At the May 15,2000 Council Worksession, a 2001 Budget-planning calendar was endorsed. The
calendar called for discussion of the above items at f11e June 19,2000 Council Worksession.
However, due to a full agenda of other topics, the calendar budget items have been accelerated to
discussion at f11e June 12,20006:30 p,m. budget meeting, before f11e regularly scheduled City
Council meeting at 7:30 p.m.
Preliminarv CIP (Overview Hil!.hlil!.hts)
A.
Administration
1. City Hall Facility (#200 - 00+)
Although 2001 project cost reflects aJ1 expenditure of $2,000,000, total project
costs are estimated at the $3,100,000 level. The previous 2000 - 2004 CIP
assumed more of a cost-weighting factor in 2000; while f11e preliminary 2001 -
2005 CIP assumes more of a cost-weighting factor in 2001.
The occupmcy date at this facility will also have 2001 operational budget
rmnifications wif11 respect to 4364 West Round Lake Road lease rental payments
(reduction) aJ1d operating costs at f11e greater square footage new facility
(increase).
2. Public WorkslParks Maintenance Facility (#201- 00+)
The City engaged TKDA Architects at a fee of$8,500 to conduct a space needs
study for a "staJ1d alone" maintenaJ1ce facility. The cost for such a facility was
ballparked at $3,400,000. The 2001 - 2005 CIP assumes that participation in a
joint maintenaJ1ce facility with Rmnsey County will result in reduced project costs
to the $2,400,000 level aJ1d be ready for OCCUPaJ1cy in 2006. While f11e costs for
such a project have been projected, a specific funding plaJ1 has not been
determined. It is aJ1ticipated f11at one off11e outcomes off11e MaintenaJ1ce Facility
Task Force will be to recommend a specific funding plaJ1.

On aJ1 operational note, existing roof leaks at f11e 1440 West Highway 96
maintenance garage may require some unbudgeted 2000 repair expenditures.
3. Hil!.hwav 96 Monument Sil!.ns, 1-35W and City Hall Site (#202-0n
The Highway 96/I-35W monument sign has been pushed out to 2005 to reflect
not beginning f11is project until Ramsey County has completed Highway 96
segment No. I (I-35W bridge to Highway 10),
4. Land Aeauisition (#203-01)
A new CIP item that reflects aJ1Y public purpose expenditures the City may incur
for implementing the City's street plaJ1.
5. Lake Johanna Volunteer Fire Denartment (LJVFD) CIP
In general, f11e City will attempt to be the purchaser whenever possible, raf11er
thaJ1 the Fire Department incur f11e capital costs aJ1d rebill f11em back to f11e City.

Public Works

6. Pavement Manal!.ement Prol!.ram (PMP) Reeonstruction (#400-01+)
The 200 I - 2005 CIP assumes that f11e Ingerson neighborhood project will be
accomplished in 2001. The lack of a reconstruction project in 2005 reflects f11e
trade-off of accomplishing f11e West Round Lake Road, Phase II, project (see
#408-05). The assumption is that development will occur on f11e Naegele/ATS
site aJ1d necessitate such improvement. However, if such Gateway development
does not occur, the next neighborhood reconstruction project will be substituted,
7. Lift Station Conversion to Submersible Pumns (#462-0n
Staff is recommending that the Ingerson Road Lift Station be rebuilt in
2000/2001. This is the most critical aJ1d costly (over twice f11e cost of a typical
lift station) of the remaining lift stations. Staff would then recommend that f11e
scheduled 2003 station conversion not occur to achieve aJ1 approximate $50,000
average annual five-year cost for these improvements.

C. Parks
8. Temnorarv Susvension of Cavital ProiectfPlavstructure Revlacements in this
CIP
Staff has assumed that the Council will approve funding for a long-range strategic
park plaJ1 willi respect to future uses, facility concentrations aJ1d priorities. At
present, park capital improvements are not made in llie context of a Master PlaJ1.
9. Tanker Truek RevIaeement (#516-05)
This equipment replacement item is budgeted at $100,000. As a specialized
vehicle with a high cost, it is a prime caJ1didate for sharing with oilier
communities or evaluating leasing or rebuilding options,
Staffin2lBaseline Assumntions
City Administrator Lynch may have a preliminary staffing plaJ1 to share willi Council at t1lls
meeting, In addition, staff is requesting more specific direction from Council willi respect to
baseline budget assumptions aJ1d/or net levy increase, At the May Worksession, Council
discussed bolli a zero levy growth objective aJ1d keeping growth in step willi inflation
expectations willi no consensus on lliese divergent objectives.

discuss union contract negotiations. The motion carried unmimously (4-0).

ACHIEVEMENTS
Acting Mayor Larson welcomed five Girl Scouts aJ1d f11eir families aJ1d troop leaders, adding f11at
f11e young women had attained f11e Girl Scouts' highest award for Grades 6-9, f11e Silver Award,
He read a letter from Mayor Probst commending the Girl Scouts: Am1a Louise Dinndorf, Sara
JeaJ1 Fertig, Elise Marie Nelson, Laura Pistotnik, aJ1d Lindsy Pomeroy.
Councilmember Aplikowski asked how the Girl Scouts had achieved f11eir awards. The Girl
Scouts stated f11ey held badge labs for Brownies at which f11ey assisted f11e younger girls to earn
parts of badges aJ1d patches for their troops. Councilmember Aplikowski asked what f11ey
enjoyed most about Scouting. The Girl Scouts stated they enjoyed camping.
Acting Mayor Larson commended f11e Girl Scouts' families aJ1d troop leaders for f11eir support
aJ1d commitment.

Mr. Post stated that the Council had received a draft copy ofilie 1999 Audit Report at ilieir last
W orksession. He noted it would be necessary for the Council to formally receive ilie report.
MOTION:
Councilmember Aplikowski moved aJ1d Councilmember Rem seconded a motion
to receive the 1999 Audit Report as presented. The motion carried unaJ1imously
(4-0).
B. Pay Estimate #5 (Final), Nadeau Utility, Inc., Arden Manor Park and McClung
Drive Drainage Improvements
Mr. Brown stated iliat ilie pay estimate was for improvements associated wiili ilie ditch behind
McClung Drive aJ1d reconstruction of drainage structures near ilie townhomes. He added iliat ilie
majority of the work was completed in 1999.
Mr. Brown stated the project went well aJ1d residents in the area are pleased wiili ilie
improvements. He recommended that the Council approve final payment of Pay Estimate #5 in
the mnount of$8,099.67 to Nadeau Utility, Inc. contingent upon lien waivers received.

C. Pay Estimate #2, Lametti & Sons, Ine., 1999 Sanitary Sewer Rehabilitation Program
Mr. Brown stated that iliis pay estimate is aJ1 incremental payment for sewer pipe work
corrections near the Chathmn neighborhood. He added that a sag was created when pipe spacers
separated aJ1d allowed concrete to create a ridge that has caused maJ1Y problems over ilie years.
He noted the source of the problem was identified aJ1d quickly corrected. He recommended that
ilie Council approve Pay Estimate #2 in the mnount of $59,371.73 to Lmnetti & Sons, Inc,
Councilmember GraJ1t asked wheilier City staff were satisfied with the completed project to date.
Mr. Stafford stated ilie problems have been alleviated, aJ1d televising has allowed City staff to
easily identify other problem areas.

