The Council is asked to approve the Minutes of the August 25,1997 Regular Council
I meeting.

I The Council is asked to approve claims in the amount of$I92,646.27, and payroll
for the period most recently ended. The Council should note payment to MCES
in the amount of $48,322 for September sewer charges and $40,441.50 for July
Ie SAC charges; and to Ramsey County in the amount of $49,309 for September law
enforcement.
I b. Newsletter Committee Appointment
The City Council is asked to appoint Sharon Hanzalik to the Newsletter
Committee.
I 3. Unfinished and New Business
I a. Res. #97-41. ClariJYinl! Proposed Sums of Money to be Levied for Levy Year
1997. Payable in 1998
I The City Council is asked to adopt Resolution #97-41, clarifying proposed sums
of money to be levied for levy year 1998. This motion would adopt the
preliminary levy of$I,864,320, which is a 1.91% increase, or $35,000, from the
I payable 1997 levy.
b. Res. #97-42. Adopting Truth-In-Taxation Hearing Dates and Location for
I Proposed 1998 Taxes Pavable
The City Council is asked to adopt Resolution #97-42, adopting Truth in Taxation
hearing dates for proposed 1998 taxes payable, The initial Truth in Taxation
I hearing is scheduled for December 4, 1997, with the continuation hearing
scheduled for December 11, and the final hearing scheduled for December 15,
.. 1997. Each of these meetings is scheduled for the Army Reserve Center at 7:30
p.m.

The City Council is asked to adopt Resolution #97-44, adopting the preliminary I
1998 budget. The preliminary budget for 1998 is required to be adopted by
September 15, 1997. However, whereas the adopted levy cannot increase once
adopted, the preliminary budget is not subject to these same restrictions. I
d. Res. #97-43. Recciving Preliminary Feasibilitv Report. 1998 Street
Improvement Project I
The City Council is asked to adopt Resolution #97-43, receiving the Preliminary
Feasibility Report for the 1998 Street Improvement Project. Hearings have not
been scheduled, pending final review and selection of an engineering firm for I
1998.

e. Planning Case #95-16. Balfanv Final Plat. Development Al:reement I
The City Council is asked to approve the Pinal Plat related to Planning Case #95-
16, Balfany Development Company, and the Development Agreement for the
construction of public improvements in the form of the road and utilities. I
f. Cummings Park. Trail Washout. Award Bid (Disaster Relief Funds)
The City Council is asked to award the bid for the completion of the Cummings ~
Park Trail washout project to Rehbein Construction, with an apparent low bid of
$30,905. This project will be started immediately with completion targeted for I
around October 1,1997.

I Pursuant to due call and notice thereof, Mayor Dennis Probst called to order the regular
City Council meeting at 7:32 p.m.
. Present: Mayor Delmis Probst, Councilmembers Beverly Aplikowski, Dale Hicks,
Susan Keim, and Paul Malone.
I Absent: None.
Also present were: City Administrator, Brian Fritsinger; City Accountant, Terry Post;
I Community Development Director, Kevin Ringwald; Public Works Superintendent,
Dwayne Stafford; City Engineer, Greg Stonehouse; Administrative Secretary, Sheila
I Stowell, and Recording Secretary, Cindy Schneider.
After calling roll, it was decided unanimously that from this time forward, it would be

I Councilmember Keim referred to Councilmember Aplikowski's questions raised regarding
lake shore setbacks on Page 2 of the Regular City Council minutes. Councilmember Keirn stated
that these questions appeared to remain open and unanswered, and inquired if the questions had,
I in fact, been answered. Mr. Brian Fritsinger, City Administrator, stated they had not been
answered,

A-I. Planning Case #97-15, Variances (Fence) - Michael Welsh, 1509 Colleen Avenue
Mr. Ringwald stated the applicant is requesting approval of variances to allow for the continuing I
existence of a fence. Specifically, these variances are for a fence that exceeds the height
_. requirement inthe frontxard, is not 30% open for air flow and does not have its finished side I
out.
On August 6,1997, the Planning Commission recommended denial of the variances to allow for ..
the continuing existence of a fence on height and direction of finished side, and recommended
approval of a variance for 30% open for air flow, because this section of the Code is being
proposed for elimination I
Mike Welsh, 580 Cleveland Avenue SW, #12, New Brighton (Formerly of 1509 Colleen I
Avenue), came forward to address Council. He urged Council to reconsider this matter, as the
Mayor was not in attendance at the meeting where the administrative appeal was originally
denied, He noted that the Planning Commission originally approved these variances, and was I
surprised to have their decision reversed by the City Council. He stated he and his wife feel they
are being harassed by the City. He stated a variance was applied for last Fall, which was not
mentioned in Mr. Ringwald's background memo, and was awaiting a decision on the conflict of I
code at that time. He inquired if the Code has now been changed.
Mr, Ringwald stated a proposal is before Council for later in the meeting to eliminate the I
requirement of30% open for air flow.
Mayor Probst inquired why the applicant was before Council tonight if he is no longer the I
property owner of record. Mr. Welsh explained he received the violation notice in May, and they
closed on their house in June. Mr. Ringwald added the City assumes Mr. Welsh has told the
present owner ofthe code enforcement action currently against this address, as they were I
informed prior to the sale, Mr. Ringwald also noted that he had notified the real estate agent
representing the Welsh's about the violation. ..

