Mayor Probst closed the Council Worksession at 4:47 p,m, for a Closed Executive Session to discuss pending litigation, Mayor Probst reconvened the Council Worksession at 5:56 ,m, DISCUSSION ITEMS a. County Road I and Schutta Road City Administrator Lynch introduced Mr. Jim Tolaas, Ramsey County Department of Public Works, Mr. Tolaas was in attendance to discuss the design process with Ramsey County's County Road I and Wispark project in the City of Shoreview : and the future development ramifications with the City of Arden Hills, Discussion items included Ramsey County's policy regarding semiphore cost participation between the City and County; the cleven (11) warrants to be met for County installation of a semiphore; the status of the West Round Lake Road signal reimbursement; and an update regarding future planning for the Schutta Road to Lexington Avenue segment. Staff was directed to bring back the "No Parking" resolution for County Road I at the August 28, 2000 regular City Council meeting, Highways 96/10lntersection Mr. T olaas discussed the current status of design for the Highway 96/1 0 intersection, Discussion items included the study being conducted through work with the 1-35W Corridor Coalition, a process of approximately seven (7) months, which is tied to the build out study; cost sharing and revenue sources; right-of-way acquisition; availability oftumback dollars; DRAFT ARDEN HILLS CITY COUNCIL WORKSESSION - AUGUST 21, 2000 2 ,. Mayor Probst requested that Mr. Tolaas advise Mr, Mayasich of the City of Arden Hills' desire . to bc included in any current or future discussions regarding any Twin Cities Army Ammunition Plant (TCAAP) maintenance facility planning discussions involving the County and other agencies, Mr. Tolaas stated that Ramsey County and the National Guard were in discussions about the potential resiting of the joint maintenance facility to comply with City zoning requirements, County Road E, Streetlight Standard Replacement Mr. Stafford presented evidence ofthe need to replace the seventeen (17) city-owned streetlight poles along County Road E due to the deterioration ofthe underground mountings, Mr, Stafford estimated the cost of replacement to be between $1,700 - $2,300 per standard, exclusive of mounting and lightheads, Mr. Stafford was working with a firm that suggested replacement of the concrete pillars, at approximately $3,000 per pole, Mr. Stafford recommended to the Council that they direct the City's Operations and Finance Committee to review the City's current street light poliey and potential design of a City streetlight standard, Discussion items included the immediate safety issues; involvement of the Planning Commission in any future city-wide lighting design process Staff was directed to bring a recommendation to the City Council at their August 28, 2000 regular meeting with an estimated cost for a temporary welding repair solution; as well as a recommendation to the Operations and Finance Committee and the Planning Commission for a further study, _ b. Ingerson Road Mayor Probst stated that the purpose of this agenda item tonight was for an informal presentation of the two (2) reports; that of the Ingerson Neighborhood Review Group and that of City Staff and the Consulting Engineer. Mayor Probst asked that any further elaboration on specific points in either report be held until the August 28, 2000 formal presentation to the lull City Council at their regular meeting, Mayor Probst stated that, at the August 28th meeting, a publie information meeting date would be established, with further Couneil action to follow at that publie meeting, Ms, Linda Swanson, representing the Ingerson Neighborhood Review Group, thanked Mayor Probst, Couneilmembers, City staff, and Consulting Engineer, Greg Brown, for the opportunity to review the proposed 2000 Street Improvement Project, and to provide recommendations to the City CouneiL Ms, Swanson reviewed the speeific items of agreement, and those conflicting items, between the staff and neighborhood groups, Mayor Probst expressed his appreciation that there appeared to be more commonality than differences in the reports, e e e e ARDEN HILLS CITY COUNCIL WORKSESSION - AUGUST 21, 2000DR AfT Discussion items includcd the detriment of increased road widths; potential closure of Hamline Avenue and lack of consensus of the neighborhood group; increased traffic on Ingerson and Dunlap; the Lake Josephine Associations concern for the Fernwood Channel recreational land value; untreated stormwater into wetlands; the presentation on raingardens by Mr, Haider of the City of Maplewood, and the varying soils involved; and the protection or insulation of water and sewer lines in somc areas proposed for raingarden installation, Mayor Probst complimented thc Review Group, and again thanked them for their research and presentation, Councilmember Aplikowski requested comments from anyone else in the audience, Two (2) unidentified representatives ofthe Lake Josephine Association, were present and requestcd more definitive information on the plan for the Fernwood Channel, as it directly affectcd their property, They asked the City Council to be included in any future discussions, Mayor Probst stated that the City Council anticipated the public informational meeting to be scheduled at one of the September regular Council meetings, and assured the residents that the neighborhood would be notified, Staff was directed to establish an orderly fashion to address the specific issues involved in the report, to allow the City Council to direct the consulting engineer to prepare a revised feasibility report, c, 2001 Budget