Councilmember GraJ1t moved aJ1d Councilmember Aplikowski seconded a motion
to approve payment of Pay Estimate #2 in the mnount of$59,371.73 to Lmnetti &

Pay Estimate #8 (Final), Lametti & Sons, Inc., Gateway Business District,
Fourteenth Street NE

Mr. Brown stated f11at f11e Gateway District project was completed in fall 1998, alf110ugh some
outstanding road surfacing items were not remedied by f11e contractor until spring 2000. He
added f11at this final payment reflects release of the retainage on the project. He recommended
f11at the Council approve the final payment, Pay Estimate #8, in the amount of$2S,710.11 to
Lametti & Sons, Inc,
Acting Mayor Larson asked whether 5% retainage is sufficient incentive for contractors to
complete construction projects in a timely manner. Mr. Brown stated f11at 5% retainage is
usually sufficient for small contractors. He noted that large contractors are often quicker and
more reliable, although retainage is not as imperative for them. He added f11at state projects do
not hold any retainage.
Acting Mayor Larson asked whether the contractor is aware of the retainage during f11e bid
process, aJ1d whether other cities hold more f11m 5% retainage, Mr. Brown stated f11e contractor
is always aware of the retainage. Mr, Post noted f11at the contractor must post a performance
bond that cm only be released upon completion of the construction project. He added f11is is an
additional incentive for f11e contractor to get the job completed in a timely manner.
MOTION:
Councilmember Aplikowski moved aJ1d Councilmember Rem seconded a motion
to approve final payment of Pay Estimate #8 in the amount of$25,710.11 to
Lametti & Sons, Inc., upon receipt of final papers. The motion carried
unaJ1imously (4-0).

E. Mounds View Senior High SehooI Construction Manager, Stahl Construction
Company, Gregg A. Johnson, Projeet Manager; Time Extension Request from State
Fire Suppression Requirements
Acting Mayor Larson welcomed Gregg Johnson, Stahl Construction's Project Manager for f11e
Mounds View Senior High School Construction project.
Councilmember Rem stated that the time extension request appears to be a procedural issue,
noting that Staff has not indicated aJ1Y problems with f11e request.
Acting Mayor Larson asked why f11e City of Arden Hills, as well as Shoreview and North Oaks,
is being asked to take such m action. Mr. Johnson stated that the State Fire Marshall requires
that the local municipalities be in agreement with regard to the time extension request.
Acting Mayor Larson noted f11at City staff had recommended that f11e Council defers taking aJ1Y
action on this issue, and asked whef11er f11is would be m impediment to completion of f11e
construction project. Mr. Johnson stated f11at a deferral would impede construction.

Councilmember Aplikowski asked why the decision should be deferred if it will impede the
project. Acting Mayor Larson stated that it is a question of liability aJ1d whether the City is
comfortable with the continued postponement of the work. He noted that the State Fire Marshall
did not indicate that the City was statutorily obligated to approve the request.
Councilmember Rem asked whether City staff had requested the City Attorney's opinion, Mr,
Post stated he was unsure.
Acting Mayor Larson stated that the Council would be indicating a reluctaJ1ce to accept liability
if the decision was deferred.
Councilmember Rem stated that the Council should defer decision if the City's position was
unclear. She added it is important for the City to determine its position aJ1d then accept or deny
the request.
Mayor Probst arrived at 8:06 p,m.
Councilmember GraJ1t asked for clarification with regard to the State Fire Marshall's position,
adding that they have the ability to graJ1t aJ1 extension. Mr. Johnson stated that the Fire Marshall
would be running against their own five-year statute, aJ1d code violations would have to be
corrected by summer 2001, which could impact the construction schedule.
Councilmember Larson stated that the City should not accept liability unless a statutory
obligation is clear.
Mayor Probst apologized for his late arrival. He agreed that it seems unusual to request that a
city take such aJ1 action, adding he is reluctaJ1t to approve the request without understaJ1ding why
it is being made.
Councilmember Rem stated that further information should be collected to guide the Council in
accepting or denying the request rather thaJ1 deferring the decision.
Councilmember Larson asked how North Oaks aJ1d Shoreview had reacted to the request. Mr.
Johnson stated the issue had not yet been addressed in the other communities.
Councilmember Aplikowski stated she would favor tabling the decision until more information
could be gathered.
Councilmember GraJ1t referred to the State Fire Marshall's May 26 memo, noting that the memo
does not state whether aJ1 ongoing extension CaJ1 be graJ1ted if the five years by statute has lapsed.
MOTION:
Councilmember Larson moved aJ1d Councilrnember Aplikowski seconded a
motion to table the time extension request from the State Fire Marshall to allow
City statfto explore the City's obligations aJ1d requirements under State law. The

F. Planning Cases
1. Case #00-22, FairIsaae, 4285 Lexington Avenue (SUP Amendment)
Ms, Chaput explained that f11e applicaJ1t requests approval of aJ1 amendment to their Special Use
Permit (SUP) for aJ1 additional monwnent sign at the front of their building along f11e existing
private drive. The current sign does not adequately mark f11e property aJ1d, since f11e street is not
marked, there is insufficient signage to direct traffic to f11e facility,
The SUP on f11is property, approved in 1996, was originally intended for Control Data. Since

approved master plm. The overall plaJ1 allowed for signage along Lexington Avenue at f11e same
level as it existed in 1996. This limited the property to one pylon sign at f11at location for Control
Data.
Fair Isaac currenfly has a pylon sign along Lexington Avenue, directing traffic to its facility.
This sign rests on the comer of Lexington aJ1d a private drive. The facility faces f11e private
drive. Therefore, the applicmt wishes to put up a sign in front of f11e building so that its location
is more recognizable. The sign ordinaJ1ce allows for one freestmding sign for each frontage
along a public street. Although f11is is not a public street, it was evaluated according to f11at
standard. There are at least two frontages along f11is street, allowing for at least two freestaJ1ding
signs.

The proposed sign meets f11e square footage aJ1d height requirements of f11e code. The setbacks
were not required to be met wince the sign is not being located along a public right-of-way.
Ms, Chaput stated f11at f11e PlaJlliing Commission recommends approval of PlaJlliing Case 00-22,
amendment to the Special Use Permit for Fair Isaac, wif113 conditions.

