Chair Sand called the meeting to order at 7:10 p.m. DRAFT

Present were Commissioners Clayton Larson, Ken Bezdicek, Elizabeth Modesette,
Clayton Zimmerman, Roberta Thompson, David McClung, and Chair David Sand.
Absent: None.
Also present were Mayor Beverly Aplikowski, Councilmember David Grant, Community
Development Director, Scott Clark, City Planner Peter Hellegers, City Engineer Greg
Brown, and Recording Secretary Kathleen Altman.
A. APPROVAL OF MINUTES FROM PLANNING COMMISSION MEETING
HELD ON JUNE 1. 200S.
. Commissioner Zimmerman requested the following ehanges: Page 14, second paragraph
from the bottom, first sentence should read: "Commissioner Zimmerman stated he
believed with the additional five recommendations given tonight by staff and the
comments made at this public hearing, this needed to be tabled for further evaluation."
Commissioner Thompson requested the following changes: Page 3, delete the ninth
paragraph from the top. Page 6, second paragraph from the bottom, last sentence change
considerable to considerably. Page 7, last paragraph, 9th sentence, change smaller to
smaller. Page 8, third paragraph, second sentence, change work to worked. Page 13, last
paragraph, 11 th sentence, change are to area.
Commissioner Zimmerman moved, seconded by Commissioner Larson to approve the
June 1, 2005 minutes as amended.
The motion carried unanimously (7-0).
B. INFORMATION ITEM
1. MnDOT/Ramsev County Radio Tower Reconstruction proiect (across Lake
Valentine Road from MVHS)
Mr. Hellegers stated the radio tower was owned by the State of Minnesota and a
. representative [rom MnDOT was in attendanee to discuss this.
Lynn Ness, System Engineer MnDOT, summarized their plans to replace the existing
tower on 1929 Lake Valentine Road.

A. PLANNING CASE #05-17: PRESBYTERIAN HOMES, 2845 HAMLINE
AVENUE N. #100, ROSEVILLE, MN; SUP AMENDMENT FOR MCKNIGHT
CARE CENTER ADDITION (3220 LAKE JOHANNA BL YD.)
Mr. Hellegers stated applieants were requesting a Special Use Permit Amendment for an
addition to the south end of the McKnight Care Center on the Presbyterian Homes
property in Arden Hills. Staff recommended approval of the Special Use Permit
Amendment for the Presbyterian Homes, after making a finding that the special use will
not have an adverse impact on the surronnding properties or on the community as a
whole, based on the following conditions:
L Revised Final Plans. The applicant shall submit revised plans, responsive to the
comments from the Plan review Comments section of staff s report (9),
contained in City Planning File #05-12, for review and approval by the City
Planner, City Engineer, and City Building Official, prior to issuance of building
permits.
2. Landscaping Plans. The applicant shall submit a revised landscape plan for
review and approval by the City Planner prior to the issuance of any occupancy
permit.
3. Screening of Mechanical Overating Equipment. All mechanical operating
equipment shall be screened to meet City regulations. .
4. Noise Level of Meehanical Overating Equipment. All meehanical operating
equipment shall meet the City regulations for noise levels. If the City Council
determines that the noise level from the mechanical operating equipment is not
meeting City regulations for noise levels; the applicant shall be required to
reduce the noise levels from the mechanical operating equipment.
5. Proteetive Fencing on the Retaining Wall. Protective fencing shall be erected at
the top of the retaining wall. Fencing may be decorative (wrought iron) or a
vinyl coated chain link style fencing (suggest black, brown, or dark green).
6. Exeeution of an SUD Amendment Permit. Execution of an SUP Amendment
Permit drafted by the City Attorney and approved by the City Council prior to
the issuance of a Building Permit.
7. Necessarv Approvals from Other Agencies. The applicant shall obtain all
neeessary permits from the Rice Creek Watershed District, Ramsey County,
State of Minnesota Department of Natural Resources and any other governing
ageneies where applicable.

