WEDNESDA Y, JUNE 7,2006 7:00 P.M. - ARDEN HILLS CITY HALL CALL TO ORDER Chair Sand called the meeting to ordcr at 7:02 p.m. ROLL CALL Present were Commissioners Clayton Larson, Elizabeth Modcsette, Clayton Zimmerman, Roberta Thompson, David McClung, and Chair David Sand. Absent: Commissioner Ken Bezdicek. Also present were Councilmember David Grant, Community Development Director, Karen Barton, City Planner James Lehnhoff, and Recording Secretary Kathleen Altman, A, APPROVAL OF MINUTES FROM PLANNING COMMISSION MEETING HELD ON MAY 3, 2006, Commissioner Zimmerman moved, seconded by Commissioner Thompson to approve the . May 3, 2006 minutes as presented. The motion carried unanimously (6-0), PUBLIC HEARINGS None. UNFINISHED AND NEW BUSINESS A. PLANNING CASE #06-017: SITE PLAN REVIEW; LEN GALLUS; 1104 AMBLE DRIVE Mr. Lehnhoff stated the applicant was requesting a site plan review to construct a six-foot high fence in the front yard setback along Lexington A venue and near the comer of Lexington Avenue and Amble Drive, Staff recommended approval with the following conditions: L The project shall be completed in accordance with the plans submitted. Any significant changes to these plans, as determined by the City Planner, shall require review and approval by the Planning Commission, 2. The applicant shall keep the fence maintained and promptly repaired if any . damage occurs to the fence, including graffiti. 3. Mr. Lelmoff stated staff had not received any letters, emails, or telephone call from property owners or occupants in regard to this planning case, However, site plan reviews are not public hearings and do not require public noticc, Len Gallus, I I 04 Amble Drive, applicant, stated he was going to put in at least one junipcr, as weJl as lower landscaping along the fence. He stated he did not want anything tall on the comer to allow appropriate site Jines. Mr. Lehnhoff noted Mr. Gallus would not be allowed to put plantings within the public right-of-way. Commissioner Larson asked if the sitc triangle was protected at this location. Mr. Lelmhoff responded under City Code it met and exceeded the sight triangle, but they were still waiting for permission from Ramsey County, Chair Sand asked if this proposed fence would be in line with the fences to the north, Mr, Lehnhoff responded it would approximately align to thc existing fences. . Mr. Gallus stated his neighbor to the north was also intending on putting in a fence, but he was not sure if he had applied for a pemlit yet. He indicated the main reason he wanted a fence was for privacy and noise reduction. He belicved he could make this fence look attractive and the grass would be irrigated on both sides of the fence, Commissioner McClung moved, seconded by Commissioner Larson, to rccommend approval of Planning Case No, 06-017, Leonard Gallus, 1104 Amble Drivc, Site Plan subject to the six conditions as outlined in staff s May 22, 2006 report. The motion carried unanimously (6-0). B. PLANNING CASE #06-018: SITE PLAN REIVEW; 1212 LLC; 1212 RED FOX ROAD Mr. Lehnhoff stated applicant was requesting a Sitc Plan Review to modify the exterior of the existing building at 1212 Red Fox Road in the B-4 Zone. Staff recommended approval of the Site Plan subject to the following conditions: 1. The project shall be completed in accordance with the plans submitted, Any significant changes to these plans, as detcrmined by the City Planner, shall require review and approval by the Planning Commission. . 2, The applicant shalJ obtain the necessary building permits before beginning any modifications to the exterior of the structure, 3. Signage shaJl comply with the Sign Code. Signage shaJl not be installed without an approved sign permit. -.----- -- ---- - - ---- ARDEN HILLS PLANNING COMMISSION - JUNE 7, 2006 3 4. Lighting shall conform to the requirements m Section 6.E.3 of the Zoning . Ordinances, Lighting shall be directed away from adjacent properties, hooded, and not cast light that exceeds a mcter reading of one fool candle on the travel lanes of adjoining public streets or 4 foot candles on adjoining residential properties. Mr. Lehnoff noted staff had not received any letters, e-mails, or telephone calls from property owners or occupants in regard to this planning casc. However, site plan reviews did not require a public hearing or public noticc. Commissioner McClung expressed concern that there was only a single rendering of what the building would look like. Mr. Lehnhoff responded with respect to the lighting, they were not proposing any significant expansions and the landscaping would also simply be replaced and not added to. He noted only the front of the building changed with the sides and back remaining the same. He stated staff had not requested any photometric plan in this ease. Jeffrey Anderson, architect representing applicant, summarized the types of windows they were proposing to use on the building, He noted they were increasing the window area on the building. He summarized the outside materials proposed to be used on the building. He indicated the building would be stucco on thc entire east and north side with precast concrete base and new brick installed at thc entrances to visually definc the entrance point to thc building. He noted on the north side of the building the window locations would not be changed. . Chair Sand asked ifthere was any stone on the elevation. Mr. Anderson responded stone would be used at the base of the entrances. He indicated the brick would be used on the columns to the center entrance and on the face of the main entrancc. He stated there would also bc windows added on the south and west side similar to the windows being added on the cast side. Commissioner McClung stated he believed the brick looked good on the columns at the center entrance and he believed the hrick should also be used on the northeast side as wel!. Commissioner Larson stated it would be nice if the applicant would also upgrade the site to enhanec the neighborhood (i.e. curb and gutter in thc parking lot, etc.). Commissioner Modesette stated in her mind curb and gutter was for a functional use and not a site enhancement and she believcd it would be a hardship to thc applicant to require them to put in curb and gutter as long as there was not a negative impact to the environment. She stated she was not a proponent for curb and gutter just for the sake of putting in curb and gutter without a good reason. Commissioner Larson stated he was mentioning this for future reference and not necessarily for this application, Commissioner Zimmerman moved, scconded by Commissioner Larson to Planning Case 06-018, 1212 