RESOLUTION NO. 01-19
RESOLUTION ADOPTING AND CONFIRMING ANNUAL SPECIAL
ASSESSMENTS FOR DELINQUENT UTILITIES
WHEREAS, the amount to be specially assessed for DELINQUENT UTILITIES has been
duly calculated in accordance with the provisions of the City Code and Minnesota Statutes; and
WHEREAS, notices have been duly mailed as required by law; and
WHEREAS, said proposed assessments have at all times since their filing been open for public
inspections, and an opportunity has been given to all interested persons to present objections, if
any, to the proposed assessments; and
\VHEREAS, there were no oral or written objections received.
I. The anlolmts so calculated and set forth in said notices are hereby levied against
the respectivc parcels ofland described therein, and

The proposed assessments are hereby adopted and confirmed as special
assessments for each of said parcels of land and the assessments together with an
additional penalty of eight percent (8%) of the original unpaid amount, inclusive
of any previous delinquency penalty, shall be a lien concurrent with general taxes
upon such parcel.
NOW THEREFORE, BE IT RESOLVED by the City Council ofthe City of Arden Hills,
Minncsota, that the City Administrator be authorized and directed to transmit to the County
Auditor a certified duplicate of the assessment roll to be extended upon the proper tax lists of the
County. and the County Auditor shall collect said special assessments with taxes levied in 200 l,
payable in 2002.

RESOLUTION NO. 01-19
The undersigned, being the duly qualified and acting City Administrator of the City of Arden
Hills, Minnesota, hereby certifies the following:
The foregoing is a true and correct copy of a resolution on file and of official, publicly
available record in the office of the City. Said resolution was duly adopted by the City
Council at a regular meeting of the Council held on October 29.2001 . Said meeting
was duly called, regularly held, open to the public, and held at the place at which
meetings of the Council are regularly held. Councilmember Larson moved the
adoption of the resolution, which motion was seconded by Councilmember Aplikowski
whereupon majority vote, said resolution was declared duly passed and adopted.

The City of Arden Hills has historically followed a policy of annually certifying delinquent utility
bills to following year property taxes as a means of collecting delinquent utility accounts instead
of a water shutoff policy. Procedures for collections of delinquent accounts are prescribed in
Code of Ordinances, Sections 28-58 (water), 28-129 (sanitary sewer), and 28-172 (surface water
management).
DelinQuencv Status
Staff has attemptcd to more actively manage delinquent accounts with some success. There
appcars to be a base of repeat customers who are certified year after year. Perhaps they consider
this annual delinquent special assessment to be additional property taxes, and incorrectly take the
corresponding tax deduction on their personal tax returns. The attachment to the resolution
clearly shows the level ofrepeat customers.

With the 200 I budgeted utility revenues of $2, 172,600, the certification accounts represent
approximately 0.7% of this total, and approximately 1.3% ofthe 2,559 total utility account
customer base.
Recommendation
Council should consider adopting Resolution #01-19 under the Consent Calendar at the October
29,2001 Regular Council meeting entitled, "Resolution Adopting and Confirn1ing Annual
Special Assessments for Delinquent Utilities.
