SUBJECT: Boulevard Mowing Backl!TOUnd The City of Arden Hills, Parks and Public Works Departments, receive an increasing number of complaints each year regarding high grass and weeds along the shoulders of City and County roads in Arden Hills. The County will only assure their road shoulders are mowed once a year. The City does minimal mowing as time permits, but does not have the manpower or equipment to do a proper job. The City has riding mowers which work well if brush and obstacles are removed and shoulders are mowed weekly, The City also has a large flail mower which mounts on the rear of their largest tractor, but this setup works poorly on shoulders when tree limbs, signs and brush are present. Also, the flail mower chews and rips up more than it cuts, leaving an undesirable look. Considerations Attached are pictures and a highlighted map of several areas in the City where frequent mowing may be considered. If all highlighted areas were mowed weekly, it may take one man a full forty-hour week. During the mowing season, if shoulder mowing is undertaken, the Public Works and Parks & Recreation Director recommend the purchase of a side boom mounted rotary mower, This mower could also be used for light brush trimming on trails and road shoulders, as the mower works vertically as well as horizontally. Options If the City does decide to do additional mowing the following options may be considered: . Hire another seasonal worker dedicated to shoulder mowing and provide the proper equipment. (Costs are estimated to be $18,000 per year for labor and equipment maintenance, plus $20,000 for a side boom rotary mower.) . Choose areas to be mowed and contract out to a mowing service. Recommendation The Public Works and the Parks & Recreation Directors, recommend the City Council inspect the areas on the highlighted map and decide if additional mowing should be undertaken, and if so, which option would Council prefer. . . . One note to update this memo is that, since it's writing, the Nott Company (page 3) has chosen not to pursue this alternative. Reauested Action None. The City Council is being requested to commence discussions on the appropriate re-use of the Indykiewicz property at southeast intersection of Highway 96 and Round Lake Road. Back!!:round The EDA acquired the Indykiewicz property at 1920 Highway 96 on March 10, 1999. The EDA acquired this property to facilitate the relocation ofthe intersection of Highway 96 and Round Lake Road. The relocated road will utilize approximately the southeasterly 40 percent of the site (Exhibit A). Thereby, leaving a remnant parcel from this acquisition. The remnant parcel from the Indykiewicz acquisition is approximately 3.3 acres in size. Additionally, it may be possible to obtain the right of way for the former Round Lake Road from MnDOT (who actually has title to the ground that the existing Round Lake Road is located on) and combine it with the Indykiewicz remnant piece for redevelopment purposes. The Round Lake Road right-of-way remnant piece is approximately 0.7 acres in size. If the remnant right-of-way is able to be combined with the Indykiewicz remnant parcel then the redevelopment site would be approximately 4.0 acres in size. Time Frame for decision makin!!: The City Council on Monday, March 8,1999, approved Resolution #99-07, which awarded the contract for the Round Lake Road reconstruction project to Forest Lake Contracting. As a part of this contract Forest Lake Contracting will have until the end of this year to remove the black dirt from the property. The black dirt will be stored on the remnant piece of the Indykiewicz property. Therefore, the title to this property could not be sold until January of 2000. If the City wishes to obtain title to the remnant piece of right-of-way for Round Lake Road (and probably the remaining piece of Round Lake Road, south of this project) the request to declare as excess to MnDOT and MnDOT to release it to the City will take at least nine months, maybe longer. The Staff assumes that the City Council wishes staff to pursue this and unless directed otherwise will commence on this activity, with the City Engineer being the lead. , . Re-use ofIndykiewicz Site Page Two March 15,1999 ~ Site Constraints e 1. Utility lines. Approximately the western 40 percent of the remnant parcels (lndykiewicz and right-of-way) is under the NSP electric transmission easement. Although a structure cannot be built under this easement parking and landscaping can be located here. 2. Access. Access to Highway 96 is going to be limited by Ramsey County to right-in and right-out access in the most liberal situation to no access in the most restrictive. Access to the site from Round Lake Road will be limited to right-in and right-out for the northerly portion of the road due to the median in Round Lake Road. South of the median the sight will have full movement access to Round Lake Road. 3. On-site Ponding. The pond to be constructed south of Round Lake Road (on Parcel D) was sized to accommodate the run-off from the development of this site, so no on-site ponding should be required on the redevelopment site. Comprehensive Plan The Comprehensive Plan includes by reference the "Planning Study for NE 1-694/I-35W" (the Plan) that ultimately became known as the Gateway Business District. The Plan identifies the use for this site as "Business" (Exhibit B). The Plan does not provide a detailed description of .