RESOLUTION NO. 03-55
RESOLUTION APPROVING LAKE IMPROVEMENT DISTRICT
CRITERIA FOR KARTH LAKE AND
ESTABLISIDNG A DATE FOR A PUBLIC HEARING
WHEREAS, pursuant to Minnesota Statutes 459.20 and Minnesota Statutes 103B. 501-
103B.581, the City of Arden Hills has the authority to establish and administer a Lake
Improvement District for lakes located wholly within its boundaries;
WHEREAS, Karth Lake is located wholly within the boundaries of the City of Arden
Hills;
WHEREAS, the consulting engineer for the City of Arden Hills has prepared a report
(Engineering Study) dated the 20'h day of August 2003, which describes a necessity of
constructing and monitoring a lake elevation control structure for Karth Lake and which is
attached hereto as Exhibit A; and
WHEREAS, pursuant to Minnesota Statutes 103B.501-103B.581 in Minnesota rules
6115.0900-6115.0980 the City of Arden Hills has prepared a proposed order establishing and
providing for the administration of the Karth Lake Improvement District for the purpose of
constructing and monitoring a lake elevation control structure.
NOW, THEREFORE, BE IT RESOLVED by the Arden Hills City Council:
I. The Engineering Study is approved.
2. The boundaries of the proposed Karth Lake Improvement District as illustrated
and described in the Engineering Study are temporarily approved subject to final
approval following the public hearing.
3. The City of Arden Hills intends to establish the Karth Lake Improvement District
as proposed in the Engineering Study.
4. The public hearing to accept comments regarding the establishment of the Karth
Lake Improvement District shall be held at 7.00 p.m. on the 29th day of
September, 2003 at the Arden Hills City Hall, 1245 west Highway 96, Arden
Hills,MN.
5.
Consulting Engineer for the City of Arden Hills shall provide the Commissioner
of the Department of Natural Resources and the Minnesota Pollution Control
Agency a certified copy of this resolution and the document of criteria for the
Lake Improvement District for Karth Lake at least 40 days prior to said public
hearing.

6. At least 21 days prior to said public hearing, the City Administrator shall provide
mailed notice of the day, time, and place of the hearing to all property owners as
detennined by the Ramsey County Tax records; along with published notice within
the City of Arden Hills legal newspaper at least once a minimum of 21 days prior to
said hearing.
ADOPTED by the Arden Hills City Council this 25th day of August, 2003.