Commissioner Bezdicek asked if the brick would be consistent with the existing building.
e John Mehrkens, Presbyterian Homes, replied the brick would be matched as close as
possible, He noted the building should look very consistent.
Commissioner Modesette asked ifthere had been a neighborhood meeting. Mr. Hellegers
replied there had been a neighborhood meeting with 12 to 14 residents in attendance.
Commissioner Modesette asked if there would be anything further other than plantings
along the top of the retaining wall. Mr. Mehrkens replied staff had recommended a fence
on the top of the retaining wall, which they would comply with.
Commissioner McClung asked on the rooftop terrace, what type of fencing would there
be and how wide were the posts going to be. He indicated he was concerned about
screening the terrace. Mr. Mehrkens replied the top floor would have a vertical slatted
fence, to bring in light and allow residents to look out as well. He stated the fence would
sit on a knee wall, which would sit 2-3 feet off of the finished floor. He indicated they
would use this only during staff supervised times. He stated there would be planter pots
and a garden that would be used as an activity, as well as a screening use. He noted the
closest point to a residential home would be 210 feet.
Commissioner McClung asked if the low level hedges would be removed. Mr. Mehrkens
replied they intended on keeping the hedges where they were.
. Commissioner Thompson asked how successful did they think they would be in
relocating the large trees. Mr. Mehrkens stated after further analysis, a couple of the trees
were diseased and would need to be removed, but the trees they could remove and
relocate they would and if those trees did not live, they would be replaced with like trees
of reasonable size.
Commissioner MeClung moved, seconded by Commissioner Modesette that the Planning
Commission considered the effect of the proposed use based upon the health, safety,
convenience and general welfare of the owners and occupants of surrounding land, in
particular, and the community as a whole, in general, including but not limited to the
following factors: existing and anticipated traffic and parking conditions; noise, glare,
odors, vibration, smoke, dust, air pollution, heat, liquid or solid waste, and other nuisance
characteristies; drainage; population density; visual and land use compatibility with uses
and struetures on surrounding land; adjoining land values; park dedieations where
applieable, and the orderly development of the neighborhood and the City within the
general purpose and intent of this ordinance and the Comprehensive Development Plan
for the City and reeommended approval of Planning Case No. 05-17, Presbyterian
Homes, 2845 Harnline Ave. N. #100, Roseville, MN; SUP Amendment for McKnight
Care Center Addition (3220 Lake Johanna Blvd.) subject to the seven conditions as
outlined in staffs July 6, 2005 report.

A. PLANNING CASE 05-12: ROYAL OAKS REALTY. 1000 COUNTY ROAD E
WEST, SHOREVIEW. MN: MASTER AND FINAL PUD AND PRELIMINARY .
PLAT FOR OLD CITY HALL AND PUBLIC WORKS SITE (1440-1450
HIGHWAY 96)
Mr. Hellegers stated applicant was requesting a Master and Final PUD and Preliminary
Plat for the redevelopment of the old City Hal1/Public Works property as a 7 building, 30
unit, office condominium eomplex. Staff recommended approval of the Master and Final
Planned Unit and Preliminary Plat subject to the following conditions:
1. Revised Final Plans. The applicant shall submit revised plans, responsive to the
comments from the Plan Review Comments contained in City Planning File #05-12
for review and approval by the City Planner, City Engineer, and City Building
Official, prior to the issuance of building permits.
2. Development Timeline. The applicant's timeline for development shall be as follows:
- Phase 1: Summer 2005 - The developer may begin grading, installing
utilities, and construction of storm water improvements. It is expected that
construction on 3 buildings/l 6 units (presumably units 15-30), will also begin
at this time. The 3 buildings/16 units are expected to be ready for occupancy
by the spring of 2006.
Phase 2; Summer - 2006 - The developer expects to begin construction on
the remalmng 4 buildings/l4 units (presumably 1-14) with expected
occupancy of these units by the spring of2007.
Extensions beyond 2007 shall require application to the City Council for review and .
approval. At the time of applieation for extension, the City Council may include such
conditions of approval as they determine necessary for compliance with City Code.
3. Number of Businesses in a Unit. 30 office condominium uses have been proposed for
development on individual lots. Only one business shall be permitted to occupy any
one lot within the development.
4. Retail Uses. Retail uses shall not be allowed to occupy any of the units in the
proposed development, exeept for incidental or accessory sales.
5. Restaurant Uses. Restaurant uses shall not be allowed to occupy any of the units in
the proposed development.
6. Residential Uses. Residential uses shall not be allowed to occupy any of the units in
the proposed development.
7. Landscaping Plans. The applicant shall submit a revised landscape plan for review
and approval by the City Planner prior to the issuance of building permits. The
revised landscape plan shall include a mixture of eoniferous and deciduous trees
along the west buffer yard of the development. The mixture of landscaping shall
adequately screen the development from the residential properties to the west.
8. Tree Preservation. The applicant and their contractors shall work with the City
Planner and City Forester to save as many existing, healthy, and well placed trees as
possible in the areas designated as landscape space.
9. Signage. One freestanding monument sign at the Highway 96 entranee shall serve for
the development. Wall signage within the development shall include 30 square feet
for each unit shall be permitted in accordance with the City's Sign ordinance. Each .
unit shall have 30 square feet including the I square foot address and name plaque
adjacent to the main entry for the unit. The 30 square feet of signage may be on the
side of the building or the front but not on the rear of the building. The unit signage
of 30 square feet may be illuminated by small decorative lighting fixtures which