it Mayor Probst inquired if the only section of Code that was unclear was the 30% open for air
flow, Mr. Ringwald stated that was correct, and added the applicant was told last fall that all
other sections of the code would be enforced except for possibly the 30% open air flow
I requirement. When the fence was observed this spring, it was noted that the required repairs had
not been made, and a notice was sent at that time.
I Councilmember Hicks inquired regarding the height variance request. Mr. Ringwald stated the
part of the fence that faces Colleen Court in front needs to be lowered to 36 inches.
I Mr, Welsh stated Colleen Court did not exist when this fence was originally built.
Councilmember Aplikowski inquired if the applicant was presently living at this address, Mr.
I Welsh stated he was not.
Councilmember Aplikowski inquired why the applicant was before Council and not the present
I owner of the property. Mr. Welsh stated that based on Mr. Ringwald's statements, he held off on
any rcpairs made to the fence until the code is changed.

I Mrs. Francesca Welsh stated she has seen fences in the City with similar circumstances as
theirs, and feels the City"is making these requirements more on principal than a desire for code
enforcement. She stated she feels the fence should be "grandfathered" in, because it is nine years
Ie old. Mayor Probst stated this process started with a complaint to the City, and further noted the
fence was never granted a building permit.
I Mrs. Welsh stated the adjacent neighbors have stated they don't mind the present appearance,
and that it was neighbors further down the block that complained, Mr. Welsh stated he has seen
I at least four other fences in the City with the same problem as his fence,
Councilmember Aplikowski inquired if the part of the fence with the height problem was an
I entrance fence. Mr. Ringwald stated this fence is technically on the front yard of the property,
but appears as a side or rear property line due to how the house sits on the lot.
I Mr. Welsh stated that Colleen Court did not exist when the fence was built, and he did not find it
logical to put the finished side out on an undeveloped acre of land,
I Councilmember Hicks stated the Welsh's shouldn't feel as ifthe City is harassing them; even if
there are other fences in the City with the same problem, theirs has received a complaint and
needs to be dealt with. He stated if the neighbors to the east had no problem, he could support a
I variance for the unfinished side and 30% open air flow, but would still support reducing the
height.
I Councilmember Aplikowski stated it would be just as much work to repair one problem as it
would be to repair both, and stated she is considering granting a variance for everything.

Mayor Probst inquired where the front yard is on this property, Mr. Ringwald showed an ..
overhead of the property.
Mayor Probst stated the ordinance was in place when this fence was built, and to grant these
variances would set a bad precedent, as the City can't arbitrarily approve one and not another. I
He stated it would be possible to approve a variance for height but not for the finished side out.
Councilmember Malone statcd the fence was also built without a permit, and a building I
contractor would have known the finished side belongs facing out. He stated others in the area
have complied with the ordinance, and to grant a variance would send the wrong message to I
others in the area who have obtained permits and are in compliance with Code.
Mr. Welsh stated he knows of a fence built just last summer that does not comply with the 30% I
open for air flow ordinance. Mrs, Welsh stated the repairs would necessitate destroying the new
owner's and adjacent neighbor's landscaping.
Mr. Ringwald noted that neighbors directly adjacent to this property have talked to staff, as of I
.-. last summer.
MOTION: Malone moved and Hicks seconded a motion to deny the variance for height in I
front yard and finished side out, but approve the 30 percent open for air flow
vanance. .-
Councilmember Keirn noted an item can only be "grandfathered" in if no ordinance existed at the
time of construction, and this was not the case with this fence, I
Councilmember Hicks inquired if the new owners had been informed of this issue, as it would be
the new owner's responsibility to correct the problem. He stated he hopes they were told, as I
doing so would have been the responsibility of the Welsh's.
Councilmember Aplikowski stated she knew of another similar problem in the area, and that I
fence was able to be brought up to Code without any major destruction of landscaping. She
further stated this problem was no longer the applicant's responsibility. Mrs, Welsh stated they I
are still the ones receiving notices from the City regarding this matter,
Mayor Probst asked for a vote on the motion, I

A-2. Planning Case #97-]6, Site Plan ReviewNarianee (Height of Structure) - Friskies I
Pet Care, 4251 Fernwood Avenue
Mr. Ringwald stated the petitioner is requesting approval of site plan review for a 672 square I
foot addition which is to accommodate an enclosed silo onto their existing facility, including a ..

