Lvnch ,hereinafter referred to as "Employee." 1. POSITION The Employer agrees to employ Employee as its City Clerk! Administrator commencing on November 10 , 1999. Employee agrees to serve as the City Clerk! Administrator for the Employer and will devote his full business time and best efforts to the City and will not engage in any other business or occupation. Employee agrees to perform the duties of ilie City Clerk! Administrator as set out in the Arden Hills Ordinances and policies as they are now in effect, and as they may be amended from time to time. Additionally, Employee shall be required to perform such oilier duties as may be directed by the City Council from time to time. 2. SALARY The Employer agrees to pay Employee a starting salary of.JH...% ofthe maximum/top end of the 1999 salary range ($ 57,500 ) starting November 10 , 1999, and thereafter at such rate as may be fixed, from time to time, by the City Council. A performance and salary review will be given at the end of six (6) months (May 10, 2000) and at twelve (12) monilis (November 10,2000). Thereafter, Employee's salary and performance will be reviewed in November, 2001, and every twelve (12) monilis thereafter in accordance with the review of the compensation of other City employees and in compliance with the City's comparable worth plan. 3. DEFERRED COMPENSATION It is agreed that the Employee will continue as a participant in the Public Employee's Retirement Association (PERA) system. The Employer will allow Employee to enroll in the ICMA Retirement Corporation (ICMA) 457(b) deferred compensation plan. The Employer agrees to match contributions to this deferred compensation plan to a maximum of ~% of Employee's base salary. 4. ANNUAL VACATION, SICK LEAVE At Employee's hire date of November 10, 1999, Employee shall have a vacation leave balance of eighty (80) hours. Thereafter, the Employee shall continue his vacation leave accrual in accordance with current City policy, as amended from time to time; however the maximum accrual may not exceed the maximum established by the City's policy. During Employee's probationary period, the beginning vacation leave balance can be utilized by Employee. 5. HOLIDAYS Employee shall receive the same standard holidays as detailed in current City Ordinance. CITY ADMINISTRATOR AGREEMENT P AGE TWO .,.... . 6. INSURANCE Employee will receive the same per month/per employee allotment for benefits as detailed in City Ordinances/policy. Those benefits include health, dental, short-term disability, long-term disability, and life insurance. 7. DUES AND SUBSCRIPTIONS The Ernployer agrees to budget and pay the professional dues and subscriptions necessary to maintain Employee's membership in those national, regional, state and local associations for the good of the City and desirable for Employee's continued professional participation, growth and advancement. The Employee will detail and justify these expenses as a part ofthe City's annual budget process. 8. PROFESSIONAL DEVELOPMENT a. The Employer recognizes the need for, and encourages, the Employee to be active in professional activities and therefore, the Employer hereby agrees to budget and to pay the travel and subsistence expenses of Employee for professional and office travel, meetings, and occasions adequate to continue the professional development of Employee and to adequately pursue necessary official and other functions for the Employer, including but not limited to, the annual conference and meetings of the International City Management Association; the League of Minnesota Cities; the State Managers' Association; and such other committees thereof on which Employee is a member. . b. The Employer also agrees to budget and to pay for the travel and subsistence expenses for Employee for short courses, institutes, and seminars that are necessary for his professional development and for the good of the City. c. Notwithstanding the foregoing provisions, the Employer retains the right to limit or expand the Employee's activities described herein from time to time at its sole discretion. 9. GENERAL EXPENSES The Employer shall reimburse Employee for all business expenses incurred while representing the City, including, but not limited to meals, civic club memberships, and subscriptions. 10. TERMINATION AND SEVERANCE PAY For purposes of calculating severance pay, the Employee start date shall be November 10, 1999. Nothing in this agreement shall prevent, limit or otherwise interfere with the right of the Employer to terminate the services of Employee at any time, for any reason, subject only to the provisions of this agreement. Furthermore, nothing in this agreement shall prevent, limit or otherwise interfere with the right of Employee to resign at any time from his position with the City, subject only to the provisions of this agreement. . '" . . . CITY ADMINISTRATOR AGREEMENT PAGE THREE In the event the Employee is terminated by the Employer during such time that the Employee is willing and able to perform the duties of City