. comply with the City's lighting standards. The building housing units 26-30 shall be
permitted to have one 60 square foot, internally illuminated sign which faces
Highway 96 to the north. This building shall be limited to 30 square feet on either the
west or south sides of the building, so that the total building signage would not
exceed 90 square feet.
10. Screening of Mechanical Operating Equipment. All mechanical operating equipment
shall be screened to meet City regulations.
11. Decorative Fencing to Surround the Pond. Decorative painted fencing (like painted
wrought iron fencing) shall be erected around the pond at the northeast comer of the
property to protect pedestrians from falling into the pond.
12. Exeeution of a PUD Permit. Execution of a PUD Permit drafted by the City Attorney
and approved by the City Council prior to the issuance of a Building Permit.
13. Park Dedication. Satisfaction of the park dedication requirements as approved by the
City Council in the amount of $40,000.00.
14, Final Plat. The applicant shall submit an application for a Final Plat within six (6)
months following City Council approval ofthe PUD and Preliminary Plat.
15. Necessary Approvals from Other Agencies. The applicant shall obtain all necessary
permits from the Rice Creek Watershed District and Ramsey County.
Commissioner Modesette asked if there had been any new information with respect to the
turn radius for the entry drive. Mr. Hellegers replied there might be a little bit of
additional space to work with, but it would not be 50-feet of additional space as
recommended. He noted moving the pole was not something that had been discussed.
. Commissioner Modesette asked if they had discussed with the developer the location of
the windows on the south side. Mr. Hellegers responded he had not spoken with the
developer regarding this and he requested the developer answer this question.
Chair Sand asked if the entire site was zoned neighborhood business now. Mr. Hellegers
replied it was approved as neighborhood business at the June meeting.
Chair Sand stated the City had received several emails and other correspondence from
residents, including a memorandum from Gale E. Van Buskirk at 1390 Arden View
Drive, attaching a petition signed by 154 citizens opposing this project.
Commissioner Thompson asked if there had been a new landscape plan submitted. Mr.
Hellegers replied they had not received a landscape plan at this time, but one would be
required before this would get final approval.
Chair Sand invited anyone for or against the variance to come forward and make
comment.
Elwood F. Caldwell, 1451 Arden View Drive, stated he was commenting on behalf of the
Board of Directors of Arden Hills North Homes Association. He presented his written
comments: "This is in response to the eight.page memorandum dated July 6 containing
. the staff reeommendations plus various attachments, to both of whieh we will refer, but
more particularly to the 16 specific conditions for approval on pages 6 and 7.
No. 1 stated in part that "The applicant shall submit revised plans, responsive to
comments from the Plan Review Comments contained in City Planning File #05-12..."

