared by Guidant in 2002. .
However, Guidant has indicated that the property will likely be incorporated into the Campus
Master Plan. For the purposes ofthis application it is assumed that the Arden Woods
property will become part of the overall Guidant Campus; however, the requests in this
application do not preclude Arden Woods from acting as a separate conforming property in
the future if necessary.

The Guidant Master Plan proposes a six level, 900 stall parking garage in the place of the
proposed surface parking lot south of Guidant Drive South. The surface lot is essentially a
placeholder for a future parking garage. The parking garage is currently part of Phase II of
the Master Plan (2010-2015).
As noted above, the Arden Woods property is not included in the Guidant Master Plan.

1. Zoning - Meets Requirement
The Guidant Campus is located in an 1-1: Limited Industrial Zoning District and has a Master
Plan PUD Overlay which is the governing document for the Carnpus. A surface parking lot
is an approved use in both the I-I: Limited Industrial District.

, Although the proposed parking lot on the south side of Guidant Drive South will remove

approximately 52,000 square feet of landscaped area from the Guidant Calnpus, the Campus .
still exceeds the minimum landscaping requirement for the I-I Zone. Under this proposal,
total landscaped area will decrease from 53.9 to 52.6 percent on the Guidant Campus. Upon
full implementation of the Master Plan, the landscaping area is expected to be approximately
53 pcrcent (not including the Arden Woods property).
While the landscaped area on the Guidant Campus is slightly decreasing, the landscaped area
at tbe Arden Woods office building is increasing from 46.6 percent to 54 percent with the
added landscaped area along Lexington Ave.

The landscaped area for the combined properties will decrease from 53.5 percent to 52.7
pcrcent.
The proposed landscaped berm will be similar in character to the berm along the cast em edgc
of the Guidant parking lot to the north of South Guidant Drive on Lexington Ave (the
parking lot for the former Control Data building), The berm will range from about 12 to 20
feet higher than the Arden Woods parking lot, which is several fect below Lexington Ave.
The landscaped buffer will partially block the view of the parking lot from Lexington Ave.
Since there are no new buildings associated with this proposal, the City's requirements for
minimum caliper inches oftrecs are not triggered. However the minimum size rcquirements
would still apply. The minimum size of planted trees is 3 caliper inches for overstory
deciduous trees, 2 caliper inches for ornamental trees, and a minimum 8 foot height for

coniferous trees. The landscaping plan appears to meet all pertinent requirements of the
landscaping requircment in the Zoning Ordinance,
. The existing ash trees along Lexington Ave. at the Arden Woods parking lot will remain with
the new berm.
3. Aesthetics - Meets requirement
The additional green space along Lexington Ave at the Arden Woods office building should
improve the view of the property from Lexington Ave. The increase in green space benefits
the applicant by establishing a better appearance for a primary entrance to the Guidant
Campus. The change also benefits thc City by increasing green space and enhancing the
image ofthe City of Arden Hills to travelers on Lexington Ave.
Although the proposed 157 space parking lot south of Guidant Drive South will reduce the
amount of landscaped area on the Guidant Campus, it is unlikely that the parking lot will
have any visual impact to travelers on Lexington Avenue. The new parking lot is
approximately 260 feet from Lexington Avenue and most of the land between the proposed
parking lot and Lexington Ave. will remain vegetated.
4. Parking - Meets requirement with proof of parking
In order to comply with requests made by the Fire Marshall to ensure adequate access to the
. Arden Woods office building with the removal of access to Lexington Ave, the parking
island to the left of the entry from County Road F will be removed. Although this change is
not reflected on the site plans, an additional three parking spaces will be removed.
Removing the island will make the western portion of the building more accessible to the
larger fire trucks and satisfies an agreement made with the Fire Marshall and Building
Official to allow the removal ofthe access to Lexington Ave before the Arden Woods office
building is fully sprinkled.
The net change in parking stalls, including the above modification, is an increase of 105 new
parking spots.