Mr. Post stated that staff was continuing to work on the previous directive ofthe City Council to provide a 200 I Budget, based on a maximum levy increase of 2,5%, Mr. Post addressed the proposed unbudgeted streetlight standard repair and/or replacement, and stated that this could possibly be considered as a 2000 project as funding was more readily available at this time, Mr. Post also addressed the Council's proposal for the 2001102 Pavement Management Plan (PMP), and the possibility of pending development in the Gateway Business District and the possible need to reprioritize the West Round Lake Road Phase II project. Councilmember Aplikowski proposed increasing the 2001 levy by three percent (3%), Mr. Post advised that the optional dates for the City's Truth in Taxation dates would be December 4th or December II th, with the Preliminary Levy due to Ramsey County by September 15,2000, Staff was directed to plan for the Ingerson Neighborhood Project as the PMP Project for 200 I, and that future projects would most likely continue on a two-year cycle and process; and to continue with the proposed 2,5% maximum levy increase, IJ'-<AFT ARDEN HILLS CITY COUNCIL WORKSESSION - AUGUST 21, 2000 4 STAFF COMMENTS e Parks Director Moore reported on various activities of the Parks and Recreation Department including, recent trail grooming and brush clearing; Ingerson Park play structure installation; fall aeration; Cummings Park wam1inghouse repair done by staff at an (approximate savings of $4,000; addition of a practice soccer field at Floral Park; field #3 at Perry Park now being opcrational; ongoing improved working relationship \vith Northwestern College regarding the Presbyterian Homes field and the agreement to provide the City fees for services rendered, Planner Chaput reported on various issues before the Planning Commission regarding ordinance and sign changes; as well as seeking Council input at a future joint Planning Commission/City Council Worksession, Recreation Program Supervisor Olson updated the Council on various Recreation activities including increased soccer registrations; no need for additional fields; and addition of a new pre- school soccer program, Public Works Dircctor Stafford reported that the City was making good use of the sewer maintcnance easement machine recently purchased jointly with the City of White Bear Lake; a planned meeting with BR W staff on Thursday to discuss the Highway 96 median cut at the new City Hall site; testing and repair of the City's civil defense sirens; status of the requested speed study for Highway 51; the research and drafting of an ordinance requiring installation of grease traps to prevent recurring grease problems in City sewer Jines from food processors and restaurants, Mr. Stafford reported that more of these problems were being found with the . advanced televising of the sewer lines, Mr, Brown stated that a report on the recent televising of the City's sanitary sewer system would be forthcoming, with the Edgewater and Ingerson neighborhoods having the most immediate areas for concern, City Treasurer Post reported that he would be seeking Council authorization in the near future for submitting a grant proposal to the Minnesota Department of Transportation (MnDOT) for reimbursement of property acquisition costs at the Indykiewicz site, Mr, Post also stated that additional Finance Department activities included work on the 2001 Budget and election training, City Administrator Lynch reported on the upcoming Preconstruction meeting for construction of the City Hall facility; meeting with MnDOT and Ramsey County for potential relocation of a National Guard site and commercial driver's facility from Fort Snelling to the Twin Cities Army Ammunition Plant (TCAAP); and a recent meeting with the St. Paul Water Utility regarding their interest in purchasing the City of Arden Hills' water system, Related discussion items included the viability of ownership of the water system by another party; capacities of neighboring communities; and the status of the request for the City to acquire the TCAAP infrastructure system, e . . e ARDEN HILLS CITY COUNCIL WORKSESSION - AUGUST 21, 2000 Df>\ f'" P"'T · l(r~= . COUNCIL COMMENTS Councilmember Larson requested further Council follow up to staff recommendations regarding revisions to the City's Zoning Ordinance and why the Council failed to reach a consensus, Councilmember Larson asked that the Council reconsider their decision regarding continuing parking issues; non-owner-occupied residences; property valuation repercussions; and further public information of the proposed changes, It was the consensus of the Councilmembers and staff was directed to schedule a joint Workscssion in September between the Planning Commission and City Council to discuss various zoning ordinance revisions, including the above-referenced item and antennas, Another concern raised by Councilmembers was the numerous complaints received regarding the home-based business on County Road E, Planner Chaput advised that there was an application forthcoming to the Planning Commission from the resident for a Class Two Home Business, Councilmember Rem advised that Mayor Probst would be presenting a historical perspective on the lengthy process for the construction of the new City Hall facility at the next Operations and Finance Committee meeting, Councilmember Aplikowski advised that the City Events Task Force was moving forward with plans for the City's Fiftieth Anniversary celebration and that a one-time annual calendar was being planned, with historical photographs being solicited, Councilmember Aplikowski also reported