LLC, 1212 Red Fox Road, Site Plan review subject to the four conditioned . as outlined in staff s May 22, 2006 report. PLANNING CASE #06-013: VARIANCE AND PRELIMINARY PLAT; AMITIES LLC; 3685 & 3695 NEW BRIGHTON ROAD (CONTINUED) . Mr. Lehnhoff stated staff recommends tabling Planning Case 06-013 until the July 5, 2006 Planning Commission meeting. Commissioner Larson moved, seconded by Commissioner Zimmerman, to table Planning Case 06-013 until the July 5, 2006 Planning Commission meeting, The motion earned unanimously (6-0). D, nANNING CASE #06-014: UPDATED SIGN CODE Mr. Lehnhoff explained that in 1997, a lawyer from Georgia, working with various sign companies, began a search for locations to construct new billboards, some as tall as five to seven story buildings. Many cities do not permit new billboards, which is the case in Arden Hills, or permit billboards of that size. Despite the restrictions on billboards, the lawyer would apply for the sign permit with the expectation of a denial. Once denied, the lawyer would file a lawsuit against the controlling government unit, often a city, claiming that the sign regulations are unconstitutional and, consequently, the sign regulations should be deemed unenforceable. If the sign regulations are deemed unconstitutional and unenforceable, the city may be obligated to approve the billboards or come to some sort of a negotiated settlement. . Although the results of the lawsuits have been mixed, the sign regulations in some cities and counties have been deemed unconstitutional because sign content was inadvertently regulated. A city cannot regulate the content of a sign and, generally speaking, cannot show preferential treatment toward signs based on content. Basically, a city carmot tell a business or resident what they can and cannot have for a message on their sign or hold higher regard for a sign based on its content. Cities that exempt some signs from sign regulations or show preference for a type of sign based on content are at risk of having their sign regulations deemed unconstitutional. An exemption for for-rent, for-sale, or even religious signs has been construed to be a form of regulating content. Due to these types of exemptions, the cities of Hopkins, Eden Prairie, and Bloomington have faced such lawsuits, some of which is ongoing and costly. On March 13, 2006, the City Council adopted a sign moratorium to allow the City time to update the Sign Ordinance to remove any potential constitutional issues without the pressure of facing a costly lawsuit. Although Arden Hills has not receivcd any requests for new billboards, the City's frontage on Interstate 35W, Interstate 694, US Highway lO, and Highway 96 makes this an important issue. Mr. Lehnhoff reviewed the changes and modifications made to the Sign Code for the Commissioncrs. He ask cd for all questions, changes, or concerns, including any spelling . or grammar mistakes. Commissioner McClung stated he had a concern about changing from a Sign Ordinance to a Sign Code. He stated he was not concerned about how difficult a Sign Ordinance ARDEN HILLS PLANNING COMMISSION - JUNE 7, 2006 5 would be to ehange. He noted the City was unique and signs were a big issue in the City . with residential interest and he was concerned if they went to a Sign Code, there would be no publie hearing involved. He indicated he preferred this be maintained as a Sign Ordinance and not a Sign Code. Mr. Lehnhoff slated the City Attorney had recommended the City switch to a Sign Code, which would becomc part of the official City Codc. Ms. Barton stated with a Sign Code, it wou Id allow staIT to make minor adjustments to the Code without have to bring it to a public hearing, though it would still require City Council approval. She noted any major content changes to the Sign Code staff would foresee putting together a task force, which would involve publie participation. Chair Sand asked what othcr cities had done. Mr. Lchnhoff responded other citics used both Sign Ordinances and Sign Codes and there did not appear to be a preference. He noted any change to the Sign Code would require City Council approvaL Commissioner McClung stated he did not mind keeping this as a Sign Ordinance because he did not believe it was a burden on the Commission or City staff. Mr. Lehnhoff stated the only part that would not come baek to the Planning Commission under this proposal was an actual textual change to the Sign Code. The Planning Commission would still review signs for proposed developments and any signs that cxcceded or deviated from the Sign Code. . Commissioner McClung stated he saw this as a zoning issue and those wcrc issues that might get some residential interest where thcy might want to comment. Commissioner Zimmcrman noted on Pagc 3, Subd. 3, the word perpcndicularly should be checkcd for grammatical use. Commissioner Larson asked staff look at this subdivision again with respect to signage on berms. He stated with Subd. 28, he had a coneem about signage on roofs being above the roofline. Chair Sand expressed concern with the wording on Page 9, under 1400.8 Rcview Process, "All permits not reviewed within sixty (60) days shall be deemcd approved.". He requested staff clarify the wording under that provision. He indicated if staff had 75 days to inform the applicant of approval or disapproval, this could cause confusion. He indicated under 1400.9 Appeal Process should also be clarified with respect to the deadlines. Commissioner Modesette asked staff to look at Page 10, 1400.1] V iola!ions provision with respect to the fines and thc wording "each day". Chair Sand inquired if the City had jurisdiction with signs in the County right-of-way. Mr. Lehnhoffresponded that was something staff would look into, . Commissioncr Modesette statcd on Page 13, Subd. 9, it would be her prefcrence to have roll-out portable signs as a tcmporary sign and not a prohibited sIgn. Mr. Lehnhoff responded he would look at how to change this to a temporary sign, ARDEN HILLS PLANNING COMMISSION - JUNE 7,2006 6 Chair Sand asked how they addressed thc amount of illumination of signs to prcvent signs being too bright. Mr. Lehnhoff stated this type of a provision could be added to . Section 1400.15. Chair Sand asked how they would address scrolling signage. Mr. Lehnhoff stated that could be added to Section 1400.13 as being a non-permitted sign and he would work on wording for that provision, He also stated the definition for flashing signs could be adjusted to account for scrolling signs. Commissioner Larson asked if they could prohibit scrolling signagc bcing changed more than a certain number of times during