Since the Arden Woods building is not part of the Guidant Master Plan and is a separate
property, it technically has separate parking requiremcnts from the Guidant Campus.
Although Guidant has indicated that the Arden Woods property is likely to be incorporated
into the rest of the Campus, a portion of the proposcd landscaped area could revert to parking

spaccs if the property is sold and additional on-site parking is needed. The proof of parking
shows that an additional 63 stalls could be created on the Arden Woods site, which would .
essentially replace the proposed landscaped bcrm.
Despite the increase in parking spaces, Guidant acknowledges that there is a 557 parking stall
deficit on the Guidant Campus per the Zoning Ordinance requirements. While Guidant has
indicated that thcre is a sufficient number of parking stalls on the Campus for employees and
visitors, Guidant has included a proof of parking for an additional 635 parking spaces, if the
space is needed. The proof of parking is on Plan G002 and can be found at the northeastern
portion of the Campus. According to the proof of parking, there is the potential for a new
415 space lot and a 220 space expansion of an existing lot.
s. Traffic, Access, and Circnlation - Meets requirement with conditions
The Lake Johanna Fire Department Fire Marshall, Eric Nordeen, has reviewed thc proposal
and offered several comments regarding the proposed parking modifications at Guidant. His
comments arc primarily centered on ensuring that emergency vehicles can safely and
completely access the Arden Woods building. Mr. Nordeen's original comments are in
attachment 3B-2.
A meeting was held with Guidant personal to review the Fire Marshall's concerns. From this
meeting, an agreement was made to modify the Ardcn Woods parking lot to ensure that fire
trucks have access to all sides of the building. As part ofthis agreement, Guidant will submit .
a schedule for completing the sprinkler installation in the Arden Woods building and the
access to Lexington Ave, can be removed before the sprinkler installation is complete. This
agreement is subject to final review by the Fire Marshall. Although the site plans do not
reflect the small change, thc island to the left of the entrance to Arden Woods from County
Road F win be removed, which is currently limiting the maneuverability of fire trucks in the
parking lot.
Although a traffic study has not been conducted regarding the removal of access to
Lexington Ave. from Arden Woods, the City Engineer, the Fire Marshall, and other City staff
agree that removing an uncontrolled access to Lexington Ave. may improve traffic safety on
Lexington.
6. Lighting - Meets Requirement
Thc Zoning Ordinance requires that lighting shall not cast more than 0.4 foot candles on
adjoining residential property and not more than onc foot (1.0) candle on the travellancs of
adjoining public streets. Since the parking lot modifications at Arden Woods would move
light poles farther away from a public street this should not be a problem. There are no
residential properties in the vicinity of the proposed south parking lot.

7. Grading and Utilities - Meets Requirement with conditions
. The City Engineer has reviewed the grading, drainage, and utility plans for the proposal, and
those comments are attached. A condition requiring compliance with the comments in the
letter are included as a condition for approval that must be completed before any building
permits are issued.
The City Engineer also noted that permits must be obtained from the Ricc Creek Watershed
District (RCWD) before any building permits are issued.
Staff Recommendation
In Planning Case #06-0] 0, Staff recommends approval of the Planned Unit Development Mastcr
Plan (6th) Amendment and Site Plall Review subject to the following conditions:
1. The applicant shall continue to abide by the conditions of approval as stated in the
approved Master Plan PUD except as alnended by the six subsequent amendments,
2. A PUD Amendment fornI, drafted by the City Attorney, shall amend the PUD and
encompass all five amendments to the Master Plan PUD, A building permit may only be
issued after the PUD Amendment document receives the approval of the City Council
and is executed by both the City Council and the applicant.
3. The project shall bc completed in accordance with the plans submitted as part of the
master plan amendment and site plan review application. Any significant changes to
. these plans, as determined by the City Planner, shall rcquire review and approval by the
Planning Commission.
4. The master plan amendment and site plan review shall automatically expire and become
void one (I) year from and after the date on which the Council granted such approval if
work on the project has not begun within that time period.
5. The applicant shall obtain any necessary permits from Rice Creek Watershed, the
Pollution Control Agency, the NPDES (National Pollution Discharge Elimination
System) permit, and any other necessary permits before a building permit is issued. The
City shall be copied with all required permits.
6. Any changes to the grading, erosion, or drainage plans shall be submitted to the City
Engineer for approval.
7. Erosion control measures shall be inspected by the City Engineer before construction
begins.
8. The applicant shall comply with the following conditions recommended by the Lake
Johanna Firc Department:
a. The applicant shall install "No Parking Fire Lane" signs on the north side of
Guidant Drive South upon completion of the changes to Guidant Drive South.
b. The entrance from County Road F to the Arden Woods parking lot shall be
modified to allow fire apparatus to turn east or west into the lot.
c. Thc entrance from Country Road F to the Arden Woods parking lot shall maintain
an unobstructed vertical clearance of not less than 13 feet 6 inches.