Clerk! Administrator, then in that event, the Employer agrees to continue to provide and pay for the benefits set forth in paragraph "6" above for a period of up to one year following termination, and pay Employee at the time ofreceipt of his last paycheck a lump sum cash payment equal to the following: First six (6) months Six (6) months to twenty-four (24) months After twenty-four (24) months Sixty (60) day aggregate salary Ninety (90) days aggregate salary One hundred-twenty (120) days aggregate salary In addition to said severance pay, if Employee leaves the employ of the City, the Employee shall be paid for any unused vacation. Compensation shall be given for any unused sick leave in accordance with City policy. If Employee voluntarily resigns his position with the City, the Employee agrees to give the Employer thirty (30) days advance notice. 11. HOURS OF WORK It is understood that the position of City Clerk! Administrator requires attendance at evening meetings and occasionally at weekend meetings. It is understood that employee may be absent from the office to a reasonable extent in consideration of extraordinary time expenditures for evening and weekend meetings at other than normal working hours. 12. AUTOMOBILE Employee shall be paid $275.00 per month to use his personal automobile for City business within the Twin Cities metropolitan area. During the Employee's first six (6) months of employment, Employer shall reimburse Employee for any down payment or up front costs associated with the acquisition of a personal vehicle, with such reimbursement being limited to a maximum of twenty percent (20%) of the vehicle's fair market value. Said monthly allowance shall be subject to change upon mutual consent of Employee and the Employer. This amount will be reviewed at the performance and salary review dates. 13. GENERAL CONDITIONS OF EMPLOYMENT If any provision, or any portion thereof, contained in this agreement is held to be unconstitutional, invalid or unenforceable, the remainder of this agreement, or a portion thereof, shall be deemed severable, shall not be affected, and shall remain in full force and effect. 14. INDEMNIFICATION Employer shall defend and indemnify Employee, pursuant to Minnesota Statutes 9 466.07 and 465.76. Code Enforcement Update Code Enforcement Official Dave Scherbel, and Associate Planner Nancy Randall, will update the Council on recent Code Enforcement activities. This information is maintained in an internal City database. Parks and Recreation a. Ramsey County Parks Department. Tony Schmidt Park Mr. Holmberg of the Parks Department, and the County's architectural subcontractor, will present proposed designs for six (6) structures (beach house, picnic shelters, restrooms) at Tony Schmidt Park, and seek input from Council on the design plan. Public Works a. Old Hi!!:hway 10 Water Main Petition Discussion City Engineer Greg Brown may have preliminary costing information on the proposed project. Council may wish to discuss the special assessment implications of this information. b. Hi!!:hways 10/96 Discussion Council may wish to begin discussion on which design alternative (i.e., build as is, ramp option, or frontage road option) it wishes to formally endorse at the October 25,1999 Council meeting. c. St. Paul Water Utility Distribution Serviccs Discussions Mr. Stafford will brief Council on the array of distribution services the St. Paul Water Utility is proposing to provide the City of Arden Hills in exchange for taking over ownership of water infrastructure assets. . . . CITY OF ARDEN HILLS MEMORANDUM DATE: October 15, 1999 TO: Mayor and City Council &It. o.h ^ J Dave Scherbel, Building Officiall.~'1 ~ Code Enforcement Update FROM: SUBJECT: Arden tower Staff sent a letter to Mr. Dan Vaughan on September 17, 1999, relaying the public safety concerns City staff has regarding the tower. On October 8,1999, I had a meeting with Mr. Vaughan at City Hall. Mr. Vaughan requested review of the City files on the tower property, and did so at that meeting. Copies of specific file items were copied for Mr. Vaughan. Mr. Vaughan stated that he had a meeting with EEl Engineering on October 12, 1999, and wished to obtain all the information he possibly could on the tower. Mr. Vaughan also stated that he did not have any of the original construction documents that were part of Planning Case # 81-05. Mr. Vaughan also acknowledged that the tower was never originally designed for Yz" radial ice, and that he doubted the tower would meet current code, but was willing to do whatever it took to make the tower safe, including the rebuilding of the tower. Mr. Vaughan stated that he had already started to obtain quotes on the construction of a new tower. Staff comments Regarding the Arden tower, staff suspects the tower will not meet code and Mr. Vaughan will seek to rebuild tower. Perkins Restaurant The following is a brief update on the past history regarding the Perkins restaurant. The Fire Inspector for Lake Johanna wrote orders to post a no parking sign in front of the building's