the day. Mr. Lelmhoff reviewed the three options for off-premise signs, He stated that these options were a starting point and would require modification. He pointed out the spreadsheet that shows how other cities handle off-premise signs. He noted that most cities do not permit signs in the public right-of-way. Mr. Lehnhoff stated that the only thing we can't do is give a broad exemption to real state, open house, or other specific types of signs. Commissioner Zimmerman stated he agreed with Option C in regards to off-premise sIgns. He questioned how real estate companies would be able to put up Open House signs if the signs were put up on the weekends and City Hall was closed. Commissioner Larson expressed concern that people would not register and ask lor . permission to place their signs and he believed the City would need to remove the signs. He did not believe they should enforce realtor signs, garage sale signs, ete., but rather enforce transient signs. He statcd Option C with the requirement of the name and address, obtaining written permission, and coming to City Hall for registering their signs was not workable. Commissioner Modesette stated she was more in favor of Option C over Options A and B. She stated she did not see why they had to say "during daylight hours" if this was a temporary sign, Chair Sand bclieved Option C was the most flexible, but he agreed that some of the provisions within Option C were not workable, such as registering with City Hall, as well as the owner's name and address on the signs. He stated with respect to a half mile rule, there might be instances where more signage was required if it was a difficult location to find. Commissioner Thompson stated he agreed with Commissioner Modcsette with respect to daylight hours noting that in the winter, daylight was very short. She indicated they might want to require the sign be taken down within a certain time period after the event. She agreed having a name and address on the sign should not be included, as well as the registration with City Hall. She liked the aspect of the written permission if it was on someone else's property. She asked if they needed to address that the City had the right . to remove and destroy any sign if was in violation of the Code. Patrick Ruble, Government Affairs Director for SL Paul Area Association of Realtors, stated they struggled with sign issues on a daily basis. He thanked staff for being open ARDEN I-lILLS PLA!\TNING COMMISSION - JUNE 7, 2006 7 , and cooperative with working with the realtors on these issues. He stated signagc was . very important to marketing real estate and hc wantcd to work with City staff more on this issue. He stated if there was an issue with a realtor sign, the City could call him and he would contact the owner of the sign and have them remove it. He indicatcd if they would be required to register with the City Hall and obtain property owncr pennission, this would be a burden to realtors, but if they could register onc time on-line, this might be a possibility, He believed there were ways to work with the City on this issue. Angela Hames, Real Estate Agent and resident of Arden Hills, stated she has bccn a resident of Arden Hills for 13 years. She stated she would be happy to address any questions with rcspect to the business of real estate and the signage. She stated that limiting off-premise signs to no more than four was problematic for neighborhoods that had more than one access. She stated in some areas four signs were not sufficient to direct traffic to thc home for sale. She stated therc was not a problem with listing a sign owner's name and address on real estate signs and signs were written with permanent market on the inside of the sign with the owncr's name and address. She indicated thc signs were expensive and real estate agents did not want to lose their signs. She stated that some cities charge an impound fcc to retrieve a sign, which is a strong inccntive to pick up our si gns. She stated to include the name and address of thc home they were selling would be burdensomc and probably would not look good because that infonnation would need to be temporarily affixed to the sign. Shc stated it would be very burdensome to register real estate signs with City Hall. In Table I, she exprcssed concern that tcmporary signs were allowed in only District] and District 3. She believed . allowing tcmporary signs in all of the Districts would be very helpful. Commissioner McClung noted the problem they had with this was the City did not want to see a lot of temporary commercial/business signs. Ms. Hames stated the riders added to the real estate signs did add to the square footage, but the riders did communicate valuable information. She noted the brochure boxcs were a very marketing tool and she understood the brochure boxes were not part of the signage. She indicated without thc riders the signs were 2 feet by 3 feet and there might be up to two or three different riders on each sigu. She encouraged them to allow the Jiders. She noted they wcre seeing longer market timcs and signage and timing was critical. She stated real cstate agents were good about picking up their open housc signs because they usually nccded those signs for anothcr opcn house that day, She statcd to allow open houses only on weekends, did not allow networking of agents, which wcrc held on Tuesday when agents toured perspcctivc properties, She asked for a provision for these types of events. She indicated it would also be burdensome to only plaee signs within a half milc of the home being sold as there were instances whcre they needed to direct peoplc from a major route to the home, which was over a half mile away. Shc asked them to reconsider this requirement. Commissioner Zimmennan stated they also needcd to addrcss thc signs that directed people to homcs for sale off of a major thoroughfarc. Ms, Hamcs stated that most cities do not allow dircctional arrows and she understood this concern. Shc stated she did not . bclieve the City would gct a lot of complaints from realtors regarding not pelmitting thcse types of signs, She noted it was the temporary signs that wcre the "life blood" of their business and not the arrow signs. She indicated all of the temporary signs were for marketing to sell a home more quickly. She stated the City needed to be conscious that ARDEN HILLS PLANNING COMMISSION - JUNE 7, 2006 8 thc housing stock in Arden Hills did not continue to decrease in value. She stated she has not seen any community address the riders on real estate signs. . Mr. Lehnhoff stated staff would change some of the requested changes and