d. The applicant shall submit of a schedule for completing the installation of
sprinklers in the Arden Woods office building for approval by the Fire Marshall .
before any building permits are issued.
9. The applicant shall comply with the conditions recommended by the City Engineer in the
March 28, 2006, memo to the City Planner. Updated site plans, including the changes
made with the agreement with the Lake JohaJll1a Fire Department, shall be submitted for
approval by the City Engineer and Fire Marshall before any building permits are issued.
10. The applicant shall provide an "as built" survey upon completion of the project that
includes all required changes.

and mailed to residents within three-hundred fifty (350) feet ofthe subject property.

Completellncomplete Applications
An incompiete application will delay the processing of land use requests. The application approval time
commences and an application is considered officially filed when the City Planner has received and
examined the application and determined that the application is complete. A decision on whether the
application is complete or incomplete shall be made within fifteen (15) days following the submittal of the
application. When the application is deemed to be "complete" it shall be placed on the agenda of the first
possible Planning Commission meeting occurring at teasl thirty (30) days from the date of official .

Description of Request .
This submittal describes surface parking modifications on the Guidant Corporation
campus and the adjacent Arden Woods property recently purchased by Guidant
Corporation.
Modifications consist of the following:
Guidant Drive South:
Remove two foot wide center island to allow for 90 degree parking along the south curb
line. The existing width of Guidant Dr. So. is approximately 48 feel. The proposed
change would provide 18 foot deep parking stalls with a 30 foot wide two-way drive.
New Surface Parking Lot:
Create a new 157 stall surface parking lot approximately 20 feet south of Guidant Dr. So.
and approximately 300 feet west of Lexington Ave. Access to the lot will be via a new
curb cut in Guidant Dr. So. that aligns with an existing curb cut to the north.
Arden Woods Parking Lot Modifications:
Remove 63 parking stalls at the east side of the existing parking lot, adjacent to
Lexington Ave. Close the existing curb cut onto Lexington. Construct a landscaped
berm, 90 feet wide, between Lexington and the remaining surface lot. The berm will
extend /Tom approximately 50 feet north of County Road F to the north property line of .
the Arden Woods lot. The berm will be landscaped in a fashion similar to the berm east
of Building F. There will be no change in the quantity of handicap accessible stalls for
Arden Woods, The parking requirements for Arden Woods will be met through "proof of
parking". The proof of parking shall consist of the reconstruction of the 63 removed stalls
if they required by future occupancies.

Thanks again for meeting with us today. We appreciated the opportunity to meet face to face and resolve the
concerns.
As I mentioned in my subsequent phone cail to James, we will be including the removal of the center island (in
front of the Arden Woods office building) within the scope of work to be completed during the modifications, As
was discussed at the meeting. by adding this additional work to the project, we will have met the Fire
Department's need for access to the southwest side of the building, Additionally, I will send a letter to Eric directly
(copying James and Dave) that will outline the phase out of the outside tenancy of the building, which will in turn
provide a timeline for the sprinklering of the site. With these two actions. Eric agreed to withdraw the concern
about the Lexington Ave closure ahead of complete sprinklering of the building,
With respect to the other comments about the Arden Woods modifications, the address of the building will remain
4105 Lexington Ave North and there will be no less than 13 feet 6 inches of unobstructed vertical clearance from
County Road F.
. Finally, with respect to the Guidant Drive South comments, we provided plans that were acceptable to Eric which
showed the turning radii from either direction, And we agreed to post the north side of Guidant Drive South as
"No Parking" in the area to be modified when the project is complete.