Case #00-23, Perkins & Will, Valentine Hills School, 1700 County Road E-2 (SUP
Amendment)
Ms. Chaput explained that the applicaJ1t requests approval of m mnendment to their Special Use
Permit for Valentine Hills Elementary School to construct a 10,399 square foot addition.
The Zoning OrdinaJ1ce requires a Special Use Permit for "general education schools" in the R-l
Zoning District. Since this school was constructed prior to that ordinaJ1ce requirement, the
school did not have a SUP until a significaJ1t expaJ1sion occurred in 1987, with Planning Case 87-
03. The proposed addition is for classrooms, a front entryway aJ1d mechmical room.
The proposed addition meets all of the criteria outlined in the zoning ordinmce with the
exception of required parking aJ1d screening of mech3l1ical equipment. A total of 107 parking
spaces are required (including the new addition) but there are only 87 in total. The applicant has
stated that the additional space will not increase the number of people in the facility. Therefore,
parking is not a concern since the current mnount appears to be adequate.
By Section VI, E, 4, j, all mechmical equipment is to be screened. The proposal has mechanical
equipment on the roof of the structure without screening. The Plmming Commission did discuss
this at length md provided a condition on the approval that seemed appropriate to meet this
requirement.
Ms. Chaput stated that the PlaJ1ning Commission recommends approval of Planning Case 00-23,
mnendment to the Special Use Permit for Valentine Hills Elementary School, subject to 5
conditions.
Mayor Probst asked whether the additional brick work aJ1d window trim would match f11e
existing building. Doug Pierce, a representative of Perkins & Will Architects, conflfffied f11at the
brick will match, md a medium bronze window trim is recommended for the addition while f11e
existing window trim is dark bronze. He added that the medium bronze color would match the
new fascia.
Councilmember GraJ1t asked whether all temporary structures would be removed. Mr. Pierce
confirmed this.
Mayor Probst asked whether the construction project would be phased over a period oftime. Mr.
Pierce stated the project would be phased over 14 monf11s.
Councilmember Rem asked whether the Planning Commission's condition concerning screening
of rooftop mechmicals was acceptable to the applicaJ1t. Mr. Pierce stated that f11e
recommendations had been incorporated into the revised design.
Councilmember GraJ1t asked how the applicmt would accommodate the arrival aJ1d departure of
students during construction. Gregg Johnson, Stahl Construction, stated f11at gate systems md
fencing would be used to block off construction areas during drop off aJ1d pick up times.

Councilmember Larson asked whether problems with regard to staff parking in the Chatham
neighborhood have been remedied. Mr. Beaty stated that the issue was resolved aJ1d school
volunteers no longer park there at inappropriate times.
Councilmember GraJ1t asked whether children entering the school through the new entryway
would be clearly visible to parents who are picking them up or dropping them off. Mr. Pierce
stated that the front door will be immediately visible aJ1d provides for security.

Plan Review)
Ms. Chaput noted that a representative of the applicaJ1t was not present at the meeting. Mayor
Probst suggested that the Council proceed with the request unless it becomes necessary for the
applicaJ1t speak.
Ms. Chaput explained that the applicant is requesting approval of a site plaJ1 review to allow for a
5,000 square foot cafeteria expaJ1sion for their facility located at 4100 Hamline Avenue North.
The proposed expaJ1sion is for a cafeteria aJ1d corridor addition. The cafeteria expaJ1sion runs
along the West Side of Building B. The expaJ1sion also includes a small patio area.
The City Council approved the master plaJ1 for GuidaJ1t with Planning Case 99-15. Site PIaJ1
approval is allowed for proposals shown on the approved master plaJ1. With Planning Case 99-
15 the expaJ1sion of the cafeteria was shown on the approved master plaJ1.
The proposed addition meets the requirements of the City Zoning OrdinaJ1ce. The applicaJ1t
recently constructed a parking lot on a separate parcel owned by the applicant to alleviate parking e
concerns. They were allowed to do this by showing proof of parking on the campus. The

Joint Powers Agreement, City of Arden Hills and State of Minnesota Department of
Military Affairs, Authorization to Execute, With Proposed Memorandum of
Understanding (MOD)
Mr, Post stated that the laJ1d conveyance authorized by Congress in October 1999 required f11e
City to accommodate certain needs of the Miffi1esota National Guard for training purposes. He
added f11at a Joint Powers Agreement had been drafted to define the relationship between f11e two
parties.
Mr. Post stated f11at, as part off11e Agreement, the National Guard had identified a need for some
office space with data aJ1d computer lines, which would not be utilized as a public office. He
added that meeting rooms in f11e basement of the new City Hall facility would also be made
available to National Guard staff under a specific set of guidelines.
Mr. Post stated f11at City staff has had ongoing discussions with f11e National Guard wif11 regard
to security, maintenance, phone aJ1d data lines and funding of installation. He added f11at f11e
National Guard has been mnenable to these issues, aJ1d has suggested aJ1 addendum to f11e Joint
Powers Agreement.
Mayor Probst stated f11at the National Guard originally expressed an interest in having a presence
at the site. He added f11is would be to f11e City's benefit aJ1d would promote cooperation between
the two orgaJ1izations. He urged f11e Council to support f11e Joint Powers Agreement.

Mr, Post stated, in the Joint Powers Agreement, Section III, under "Office Space", a minimum of
320 square feet for the office space is specified. He noted that this was redrafted in the .
addendum to specify a maximum of 300 square feet for the office space.
Councilmember Rem asked whether the agreement was a final document as it was signed by
General Andreotti but was not dated. She asked whether the office space in question was
included in building budgets aJ1d construction plaJ1s
Mayor Probst stated that he is comfortable with the direction of the project Mr. Post added that
the office space will be located in the basement of the City Hall facility aJ1d will be accessed by a
separate entraJ1ce to prevent intermingling with City operations. He noted this access has been
included in construction plaJ1s.
Councilmember Larson stated, in his opinion, the cultivation of a relationship with the National
Guard is a positive step. He added the law provides for making the building available to the
Guard for meetings, and the City is going beyond that by providing office space to accommodate
them. He asked whether the National Guard had requested the office space.
Mayor Probst stated that the National Guard's presence in the facility was much more onerous in
the initial draft of the Joint Powers Agreement. He added that full access to the building, as well
as control of conference rooms, was originally indicated. He noted that the provision of a
dedicated office space seems the best way to accommodate the National Guard.
Councilmember Aplikowski stated that the inclusion of a barbed wire fence seems military
staJ1dard. Mayor Probst stated the National Guard might accept a delayed implementation plaJ1.
Councilmember Rem asked whether this was pmt of the written agreement. Mayor Probst stated
it was not.

Couneilmember Rem stated that Article X of the Agreement, "Entire Agreement/Future
Modification", refers to the fact that the entire agreement is contained therein. She added that
such laJ1guage indicates the entire agreement is comprised in the document. Mayor Probst stated
that the document was written to capture the fact that the agreement is ongoing aJ1d future
addendums will happen, He added it is unreasonable to think that the agreement as written is
final.
Councilmember Rem asked for clarification with regard to the statement "the entire agreement is
contained herein", Councilmember Larson stated that addendums could be incorporated into the
document through a reference. Mayor Probst stated that the agreement supersedes all previous
discussions aJ1d versions, aJ1d modifications will only be recognized and valid when put in
writing.

A. Planning Case #99-03 Update, Josephine East LLC, 3183 Lexington Avenue,
Preliminary and Final Plat and Variance
Mr. Post referred to a memo from Mr. Lynch dated May 26 in which he reviewed f11e Josephine
East partnership situation. He added that f11e Council might consider connection of Shoreline
Lane to have it serve as a through street. Councilmember Larson stated, in his opinion, f11is is a
good time to address the issue, adding it makes more sense thaJ1 constructing a temporary cul-de-
sac.
Mayor Probst agreed, stating that f11e situation does not seem to be headed for a friendly
settlement. He added f11at it would be preferable to resolve the issue rather thaJ1 drag it out
further.
Councilmember Aplikowski stated f11at this was f11e first planning case she reviewed as a
Councilmember. She expressed agreement that f11e issue be resolved.
Mayor Probst stated f11at f11e issue of condemnation needs to be tied to a public purpose, which is
the completion of the street. He reiterated f11at the process needs to be completed.
Councilmember Larson stated f11at action by the City Council would remove the developers from
f11e process. He added that if the City moves forward wif11 condemnation, f11e developer will no
longer need the approval off11e property owners for the cul-de-sac.
Mayor Probst stated f11e developers would still be responsible for aJ1Y legal costs incurred by f11e
City to resolve f11e issue.
Councilmember Rem asked whether legal action aJ1d costs are aJ1ticipated wif11 regard to f11e
Bachman property. Mayor Probst stated a friendly acquisition might be possible, but should not
be expected. Councilmember Rem asked whether the City would incur such costs. Mayor
Probst stated it would be difficult to argue that f11e developers should be responsible for f110se
costs.
Mr. Post stated that the properties should be appraised prior to consideration of condemnation.
He added that f11e notion of a through street had been a contentious neighborhood issue, and aJ1
informational meeting or public hearing might be appropriate at some point.
Mayor Probst stated that if the Council is in agreement on f11e issue, City staff could be requested
to draft an action plaJ1 for implementation at f11e Council's next meeting. He added that staff
could identify the next consecutive actions required of the Council.