re-evaluate the off-premise sign options based on tonight's dicussion and have the City Attorney review it. He stated a motion is not required at this time and he would inform the Planning Commission of the next step. The sign regulations arc likely to go to the June 26 City Council meeting for review. C. NEW CITY WEBSITE - VERBAL UPDATE Mr. Lehnhoff updatcd the Commission on the new City web site features scheduled to be on-line at the end of the month, Commissioner McClung thanked Mr. Lehnlloff for Ilis hard work and efforts on tllc new web site. Backl!round l. Overview of Request: The applicant proposes to install a second 12,000 gallon nitrogen tank immediately south of the existing 12,000 gallon nitrogen tank (The first tank was approved in Planning Case 02- 33). The second nitrogen storage tank would be placed on a concrete slab, and the fence around the existing tank would be extended approximately twelve feet to the south to completely enclose the proposed second tank. Manufacturers' Services, now known as Celestica, was originally approved to construct one building at 4300 W, Round Lake Road under Planning Case #96-12. The applicable statutes from thc Zoning Ordinance in relation to the special use permit amendment and site plan rcquest are as follows: 1. Screenin g/Lan dscaping The Gatcway Business District does not havc specific scrcening requirements; however, Section 6.E,(j) of the Zoning Ordinance states: (j) Screening of Mechanical Operating Equipment: Screening shall also be providcd where mechanical equipment is located on the ground or on the roof of the premises; such screening shall be constructed and located so as to prevent direct view of said equipment Mechanical operating equipment shall include all exterior dcvices uscd to service the building or its occupants, including but not Iimitcd to electrical, HVAC, plumbing, communications (including telephone and dish antennae) and storage tanks. The fencc around the existing nitrogen tank is proposed to be extended twelve feet to the south to fully enclose the sccond nitrogen tank. The existing vegetation and fence for the air handling units, which were approved in Planning Case 06-003, would provide additional screening for the nitrogen tank from Round Lake Road. Given the small footprint of the project, it is unlikely that the additional tank would have an impact or be noticed from adjacent properties, Round Lake Road, or Interstate 35W. . A photo simulation of the tank and fence are included with the submittal from the applicant (Attachment 3A-l), 2. Parking The proposed nitrogen tank would not result in the loss of any parking spaces. However, as noted above, the applicant has indicated that a separate application will be sllbmitted for the August 2006 Planning Commission to expand parking on the site. 3. Orderly devclopment of the neighborhood and the City within the general purpose and intent of this ordinance and the Comprehensive Development Plan for the City, Findings of Fact The Arden Hills City Council approved the use of the property for an office, production, and . warehousing building through Special Use Pem1it #96-12 on July 2, 1996. For amendments, the PI311Jling Commission must make a finding as to whether or not the proposed amendment to the Special Use Pem1it would adversely affect the surrounding neighborhood or the community as a whole based on the aforementioned factors. Staff offers the following findings for consideration: 1. The proposed tank will have no afTect ontraffie and will not reduce the number of parking spaces on the site. 2. The proposed tank will not create any noise, odors, or have any noticeable visual impact. 3. The proposed use will have no affect on drainage or population density. 4. The applicant proposes to extend thc cxisting fence twelve feet south to fully screcn the proposed tank from adjaccnt properties. The fence around the air handling units and the vegetation to the south will almost fully screen the nitrogen tank area from Round Lake Road and Interstate 35W, 5. It is unlikely that the proposed tank would affect land values. 6. Background I. Overview of Request: The applicant proposes to add four new loading docks to the south side of the existing 11,720 square foot building at 3755 Dunlap Avenue. Modifications to buildings in the B-4 Zone require an approved site plan review. Three ofthe docks would be 16' wide and 14' high and the western most dock would be 12' wide and 14' high. There is one existing loading dock on the south side of the building near the front of the building and one loading dock on the west (rear) side of the building. Both of the existing docks doors would remain. The applicant is not proposing any other changes to the building or the lot. The building contains 10,320 square feet of warehouse space and 1,400 square feet of office space on a .93 acre lot. The business occupying the space, an insulation installer and contractor, is a conforming office/warehouse use in the B-4 Zone. According to the applicant, the doors are nceded to provide better access to the warehouse portion of the building for easier and more efficient loading and unloading of insulation materials. The City has reviewed one past variance application for the property in 1988 from a previous owner. Planning Case 88-19, which was a request to exceed the permitted lot coverage to expand parking, was denied, The building and stmcture do exceed the total permitted lot coverage in the B-4 Zone; however, the applicant is not requesting an increase in the impervious coverage in this application, Total lot coverage is approximately 86 percent (30 percentage points for the structure and 56 percentage points for the remaining impervious surface). The permitted lot coverage in the B-4 Zone is 75 percent (25 percentage points for the stmcture and 50 perccntage points for any other impervious surfaces). Purpose of the B-4 Zone Development - Section 5.D.9.d The purpose of the B-4 Zone as defined in the Zoning Ordinance provides some design guidance for buildings in the BA Zone. Section 5.D.9 states that the purpose of the B-4: Retail Center District is: a. To mcct retail shopping needs of the surrounding community by providing a district that will accommodate a wide range ofretail goods and services. b. To promote business prosperity by creating an attractive and functional retail center. c, To provide an integrated retail trade center that groups compatible retail uses in one or more multiple-occupancy buildings. Free standing, single-occupancy buildings will be allowcd if planned and constructed as part of a unificd development that contains a retail center