I recently received comments from the Lake Johanna Fire Chief regarding your application to construct a new
parking lot on the Guidant Campus and to modify the parking at the Arden Woods parking lot. While I do not
. think that his comments will delay Guidant's application, his recommended conditions for approval are fairly
substantial. His letter will be included with the report to the Planning Commission and will be included with my
recommended conditions for approval. Since at least one of his recommended conditions may affect the timing of
the project, I wanted to send you a copy of his comments to help you prepare for the April 5 meeting, If the

application is approved. the Planning Commission is likely to include all of the recommendations from the Fire
Chief as part of the conditions for approval.
The Fire Chiefs comments are as follows: .
Guidant Drive South
-- Recommend installing "No Parking Fire Lane" signs on the north side of Guidant Drive South when completed,
-- Verify the turning radius into the new parking lot and the width of entrance to ensure that fire apparatus can turn
into the lot from either direction.
Arden Woods Modifications
-- The entrance from Lexington Ave must remain until the building is completely outfitted with sprinklers.
-- The entrance from County Road F must allow a 55' turning radius at the entrance of the parking area to allow
fire apparatus to turn east or west.
-- Verify if the address is going to be chance since the building will not have access to Lexington Ave.
-- The entrance from County Road F needs to maintain an unobstructed vertical clearance of not less than 13 feet
six inches.

Front Porch Encroachment

In May 2005, the City adopted an amendment to the Zoning Ordinance that allowed front porches to
encroach into the front setback under certain conditions without a variance (Section 6.C.2.d of the
Zoning Ordinance). One of the conditions was that the front porch could not be any closer than 30 feet
to the front lot line. However, in certain parts of the City (e.g, Chatham neighborhood), many ofthe
homes were built 30 feet or less from the lot line, which preeludes them from constructing a front porch
per the current front porch ordinance amendment. Although the amendment did increase flexibility for
. many ofthc dwellings in the City, entire neighborhoods are still unable to construct a front porch.
In September 2005, the Planning Commission reviewed an ordinance amendment proposal to allow the
construction of a front porch for homes that are closer than 40 feet to the front lot line in the Chatham
Subdivision. Based on a review of the minutes from that meeting, the Planning Commission was
concerned with the proposal because it singled out a specific neighborhood and may not have resolved
the issue for most of the dwellings in Arden Hills. Staff was requested to revise the ordinancc
amendment with the intent of resolving the issue for virtually all dwellings in the City instead of an
ordinance for a specific neighborhood.
Ordinance Proposal
Staff has prepared an ordinance amendment that addresses the front porch encroachment issue for
virtually all dwellings in the City in a consistent manner. The basic idea of the amendment is to change
from an ordinance that states porches cannot be closer than 30 feet to the front lot line to a more flexible
but consistent standard, The new language determines the extent of the front porch encroachment on the
current distance between the dwelling and the front lot line. Essentially, the closer a dwelling is to the
front lot line, the smaller the allowed encroachment is for the porch.

The proposed amendment would allow the front porch to extend into the front setback up to 25 percent
of the existing setback between the front lot line and the dwelling. For example, if the dwelling is 30
feet from the front lot line, the porch could encroach up to 7.5 feet into the front yard (30 feet * .25 = 7.5 .
feet). However, no porch could be eloser than 20 feet to the front lot line without a variance. While
there may be a handful of properties that this amendment does not cover, this ordinance proposal
provides a consistent front porch encroachment standard for most properties in the City.
Furthermore, this ordinance amendment cxpands the front porch flexibility to more residential
properties in the City while protecting the current privileges of property owners. Under the existing
ordinance language, dwellings that are 40 fcet from the front lot line can construct a front porch up to 30
feet from the front lot line. This new ordinance language preserves the ability of those dwelling (40 feet
* .25 = 10 foot front porch encroachment).
Discussion Points
There are three remaining issues that need to be resolved regarding this proposal:
1. Should lots redeveloped after the adoption of this Ordinance be requircd to meet the full 40 foot
setback, including the front porch?
2. Should lots that were vacant before the adoption of this Ordinance be required to meet the full
40 foot setback, including the front porch?
3. Currently, up to 35 percent of the fa~ade of the covered porch may be occupied by columns,
spindles, or railings. Solid walls (even partial) are prohibited. Should glass be allowed to be a
part of the 35 percent of the fa~ade that may be covered?
If the covered porch is required to be set back farther from the front lot line with a redeveloped
structure, it may be viewed as a penalty to rebuild a dwelling ifthe porch has to be farther back from the .
front lot line than what would have been allowed had the old structure remained. However, it is always
a goal to reduce the number of non-conforming structures where feasible.
The existing covered porch ordinance does not distinguish between developed, redeveloped, or vacant
lots. Currently, any residential lot may have a front porch as close as 30 feet to the front lot line.
The question regarding glass was brought up by the Building Official for clarification.