Mr. Post stated, wif11 regard to another matter, that f11e acquisition costs of f11e Indykiewicz
property is near completion, He added that f11e City incurred all of the upfront costs wif11 f11is a
acquisition. He noted f11at a significaJ1t portion of these costs would be reimbursable by Ramsey ..
County, as the costs would have been incurred by them to complete the Highway 96 segment #1
project.
COUNCIL COMMENTS AND COMMITTEE ACTIVITY REPORTS
Councilmember Grant stated that the Parks aJ1d Recreation Committee met May 23 and
continued to review City parks and consider improvements for inclusion in upcoming budgets.
Councilmember GraJ1t stated that the Ingerson Task Force will meet June 6 at 5:30 p.m. and will
begin to focus on its final recommendations to the CounciL
Councilmember GraJ1t stated, as a reminder, that the Day in the Park would be held June 10.
Councilmember Larson stated that the Water Quality Task Force met aJ1d reviewed Council
comments on their draft report. He added the task force is addressing the Council's concerns aJ1d
finalizing the document. He noted they would meet June 13.
Councilmember Aplikowski thanked the other Councilmembers for their support. She added she
is back to work.
Councilmember Aplikowski stated that the Events Committee would meet May 31. She added e
f11at f11e Newsletter Committee has not met recently.
Councilmember Rem stated that the Web Site Task Force met twice recently to review aJ1d
prioritize tasks. She added f11at they would be ready for submittal to f11e Council by the end of
the monf11. She asked whether a Worksession or regular council meeting would be f11e
appropriate venue.
Councilmember Rem stated that she attended the AMM meeting on May 18 with Mr, Post and
cast her ballot for Councilmember Aplikowski for the AMM board.
Councilmember Rem stated that the Operations and Finance Committee is compiling a report on
garbage hauling and water rate issues,
Councilmember Rem stated she attended the Northwest Youth aJ1d Family Services board
meeting on May II.
Councilmember Rem stated that the Web Site Task Force had discussed the possibility of a
written technology policy for City staff, as more technology becomes available.

Mayor Probst stated there had been some discussion with regard to funding for perennials to
create more easily maintainable gardens, He added he would wish to re-energize that discussion.
Mayor Probst congratulated Councilmember Aplikowski on her appointment to the AMM Board.
Mayor Probst stated he would like to reiterate the City's interest in the Metro TraJ1sit
restructuring plar1.
Mayor Probst asked, with regard to the City's sump pump inspection program, whether the City
staff had experienced difficulties with property owners with illegal pumps, He asked whether
homeowners have been compliant when informed that their pumps are illegal, aJ1d how staff
plaJ1s to deal with those who refuse access.
Mr. Stafford stated that City ordinaJ1ce allows access to meters, aJ1d the new ordinaJ1ce for the
sump pump inspection allows a City representative to complete that inspection. He added that
residents with illegal pumps have been cooperative, aJ1d some have made corrections aJ1d have
called for reinspection. He noted that it has been a successful campaign to date.
Mayor Probst stated that the Council had received a summary from staff with regard to bids
received for the City Hall facility. He added there are a number of alternate costs upon which the
Council will have to act in the near future. He noted that bids are up 10% over a year ago.

TraJ1sportation Employee Testing Act for all public entities were published in 1994. The
regulations contained numerous chaJ1ges iliat superseded state law allowing optional drug aJ1d
alcohol testing in the workplace. In 1995, the City adopted regulations aJ1d procedures for a
drug-free workplace for employees in safety sensitive positions. This policy was adopted
December 26, 1995, by Resolution No. 95-89, aJ1d became effective JaJ1uary 1, 1996.
This Act required all employees whose job duties included the operation of a commercial motor
vehicle aJ1d who were required to hold a commercial driver's license (CDL) to be subject to
raJ1dom drug aJ1d alcohol testing. With few exceptions, drivers required to have a CDL are
subject to ilie controlled substaJ1ce aJ1d alcohol testing rules. A CDL is required for drivers
operating a vehicle with a maJ1ufacturer's gross weight rating in excess of26,001 pounds; for
drivers who operate a vehicle designed to carry seven (7) or more passengers; or drivers who
operate a vehicle iliat is used in ilie transportation of a placardable amount of hazardous material.
Employees who operate iliese vehicles typically would be performing what is categorized as
safety-sensitive functions.
Employers must provide to all existing aJ1d future employees information on drug aJ1d alcohol
misuse, ilie employer's policy, the testing requirements, aJ1d how aJ1d where employees CaJ1 get
help. All supervisors of safety-sensitive employees must attend at least one hour of training on
the signs aJ1d symptoms of drug abuse aJ1d one hour of training on alcohol misuse symptoms aJ1d
indicators used in making determinations for reasonable suspicion testing. Supervisors are now
required to receive aJ1 additional two (2) hours of training to be able to identify problems.
Which emnlovees are imnaeted bv these rel!.uIations?
At this time, the existing policy would only affect those employees in ilie Public Works
MaintenaJ1ce aJ1d Parks MaintenaJ1Ce Departments. Even iliough ilie Parks Maintenance
employees do not typically perform safety-sensitive functions, they have CDL's aJ1d are
available for emergency service. This requires them to be raJ1domly tested along wiili ilie other
maintenaJ1ce workers,

Who will conduct the random testinl!: and drawinl!:?
Staff has contracted, as in the past, with the Minnesota Counties/Minnesota Counties InsUfmce
Trust (MClT). MCIT contracts both the testing aJ1d raJ1dom drawing. The collection site for
testing has been chaJ1ged to a laboratory in Fridley. Maintenmce employees driving commercial
motor vehicles are part of aJ1 mmually updated faJ1dom testing pool.