[emphasis added]. Since we endorse those comments unequivocally, we believe that the
revised final plans should comply with rather than be responsive to them. "Responsive" .
according to the dictionary means "making answer or reply" or simply "answering."
Nos. 2-8 are conditions on which we have no comment or with which we agree.
No.9 deals with signage. Notwithstanding the 30 square foot maximum unit wall
signage allowed by ordinance in the NB district, we previously recommended a
maximum of 6 square feet, which has been ignored. Signage in a very similar Royal
Oaks development in LakeviIIe, of which you have seen color photographs, currently
appears to fall within that limit. In any event, unit wall signage should be limited to not
over 15 square feet, wbich we understand units in the Lakeville development may be
permitted.
We also objeet strongly to the 60 square foot internally illuminated sign proposed to be
allowed on the north wall of building 26-30 that would be visible over the holding pond
from Highway 96. In our view it would detract substantially from the "townhome"
appearance of the development.
Nos. 10-15 are eonditions which we previously recommended and which received zero
acknowledgment or attention in the July 6 staff recommendations. It deals with the
problematie Hamline Aveuue/Karth Lake Circle/Site Access interseetion. At the very
least, the plat should be revised to show larger than standard radii (50-foot recommended)
on the northwest and southwest comers ofthat intersection as recommended by the traffic .
study (on page 14 of Attachment 4b-3 to the June 1 staff recommendations) and
concurred in by the Ramsey County traffic engineer Dan Soler as item 4 in his
memorandum of May 20, 2005 (Attachment 4a-4 to the June 6 staff recommendations).
If the project is approved, the additional condition should require construction of the radii
at that intersection in the initial phase of development.
In summarv, we continue to obiect to this proiect. but ask that if you recommend
approval to the Citv Council, at the very least vou retain or strengthen the present staff
conditions 2-8 and 10-15, and in addition:
1) In condition No.1, require compliance with and not merely responsive to the many
comments from the Plan Review Comments section ofthe staff report;
2) In condition No.9, limit unit wall signage to not over 15 square feet and preferably
not over six square feet, and delete permission for any sign on the north wall of units
25-30;
3) Add a condition No. 16 requiring that the recommended 50-foot radii at Hamline
A venue be shown on the plat and be constructed in the initial phase of construction of
the development."
Commissioner McClung stated in order to construct a 50-foot radii would require some
easement from the townhome association. He asked if the townhome association had
discussed this.
Dave Ehresman, 1481 Arden View Drive, President of Arden HiIIs Townhomes North, .
stated they did not favor the lighted, illuminated sign on the building. With respect to the
50-foot radius curve he offered the townhome association was willing to negotiate an

easement at no cost to the developer to allow a 50-foot radius to be incorporated into the
. development.
Connnissioner Larson asked if they would need to obtain right-of-way from the daycare
also. Mr. Hellegers responded the Developer would need to work with Excel to move the
pole and there might be a need to also obtain an easement from the daycare.
Mr. Clark stated the other question they needed to discuss was that the traffic engineer
study had discussed a 50-foot radius and this did not conform with other street
intersections in the City.
Mr. Brown stated a normal intersection had a 25-30 foot radius and he was not sure
where the 50-foot reconnnendation eame from and they did not anticipate large truck
traffic. He reconnnended as large of a radius as possible, but 50 feet appeared to be
excessive and 25-30 would be more appropriate.
Connnissioner Larson asked if this would stand out as being dissimilar to other streets
that accessed Hamline. Mr. Brown replied it would.
Dan Soler, Traffic Engineer Ramsey County Public Works Department, stated originally
when he looked at the traffic study, he was not sure there was a number in it, but he
agreed there should be some type of a radius on that corner. He indicated there are only
two reasons why they would want a larger radius including a high number of semi.traetor
. trailers using the access and to ensure that when vehicles are turning they end up on the
correct side of the road. He reconnnended there be a reasonable radius, such as 25-30
feet. He noted there were no 50-foot radius on Hamline and Highway 96.
Connnissioner Zinnnerman asked if the County had any guidelines with respect to radius.
Mr. Soler replied they did and the radius ranged from 25-50 feet depending upon the
factors, but he recommended a 25-30 foot radius for this development.
Chair Sand asked if there was adequate access on Highway 96 to stripe the highway for
the turn lane. Mr. Soler replied there was sufficient width for a turn lane and he
reconnnended striping and signing be put into place.
Chair Sand asked if there should be an acceleration lane for exiting vehicles. Mr. Soler
responded there was not sueh a lane anywhere else on Highway 96 and typieally they did
not use acceleration lanes on Highway 96 or any other County roads.
Connnissioner Modesette inquired about "U" turns. Mr. Soler stated "U" turns were not
an issue anywhere there were "U" turns at a protected signal. He acknowledged "U"
turns in some areas were a problem and in some areas they were not and it depended
upon the location.
Connnissioner Zimmerman asked if there was any precedence in there being a sign some
. number of feet before the entrance/exit to the property that indicated that there was traffic
entering from the right. Mr. Solder replied signage such as this might be helpful. He
stated they could look at the sight lines to see ifthis made sense.