VARIANCE PROCEDURES
WHAT Is A VARIANCE?
A variance is a legally permitted deviation from the provisions of the Zoning Ordinance as deemed necessary by
the Planning Commission and City Council when the strict interpretation of the Ordinance would create undue
hardship or restrict reasonable use. To determine if a hardship exists, the City must find that the strict
interpretation of the Zoning Ordinance is impractical because of circumstances related to lot size. shape,
topography or other unique characteristics of the property, However. it must be determined that the variance will

CITY REVIEW PROCEDURE:
1. Applicant reviews proposal with City Planner before plans are finalized.
2. Applicant submits application and supporting documents to the City.
3. Planner prepares written review of application for Planning Commission and City Council (City Attorney,
Engineer, Building Inspector and Fire Chief may also prepare reviews depending upon issues involved in
application),
4. Planning Commission reviews proposal and makes recommendation to City Council.
5. City Council reviews application and takes action.
6. City Staff processes permits.
HARDSHIP CRITERIA:
The variance procedure in the Arden Hills Zoning Ordinance (Section Viii, 4) and Minnesota statures 462.357 Subd,
6, requires the City to consider seven matters when hearing requests for zoning Code variances:
1. The property in question cannot be put to a reasonable use if used under conditions allowed by the official
controls;
2. The plight of the landowner is due to circumstances unique to the property not created by the landowner;
3. The deviation from the Ordinance with any attached conditions will still be in keeping with the spirit and intent
of the Ordinance;
4. The variance will not create a land use not permitted in the zone;
5, The variance will not alter the essential character of the City;
6. The variance is not for economic reasons alone;
7. The proposed use is permitted within the zone.
Depending on the application, the City may include other evaluation criteria as deemed necessary. Responses to the
above seven criteria must be referenced in a written statement describing the project proposal.
INFORMATION REQUIREMENTS:
The application and supporting documents must be submitted at least thirty days before the Planning Commission
meeting, which is usually held the first Wednesday of each month. Please review the project checklist to ensure that
all required materials have been submitted, While a certified survey is not required in all circumstances, please

At the March 13, 2006, City Council meeting, the Council voted to approve a one-year sign
moratorium while Staff develops a revised sign ordinance. Recent court cases in Minnesota and
around the country regarding billboards and other forms of advertising have prompted us to
review the Arden Hills sign ordinance to ensure that it is conformance with State statutes, is
constitutional, and is meeting City needs.
. In order to help make the moratorium a smooth transition for residents and business, the
following exceptions are in the moratorium:
1. Signs in commercial and industrial areas may still be refaced provided that the new
facing is not any larger than the previous face. Re-facing refers to changing the message
on the sign and not (he sign structure itself. This process would still require a permit.
2. Residential areas can post a sign that is six square feet or less in size without a permit. A
primary reason for this provision is to allow residential properties to post a for sale sign
without the need for a permit.
3. New temporary signs may be posted with a permit for up to 90 days or upon termination
of the moratorium, whichever is earlier, subject to certain provisions listed in the
moratorium.
The moratorium has been enacted for up to one year. If the moratorium is needed for more than
one year, it can be extended after a public hearing is held; however, we anticipate reviewing and
adopting a new sign ordinance within next few months. Upon adoption of a new sign ordinance,
the moratorium will be lifted.
When the sign ordinance update is ready for public comment, it will be brought to the Planning
Commission for review.
No action is required at this time.