or is developed after such a retail center is developed. d. To produce a positive visual image by establishing a high standard of design and development. e, To allow transitional uses that will allow an orderly phasing out of existing uses and development that are not appropriate in a contemporary retail center and a phasing in of uscs and development as warranted by market conditions. f. To encourage grouping of uses that are mutually supportive and have similar require- ments for vehicular and pedestrian accessibility and exposure. . g, To alleviatc potential traffic congestion on local strcets by the design of the circulation pattern and arrangement of uses. h, To implement that part of the Arden Hills Comprchcnsive Plan known as the Lexington A venue Business Area Plan. 2. Building Exteriors, Site Features, and Site Development - Section 5.J.6. The special requircments for the B-4 Retail Centcr District include the following design guidelines: Accomplishing the stated purpose of the B-4 District requires particular concern for the design of buildings, site features (such as landscaping, lighting and signage) and site dcsign, The arrangement, geometry, massing, materials and colors shall bc rcsponsive to existing buildings, site features and site design on adjoining propcrties. The Planning Commission and City Council shall consider thc cffect 0 f the proposed use upon the health, safety, convenience and general welfare ofthc owners and occupants of the surrounding land, in particular, and the community as a whole, in general, including but not limitcd to the following factors: I. Existing and anticipatcd traffic and parking conditions; 2. "loise, glare, odors, vibration, smoke, dust, air pollution, heat, liquid or solid wasle, and other nuisance characteristics; 3, Drainage; 4. Population density; 5. Visual and land use compatibility with uses and structures on surrounding land; adjoining land values; 6. Park dedications where applicable; and the 7. Orderly dcvclopment of the ncighborhood and the City within the general purpose and intcnt of this ordinance and the Comprehensive Development Plan for the City. Findings of Fact The Planning Commission must make a finding as to whether or not the proposed modifications to the building at 3755 Dunlap Avenuc would adversely affect the surrounding neighborhood or thc community as a whole based on the aforementioned factors. Staff offers the following . findings for consideration: On the Purpose of the B-4 Zone: 1. While thc existing use is not retail based and is unlikely to advance the retail goals of the zone, the current officc/warehouse use is a legal, confornling use in the B-4 Zone, 2, The proposed exterior modifications to 3755 Dunlap Avenue will likely increase the usefulness ofthc building for thc existing office and warehouse use. The applicant is not proposing any other changes or upgrades to the extcrior of the building. 3. The proposed modifications are compatible with the other buildings in the B-4 Zone in terms lot arrangement and dcsign. Eight of the other nine buildings in the B-4 Zone have loading docks (Attachment 3B-2). Six of the eight buildings havc four or more loading docks. The building immediately north of the subject property has 18 loading docks and the building to the south of the subject property has four loading docks, 4, The vchicular and pedestrian circulation will be similar in character to the other buildings in thc B-4 Zone. 5. On the Design Requirements of the B-4 Zone: 6. The mass of the site will not change and the color of the building has not been proposed to change. The existing color is similar to other buildings in the B-4 Zone. The proposed loading dock doors will be similar to the existing dock doors. On the Special Use Permit Evaluation Criteria: 7, The proposed modification will not reduce parking on the site. There is sufficient space for additional parking to accommodate all of the employees at the rear of the lot. The additional loading dock doors may reduce truck tranic congestion on the site due to better acccss to the warehouse and faster loading and un loading times, 8. The proposed modification is unlikely to produce any permanent increase in noise, glare, odors, vibration, smoke, dust, air pollution, heat, liquid or solid waste, or any other nuisance characteristics. Thcrc may be temporary dust or odors during construction. 9. The proposed modification will not affect drainage, The western portion of the lot drains toward Dunlap A venue and the eastem portion of the lot drains toward the rear of the lot, There are no known drainage issues and drainage will not be altered with this proposal. 10, The proposed use will not affect thc population dcnsity of the ncighborhood. 11, The proposed cxtcrior modifications to 3755 Dunlap Avenue will likely have a neutral affect on adjacent properties or the City as a whole, 12. The park dedication fee does not apply to this project, 13. The proposed modifications are in confoTInance with the requirements of the Zoning . Ordinance. The proposed modifications are not in conflict with the Comprehensive Dcvelopment Plan. 14. The paint on the building has been stained by rust and the light on the south side ofthe building is broken. Resident Comments Staff has not received any letters, e-mails, or telephone calls from property owners or occupants in regard to this planning case. Howevcr, site plan reviews do not require a public hearing or public notice. The exterior of the building shall bc washed and/or painted to remove rust stains, to repair any damage that may be caused during construction activities, and to fix any other pealing arcas. If the building is painted a new color, the paint shall be compatible with the brick on the office area of the huilding and other buildings in the B-4 Zone. Options I. The request also includes a variance from the Zoning Ordinance to allow Lots I and 2 to partially share a driveway and an access point to New Brighton Road. The preliminary plat is not contingent upon approval of the . vanance. Background The applicant submitted the original preliminary plat and variance application on April 10th, 2006. That application sought to re-plat 3685 and 3695 New Brighton Road into four lots. A variance was also requested to allow all four lots to share one private driveway and for two lots to not be adjacent to the public right-of.way, Due to the design of the preliminary plat, the plat was contingent upon approval of that variance. That application was reviewed on May 3'd, 2006, and the Planning Commission voted 3-2 (with one abstention) to recommend denial to the City Council. The