Chair Sand asked if there was anything that would prevent the driveway access to be laid
out at a different location on Highway 96. Mr. Soler replied the driveway could not be .
too close to where the right turn lane began at Hamline.
Commissioner McClung noted the Hamline turn lane during rush hour did back up
almost to this proposed driveway entrance.
Commissioner McClung stated there was an issue with traffic on southbound Hamline
during morning rush hour.
Jim Hartsoe, President Townhouse Villages Homeowners Association South, 4430 Arden
View Court, stated the traffic on Hamline was a big problem, especially between 7-9 a.m.
He noted there was no light on Arden View Drive. He asked if people going north on
Hamline be able to turn left into the development. He did not believe the traffic
questions had been addressed well. He stated he had a concern about the number of
businesses being proposed on the property. He expressed concern with respect to
drainage. He stated the homeowners found it difficult getting and in out onto Hamline
Avenue and asked this be taken into consideration.
Kathy Sikano(?sp), Karth Lake Circle, expressed concern about the inability of people to
turn left onto Karth Lake Circle off of Hamline during rush hour. She noted there was no
left turn lane to allow people to turn into Karth Lake Circle.
Diane Phillipi, 1442 Arden View Drive, expressed concern about the lanes merging .
where the proposed driveway was going to be put.
Cindy Owen, 4490 Hamline, expressed concern about the traffic increase on Hamline.
She noted the traffic had grown immensely over the past years and she was concerned
about the safety of the residents on Hamline Avenue.
Gail Van Buskirk, 1390 Arden View Drive, stated she had submitted a petition with 154
signatures in opposition to this development. She indicated a lot of citizens were
concerned about this. She stated she was concerned with the traffic study in that they
tried to use the current traffic and foreeast future traffic, without addressing the increase
of traffic with Guidant's development. She indicated the study also did not address the
increased traffic onto all of the streets that exited onto Hamline Avenue. She noted no
environmental impact statement had been done, but with the water and drainage
concerns, she encouraged them to require an envirornnental assessment or impact
statement to make sure those issues were under control. She asked them to deny this
planning case.
Susie Severson, 1345 Arden View Drive, expressed concern about the police traffic on
Hamline Avenue and the safety of the ehildren in the area.
Elwood Caldwell noted the traffic study had recommended a 50-foot radii and he
believed this intersection was like no other interseetion in the City and needed that radii. .
Terry Giel, 4534 Keithson Drive, stated making a "U" turn on Highway 96 was
problematic.