A MORATORmM RELATED TO THE PLACEMENT OF SIGNS
The Arden Hills City Council Ordains:
372.01 Recitals.
A. The City of Arden Hills ("City") is in the process of reviewing its
regulations regarding new permanent signs and temporary signs in the
City.
B. As used herein, "Sign" means any name, identification, description,
display, logo, illustration or device which is affixed to, painted or
rcpresented directly or indirectly upon a building or other surface or piece
ofland, and which directs attention to an object, product, place, activity,
person, institution, organization or business.
C. The existing Sign Ordinance is incompatible with City goals and may
allow undcsirable sign types and sizes,
D. The City anticipates that there will be additional submittals for the .
construction of new permanent signs in the City.
E. In order to permit the City Council to review and evaluate changes to the
City's current regulations and to preserve the integrity of the planning
process, the Arden Hills City Council hereby determines that a sign
moratorium for new permanent signs temporary is appropriate.
372.02 Exceptions. The City hereby adopts a sign moratorium applicable to the
construction or installation of new signs in the City except for the following:
A. Construction of signs in residential sign district 1 and district 2 (Figure 1)
shall be allowed without a permit, provided that they are six squarc feet or
less in size, are less than eight feet in height, maintain the structure
setbacks of the underlying zone, and are not illuminated in any form.
B. The sign face on an existing wall, freestanding, monument, or pole sign
may be replaced with a sign permit provided that the new sign face does
not excecd the dimensions of the sign face before the adoption of this
Moratorium.
C. Temporary signs may be permitted with a sign permit for a total of90
days per calcndar year or upon termination of the Moratorium, whichever
is earlier, provided that the temporary sign does not require any new
construction or structural modifications and is in accordance with the sign
area, height, and lighting restrictions listed in Table 1.
D. Off-site signs and billboards shall be prohibited in all sign districts in .
Table 1.

. E. Official public notices or warning signs required by local, state or federal
I law, including but not limited to traffic control and other regulatory

372.03 Duration of Moratorium. The sign moratorium will commence on the
effective date ofthis ordinallce and will continue for one year thereafter unless
otherwise tenninated or extended by action of the City Council.
372.04 Enforcement. The City may enforce any provision ofthis ordinance by
mandamus, injunction, or any other appropriate civil remedy in any court of
competent jurisdiction.
372.05 Separability. Every section, provision, or part of this ordinance is declared
separable from every other section, provision or part of this ordinance. If any
section, provision, or part of this ordinance is adjudged to be invalid by a
court of competent jurisdiction, such judgment shall not invalidate any other
section, provision, or part of this ordinance.
Effective Date. This Ordinance shall be effective the day following its
publication or on the day following the publication of an Ordinance Summary
approved by the Arden Hills City Council.
. Adoption Date. Passed by the Arden Hills City Council on this 13th day of
March, 2006.

SUBJECT: BlueCross BlueShield Comprehensive Plan Update Opportunity
The Metropolitan Council requires jurisdictions to submit a comprehensive Plan outlining their
policies and objectives related to land use and zoning. This plan is required to be updated every
ten years, and the next update is due at the end of 2008.
BlueCross BlueShield of Minnesota is offering mtmicipalities the opportunity to apply for a
grant to encourage active living in the comprehensive plan. The grant is intended to assist
municipalities to integrate active living principles into their communities. Specifically, this
funding opportunity is designed to support communities in preparing their comprehensive plan
. and identifying relevant ordinance subsections for modification in keeping with the new plans.
The term "active living" denotes a way of life that integrates physical activity into daily routines,
not just for recreational purposes, but also for utilitarian purposes such as errands, trips to the
grocery store, community to work, etc. Research shows that cities can have a positive impact on
rates of physical activity through planning and policy.
The grant would provide up to $75,000, as well as providing technical assistance and training
opportunities.

SUBJECT: Comprehensive Plan
The next Comprehensive Plan update is due at the end of 2008. While that seems like a distant
date, the comprehensive planning process takes a considerable amount of time and effort to
produce a quality, useable product. Over the next several months, Karen Barton and I will be
attending training sessions at the Metropolitan Council to learn about the information
requirements and analyses that must be included with the updated Plan.
Although no action is required at this time, please keep it in the back of your mind that the
. planning process is on the horizon and will involve the Planning Commission. The
Comprehensive Plan helps set the stage for what residents and businesses what the City of Arden
to look like and how the City should function in the next 10, 20, an 30 years. Just as important,
the Plan helps all of us understand the role that Arden Hills plays in the metropolitan region.
The Comprehensive Plan is an extremely important document that will require a considerable
amount of staff time and resources as well as community involvement.