applicant submitted a letter to the City Council requesting the application be tabled with the intent of submitting a revised plat application. The City Council rcviewed the application on May 22"d, 2006, and voted to table the application and remand it back to the Planning Commission for further review. Due to the limited time between the May City Council meeting and the June PlarUling Commission, the applicant was not able to submit a revised application in time for the June 2006 Planning Commission meeting. Lots 3 and 4 are on the 3685 New Brighton Road property. Lot 2 is split by the two existing parcels. The applicant is proposing to have Lots I and 2 sharc one access point to New Brighton Road. Lot 3 would access Thom Drive, and the existing access on proposed Lot 4 would be relocated from New Brighton Road to Thom Drive. The Subdivision Code and Zoning Ordinance do not have provisions for sharing a driveway or road access; therefore, the . applicant is requesting a variance for a partially sharcd driveway and access point. According to the proposed plans, Lots 1,2, and 3 would accommodate walk-out style homes. All ofthe structures on the 3695 New Brighton Road property would be removed. Subdivisiou Ordinance - Meets requirements with conditions except the applicant is . proposing to have Lots 1 and 2 share a portion ola driveway to New Brighton Road. A. Easements. City subdivision regulations require twelve (12) foot wide utility and drainage easements dedicated to the City along the right-of~way and centered on common lot lines. The survey docs not currently show these required easements. It should be noted that the City does not assume responsibility for maintenance of these areas. The easements will allow access if it is ever necessary to enter these areas. B. Grading, Tree Removal, & Erosion Control. The property decreases in elevation approximately thirty-three feet from New Brighton Road to the wetland along the western side of the property. The applicant has submitted a preliminary grading and erosion control plan, which has bccn reviewed by the City Engineer. Sheet four shows the areas planned for tree removal. The tree removal would be needed for the proposed home on Lots 2 and 3. The tree removal near the wetland would be for thc infiltration basin. The infiltration basin is designed to filter stOTInwater before it enters the wetland. This original preliminary plat and variance proposal was reviewed by Rice Creek Watershcd. The Rice Creek Watershed deemed the application incomplete until the items in the attached letter are submitted (Attachment 3C-3), The applicant is . working with Rice Creek Watershed to address the items in letter. The soil borings, which are requested in item one, have becn prepared by the applicant. C. Utilities. Lots 4 will use the existing water and sewer corlliection, Lots 1,2, and 3 will havc a new cOilllection to City utilities. The developer is responsible for the cost and installation of utilities to the properties. Work on utilities within the City right-of-way will require approval from the City's Operations and Maintenance departmcnt and approval from the City Engineer. D. Access f Street Design. The applicant is proposing to have Lots I and 2 share a portion of the driveway and access to New Brighton Road. Lot 3 would access Thom Drive at a new access, and Lot 4 would have its existing access moved from New Brighton Road to Thom Drive. Any new access points on New Brighton Road would require approval from Ramsey County. The proposcd access points on Thom Drive meet City requircments for driveway locations and proximity to existing intersections. The City Engineer has reviewed the utility easement and detelmined that the portion needed for the driveway is excess and has no current or future use. However, thc City Council will need to hold a public hearing before any portion oflhe utility easement can be vacated. Ifthe preliminary plat is approved, it would need to be contingent upon the City Council approving a vacation of a portion of the utility easement. The City Council could hold a public hearing for the vacation when the preliminary plat is reviewed. A variance would be required for two lots to share a portion of a driveway and an access point. E. Park Dedication. Since this subdivision results in the creation of two new residential lots, the park dedication fee applies. Section 1130.08 of the City Subdivision Code states that all subdivisions are required to dedicatc a portion of their land for recrcation and conservation purposes. In lieu ofthc land dedication, the City Council may require the applicant to pay, as an equivalent contribution, an amount in cash equal to the percentage ofthc land required to be dedicated multiplied by the fair market value of the property at the time of the final approval of the subdivision. Should a fee be accepted in lieu of a land dedication, the park dedication fee would be six pcrcent of the land value of the property at the time of final approval . of the subdivision. The applicant is also proposing to remove an existing accessory structure that would straddle thc proposed lot line between Lots 2 and 4, The existing dwelling and accessory structure on the 3685 New Brighton Road would remain and become part of Lot 4. The applicant has indicated that they arc working with the property owner to the north (3707 New Brighton Road) to replace the existing retaining wall between Lot I and the propcrty to the north. A retaining wall greater than four feet in height requires an approved building permit. No plans for a retaining wall have bccn submitted at this time, 3. Granting a Variance to the Zoning Ordinance In the revised application, the applicant is proposing to have Lots I and 2 to share a portion of their driveway and sharc the access point to New Brighton Road. While there are a number of partially shared driveways in the City, Section 6.F.3.c.