f' height variance (42 feet proposed, when 35 feet is allowed). This silo will make the operation of
the plant more efficient, but is not expected to increase production.
I Mr. Ringwald showed overheads of the existing and proposed silos, and the screening to be
provided. The Planning Commission at their August 6, 1997 meeting, required that additional
screening in the form of evergreen trees be provided, The Planning Commission also
I recommend approval of the height variance and the site plan review at this meeting.
Mayor Probst requested clarification that the proposed silo will look identical to the existing one,
I Mr. Ringwald stated that was correct.
MOTION: Malone moved and Hicks seconded a motion to approve the height variance and
I site plan review in Planning Case #97-16, contingent upon the applicant
complying with the Planning Commission recommendations for screening. The
motion carried unanimously (5-0).
I A-3. Planning Case #97-18, Zoning Ordinance Modification - City of Arden Hills
I Mr. Ringwald statcd the Planning Commission recommended approval of the amendments to the
following ordinances: VI, C, I, a; VI, C, I, d; VI, C, 2, a; VI, E, 4, c; VI, G, 3, a(2); VI, G, 6, a;
and IX, A, 2; and to dcfer action on recommendations for the following ordinances: VI, E, 4, d
Ie and VI, F, I, e. If the City Council is supportive of the proposed modifications to the Zoning
Ordinance, then the City Attorney should be directed to prepare the ordinance for Council's
I approval, which would incorporate these changes into the Zoning Ordinance. The Staff
anticipates bringing sections VI,E,4,d and VI,F, l,c to the Planning Commission in October rather
than September, due to the changes suggested requiring a republication of the Public Hearing
I noticc.
Councilmembcr Malone stated he was under the impression that VI, F, I, c (Building Standards)
I requires that all driveways be pavcd, Mr. Ringwald stated it does rcquire that drivcways be
paved, except for single and two-family homes.
I Councilmember Malone inquired regarding the 30% open for air flow rcquirement, stating the
original intent was to not have solid fences. He stated varianccs have been denied for solid
walls, but other sections in the Code permit walls.
I Councilmember Malone stated he is hesitant to approvc dcletion of the 30% open for air flow
requirement. Mr. Ringwald stated this ordinancc could be pulled and brought back for further
I discussion.
I Mayor Probst inquired if the recodification would be a separate action by Council. Mr.
Fritsinger replied it would be separate.
.. Mr. Ringwald stated his preference to discuss the Code regarding walls at a later date.

Council member Malone sought clarification on the interpretation of Section VI, C, 1, and that it ..
was the intent that if houses on the same block were closer to the street or on a mean setback
line, that became the setback line, not necessarily further back. The current code states that,
where the principle buildings have a different setback from the minimum, the setback of the new
structure is not less than the prevailing setback; allowing recognition of houses closer to the I
street than the prescribed 40 feet in certain neighborhoods. In situations where the principle
buildings have a greater setback, COLmcilmember Malone suggested his interpretation of the I
intent was not to push other buildings back. Councilmember Malone inquired ifthere had been
cases come before the City where prevailing setbacks were an issue.
Mr. Ringwald replied affirmatively, and that variances for setbacks had been granted based on I
other houses in the area having corresponding setbacks, Mr. Ringwald cited several examples,
and stated it was current City practice to require a variance for less than minimum setback, or I
lines were drawn and a median number used. A discussion ensued regarding related setback
Issues.
Mayor Probst stated he does not fully understand the 30% open for air flow requirement, stating I
there are many fences in the City that do not meet this requirement, but are still attractive to look
at. Mr. Ringwald stated this issue could be set aside and discussed further in the future. I
Council member Aplikowski noted businesses have high fences and do not have open for air flow
requirements, Mr. Ringwald stated this is for screening. ~
Councilmember Aplikowski noted this could be taken as a double standard, as the ordinance
reads "except for screening". I
MOTION: Hicks moved and Malone seconded a motion to authorize the City Attorney to
make the changes to the Zoning Ordinance as recommended by the Planning I
Commission, excepting the sections outlined in the attached memo and section
VI, E, 4, c for fulther clarification. I
Councilmember Malone requested an amendment to approve section VI, E, 4, c since the
majority of the Council approvc of this change. Councilmember Hicks accepted the amendment. I
Councilmember Aplikowski suggested this section should not be approved until the solid wall
issue is completely clarified. I
Councilmember Malone withdrew the amendment.
Councilmember Aplikowski inquired why Round Lake is classified as Recreational I
Development. Mr. Ringwald stated this c1assilication is assigned by the Department of Natural
Resources (DNR), not by the City. He suggested this classification may have been applied due I
to the normal recreational character oflakes, even though not applicable to Round Lake,

B. Comprehensive Plan, Request for Proposals (RFP's)
I Mr. Ringwald stated Staff is requesting City Council authorization for a Request for Proposals
for updating the City's Comprehensive Plan to a short list of planning firms in the Twin Cities
I (approximately 9), Mr. Ringwald advised the Council that Staff had received notification earlier
that day that the City of Arden Hills has been awarded a grant of approximately $8,300 from the
Metropolitan Council to aid in updating the City's Comprehensive Plan,
I Mr. Ringwald requested that Council review the dateline in the attached memo to see if these
dates would work with their schedules.
I Mayor Probst inquired ifMr. Ringwald needed a commitment to these dates at tonight's meeting.
Mr. Ringwald stated he would, if the Request for Proposals is approved.
I Councilmember Malone inquired if a large response is expected, Mr. Ringwald replied he
-- expects replies from most of the firms sent a Request for Proposals.

MOTION: Malone moved and Aplikowski seconded a motion to authorize Staff to prepare (
the Request for Proposals and that the RFP's be distributed to the planning firms
Ie identified, The motion carried unanimously (5-0).
C. Award Contract for South Water Tower Maintenance and Repairs
I Dwayne Stafford, Public Works Superintendent, stated engineers reviewed the South Water
I Tower and estimated the necessary repairs at approximately $25,000. Proposals for this work
have now been received, and Staff wishes to award the bid to Odlund Protective Coatings for
$20,450, This company also did repairs for the North Water Tower, and they are able to begin
I work this fall.
MOTION: Malone moved and Keim seconded a motion to award the bid for repairs to the
I South Water Tower to Odlund Protective Coatings in the amount of $20,450, with
the work to be completed by October I, 1997. The motion carried unanimously
(5-0).
I ADMINISTRATOR COMMENTS
I Mr. Fritsinger stated he wished to comment on the absence of Gateway Business District items
on the agenda, as these items were expected to consume a large portion of tonight's meeting.
I Mr. Fritsinger stated bids for the work on 14th Street have been received, and the City can move
forward once the final purchase agreements from Welsh are signed. However, this has not