RESOLUTION ADOPTING
TRANSPORTATION EMPLOYEE DRUG AND ALCOHOL MODEL POLICY
UNDER THE OMNIBUS TRANSPORATION EMPLOYEE TESTING ACT
WHEREAS, f11e City of Arden Hills is genuinely concerned wif11 f11e use md abuse of
unauf110rized drugs aJ1d alcohol as f11ey relate to the safety aJ1d work performance of its
employees in safety sensitive positions, specifically employees with Commercial Drivers
Licenses (CDL's), Arden Hills recognizes a growing nationwide concern with drug and alcohol
abuse in f11e workplace md its negative impact on productivity, safety md employee morale; md
WHEREAS, the City of Arden Hills wishes to protect the employee, co-workers and the public
from the hazards created by aJ1 employee in a safety-sensitive position who might endmger
his/her/others health aJ1d well being through the use of unauthorized drugs mdlor alcohol; md
WHEREAS, under the Federal Occupational Health aJ1d Safety Act for Workplace Safety, it is
the City's responsibility to maintain a safe working environment for all its employees; and
WHEREAS, effective June 12,2000, f11e City's initial regulations md procedures for drug free
workplace for employees in safety sensitive positions, as adopted by Resolution No. 95-89 on
December 26, 1995, md effective on Jmuary I, 1996, are hereby revised in accordaJ1ce with the
policy entitled, Attaehment A, attached hereto aJ1d made a part thereof, md encompassing the
controlled substance aJ1d alcohol testing requirements of:
The Federal Department of Transportation, Federal Highway Administration as outlined
in 49CFR, Part 391, Subpart H aJ1d Part 382. The Minnesota Department of
Trmsportation, effective August I, 1993, essentially adopted the Federal requirements
with some exceptions aJ1d earlier implementation dates.
The purpose of these procedures is to establish employer-based alcohol md controlled
substmces testing programs to help prevent accidents aJ1d injuries resulting from the
misuse of alcohol and controlled substmces by drivers of commercial motor vehicles
(CMV). This regulation prohibits my alcohol misuse that could affect performaJ1ce of
driving a CMV, including: I) use on the job; 2) use during the four hours before driving a
CMV; 3) having prohibited concentrations of alcohol in f11e system while driving
CMV's' 4) use during eight (8) hours following m accident; md 5) refusal to take a
required test. This regulation prohibits my controlled substmces use, without a licensed
doctor or medicine or osteopathy's written prescription.

NOW THEREFORE, BE IT RESOLVED by the City Council of the City of Arden Hills,
Minnesota that:
I) The City of Arden Hills hereby adopts the attached regulations aJ1d procedures for
employees in safety sensitive positions as mmtdated by the Federal Department of
TraJ1sportation, Federal Highway Administration as outlined in 49 CFR, Part 391,
Subpart H aJ1d Part 382. In addition, the attached regulations aJ1d procedures
reflect the conditions aJ1d limitations for drug mtd alcohol testing in the workplace
according to Minnesota Statute.
2) The City Administrator is hereby authorized to serve as the City's Anti-Drug
Program MaJ1ager
3) The City Administrator is hereby authorized to execute aJ1 Anti-Drug aJ1d Alcohol
PlaJ1 for the City of Arden Hills; aJ1d Associate Member Participation Agreement
with the Minnesota Counties InsUfaJ1ce Trust.

POLICY IMPLEMENTING
TRANSPORTATION EMPLOYEE DRUG AND ALCOHOL POLICY UNDER
THE OMNIBUS TRANSPORTATION EMPLOYEE TESTING ACT
(ADOPTED BY CITY COUNCIL 6/12/00 AND EFFECTIVE 6/12/00)
The abuse of drugs aJ1d alcohol is a nationwide problem that affects persons of every age, race
aJ1d gender. The City of Arden Hills recognizes that work performaJ1ce aJ1d safety problems are
created when employees use or abuse illegal drugs aJ1d1or alcohol. The City of Arden Hills
wishes to provide a safe workplace for its employees aJ1d to maintain a drug aJ1d alcohol free
workplace, The City of Arden Hills has established the following policy on drugs aJ1d alcohol
with drug aJ1d alcohol testing provisions maJ1dated by the Omnibus TfaJ1sportation Employee
Testing Act of 1991.
1.
POLICY
All employees are strictly prohibited from using, possessing, maJ1ufacturing, dispensing,
selling, or traJ1sferring drugs, alcohol or drug paraphernalia or being under the influence
of drugs or alcohol while working or performing job duties or while on City premises or
while operating City vehicles, machinery or equipment. No employee shall perform
safety-sensitive functions within four (4) hours after using alcohol. "Drugs" are defined
as aJ1Y controlled substance. Any employee found to be in violation of this policy is
subject to discipline up to aJ1d including termination of employment.
2. COVERAGE
The Omnibus TraJ1sportation Employee Testing Act (the Act), requires that all employees
whose job duties include the operation of a commercial motor vehicle aJ1d who are
required to hold a commercial driver's license (CDL), shall be subject to drug aJ1d alcohol
testing. "Commercial Motor Vehicle" (CMV), meaJ1S a motor vehicle or combination of
motor vehicles used to traJ1sport passengers or property if the motor vehicle meets aJ1Y
one of the following criteria:
A.
Has a gross combination weight rating of 26,00 1 or more pounds, inclusive of a
towed unit with a gross vehicle weight rating of more thaJ11 0,000 pounds; or
B.
Has a gross combination vehicle weight rating of26,OOl or more pounds; or
C.
Is designed to traJ1Sport seven (7) or more passengers including the driver; or
D.
Is of aJ1Y size aJ1d is used in the traJ1sportation of materials found to be hazardous
for the purposes of the Hazardous Materials TraJ1sportation Act aJ1d which require
the motor vehicle to be placarded.

All applicaJ1ts, including persons currently employed by f11e City of Arden Hills f11at _
apply for a position where job duties include operating CMV's, will be required to take a .,
drug aJ1d alcohol test, purSUaJ1t to f11e federal regulations, if a job offer is made.
3. DEFINITIONS
Accident means aJ1 occurrence involving a CMV operating on a public road f11at results
Ill:
I. A fatality; or
2. Bodily injury to a person who, as a result ofthe injury, immediately
receives medical treatment away from f11e scene of the accident; or
3. One (I) or more motor vehicles incurring disabling damage as a result of
the accident, requiring the vehicle to be traJ1sported away from f11e scene
of f11e accident by a tow truck or of11er vehicle.
Alcohol meaJ1S the intoxicating agent in beverage alcohol, ethyl alcohol or of11er low
molecular weight alcohol, including methyl or isopropyl alcohol.
Alcohol Concentration (or content) meaJ1S f11e alcohol in a volume of breaf11
expressed in terms of grams of alcohol per 210 liters of breaf11 as indicated by aJ1
evidential breath test under f11is policy aJ1d federal regulation.

Alcohol Use meaJ1S the consumption of aJ1Y beverage, mixture, or preparation,
including aJ1Y medication, containing alcohol.
Appointing Authority meaJ1S the City Administrator or other City officer to whom the
Administrator has delegated auf110rity to appoint personnel.
Breath Alcohol Technician (BAT) means aJ1 individual who instructs aJ1d assists
individuals in the alcohol testing process aJ1d operates an Evidential Breaf11 Test Device
(EBT),
Chain of Custody meaJ1S procedures to account for the integrity of each urine specimen
by tracking its haJ1dling and storage from point of specimen collection to final disposition
of the specimen. With respect to drug testing, f11ese procedures shall require that aJ1
appropriate Drug Testing Custody Form be used from time of collection to receipt by f11e
laboratory aJ1d f11at upon receipt by the laboratory aJ1 appropriate Laboratory Chain of
Custody Form(s) account(s) for the sample or sample aliquots (split samples) wif11in f11e
laboratory .

placarded under the hazardous materials regulations, 49 C.F .R., Part 172, Subpart
F.
A commercial motor vehicle does not include a fire truck or other emergency fire
equipment.