(4) states: (4), Proximity to lot lines, Access drives may be placed adjacent to property lines, but in no case shall a driveway be placed nearer than five (5) feet to an existing drive on an abutting parcel. . The above restriction does not permit driveways to be shared or directly adjacent to each other. A variance would be needed for Lots I and 2 to partially share a driveway. Please note that the revised variance application is not for a variance from the Subdivision Code. The new request would be a variance from the Zoning Ordinance, which has slightly diffcrcnt evaluation criteria that are outlined below. A variance from the Zoning Ordinance relates to the design and layout of structures and surfaces on the lots themselves. A variance from the Subdivision Code would relate to the fundamental design and layout of the plat design. In the revised application, a variance is not needed for the design of thc preliminary plat. The revised preliminary plat design is not contingent upon approval of this variance requcst to allow two lots to partially share a driveway. If the variance is approved, a separate motion from the preliminary plat would be needed. State Criteria for Evaluating Variance Requests: , Minnesota State Statue in Chapter 462.357, Subdivision 6, (2), defines "undue . hardship" as: "...means the property in question cannot be put to a reasonable use if used under conditions allowed by the official controls, the plight of the landowner is due to circumstance unique to the property not created by the landowner, and the variance, ifgranted, will not alter the essential character of the locality. Economic considerations alone shall not constitute an undue hardship ifreasonable use of the property exists under the terms of the ordinance... " Minnesota State Stature 462.357, Subd. 6, requires that Cities consider the following five matters when hearing requests for zoning ordinance variances: I. Are the circumstances for which the variance is requested unique to the property? 2. Would granting the variance be in keeping with the spirit and intent of the City's Zoning Ordinance? 3. Could the property in question be put to a reasonable use without the granting of thc variance? 4, Was the hardship created by the owner? 5. Would granting the variance alter the essential character of the neighborhood? B. Local Criteria for Evaluating Variance Requests: Section 8.D.4.c of the Arden Hills Zoning Ordinance states: . Adherence to this provisions of this [zoning} ordinance is required except for special cases, which arise because the configuration of a particular parcel. The condition shall not have been creatcd by the landowner. A variance or variances may be granted ;;-om specific provisions of this ordinance because such land factors as length of a side of a lot, the shape of the lot or the unusual terrain prohibit reasonable development equivalent to that which would be permitted without variance on a similar size lot located in the same district, but which lot has no unusual configuration. Economic conditions alone shall not be grounds for a variance, 4. Additional Plan Review The City Engineer, City Attorney, Fire Marshal, and the Building Official have reviewed the preliminary plat and variance application. The comments from the City Engineer are technical in nature and do not affect the fundamental design of the subdivision (Attachment 3C-2). The applicant's surveyor was provided with a copy of the City Engineer's comments. The Building Official did not have any comments regarding this proposal. Findings of I<act Zottittg Ordittattce Findings: 1. The preliminary plat proposal meets or exceeds all of the requirements of thc underlying R-2 Zone, including minimum lot sizc, lot width, and lot depth. 2. All four lots in the preliminary plat arc capable of accommodating a dwclling that meets all required setbacks and coverage limits without a variance. Subdivisiott Ordinance Findings: 3. Thc proposed Lots mcct or exceed all of the requirements of the City of Arden Hills Subdivision Code, 4, All four lots are adjacent to the public right-of-way and capable of supporting separate driveways ifthc variance for a shared access point is denied. 5. A park dedication fec will be required for this subdivision proposal. . Variance Findittgs 6. The reasons for the variance are not particularly unique to the property. The variance is not based on a hardship unique to the lot size, dimensions, or topography. There does not appear to be any significant barriers to constructing separate driveways to New Brighton Road unless Ramsey County would require the two lots to share onc acccss point to New Brighton Road. 7. The Valiance would be within the spirit and intent of the Zoning Ordinance. Although the Zoning Ordinance requircs each lot to have a separate drivcway, a large portion of each driveway would be separate. It is unlikely that the sharcd portion of the driveway would negatively impact the neighborhood. 8. The property could be put to use without the variance; however, granting the variance may increase safety without negatively influencing the neighborhood, 9. Whilc none of the other parcels in the surrounding neighborhood have a partially sharcd driveway, it is unlikely that this variance would alter the essential character of thc neighborhood. In Planning Case #06-013, Staff recommends approval ofthc preliminary plat based on the eight . findings of fact and submittcd plans. Provided that the City Council approves a partial vacation of the utility easement for the proposed driveway on Lot 3, the lots in the subdivision meet or exceed a1l of the requircments of the undcrlying R-2 Zone. While the rcqucsted variance is unlikely to have a negative impact on the adjacent properties or the City, Staff cannot recommend approval of the variance due to the lack of a bona fide hardship. The City has not received any comments from Ramsey County to determine if there is a prefcrence for one or two driveway access points to New Brighton Road for Lots I and 2. If the Planning Commission does recommend approval of the variance, findings supporting the approval should be cited. Once the preliminary plat is approved by the City, no additional conditions related to the design of the preliminary plat can be added. The final plat is simply a review process to ensure that the changes required in the preliminary plat have been made. Staff proposes the f01l0wing sixteen conditions if approval of the preliminary plat is recommended to the City Council: 1. Thc preliminary plat shall be contingent upon approval of a request to vacate a portion of the utility easement for the driveway on proposed Lot 3. 2. The applicant shall comply with applicable provisions of the City Code and related ordinances. 3. The applicant shall submit the final plat and application to the City of Arden Hi1ls within three months of the preliminary plat approval date or the approval shall expire . unless an extension is granted by the Planning Commission. The final plat sha1l reflect a1l changes req uired in the conditions of approval for the preliminary plat. 4. The project shall be completcd in accordance with the plans submitted as part of the preliminary plat application. Any significant changes to thesc plans, as determined by the City Planner, shall require revicw and approval by the Planning Commission. 