happened yet. He stated the City has 90 days to act on these bids, and could either return them to ..
the bidders, or hold them for a short period of time while the Welsh issues are being resolved.
Mayor Probst suggested holding onto the bids for the moment, as the City has only just received
them. He inquired what issues are holding up the Welsh agreements. Mr. Fritsinger stated the I
main issues are property acquisition dates.
Mayor Probst inquired what the issue was with the property acquisitions, Mr. Fritsinger stated I
Welsh is mainly concerned with the high cost of soil correction on some of the parcels, Welsh is
reluctant to close on these parcels until the exact soil correction figures are known, There are
various soil experts working on proposals at the moment. I
Mayor Probst agreed that work should not continue in this area until those issues are resolved. I
Mr. Ringwald stated that work camlot continue until these issues are resolved, as the property
would not be Welsh property until the purchase agreements are finalized,
Mr. Stonehouse stated the figures for the 14'h Street work came in slightly lower than originally I
estimated,
Councilmember Malone'stated the low bidder should be contacted and told of this situation, and I
that their bid may not be acted on in the near future,
Mr. Fritsinger stated the City's concern with these delays, stating the bid probably could not be .-

COUNCIL COMMENTS I
Councilmember Keim referred to a recent article in the Bulletin, stating the article may have I
misled citizens, as it is not clear whether a pedestrian trail will be constructed over I-35W or over
Highway 10, She stated it may be helpful to try and let citizens know of the City's position, and
ofthe errors that were in this article. I
Mr, Fritsinger stated this issue was discussed with staff of the Bulletin, and they reported on the
conversations that went on at the meeting. I
Mayor Probst stated the article may lead people to believe that a safe pedestrian trail with no
vehicle conflicts will be built over I-35W, and this is not the case. I
Councilmember Keim agreed, stating the article makes the trail sound much safer than the City
believes it will be. I

Mayor Probst complimented Mr. Fritsinger's recent article in the Bulletin regarding bonding
I issues associated with this project.
Mayor Probst requested clarification that the proposed agenda for the September 15th Council
I Worksession will be the agenda used. Mr. Fritsinger stated he wishes to discuss the topics as
noted, as they are an extension of what was discussed at the recent Staffretreat.

Background
Staff has been developing, reviewing and summarizing the proposed 1998 budget throughout the
summer. At the outset of this process, Council gave general direction to staff with regards to pay
plan assumptions, capital plan items and net levy percentage increase expectations. ,
- . At this stage in the budget process, a levy after HACA and LP A payable in 1998 of $ I ,864,320 is
being proposed. This preliminary levy represents a 1.91 % or $35,000 increase over the
comparable payable 1997 adopted levy. The following table analyzes the need for this level of
increase by summarizing changes in other revenue categories as well as related expenditures by
function.

extraordinary increase is related to three spending items:

SUBJECT: 1997 Truth in Taxation Dates
In addition to certifying the Preliminary Levy to Ramsey County for proposed taxes payable in
1998, the City is also required to select Truth in Taxation Public Hearing dates.
The selection of Truth in Taxation public hearing dates is complicated by the fact that the City
hearing dates cannot conflict with previously selected dates by the county, school districts and
metropolitan special taxing districts. Specifically, December 1,2,8,9,10,16 and 17 are not
available.
Also, the process must occur within the period from November 29, 1997 to December 20, 1997,
This time frame basically precludes the use of any regularly scheduled Council meetings (i.e.,
- November 24, December 8, or December 30). During 1996, the City Council also scheduled its
hearing dates for similar Thursdays as identified below.
Recommendations
Staff would recommend the adoption of Resolution #97-42, adopting the following Truth in
Taxation Hearing dates:

1. Schedule the Initial Hearing on Thursday, December 4, 1997 at the Army Reserve Center.
I 2, Schedule the Continuation Hearing (if needed) on Thursday, December 11, 1997 at the
Army Reserve Center.

Background
At the August 8, 1997 Worksession, discussion on the 1998 budget detail was held. These
discussions solidified a number of questions raised by City Council and staff, and also allowed
staff to prepare the preliminary budget and preliminary levy. I
The City is mandated to adopt a preliminary budget by Minnesota Statutes 275.065, Subdivision
1. It states that the City must adopt the preliminary/proposed budget for the upcoming year by
September 15, 1997.
The preliminary budget is not subject to the same restrictions on subsequent increases as is the
. proposed levy, The actual budget amount certified by the City during the official adoption Truth
in Taxation hearing may be higher or lower than the amount the City adopts now. The budget
may remain flexible during the year.
Services and Programs
The proposed budget and tax levy was prepared with the objective of maintaining existing
.. service levels. Although no major service level changes are proposed, the budget does place
more of an emphasis on core services such as police protection, street maintenance, snow
removal, and code enforcement. The City is proposing to add the snow plowing of park trails
- during the winter of 1998.