Confirmafion (or confirmatory) Test. In drug testing, a second aJ1alytical procedure to
identify the presence of a specific drug or metabolite that is independent of f11e screening
test aJ1d f11at uses a different technique aJ1d chemical principle from that of the screening
test, in order to ensure reliability aJ1d accuracy. (Gas chromatography/mass spectrometry,
(GCIMS) is f11e only auf110rized confirmation mef110d for cocaine, marijuaJ1a, opiates,
amphetamines, aJ1d phencyclidine,) In alcohol testing, a second test, following a
screening test wif11 a result of 0.02 or greater that provides qUaJ1titative data of alcohol
concentration.
Confirmatory Retest for controlled substances, it meaJ1S a third aJ1alytical
procedure to reconfirm the presence of a specific drug or metabolite. If the test result of
the primary specimen is positive, the driver may request that f11e MRO direct f11e split
specimen be tested in any different DHHS - certified laboratory for presence off11e
drug(s).
Consortium meaJ1S aJ1 entity, including a group or association of employers or
contractors, that provides alcohol or controlled substaJ1ce testing as required by federal
regulations, or of11er V,S. Department of TraJ1sportation alcohol or controlled substances
testing rules, and f11at acts on the behalf of the employers.

Controlled Substance has the meaning assigned by 21 U.S. C 802 aJ1d includes all
substaJ1ces listed on Schedule 1-5 as they may be revised from time to time (21 C.F.R.
Part 1308).

Driver meaJ1S aJ1Y person who operates or maintains a commercial motor vehicle. This
includes, but is not limited to full-time, regularly employed drivers, part-time aJ1d
temporary drivers, leased drivers aJ1d independent owner/operator contractors who are
either directly employed by or under lease to the City or who operate a commercial motor

employment/pre-duty testing only, the term "driver" includes a person applying to the

designee of the City Administrator.

Medical Review Offieer (MRO) meaJ1S a licensed physiciaJ1 responsible for receiving
laboratory results generated by an employer's drug testing program, who has knowledge
of substance abuse disorders aJ1d has appropriate medical training to interpret aJ1d
evaluate aJ1 individual's confirmed positive test result together with his or her medical
history aJ1d aJ1Y other relevaJ1t biomedical information.
Performing a Safety Sensitive Function is a driver is considered to be
performing a safety sensitive function during aJ1Y period in which the driver is actually
performing, ready to perform, or immediately available to perform, or in a state of
readiness to perform aJ1Y safety sensitive function while on duty.
Random Seleetion meaJ1S a mechaJ1ism for selection of employees for testing where each
employee has aJ1 equal chaJ1ce of being tested each time selections are made.
Reasonable Suspicion meaJ1S that the City of Arden Hills believes the appearaJ1ce,
behavior, speech or body odors of a driver are indicative of the use of a controlled
substaJ1ce or alcohol based on the observation of at least one (I) supervisor or official
who has received training in the identification of behaviors indicative of drug aJ1d alcohol
use.

Refusal to Submit (to an alcohol or eontrolled substance test) means that an
employee:
A. Fails to provide adequate breath for testing without a valid medical explanation
after her or she has received notice of the requirement for breath testing;
B. Fails to provide adequate urine for controlled substaJ1ces testing without a valid
medical explaJ1ation after he or she has received notice of the requirement for the
urine testing; or
C. Engages in conduct that clearly obstructs the testing process,
Safety Sensitive Funetion meaJ1S at all times from the time a driver begins to work or is
required to be in readiness to work until the time he/she is relieved from work aJ1d all
responsibility for performing work and includes the following:
A. All time at a carrier or shipper plaJ1t, terminal, facility, or other property, or on
any public property, waiting to be dispatched or in a state of readiness to drive
and/or maintain a commercial motor vehicle, unless the driver has been relieved
from duty by the City of Arden Hills;

B.
All time inspecting equipment as required by the Federal Motor Carrier Safety
Regulations or otherwise inspecting, servicing, or conditioning a CMV at any
time;
All time spent at the driving controls of a CMV;
c.
D. All time, other thaJ1 driving time, in or upon aJ1Y CMV except time spent resting
in a sleeper berth;
E. All time loading or unloading a CMV, supervising, or assisting in the loading or
unloading, attending a CMV being loaded or unloaded, remaining in readiness to
operate the CMV, or in giving receiving receipts for shipments loaded or
unloaded;
F. All time spent performing the driver requirement on the Federal Motor Carrier
Safety Regulation relating to accidents;
G. All time repairing, obtaining assistaJ1ce, or remaining in attendaJ1ce upon a
disabled CMV.

Screening Test (also known as Initial Test) in alcohol testing, it meaJ1S aJ1
aJ1alytical procedure to determine whether a driver may have a prohibited concentration
of alcohol in his or her system. In controlled substaJ1ce testing, it meaJ1S aJ1 immunoassay
screen to eliminate "negative" urine specimens from further consideration.

State of Readiness meaJ1S a driver who is on call, ready to be dispatched, to perform
safety sensitive functions while on duty.

Substance Abuse Professional (SAP) means a licensed physiciaJ1 or a licensed or
certified psychologist, social worker, employee assistaJ1ce professional, or addiction
counselor (certified by the National Association of Alcoholism aJ1d Drug Abuse
Counselors Certification Commission) with knowledge of aJ1d clinical experience in the
diagnosis aJ1d treatment of alcohol aJ1d controlled substaJ1ces-related disorders.
Supervisor meaJ1S the person designated by the City to perform supervisory functions
over the City's drivers.
Violation Rate meaJ1S the number of drivers found during raJ1dom tests given purSUaJ1t to
this policy aJ1d federal regulations to have aJ1 alcohol concentration of 0,04 or greater, plus
the number of drivers who refuse a raJ1dom test required by this policy aJ1d federal
regulations, divided by the total reported number of drivers in the industry given raJ1dom
alcohol tests purSUaJ1t to this policy aJ1d federal regulations, plus the total reported number
of drivers in the industry who refuse a raJ1dom test required by this policy aJ1d federal
regulations.
CIRCUMSTANCES UNDER WHICH
DRUG AND ALCOHOL TESTS SHALL BE REQUIRED OR REQUESTED

DURING THE APPLICATION PROCESS
All job applicaJ1ts, including persons currently employed by the Employer, applying for a job
where duties include operating the Employer CMV's are required to undergo testing for alcohol
aJ1d drugs if a job offer is made, The job offer is contingent upon a negative drug aJ1d alcohol
test report aJ1d the applicaJ1t's written agreement authorizing former employers to release to the
Employer all information on the applicaJ1t's alcohol tests with a concentration result of 0.04 or
greater, positive controlled substaJ1ces test results, aJ1d refusals to be tested, within the preceding
two (2) years,
REASONABLE SUSPICION
A drug test shall be required if the Employer has a reasonable suspicion that aJ1 employee has
violated the provision ofthis policy regarding alcohol or controlled substaJ1ces, Reasonable
suspicion alcohol tests should be administered as soon as practicable, If the test is not
administered within two (2) hours, the reason shall be documented.
If the alcohol test is not administered within eight (8) hours, all attempts to conduct the test shall
cease aJ1d the reasons shall be documented. NotwithstaJ1ding the absence of a reasonable
suspicion alcohol test, the employee shall not be permitted to perform or continue to perform
safety-sensitive functions until twenty-four hours have elapsed following the determination of
reasonable suspicion.

