RESOLUTION NO. 05-47
RESOLUTION FINDING A NEGATIVE DECLARATION FOR THE PREPERATION
OF AN ENVIRONMENTAL ASSESSMENT WORKSHEET FOR THE PLANNED UNIT
DEVELOPMENT, PUD PERMIT, AND PRELIMINARY PLAT FOR ROYAL OAKS
REALTY
WHEREAS: Minnesota Rules Chapter 4410 establishes a process by which citizens
may file a petition to have a Responsible Government Unit (RGU) order an
Environmental Assessment Worksheet (EAW); and
WHEREAS: on July 18, 2005, the Minnesota State Environmental Quality Board
received an EAW citizen petition and determined that the City of Arden Hills was
the Responsible Government Unit (RGU); and
WHEREAS: Minnesota Rules Chapter 4410.4300, Subpart 14 - Mandatory EAW
Categories; Industrial, Commercial, and Institutional Facilities lists the threshold
for a mandatory EAW for a commercial development in a third or fourth class city
is 200,000 square feet; and
WHEREAS: Minnesota Rules Chapter 4410.4600, Subpart 10- Exemptions; Industrial,
Commercial, and Institutional Facilities - lists commercial development in a third
or fourth class city at or below 50,000 square feet as exempt from an EAW; and
WHEREAS: Minnesota Rules establish that when a development project is neither
mandatory or exempt, an EAW may be ordered by the RGU either on their own
initiative or by citizen petition when the facts indicate that the project "may have
the potential for significant environmental impacts"; and
WHEREAS: Minnesota Rules define "environmental" to mean physical conditions,
including: land, air, water, minerals, flora, fauna, ambient noise, energy
resources, and artifacts or natural features of historic, geologic or aesthetic
significance; and
WHEREAS: In preparation for the development of the subject parcel a series of studies
were conducted, including the following:
WHEREAS: The City of Arden Hills received a Wetland Delineation Report for the
fOrmer City Hall and Public Works site on November 2004; and

WHEREAS: The City of Arden Hills received a Demolition Survey Report for the former
. City Hall and Public Works site on December 9, 2004; and
WHEREAS: The City of Arden Hills received a Phase I Environmental Site Assessment
for the former City Hall and Public Works site on December 10, 2004; and
WHEREAS: The City of Arden Hills received a Phase II Investigation Report for the
former City Hall and Public Works site on March 7,2005; and
WHEREAS: Based on the findings of the Phase II Investigation Report a Development
Response Action Plan (DRAP) will be required by the Minnesota Pollution
Control Agency to the City for redevelopment of the former City Hall and Public
Works site and will be required prior to the issuance of building permits; and
WHEREAS: Royal Oaks Realty included in their application materials a Traffic Report
for the former City Hall and Public Works site by Traffic Data, Inc. dated May 9,
2005; and
WHEREAS: The Rice Creek Watershed District has reviewed the proposed
development plans and granted the project Conditional Approval Pending
Receipt of Changes (CAPROC); and

WHEREAS: The City Engineer and County Traffic Engineer have reviewed the
methodology and findings of the Traffic Report performed by Traffic Data, Inc.
and have agreed with the methodology and results of the traffic report; and
WHEREAS: The City Engineer has reviewed the plans and materials submitted to the
City for redevelopment of the former City Hall and Public Works site and has
preliminarily approved the plans subject to conditions; and
WHEREAS: The development review process was conducted as follows:
WHEREAS: A neighborhood informational meeting was held on April 19, 2005 to
inform residents of the proposed development; and
WHEREAS: on May 16, 2005 Royal Oaks Realty submitted a completed application for
review of a Planned Unit Development and Preliminary Plat which would allow
for the construction of 30 office condos in 7 buildings on the former City Hall and
Public Works Facility site on Highway 96; and
WHEREAS: on June 1, 2005, a public hearing was held by the Planning Commission
reviewing the application by Royal Oaks Realty and at the conclusion of the
public hearing the Planning Commission tabled the item to the July 6, 2005
Planning Commission meeting; and

WHEREAS: on July 6, 2005, the Planning Commission continued review of the
application by Royal Oaks Realty and at the conclusion of the discussion the
Planning Commission recommended approval (6-1) subject to 18 conditions of

approval; and
WHEREAS: on July 11, 2005, the City Council received the recommendations of the
Planning Commission and tabled the item to a special City Council meeting on
July 18, 2005; and
WHEREAS: on July 18, 2005, The City of Arden Hills reviewed the EAW citizen petition
and determined that there was not sufficient or compelling material evidence that
the petition has "potential for significant environmental effects"; and
AND, WHEREAS: The City of Arden Hills has determined that there have been
sufficient studies completed on the subject site in order fOr the City Council to
make a determination on the Planned Unit Development, PUD Permit, and
Preliminary Plat; and
NOW THEREFORE BE IT RESOLVED: That the Council of the City of Arden Hills has
reviewed the information regarding the redevelopment of the former City Hall and
Public Works site and the EAW citizen petition received on July 18, 2005 and
makes a negative declaration finding.
ADOPTED BY THE CITY COUNCIL OF THE CITY OF ARDEN HILLS THIS 18th
DAY OF JULY, 2005.