Tony Tredal, 4521 Keithson Drive, stated she was opposed to this development. She
. noted their home had been built by Royal Oaks Realty and she had experienced many
problems with Royal Oaks Realty with them not complying with the City of Arden Hills
requirements and Rice Creek Watershed District requirement. She noted this developer
was not responsive and asked how the City could trust a company that had betrayed them
in the past.
Commissioner Thompson asked if the radius was 25-30 feet would it still be necessary to
move the utility pole. Mr. Hellegers replied staff would need to look at this.
Mr. Clark stated that more than likely the additional space for the radius would create the
need for the driveway to have additional space to the south, outside of the easement.
Commissioner Modesette asked if there was anyway to put in a dedieated turn lane for
the driveway.
Commissioner McClung recommended amendments to the conditions and wanted to add
two additional recommendations. First, with respeet to signage, his eoneern was the
variance for the signage. He stated they should allow a freestanding monument sign on
Highway 96 and it should comply with the sign restrictions. Wall sign age should be
within accordance with the City's sign ordinance standards. He was opposed to a large
sign on the back of units 26-30 and recommended that language be struck from condition
number 9. He noted he would not be in support of a sign variance. He expressed concern
. about the trail to the west in that it was only 10 feet from the back of units 1,2 and 3. He
proposed repositioning the buildings to allow a 20- foot setback from where the building
ends to the traiL He believed there would be public safety concerns, as well as drainage
concerns. He recommend a larger than standard radii with a minimum of 30-feet and
allow the applicant to bring forth a proposal that the City would approve prior to the
issuance of a building permit.
Mr. Clark stated it was his understanding the PTRC was asked to look at this and he did
not believe they had made a recommendation to move the buildings, but their concern
was that the integrity of the trail be maintained.
Commissioner Larson asked if the trail way was protected from the drainage plans
submitted. Mr. Brown replied he did not remember that area being a concern, but this
would be something they would look at further and the drainage should not adversely
impact the traiL
Commissioner Thompson asked if they should reeommend some type of lighting on the
trail for the safety of the people walking the traiL Chair Sand noted they needed to
balance the safety for the path users versus lighting issues for the homes by the trail.
Commissioner McClung stated that was the reason he wanted a larger area between the
buildings and the traiL
. Mike Black, Royal Oaks Realty, stated they might have some room to make some
adjustments between the buildings to add an additional five feet for the traiL

Commissioner McClung stated he would be willing to look at allowing some flexibility
to the required parking because this was strictly office use, whieh would give more space .
to the trail, more green space, and a larger setback for the homes on Keithson Drive.
Chair Sand asked if they could put in some environmentally friendly lighting two or three
feet off of the ground along the path.
Commissioner Thompson asked if they could require them protecting the trail while
construction was happening.
Commissioner McClung moved, seconded by Commissioner Larson to recommend
approval of Planning Case No. 05-12: Royal Oaks Realty, 1000 County Road E West,
Shoreview, MN; Master and Final PUD and Preliminary Plat for Old City Hall and
Public Works Site (1440-1450 Highway 96), subject to the conditions as noted in staffs
July 6, 2005 report and adding the following amendment/conditions: Condition 9 to read
- Signage: One freestanding monument sign at the Highway 96 entrance shall serve for
the development which shall eonform to the City's Sign Ordinance restrictions. Wall
signage within the development shall include 30 square feet for each unit in accordance
with the City's Sign Ordinanee. Signage shall be limited to the front of the building. 16.

set back at least 20 feet from the existing trail on the west side of the property. 17.
Hamline A venue Entrance: To facilitate movement in and out of the development, a
minimum 30- foot radii shall be built on the northwest and southwest corner of the
interseetion. Revised entrance plans shall be submitted to the City Engineer and Ramsey .
County Engineer for approval prior to the issuance of the building permits. 18. During
construction ofthe development and post construction ofthe development, applicant shall
provide plans to the City Engineer that will show how impact the City trail on the west
side of the development shall be mitigated including a drainage plan to prevent erosion of
the trail.
Commissioner Bezdicek expressed concern with the 20-foot setback for the trail and
requested this be revised to a 15. foot setback.
Commissioner Bezdieek moved, seconded by Commissioner Thompson to amend
Condition 16 to require a IS-foot setback for the trail, instead of a 20-foot setback. The
motion carried (6.]) (Commissioner McClung opposed).
Chair Sand noted Condition 16 would read IS-feet instead of20-feet.
Commissioner Larson requested they amend Condition number] 8 that the developer is to
provide low-level lighting for the trail behind the buildings subject to approval by the
City Planner. Commissioner McClung aceepted the amendment.

The applicant is proposing to subdivide his lot and remove a triangular piece of property of about
5,600 square feet (.1286 acres). The applicant would then have the property consolidated with

the property to the north (3576 Ridgewood Ct). The applicant is in the process of selling his
home; by subdividing and consolidating the subject piece of property, existing sightlines would .
be preserved for the neighboring property owner. The applicant's property which was larger
than the district requirements to begin, with will be left with a property which would still meet
all of the requirements. The consolidation of this new piece with the property to the north
actually improves the situation for that property as it appears that the house and deck there were
nonconforming with City setback regulations. Since this is not creating a new lot no park
dedication would be assessed.