5. The applicant shall inelude a 12 foot drainage and utility easement centcred on all common lot lines, and a 12 foot drainage and utility casement along the right-of-way. 6. The applicant shall pay a park dedication fee as determined by the City Council at the time the final plat is approved. 7. The applicant shall amend the final plat to be in conformance with all of the comments from the July 3,d, 2006, memo from the City Engineer. 8. Any extension of City services for the new lot shall be subject to review and approval by the City Engineer and a1l associated costs shall be the responsibility of the applicant. 9. Erosion control measurcs shall be installed before any grading or construction begins and shall be maintained and remain in place until groundcover is reestablished and construction is finishcd. The applicant shall provide an as-built survey upon completion of the project. 15. Thc address for the existing dwelling Lot 4 shall be changed to a Thom Drive address from the current New Brighton Road address. 16. The applicant shall work with the Arden Hills City Plamler and Arden Hills City Forester to save as many existing quality, well placed, and healthy trees as possible. Ifthe variancc is approved, Staff would recommend the following additional condition: l. The applicant shall prepare a maintenance agreement for the shared driveway and access point for Lots I and 2. Resident Comment . Staff has not received any official letters or telephone calls from property owners or occupants in regard to this planning case. Notice Although State Statutes do not require a second notice when an application has only been tabled, a second notice was published in the Arden Hills/Shoreview Bulletin. A second noticc was also prepared by the City and mailed to properties within three-hundred fi fly (350) feet of the subject property, Options I. The new code will be published on July 5th, 2006, and go into effect on July 6th, 2006. Thc Sign Code will become Chapter 12 in the City Code of Ordinances. The sign moratorium will1ift once the new code goes into effect. Sign Ordinance -7 Side Code . As noted above, the new sign regulations will be part of the City Code. While the City Council did not include a provision to require a public hearing for all changes to the sign regulations, they did reserve the right to call a public hearing as deemed necessary. Please note that any variations from the sign regulations for a specific application are still reviewed by the Planning Commission. For example, if an applicant wishes to construct a sign that is taller than normally permitted, that type of request is still reviewed by the Planning Commission. Offsite Temporary Signs Off-site temporary signs will be permitted on private property and on City public right-of-way under the new sign code (Chapter 1200.IS). Up to five signs that are less than four square feet in size, less than four feet high, at least five feet from the edge of the road, and within one mile of the property the sign is attributed to may be placed for up to thrcc consecutive days in any seven day period. Section 1200.11 was added after thc June Planning Commission meeting. This section was expanded from focusing exclusively on violations to include inspections and impoundment fee information. In rare cases where signs become a safety issue, the inspection authority gives the City the ability to remove the sign at the property owner's expense. The sign impoundment process was added to discourage citizens from placing illegal signs, particularly ofl~premise signs, and to encourage citizens to remove temporary signs before they are in violation of the sign regulations. The impoundment fee was added at the suggestion of a local real estate agent, and it would allow the City to recoup some of the administrative costs associated with the impoundment process, The City of Shoreview has a very similar program impoundment program. . At the June 121h, 2006, meeting The City Council heard the following two planning cases: . Planning Case 06-017; Len Gallus; 1104 Amble Drive; Site Plan Review for a fence variations in the front yard setback . Planning Case 06-018; 1212 LLC (Rob Davidson); 1212 Red Fox Road; Site Plan Review for exterior modifications to the building at 1212 Red Fox Road. . The City Council reviewed Planning Case 06-014: Sign Code at their June 261\ 2006, mecting. Planning Case 06-017: The City Council accepted the Planning Commission's recommendation for approval and unanimously voted to approve Planning Case 06-017. The approval is subject to the six following conditions recommended by the Planning Commission: I. The project shall be completed in accordance with the plans submitted. Any significant changes to thcse plans, as determined by the City Planner, shall requirc review and approval by the Planning Commission. 2, The applicant shall keep the fence maintained and promptly repaired if any damage occurs to the fence, including graffiti. 3. The applicant shall maintain the vegetation on the Lexington Avenue side of the fence. 4. The applicant shall locate the utilities ncar the proposed fence before the fence permit is issued. The applicant shall comply with any setbacks set by the utility company. 5. The fence shall not encroach on the public right-of-way. The lot lines shall be located prior to the issuance of the fence permit. City of Arden Hills . The fence shall not infringe on the Jines of sight for Lcxington Avenue and Amble Drivc. The fence permit shall be subject to approval by Ramsey County to ensure . that the lines of sight are protected. Mr. Gallus has already begun work on the fence. Planning Case 06-018: The City Council accepted the Planning Commission's recommendation for approval and unanimously voted to approve Planning Case 06-OIS. The approval is subject to the four following conditions rccommended by the Planning Commission: I. The project shall be completed in accordance with the plans submitted. Any significant changes to these plans, as determined by the City Planner, shall require review and approval by the Planning Commission. 2. The applicant shall obtain the necessary building permits before beginning any modifications to the exterior of the structure, 3. Signage shall comply with the Sign Code. Signage shall not be installed without an approved sign permit. 4. Lighting shall conform to the requirements m Section 6.E.3 of the Zoning Ordinances. Lighting shall be directed away from adjacent properties, hooded, and not cast light that exceeds a meter reading of one foot candle on the travel lanes of adjoining public streets or .4 foot candles on adjoining residential property.
