CITY OF ARDEN HILLS COUNTY OF RAMSEY STATE OF MINNESOTA RESOLUTION NO. 00-21 RESOLUTION ADOPTING POLICY STATEMENT RELATED TO RAMSEY COUNTY HOUSING AND REDEVELOPMENT AUTHORITY (HRA) JOINT COOPERATION AGREEMENT Whereas, the City of Arden Hills has adopted and enforces its policy prohibiting the use of excessive force by law enforcement agencies within its jurisdiction against any individuals engaged in non-violent civil rights demonstrations; and Whereas, the City of Arden Hills has adopted and enforces a policy of enforcing applicable State and local laws against physically barring entrance to or exit from a facility or location that is the subject of such non-violent civil rights demonstrations within jurisdictions. THEREFORE, BE IT RESOLVED, that the City of Arden has hereby adopted and enforces the above-referenced policies, PASSED AND ADOPTED BY THE CITY COUNCIL OF THE CITY OF ARDEN HILLS THIS 30th DAY OF MAY, 2000. CITY OF ARDEN HILLS COUNTY OF RAMSEY STATE OF MINNESOTA CERTIFICATION RESOLUTION NO. 00-21 The undersigned, being the duly qualified and acting City Administrator of the City of Arden Hills, Minnesota, hereby certifies the following: The foregoing is a true and correct copy of a resolution on file and of official, publicly available record in the office of the City. Said resolution was duly adopted by the City Council at a regular meeting of the Council held on May 30 ,2000. Said meeting was duly called, regularly held, open to the public, and held at the place at which meetings of the Council are regularly held. Councilmember Grant moved the adoption of the resolution, which motion was seconded by Councilmember Aolikowski ; whereupon majority vote, said resolution was declared duly passed and adopted. VI "J'';L./ ~.:; HilLS /I The Joint Cooperati n Agreement between the County of Ramsey and C. ~ ("MUNICIPALITY") commencing August 31, 1991, and the irst Amendment to that Agreement, effective July I, 1997, (collectively "AGREEMENT") is further amended as follows: L The effective date of this Second Amendment is July 1,2000. 2. The AGREEMENT is amended by the addition of the following language: A. By executing this AGREEMENT the MUNICIPALITY understands that it: I . May not apply for grants from appropriations under the Small Cities or State Community Development Block Grant (CDBG) Programs for fiscal years during the period in which it participates in the AUTHORITY's CDBG program; and 2, May participate in a Home Investment Partnership Act (HOME) Program only through the AUTHORITY. Thus, even ifthe AUTHORITY does not receive a HOME formula allocation, the MUNICIPALITY cannot form a HOME consortium with other local governments. B. Both the AUTHORITY and MUNICIPALITY are obliged to take all actions necessary to assure compliance with the AUTHORITY's certification required by section 104(b) of Title I ofthe Housing and Community Development Act of 1974, as amended, including Title VI of the Civil Rights Act of 1964, the Fair Housing Act, section 109 of Title I of the Housing and Community Development Act of 1974, and other applicable laws, The AUTHORITY is prohibited from funding for activities, in or in support of, any cooperating unit of general local government that does not affirmatively further fair housing within its own jurisdiction or that impedes its actions to comply with its fair housing certification. This provision is required because noncompliance by the MUNICIPALITY may constitute noncompliance by the AUTHORITY which can, in turn, provide cause for funding sanctions or other remedial actions by the Department C. The MUNICIPALITY has adopted and is enforcing: L A policy prohibiting the use of excessive force by law enforcement agencies within its jurisdiction against any individuals engaged in non-violent civil rights demonstrations; and . . 2. A policy of enforcing applicable State and local laws against physically barring entrance to or exit from a facility or location which is the subject of such non-violent civil rights demonstrations within jurisdictions, 3.