2. Division/Consolidation - Meets Requirement
Chapter 11 ofthe City Code lists the requirements for subdividing and consolidating property.
Section 1150.04 discusses the procedures for "Division or Consolidation of Platted Lots of
Record". Since the subject property is platted, and is being proposed for subdivision and
consolidation, this is the section that would explain how the City should proceed on this matter.
Requirements listed under Section 1150.04 include: a survey showing the existing and proposed
lots, lots which meet City requirements for the zoning district, a determination regarding public
welfare, conformity with other aspects of the Subdivision chapter as determined necessary, and
payment of filing fees.
Staff has reviewed these criteria and determined that: the surveys submitted by the applicant
meet City standard, the resulting lots after division and consolidation would meet the
requirements for lots in the R-I District, the proposed division/consolidation will not be

Staff Recommendation
In Planning Case #05-18 staff recommends approval of the Minor SubdivisionlLot Consolidation
William Mitchell, after making a finding that the proposed subdivision meets City standards and
will not have an adverse impact on the surronnding properties or on the community as a whole;
subject to the following condition:
A. Recording with Ramsey County. The applicant shall file the minor subdivision and lot
consolidation with the Ramsey County recorder and shall provide the City with a
recorded copy.

3. Recommend denial with reasons for denial, If the City denies the petitioners request,

1150.04 Division or Consolidation of Platted Lots of Record. In the case of an application to
divide one or iIIore lots platted into lots and blocks and designated in a subdivision plat on file
and of record in the office of the recorder or registrar of titles for the county, into one or more
separately described parcels, or an application for the consolidation of two or more snch
platted lots or parts thereof into one or more tracts, the City Council, upon review and after
report of the planning commission, may approve the subdivision or consolidation, upon
compliance with the following conditions:
Subd. 1. Survey. The owner(s) of the platted lot(s) to be so divided or consolidated
. shall file with the zoning administrator a surveyor registered land survey of the lot(s)
to be divided or consolidated. The surveyor registered land survey shall be prepared
and certified by a Licensed Surveyor.
Subd. 2. Relation to Zoning Ordinance. The parcels or tracts resulting from the
division or consolidation, as depicted in the surveyor registered land survey, shall not
have an area, dimensions or setbacks which are less than the minimum requirements
specified for the zoning district in which tbe parcels or tracts are located in the zoning
ordinance.

Subd.3. Public Welfare. It is determined that the proposed division or consolidation .
will not be detrimental to the public welfare or injurions to adjacent tracts in the area
in which the snbdivision tract is located.
Subd. 4. Conformity. The proposed division or consolidation shall conform to snch
other requirements of this chapter, which the planning commission has specifically
made such division or consolidation subject to at its first meeting at which the
application for the division or consolidation is snbmitted. The City Council may add to
or subtract from the requirements specified by the planning commission additional
requirements ofthis chapter which it deems necessary for the protection of the health,
safety, general welfare and convenience ofthe City and to secure the objectives ofthis .
chapter. Prior to the City Council's granting the owner(s) an exemption pursuant to
this paragraph, the owner(s) shall comply with all the requirements of this chapter
Which the planning commission or City Council have specifically made the division or
consolidation subject.
Snbd. 5. Such filing fee as has been established in a resolution adopted by the Council
shall be paid the zouiug administrator with every application for an exemption nnder
this paragraph.

Ladies and Gentlemen:
My wife and I are the owners of lots 24 and 25 at 3568 Ridgewood Court in
Arden Hills. We would like to split off 1/3 of lot 25 for combination with
our neighbor's lot 26.
No new lot will be created by this shift of the boundary between lots 25 and
26. The size and location of our house on the residual lots 24 and 25 would
remain more than adequate to meet current city requirements. The neighbors
house on lot 26 will benefit because their deck is immediately adjacent to the
. split off property.
Attached is a recent survey showing the present and proposed boundaries,
and the proposed legal descriptions.
We request approval of the City of Arden Hills for the proposed change.