- Staffing
No changes are recommended for full-time City staffing levels (i.e.; 20 regular full-time, I
- regular part-time). However, an intern has been recommended for assistance in the areas of
I Planning and Zoning, and Code Enforcement. Additionally, the Public Works Department is
planning on the use of two (2) temporary maintenance employees in 1998, instead of the three
(3) planned for in 1997.
I General Fund/Levy Implications
For taxes payable in 1998 and 1999, the City is under levy limitation, The legislation
I establishing the levy limit provides for adjustments to the City's base levy for the implicit price
deflator and the change in households. These adjustments would have allowed up to a $40,528

Overall Expenditure Analysis
As identified in the report explaining the 1998 levy, most of the budget expenditure increases are
reflected in increased Capital Improvement spending. These include City Hall, Gateway
Business District, Pavement Management, etc,

The City Council is asked to adopt Resolution #97-44, adopting the preliminary 1998 budget.

Attached is City of Arden Hills Resolution #97-43, regarding the 1998 Street Improvement
Projects, This is a resolution receiving the preliminary report and stating that informational
meetings and public bearings will be held at a later date for the 1998 Street Improvement Project.
The attached report addresses the reconstruction, bituminous overlay, and seal coating projocts
identified for 1998 in the City of Arden Hills Five Year Street Improvement Plan.
In addition to those streets, the two (2) streets dropped from the 1997 Street Improvement Plan
are included: Harnline Avenue North, from County Road E to the dead end; and North Snelling
Avenue from Arden Place, north to the cul-de-sac. Round Lake Road, south from Highway 96,
and Stowe Avenue, between New Brighton Road and Cleveland Avenue, are also part of this
. report.
Costs
The total estimated costs of all those improvements addressed in the report are $2,516,475,00,
which is much higher than the City typically spends each year. The Public Works
Superintendent realizes the final costs will be determined after Council receives input from
informational meetings and public hearings, At this time, the exact scope of work will be
determined.
Recommendation
- The Public Works Superintendent recommends Council adopt resolution #97-43 receiving the
Preliminary Report in the matter of the 1998 Street Improvement Project.

WHEREAS, pursuant to resolution of the Council adopted August 11, 1997, a preliminary
report has been prepared by Howard R. Green Consulting Engineers with reference to
improvement of various streets within the City of Arden Hills, and this report was received by
the Council on September 8, 1997; and
WHEREAS, the report provides information regarding whether the proposed project is
necessary, cost-effective, and feasible; and

WHEREAS, informational meetings and public hearings will be scheduled to gather public
input regarding the improvement at a later date.

, On August 11, 1997, the Arden Hills City Council initiated the Minnesota State Statue
429 process by adopting Resolution 97-40, authorizing Howard R. Green Company,
, Consulting Engineers, to prepare a feasibility study for the 1998 Street Reconstruction

'. II. PROJECT SCOPE
,
This study will analyze the feasibility of reconstructing, overlaying, and seal coating
, numerous streets within the City of Arden Hills. The study will discuss the existing
conditions of each street, proposed improvements, estimated project costs, proposed
financing methods, and project schedule.
, In an effort to prioritize street reconstruction, public opinion from potentially affected
residents will be solicited in addition to City staff and engineering input. For this reason,
, an informational meeting is proposed early in the project process to gather information
prior to initiating the formal project design. As the project progresses, more detailed
information regarding subsurface soil conditions, utilities, and specific drainage issues
, will be addressed in a follow-up report to the City Council.
III. FEASIBILITY, COST-EFFECTIVENESS, AND NECESSITY
, The proposed improvements are necessary to maintain City streets and are in accordance
with the City's Pavement Management Program (pMP). The improvements proposed
, represent the 1998 phase of the City's ongoing PMP with the addition of North Hamline
Avenue and North Snelling Avenue which were eliminated from the 1997 Street
,- Reconstruction and Maintenance Improvements. The streets that have been identified for
reconstruction, overlaying, and seal coating have been reviewed and rated to determine
the level of maintenance required.
, The improvements proposed within this study will be developed into a project large
enough to ensure a competitive bidding process. Therefore, based on the data collected
in the rating of streets and the information contained within this study, the proposed
, improvements are necessary, cost-effective, and feasible from an engineering standpoint,
and are in accordance with the City of Arden Hills' standards.
, IV, EXISTING CONDITIONS AND PROPOSED IMPROVEMENTS
,. The City of Arden Hills uses a comprehensive Pavement Management Program (PMP) to
rate all City streets. The American Public Works Associations (APWA) MicroPA VER
software is used to reduce field data into a Pavement Condition Index (PC!) rating on a
, scale from I to I 00. Streets are then selected for maintenance, rehabilitation, or
reconstruction based upon the PCI rating, Department of Public Works history of
maintenance, field observation, and engineering judgement.
-
All of the City's streets were rated in October and November of 1995 using the
--. MicroP AVER software. The data collected in the field consists of 19 different types of
- pavement distress and the level of severity of each one. The different types of distress
----. include longitudinal and transverse cracking, alligator cracking, bumps, potholes, and
weathering, among others. Based on this collected field data, the computer program
generates a PCI rating for each street. The streets are then prioritized for various
~ maintenance procedures or rehabilitation. Streets with PCI ratings of 0 to 60 are
candidates for reconstruction ranging from complete reconstruction to cold and drainage
in-place recycling (CIR) or bituminous reclamation, depending upon subsurface

,. conditions. Those streets with ratings in the range of 6 I to 80 are candidates for
rehabilitation in the form of a milling operation, followed by crack sealing and the
, placement of a 1 Y:.-inch bituminous overlay. F inaIl y, streets rated above 80 are
candidates for crack sealing and seal coating as preventative maintenance.
, The PCI report for all City streets is included in Appendix A. To facilitate the use of the
PMP, the streets were organized into five zones based upon their geographic proximity to
, one another. These zones are divided by the major highways passing through Arden
Hills. The pavement management zones are presented in Exhibit 2 and are generally
described as follows.