- intended uses for this site. ... Zonin!!: The ZOlling of this property is Gateway Business (Exhibit C). The Gateway Business district allows as permitted uses: Business Services, Clinics, Clubs-Sports Fitness, Financial Institutions, Manufacturing Uses (Class I), Offices, Personal Services, Research, and Restaurants. The Gateway Business district allows as special uses: Hotel/Motel, Multiple Use Operations, Public Uses, and Warehousing. Alternate wavs to view the redevelopment potential 1. Maximnm Return on Investment. The implementation of this option would most likely place a fast food restaurant and a gasoline station on the site and would require a rezoning. As the title implies this would probably provide the city with an immediate and large dollar return for its investment into the acquisition of the Indykiewicz site. The presence of these uses most likely would not expedite the development of the "Office corner" (northeast comer ofI-694 and I-35W). 2. Providing a site for a use that is needed by the Community. The implementation of this option may involve revisiting the Community Survey to determine which of the items listed by residents as those uses that they would like to have in the community could from a market perspective be potentially located on this property (ie., supper club). e . . e e e Re-use ofIndykiewicz Site Page Three March 15, 1999 3. Providing a site for a use that is needed by the Gateway Business District. The implementation of this option may involve talking to various Developers to find out what uses could be put on this site that may accelerate the development of the Office Comer. 4. Nott Company. The Not! Company has expressed an interest in purchasing Parcel D (the ponding area) so as to expand their building to the north. The implementation ofthis option would require the ponding area to be relocated onto the remnant parcel, which would effectively eliminate its redevelopment opportunities. (*Refer staff note.) Recommendation None. Additional discussion and study is required before a formal recommendation on the re-use of this site is appropriate. Round Lake Road Arden Hills MN 55112 VIA FACSIMILE NO. 633-7839 RE: Shoreline Drive PF&B File No, 10460.990001 Dear Joe: e The City has the authority to acquire private property for a public right-of-way and, if necessary, use its power of eminent domain. Typically, the City will hire a surveyor to legally define and illustrate the property to be acquired; to describe the type of easement which the City wishes to acquire; and to identify the record owners of the property. In addition, the City will hire an appraiser to estimate the fair market value of the land. Upon receipt of the swvey information, the City would be in a position to contact the property owners and make a purchase offer. If the negotiation was unsuccessful, the City Council would adopt a resolution authorizing the City Attorney to commence a condemnation proceeding. A Notice of Intent to Possess and a Petition for Condemnation are prepared and served upon the record owners of the property, The Notice establishes a date for the initial hearing. The Petition requests the District COUIt to determine whether the acquisition is for a public purpose and, if so, further requests the District Court to appoint three commissioners who will meet, hear testimony, and determine the fair market value of the property. Commissioners are currently paid $200 per half day or any fraction thereof. This cost is assessed to the City. Normally, it is about 4 months from the beginning to the end of the process before the COUIt Appointed Commissioners. Any party who is dissatisfied with the Commissioners' award may appeal to the District Court. The matteris then placed on the trial calendar and is processed like other civil cases. In Ramsey County, it is about 9 months Erom the date of filing the appeal to the date of trial. e In regard to the Shoreline Drive right-of-way, there is a complicating issue. There is no record of a right-of-way acquisition for a portion of Shoreline Drive which currently is being utilized as a road. These arguments should be presented by motion to the District Court before the Commissioners file their award. There is no guarantee as to the result of these arguments. Therefore, in the past, the City has taken the position that it would extend and improve the Shoreline Drive right-of-way only when adjacent property owners dedicate and develop their sites. The cost of acq1.liring and improving a public right-of-way can be specially assessed against benefitted propertY O\lVIlers pursuant to the provisions contained in MiImesota Statutes Chapter 429. Until the estimated cost of the project is prepared, it is hard to determine whether all or a portion of the costs can be specially assessed in this plU'ticular case.