POST -ACCIDENT
A post-accident alcohol and drug test is required if an employee operating a CMV is involved in
aJ1 accident, as defined in this policy that results in:
1. The death of a person or persons regardless of the amount of vehicle or property damage;
or
2. The employee receives a citation for a moving traffic violation arising from the accident.
The employee must provide aJ1 alcohol test sample as soon as practicable after the occurrence of
the accident. If the employee does not receive the test within two (2) hours of the accident, the
reasons shall be documented. After eight (8) hours, all attempts to conduct f11e alcohol test shall
cease aJ1d the reasons shall be documented. The employee must provide a urine sample for
controlled substaJ1ces testing as soon as practicable after the accident. After f11irty-two (32)
hours, all attempts to conduct the test shall cease aJ1d the reasons shall be documented. An
employee subject to post-accident testing must remain available or the employee shall be
considered to have refused to submit to testing. The employee is prohibited from using alcohol
for eight (8) hours following the accident or until the employee has undergone a post-accident
alcohol test, whichever comes first.
RETURN -TO-DUTY TESTING
An employee found to have violated this policy shall not return to work until after undergoing
retum-to-duty tests indicating an alcohol concentration ofless thaJ1 0.02 aJ1d a verified negative
result for controlled substances.
FOLLOW-UP TESTING
Following a determination by a SAP that aJ1 employee is in need of assistaJ1ce in resolving
problems with alcohol abuse aJ1d/or controlled substances use, aJ1 employee shall be subject to
unarmounced follow-up alcohol aJ1d/or controlled substaJ1ces testing as directed by the SAP.
Follow-up testing shall not exceed sixty (60) months from the date of the employee's return to
duty,
RANDOM TESTING
The City of Arden Hills will raJ1domly select employees subject to this policy for unarmounced
alcohol aJ1d controlled substaJ1ces testing using a computer based raJ1dom number generator that
is matched with aJ1 employee's identifying number. Alcohol testing shall be performed just
before, during or after aJ1 employee's performance of safety-sensitive duties. Employees selected
for testing must proceed immediately to the testing site; provided, however, that if aJ1 employee
is performing a safety-sensitive function at the time of notification, the employee shall cease
performing the safety-sensitive function aJ1d proceed to the testing site as soon as possible.
FWHA rules require f11e City of Arden Hills to conduct raJ1dom controlled substaJ1ces testing on
fifty percent (50%) of the average number of employees aJ1d raJ1dom alcohol testing on ten
percent (l 0%) ofthe average number of employees.

Employees may be selected for more than one test per year. Tests shall be spread reasonably
throughout tl1e year.

DRUG AND ALCOHOL TESTING
Controlled substances testing is conducted by analyzing an employee's urine specimen. Split
urine smnples will be collected according to FHW A regulations. The employee will provide a
urine smnple at a designated collection site. The collection site person shall pour the urine
specimen into two (2) bottles labeled "primary" and "split", seal the specimens, complete a chain
or custody document and prepare tl1e bottles for shipment to the testing laboratory for analysis.
If tl1e employee is unable to provide the appropriate qUaJ1tity of urine, tl1e collection site person
shall instruct the employee to drink not more tl1an twenty-four (24) ounces of fluids and, after a
period of no more than two (2) hours, again attempt to provide a complete smnple. Iftl1e
employee is still unable to provide a complete smnple, the testing shall be discontinued aJ1d tl1e
Employer notified. The MRO shall refer tl1e employee for a medical evaluation to determine if
the employee's inability to provide a specimen is genuine or constitutes a refusal to test. For pre-
employment testing, the City of Arden Hills may elect to not have tl1e referral made and revoke
tl1e employment offer.
The testing laboratory reports drug test results directly to the MRO. The MOR reports tl1e results
to tl1e City of Arden Hills' designated contact person. If the results are negative, tl1e City of
Arden Hills is irrformed aJ1d no further action is necessary. If tl1e test result is confirmed positive .
the MRO shall give the employee aJ1 opportunity to discuss tl1e test result. The MOR must
review any medical records supplied by aJ1 employee to determine if a confirmed positive test is
the result oftl1e employee having taken legally prescribed medication, The MOR shall notify
each employee that tl1e employee has seventy-two (72) hours in which to request a test of the
split specimen at the employee's expense. The MOR will contact tl1e employee directly, on a
confidential basis, to determine whether the person wishes to discuss tl1e positive test result.
The MOR will review tl1e confirmed positive test result to determine whetl1er tl1ere is an
acceptable medical reason for tl1e positive result. The MRO shall verify aJ1d report a positive test
result to tl1e City of Arden Hills when tl1ere is no legitimate medical reason for a positive test
result as received from the testing laboratory.
If, after making reasonable efforts aJ1d documenting these efforts, tl1e MOR is unable to reach tl1e
employee directly, tl1e MRO must contact tl1e designated Employer contact person, who shall
direct tl1e employee to contact the MRO. If the City of Arden Hills' contact person is unable to
contact the employee, the employee will be placed on suspension,
The MOR may verify a test positive without having communicated directly witl1 the employee
about tl1e test results under tl1e following circumstances:
I.
The employee expressly declines tl1e opportunity to discuss the test results.

The employee has not contacted the MRO wif11in five (5) days of being instructed
to do so by f11e City of Arden Hills.
The FWHA alcohol test rules require breath testing administered by a BAT using aJ1 EBT. Two
breaf11 tests are required to determine if a person has a prohibited alcohol concentration. Any
result less thaJ1 0.02 alcohol concentration is considered a "negative" test. If the alcohol
concentration is 0.02 or greater, a second confirmation test must be conducted. If aJ1 employee
attempts aJ1d fails to provide a adequate amount of breath, the City of Arden Hills will direct f11e
employee to obtain written evaluation from a licensed physieiaJ1 to determine iff11e employee's
inability to provide a specimen is genuine or constitutes a refusal to test. Alcohol test results are
reported directly to the designated City of Arden Hills contact person,
LICENSED TESTING LABORATORY
The testing laboratory shall be Healthcomp Evaluation Services Corporation (HESC), 2147 West
County Road D, St. Paul, MN 55112, (Phone: 888-558-8378), which is a lab certified to
perform controlled substaJ1ce testing according to DHHS regulations.
PROHIBITED DRUG AND ALCOHOL RELATED CONDUCT
The following alcohol aJ1d controlled substaJ1ce-related activities are prohibited by the FWHA's
drug aJ1d alcohol rules for drivers ofCMV's:
I. Reporting for duty or remaining on duty to perform safety-sensitive functions
while having aJ1 alcohol concentration of 0.04 or greater;
2. Being on duty or operating a CMV while f11e employee possesses alcohol, unless
the alcohol is maJ1ifested aJ1d traJ1sported as a part of a shipment. This includes
the possession of medicines containing alcohol (prescription or over-the-counter),
unless f11e packaging seal is unbroken'
3. Using alcohol while performing safety-sensitive functions;
4. Performing safety-sensitive functions wif11in four (4) hours after using alcohol'
5, When required to take a post-accident test, using alcohol within eight (8) hours
following the accident or prior to undergoing a post-accident alcohol test,
whichever comes first;
6. Refusing to submit to aJ1 alcohol or controlled substaJ1ce test required by post-
accident, raJ1dom, reasonable suspicion, or follow-up testing requirements;