,. Zone 1 Street Improvements
The proposed improvements within Zone 1 consist of seal coating Norma Circle, Gale
Circle, and James Circle. The PCI ratings in 1995 for these three streets were 90, 87, and
I 94 respectively. These ratings indicate that the streets are candidates for crack sealing
and seal coating as preventative maintenance.
I Zone 2 Street Improvements
The proposed improvements within Zone 2 consist of reconstructing West Round Lake
I Road from 13th Street to Highway 96. West Round Lake Road is a 24-foot wide
bituminous roadway with a limited amount of concrete curb and gutter and no storm
drainage facilities. The west side of the road drains to the Mn/DOT right-of-way ditch
I and is collected by Mn/DOT storm sewer. Ditches along the east side of the road drain
runoff to the south. The existing drainage patterns appear to be very poor with runoff
I ponding in the ditches on the east side of West Round Lake Road.
The roadway was overlaid in 1991 under the City's PMP and the surface remains in good
I condition with a PCI rating of 88 in 1995. This segment of roadway is designated a
Municipal State Aid Street (MSAS). Due to the current development of the Gateway
Business District, it is recommended that West Round Lake Road be reconstructed to
I. MSAS standards, to increase the level of service and improve drainage. The
reconstruction of West Round Lake Road requires a minimum width of 36-feet, with
B6 I 8 concrete curb and gutter and storm drainage facilities. Preliminary traffic volume
I projections are included within the May 1997 Gateway Business District Feasibility
Study that classifies West Round Lake Road as a high density collector roadway,
providing a high level of service, having moderate operating speeds (30 mile per hour
I design), and providing a high level of traffic mobility.

,- West Round Lake Road is proposed to be reconstructed with a center median providing
, left turn lanes between 14th Street and Highway 96 as shown on Exhibit 3. The portion
of West Round Lake Road south of 14th Street is proposed to be constructed as a typical
, 36 foot wide commercial-industrial section, also shown on Exhibit 3.
The preliminary pavement design has been generated based upon the geotechnical
, investigation completed as part of the Gateway Business District project. Based upon
projected traffic volumes and an assumed R-value of 20, the pavement section will
consist of 4 to 4-I/2-inches of bituminous, a I a-inch gravel base, and an 18-inch select
, granular subcut with HDPE edge drains to remove subgrade moisture from the roadway.
The proposed storm drainage improvements along West Round Lake Road, shown on
, Exhibit 4, consist of instaIling approximately 3,700 linear feet of RCP storm sewer
ranging in size from IS-inch to 27-inch, catch basins, and manholes, This proposed
storm sewer will be extended from the storm sewer system proposed to be constructed as
, a part of the Gateway Business District Improvements and will drain southward to the
stormwater pond included in the Gateway Business District project. At the time of this
study, the Gateway Business District Improvements project has not been awarded.
~. Zone 3 Improvements
Zone 3 improvements consist of reconstructing Fairview Avenue and Valentine Court,
rehabilitating Thom Drive, and seal coating Crystal A venue and DeIlview Avenue.

- Fairview Avenue
... The portion of Fairview Avenue to be reconstructed is between Gramise Road and
- County Road F. Fairview Avenue had PCI ratings of 21 and 23 in 1995,
'"' indicating structural failure. The street has extensive alligator 10ngitl1l'Iinal, and
edge cracking. Existing storm sewer is located at County Road F and Crystal
. Avenue.

- It is proposed to reconstruct Fairview Avenue to a 32-foot wide bituminous street
with B618 concrete curb and gutter as shown on Exhibit 5. The proposed
--. pavement section consists of 3.5 inches of bituminous. 8 inches of gravel base,
- and a 12 inch select granular subcut with HDPE edge drains to provide for the
drainage of the subgrade. A geotechnical investigation will be competed as part
of the final design to verify these assumptions.
Proposed storm drainage improvements consist of extending IS and 18 inch RCP
--. storm sewer south from Crystal A venue to Gramise Road to facilitate the future
- drainage of Gramise Road. The north part of Fairview Avenue will drain to the
=-e County Road F stormsewer system with the installation of a catch basin at County
Road F and Fairview Avenue being required.

Valentine Court had a PCI rating of 31 in 1995 making it a candidate for
., reconstruction. Significant alligator, block, and IongitudinaI cracking is present
along Valentine Court as well as rutting, weathering, and raveling, Bitwninous
berm is present with the street draining to an existing CMP storm sewer system at
, Valentine Avenue.
It is proposed to reconstruct Valentine Court as a 32-foot wide bituminous street
, with B618 concrete curb and gutter as shown on Exhibit 5. Proposed storm sewer
improvements consist of removal of the existing catch basins and CMP storm
sewer, the construction of catch basins to match the proposed curb line, and the
, installation of IS-inch RCP storm sewer.
Zone 4 Improvements

The proposed improvements within Zone 4 consist of reconstructing Indian Place, Stowe
Avenue from New Brighton Road to Cleveland Avenue, and Edgewater Avenue from
New Brighton Road to 310 feet West of Prior A venue. Streets proposed for rehabilitation
include Lake Lane, Sandeen Road, Edgewater A venue from 310 feet west of Prior
- Avenue to the cul-de-sac, and Glenpaul Avenue from New Brighton Road to Cleveland
- Avenue. Glenhill Road is proposed for seal coating maintenance.