fire connection on July 14, 1999, to be completed by August 14, 1999. On August 17, 1999, the Fire inspector reinspected the property and found the sign had not been posted. On August 18, 1999, the Fire Inspector sent a second notice indicating that the sign was to be installed no later than September 17, 1999, or a citation would be issued. The sign was not posted as of September 18, 1999, and the Fire Inspector issued a citation on September 21, 1999. Memorandum, Code Enforcement Update Page Two October 15, 1999 . Mr. Cory, (owner of Perkins restaurant) informed the Fire Inspector that he was going to shut-off his sprinkler system. The Fire Inspector responded by letter on September 22, 1999 that by simply shutting off the sprinkler system he would remain in violation of the fire code that required all sprinkler systems to be maintained in good working condition. On October 1, 1999, the Fire Inspector received a letter from Mr. Cory's attorney stating that they were going to remove the sprinkler system and that if we had any issues we should contact them innnediately. The Fire Inspector notified Mr. Cory that he could remove the sprinkler system, but advised him that if he were ever to expand his business, he would probably be required to reinstall the sprinkler system. Staff comments Regarding Perkins restaurant, staff is ofthe opinion that if the restaurant were to be built today, would it be required to have a sprinkler system. The answer is no because the restaurant has less than 300 occupants. Since the sprinkler system would not be required today, than staff is of the opinion they could remove the sprinkler system and not be in violation of any city code. The Utility has experienced and knowledgeable employees in the area of water main, service connection, valve and hydrant maintenance. . The Utility is nearing completion of a successful one (I) year trial contract with the City of Oakdale for maintenance of their water mains, valves, etc. Oakdale chose us because our estimates were considerably below their costs at the time. The actual water main repair costs have run approximately 60% of the original estimates for the year to date. We believe that this demonstrates not only the Utility's experience performing such work, but our dedication to efficiency and cost control. Mr. Bert Tracy, Oakdale Public Works Superintendent, has stated he is very satisfied with the Utility's work performance, quality of work and cost containment in the maintenance of Oakdale's water mains and services. I would like to call you sometime in August to see if you are interested in arranging a meeting where we could discuss water system maintenance and other possible services by the Utility for the City of Arden Hills. Post, Interim City Administrato..@J Paul Malone's Resignation FROM: SUBJECT: Baeke:round Attached, the City Council will find a copy of the letter from Councilmember Malone, resigning from the City Council effective November 30, 1999., In 1998, with the resignation offormer Councilmember Dale Hicks, the City Council declared a Council vacancy to exist, accepted applications, and appointed an individual to serve tl1e remainder of Councilmember Hicks' term through December 31, 1998. Considerations Council may again wish to discuss this procedure, as per Minnesota Statute 351.0 I, which addresses the resignation of a Councilmember. A resolution has been prepared for the October 25, 1999 regular City Council meeting, declaring that a vacancy exists. A draft ofthe resolution is attached and is required to be adopted for the resignation to be official, and an appointment to be made. Alternatively, Council may wish to discuss ifit wants to hold a Special Election to fill the vacant Council seat. To the extent that this alternative may take more time than the appointment option, Council should be aware of possible future actions that would require a super majority or a unanimous vote from the four City Councilmembers. - . . ~~~~I Paul L. As you well know, effective service on the council requires a significant amount oftime. In recent months I have found that my professional responsibilities are requiring increasing amounts of effort, to the extent they are interfering with my ability to continue wim the duties required of my office. Much has been accomplished during the eleven years mat I've been on the council and it has been gratifying to have been a part of the advancements we have made. A great deal of the credit dearly belongs to you, as it has been your vision and drive that have kept our city on the path toward some very critical goals. The land plan for the arsenal, the acquisition of a new site for our city haIl, and me Gateway development have all resulted from your leadership and dedication. It has been an honor to have had the opportunity to work alongside you and I will miss that, along wim your friendship. Although I can be flexible in timing, my preference would be to make my resignation effective at the end of November so me council may have the time to choose a successor.