7.
Reporting for duty or remaining on duty, requiring the performaJ1ce of safety-
sensitive functions, when f11e driver uses aJ1Y controlled substaJ1ce, except when
instructed by a physiciaJ1 who has advised the driver f11at f11e substance does not
adversely affect the employee's ability to safely operate a CMV;
.
8. Reporting for duty, remaining on duty or performing a safety-sensitive function, if
the driver tests positive for controlled substaJ1ces.
CONSEQUENCES TO EMPLOYEES ENGAGING IN PROHIBITED CONDUCT
Employees who have engaged in prohibited conduct are subject to the following consequences,
purSUaJ1t to FHW A rules:
1. Employee shall not be permitted to perform safety~sensitive functions;
2, Employees shall be advised by the City of Arden Hills of the resources available
to f11em in evaluating aJ1d resolving problems associated wif11 misuse of alcohol or
use of controlled substances;
3.
Employees shall be evaluated by a substance abuse professional who shall
determine what assistaJ1ce, if aJ1Y, the employee needs in resolving problems
associated with alcohol misuse aJ1d1or controlled substaJ1ce use;
.
4.
Before aJ1 employee returns to duty requiring performaJ1ce of a safety-sensitive
function, he/she shall undergo a retum-to-duty test with a result indicating a
breaf11 alcohol level ofless f11aJ1 0,02 iff11e conduct involved alcohol, or a
controlled substaJ1ce test with a verified negative result iff11e conduct involved
controlled substance use;
S. In addition, each employee identified as needing assistaJ1ce in resolving problems
associated wif11 alcohol or controlled substaJ1ces shall be evaluated by a substaJ1ce
abuse professional to determine that the employee has followed the rehabilitation
program prescribed;
6. The employee shall also be subject to unmmounced follow-up alcohol aJ1d
controlled substaJ1ce testing.
OTHER ALCOHOL RELATED CONDUCT
FWHA rules require f11at in the event of aJ1 alcohol test result over 0.02 but less thaJ1 0.04, aJ1
employee shall not be permitted to perform safety-sensitive functions for not less than twenty-
four (24) hours.

REFUSAL TO UNDERGO TESTING AND CONSEQUENCES OF REFUSAL\
All applicaJ1ts aJ1d employees have the right to refuse to undergo drug aJ1d alcohol testing. If aJ1
individual refuses to undergo drug aJ1d alcohol testing required by this policy, no such test shall
be given,
An applicaJ1t who refuses to take a drug aJ1d alcohol test shall be disqualified from further
consideration for the conditionally offered position.
An employee refusing to take a drug aJ1d alcohol test required by this policy shall not be
permitted to perform safety-sensitive functions and will be considered insubordinate aJ1d will be
subject to disciplinary action including possible dismissal.
EMPLOYEE/APPLICANT RIGHTS
All applicaJ1ts aJ1d employees subject to the drug testing provisions of this policy have the right
to request, at employee or applicaJ1t expense, a retest of the split urine sample within seventy-two
(72) hours of receiving notice of a confirmed positive test result.
If the employee requests aJ1 aJ1alysis of the split specimen within seventy-two (72) hours of
having been informed of a verified positive test, the MRO shall direct, in writing, the laboratory
to provide the split specimen to aJ10ther DHHS-certified laboratory for aJ1alysis. If aJ1 employee
has not contacted the MRO within seventy-two (72) hours, the employee may present to the
MRO information documenting that serious illness, injury, inability to contact the MRO, lack of
actual notice of the verified positive test, or other circurnstaJ1ces unavoidably prevented the
employee from timely making contact. If the MRO concludes that there is a legitimate
explanation for the employee's failure to contact within seventy-two (72) hours, the MRO shall
direct the aJ1alysis of the split specimen.
If the confirming retest is negative, no adverse action will be taken against the employee aJ1d aJ1
applicaJ1t will be considered for employment.
The City of Arden Hills will not discharge aJ1 employee that, for the first time, receives a verified
positive drug or alcohol test result unless:
I. The employee refuses to meet with a SAP for the purpose of an evaluation for
alcohol/controlled substaJ1ce use/abuse aJ1d recommendations for aJ1 education,
counseling or treatment program; or
2. The employee fails to enter the recommended program, or fails to successfully
complete the program; or
II
3.
The employee fails a return-to-duty alcohol and controlled substaJ1ce test at the
successful completion of the recommended program or subsequent unannounced
follow-up alcohol and controlled substance testing.

DISCIPLINE
Any person found to be in violation of this policy is subject to discipline up to aJ1d including
discharge. Disciplinary actions taken pursuant to this policy are appealable pursuant to the
procedures established in the City of Arden Hills' personnel policy and rules or any applicable
collective bargaining agreement, but not both.
Nothing in this policy limits or restricts the right of the City of Arden Hills to discipline or
discharge an employee for conduct that violates the City's policies or rules, provided the
employee is not tested for controlled substances or alcohol.
CONFIDENTIALITY OF TEST RESULTS
All alcohol/controlled substances test results and required records are considered confidential
information. Any information concerning an individual's test results aJ1d records shall not be
released without the written permission of the individual, except as provided for by regulation or
law.
ALCOHOL AND CONTROLLED SUBSTANCES CONTACT PERSON

direction, aJ1d administration of the City's alcohol aJ1d controlled substaJ1ces policy. The contact

The City of Arden Hills no longer conducts pre-employment alcohol testing of individuals given
a contingent offer of employment as a traJ1sportation employee, Pre-employment alcohol testing
has been suspended, pursuant to the suspension of the federal rule governing pre-employment
alcohol testing oftraJ1sportation employees. See 49.C,F.R. 382.301; Vol. 60, No. 90 F.R. 24765,
May 10, 1995.
The City of Arden Hills' employees are subject to drug aJ1d alcohol tests when a CMV is

The existing Playstructure at Ingerson Park was installed in the summer of 1985. It is a
wooden aJ1d steel structure that is showing it's age. The wood is in poor condition aJ1d the
steel is rusting.

The 2000 Capital Improvement Plan allocated $ 33,000 for this project. The City
received three quotes from compaJ1ies expressing interest in this project.

Parks and Reereation Committee Recommendation
At the May 23, 2000 Parks aJ1d Recreation Committee meeting, the Committee selected
the bid from the Miracle Recreation Equipment Company. The total cost for the
Playstructure, installation and Sales Tax is $18,124.88
Staff Recommendation
Staff recommends that the Playstructure at Ingerson Park be replaced aJ1d that the Miracle
Recreation Equipment CompaJ1Y provides complete installation at a total cost not to
exceed $18,124.88.

1999. This machine has the capability of flushing/jetting out sewer mains with its' high
power jetting hose aJ1d at the same time vacuuming the sludge aJ1d debris out of the
manholes as it washes down from up stream. The machine has also proved valuable in
numerous other instaJ1ces,

Storm Sewer Outlet Deltas
One of the features of the City's Vactor is the ability to suck up mud, debris aJ1d water,
yet hold the mud aJ1d debris iu its' tank while uuloading the water as it accumulates. This
is what the Public Works Department expects to do when removing saJ1d deltas building
up at maJ1Y storm sewer outlets where they empty into lakes, streams aJ1d ponds.
Reauest for Authorization ofUnbudl!eted Item
The above-described Vaetor came with only tweuty feet of flexible suction hose. This is
plenty when used with sewer c1eaJ1ing accessories. However, it will not reach most delta
areas we need to c1eaJ1. The Public Works Director asks for Council's authorization to
spend approximately $3,000 on additional suction hose aJ1d fittings for the City's Vactor
MaintenaJ1ce Machine. Those monies would corne equally from the City's Sewer Utility
Fund, aJ1d the Storm Water MaJ1agement Fund.