" Indian Place is a short cul-de-sac south of West County Road E with a 1995 PCI
rating of 53. Surmountable concrete curb and gutter exists along the street,
- however, it shows extensive cracking and settlement. Surface runoff presently
.,. drains to two catch basins located at the intersection with West County Road E.
.. Proposed improvements consist of reconstructing Indian Place as a 32-foot wide
-- bituminous street with B618 concrete curb and gutter as shown on Exhibit 5. The
- diameter of the cul-de-sac will be reduced from 120 feet to 100 feet. Storm
- drainage improvements will consist of the removal of the existing catch basins
-- and CMP storm sewer, the construction of catch basins to match the proposed
- curb line, and the installation of 15-inch RCP storm sewer to facilitate drainage of
the street.

- Stowe A venue
--- The portion of Stowe Avenue proposed for reconstruction is between New
- Brighton Road and Cleveland Avenue and will be designated as part of the City's
-. MSA system following the turnback of the roadway from Ramsey County. Stowe
Avenue is a shared street between the cities of Arden Hills and New Brighton. A
PCI rating of 19 was assigned to this portion of Stowe A venue in 1995 indicating
that reconstruction of the street is necessary. Severe alligator, block, and
-- longitudinal cracking is present along Stowe A venue with weathering and
raveling also evident throughout the roadway. There is no storm sewer present

, however, stonn sewer facilities were completed along Stowe Avenue east of New
Brighton Road with the 1995 Street Improvement Project to be extended west
along Stowe A venue in the future.
, Stowe Avenue is proposed to be reconstructed as a 32-foot wide bitwninous street
with B618 concrete curb and gutter. The proposed street section is shown on
II Exhibit 5. Proposed stonn sewer improvements consist of extending 15-inch RCP
stonn sewer from east of New Brighton Road west approximately 900 feet along
Stowe Avenue.
" Rdiewater Avenue
II Edgewater Avenue from New Brighton Road to 310 feet west of Prior Avenue is
proposed for reconstruction. This portion of Edgewater A venue received a PCI
rating of 57 in 1995. Stonn sewer is not present along this portion of Edgewater
-- Avenue with the street draining west towards the cul-de-sac to a stonn sewer
system located along the more recently constructed portion ofEdgewater Avenue.
~. The proposed reconstruction of this portion of Edgewater A venue consists of
reconstructing a 32-foot wide bitwninous street with 8618 concrete curb and
gutter as shown on Exhibit 5. Approximately 1,300 linear feet of 12-inch to 21-
inch stonn sewer is proposed to be extended east from the existing stonn sewer to

- The streets identified for bitwninous overlaying are streets that received PCI ratings of 61 to 80

.. in 1995. These streets typically display moderate levels of distress in the forms of longitudinal,
transverse, and block cracking. The bitwninous overlay procedure consists of edge milling the
-- streets, crack sealing, and placement of a 1 Yo-inch bitwninous overlay. This operation improves
-- the structural integrity of the road surface but does not provide for improved drainage patterns
- along the streets.
-- V. OTHER ISSUES

A. Permits

. Proposed reconstruction of West Round Lake Road will require the acquisition of
right-of-way from the adjacent property owners. The area of right-of-way to be
.. acquired will be dependent on the final alignment and geometric design of West
Round Lake Road. The proposed reconstruction of North HamIine Avenue will
II also require the acquisition of right-of-way. The acquisition process for these
rights-of-way was begun by the City in 1996.
II Temporary construction easements will be secured as is necessary for the
proposed construction of storm sewer and streets in areas where the rights-of-way
for construction is limited.
,. VI. ESTIMATED COSTS
II The estimated construction costs and associated overhead costs have been determined for
the construction of the proposed improvements. Construction costs were determined
using comparable construction cost data from 1997. In accordance with the City's
'. assessment manual, the overhead costs have been estimated as 32% of the total estimated
construction cost for each type of improvement, The overhead costs for the North
HamIine Avenue and North Snelling Avenue service roads have been estimated at 10%
of the total estimated construction cost as the engineering design work was completed for
II these two street as a part of the 1997 Street Reconstruction and Maintenance
Improvements project.

.. The overhead cost includes city ~dministration, engineering design, construction staking
and inspection, land acquisition and legal expenses, and assessment rate preparation. The
-- estimated costs are shown in Table 2.
-- These costs are primarily presented for the purpose of assisting City Staff and Council in
- selecting streets to be included in the 1998 Street Improvements project. A more detailed

, Seal Coat Financing
II The City's current assessment policy states that the application of a bituminous seal coat
is a maintenance procedure to be funded by the City. The estimated project cost to the
City for the seal coating portion of the 1998 Street and Utility Improvements project is
'- $18,715.00.
Bituminous Overlay Financing
, As outlined in the City's Assessment Manual, 50 percent of the total project cost of
bituminous overlay projects may be assessed to all benefitting properties adjacent to
II streets to be overlaid. The assessment rate is detennined by dividing 50 percent of the
total project cost by the assessable front footage. Table 3 below shows the proposed
rehabilitation financing.

~ It has been asswned that the assessable percentage for North Hamline Avenue and North

- percent of the estimated project cost will be funded by the City of New Brighton with the

- The total estimated project costs are $18,715, $136,390, and $2,361,370 for seal coating,
bituminous overlaying, and reconstruction, respectively. As stated before, the cost will
be financed through the use of City funds and assessments to benefiting properties. City
- resources available include the PIR fund, TIP fund, Stonn Water Maintenance Funds,
MSAS Account, Ramsey County Tumback dollars, and available New Brighton funds on
Stowe Avenue. Based on the infonnation gathered and the analysis presented, the
proposed improvements discussed in this study are feasible from an engineering
standpoint.

The City Council on June 30,1997, approved the Preliminary Plat (Red Oak Ridge) including
the right-of-way width and cul-de-sac diameter variance at Thom Drive in Planning Case #95-16,

1. Compliance with the approval of the Rice Creek Watershed District (Permit #96-105).
I 2. Preservation of those trees shown in the Tree Preservation Plan.
3. Payment of the appropriate park dedication fee.
I 4. Provision of an updated abstract of title and a development contract prior to consideration
of the final plat by the City Council.
I The City Council also authorized the payment of park dedication ($5,124.00) to be paid in one-
fourth (1/4) increments at the time of the issuance of the building permits for the four lots (Lots
1,2,3, and 4 of Block 1) which new construction is planned (Exhibit B).

The Planning Commission on June 11, 1997 recommended approval of Planning Case 95-16,

The applicant has provided the Staff with the updated abstract of title on June 26, 1997, the ..
Attorney has reviewed the title to ensure ownership and legal description. Also the attorney has
forwarded a copy of the development agreement (Exhibit C). The applicant has reviewed the
document and found it acceptable. The Staff is in the process of getting the executed signature
page from the applicant and will have it available at the meeting. I

I According to Planning Case #95-16, Mr. Balfany is developing an area of 4.5 acres for
residential housing. I do not see a benefit for accepting property in this area to fulfill his park
dedication requirement. I will be recommending a cash in lieu dedication rather than land. I
1 have spoken to Mr. Balfany and have sent him a letter outlining my recommendation for a park
dedication fee. -

1 - Park Dedication Fee Calculation ,.
Since the density of the Balfany Plat is 1.08 dwelling units per acre, the park dedication fee
would be six percent of the fair market value of the property according to our Ordinance Section
Ie 22-9. The fair market value of the property was based on the payable 1997 tax value established
by Ramsey County. The first parcel is .64 acres (20,200 feet) and has a value of$17,200. The
second parcel is 3.86 acres (168,391 feet) and has a value of$68,200. The total value of both
1 parcels is $85,400. The park dedication fee is six percent of the $85,400, which is $5,124. .
Recommendation
I I am recommending that the Balfany Planning Case #95-16 pay a park dedication fee of$5,124.
The City Council has previously agreed that this fee can be paid in four equal payments. A

4.06 Miscellaneous Reauirements. -.
A. The maintenance of the cul-de-sac island is the
responsibility of the property owner(s).
B. The lots will be custom graded at the time of sale. I
The final grading plan and tree preservation plan
shall be followed.
C. The installation and maintenance of the sewer I
ejector pumps and service lines are the
responsibility of the property owner(s). I
4.07 Public Use Dedication. In addition to the costs of
improvements and admini$trative fees, Developer shall pay
the appropriate park dedication fee, as determined by the I
City's Park Director. The city Council has previously
agreed that this fee can be paid in four equal payments.

The City Engineer shall make periodic visits to the site
to insure that the Developer and its contractor are in
compliance with the terms of this Agreement. The City fI

construction. Developer'S failure to comply with the

to insure that the improvements are constructed and
inspected pursuant to the terms of this Agreement; and I
shall further result in the asse.sllIllent of a penalty in~.

4.09 Bindina Effect. The terms and rrovisions of this
agreement shall be binding upon and ~nure to the benefit
of the heirs, representatives, successors and assigns of
the parties hereto and shall be binding upon all future I
owners of all or any part of property and shall be deemed

option of the City, shall be placed of record so as to I
give notice thereto to any. I}ubsequent purchasers and

At the August 11 City Council meeting, the City Council authorized the solicitation of bids for
I the repair of the wash-out that occurred at Cummings Park. The engineer's estimate was
originally $42,000-$50,000. Engineer Stonehouse believed that to be a conservative estimate.
The bids were anticipated to be in the $40,000 range.

The apparent low bidder is Rehbein Constructionat $30,905. They are able to begin the project
I September 11. I have set a project completion date of October 15, 1997. Rehbein Construction
does not anticipate any problems completing the project by that date.
I Funding
I have applied for reimbursement funds for this project through the Federal Emergency
I Management Agency Program (FEMA). Since Ramsey County was declared one of the areas to
receive disaster relief funds from the Federal Government, this project should be eligible to
receive funding. At this time, I believe that 75% of the eligible costs for repairing the wash-out
I will be reimbursed. I will be attending a meeting on Friday, September 5, to learn more about
the program. I anticipate having an update on what costs are eligible for reimbursement at the
City Council meeting.
I Based on previous discussions from the Council work session about the funding of this project, I
am assuming that the remaining 25% of the project cost and possibly other non-eligible costs
I would come from General Fund Park Maintenance fund as an unbudgeted expense.
Recommendation
I I recommend accepting the bid and executing the contract with Rehbein Construction for the
Cummings Park Wash-Out Repair Project. I also recommend applying for any eligible funds
.. from FEMA for disaster relief repair of public property.