on the Communications Committee and their continued diligence and dedication, Mayor Probst discussed upcoming vacancies in the City's Planning Commission; and requested clarification of the schedule for the revised City logo and its inclusion in the next Recreation Guide printing, City Administrator Lynch advised that the three options for the logo would be presented to the City Council at one of their September meetings, Discussion ensued regarding the process to be followed by staff and the consulting engineer for the Ingerson Neighborhood Street Improvement Project. Staff was directed to provide a topic by topic report to allow the City Council to reach agreement on the direction to provide to the consulting engineer for an amended feasibility study; to then hold a public informational meeting; then call for detailed plans and specifications; then the formal Public Hearing related to the Chapter 429 assessment process, Staff was further directed to consult with Ms, Swanson, as the spokesperson for the Ingerson neighborhood prior to the public information meeting; to provide an adequate number of visuals for ease of presentation and understanding; and to prepare for a review of the City's Assessment Policy regarding the basis of road width for assessment purposes, ARDEN HILLS CITY COUNCIL WORKSESSION - AUGUST 21, 2000 D.., f!"l. The County provides SCORE grants to eligible cities participating in the Recycling program, Through a Joint Powers Agreement (IP A), the County adds the City's cost for the recycling service to the residents property tax bill, and returns the collected monies to the City, along with the SCORE grant money of approximately $19,400, The City uses this money to pay for recycling costs, ReQuest Ramsey County asks the participating cities in the IP A to provide the County with a resolution establishing the Year 200 I rate for recycling services, Year 2001Rate The Public Works Director has reviewed costs for the recycling program, and contacted the service provider for input on estimating cost increases for 2001, No increases are expected for 2001, which will result in the fee for each residential parcel remaining at $22,45 per year, Recommendation The Public Works Director recommends Council adopt Res, #00-33, which continues the rate of $22,45 per year per residential parcel. CITY OF ARDEN HILLS MEMORANDUM DATE: September 8, 2000 TO: Mayor and City Council Jennifer Chaput, City Planne~ Case #00-31, Planned Unit Development Amendment Hood Flexible Packaging, 1887 Gateway Blvd FROM: SUBJECT: Request The applicant is requesting to amend the Planned Unit Development for 1887 Gateway Blvd. to allow the placement of a make-up air unit (-IT x 5'9", as shown in Exhibit A) and a chiller condenser (-1' x 5'6", as shown in Exhibit B) in front of one of the business' existing loading doors (as shown on the site plan, Exhibit C). Backl!round Hood Flexible Packaging came before the City Council with Planning Case #00-17a to request the addition of two exterior solvent tanks, a catalytic oxidizer and the expansion of one overhead door to accommodate these additions. This case was approved with the following conditions: 1. A minimum of three protective bollards be placed to protect the fence structure. 2. The dock door closest to the oxidizer not be used once the oxidizer is in place. 3. Solvent tank and oxidizer screening be cedar wood construction painted to match the building. 4. All roof top mechanical devices be screened per code requirements. 5. Solvent tank placements meet building/fire code regulations. 6. No detectable odors from the printing process be present on the exterior of the building. Zoninl! Review 1. Make-up air unit. The proposed make-up air unit is required for the operation of Hood Flexible Packaging to bring warm air into the building in the wintertime to equalize airflow. A lot of air is exhausted out ofthe building and air must be returned to the building so that negative air pressure is not created. It would be difficult to open doors or efficiently dry printed materials without it. This unit would be located directly in front of one of the dock doors so the loading dock would no longer be utilized. 2. Chiller condenser. The chiller condenser is required to chill water that in turn cools down presses and machinery for the operation ofthe business. The condenser would be placed to the south of the make- up air unit along the building. The operation of these systems is further explained in a letter by the applicant (Exhibit D). Screening of Mechanical Equipment. Section VI, E, 4,j of the Zoning Ordinance requires that, "Screening shall also be provided where mechanical operating equipment is located on the ground or on the roof of the premises.. .constructed and located to prevent direct view of the equipment". Screening types may be a fence, wall or landscaping area. It is the property owner's responsibility to provide screening, as required. e The applicant is proposing that two types of mechanical equipment be located on the ground on this property. There is no screening plan provided with this application but the applicant is willing to screen the units according to City Council recommendation. Planning Case #00-17a required the same applicants at the same address to screen their proposed outdoor units with cedar wood construction, painted to match the exterior of the building. Deadline for A~encv Actions The City of Arden Hills received the complete application for this request on August 7, 2000. Pursuant to Minnesota State Statute, the City must act on this request by October 6, 2000 (60 days), unless the City provides the petitioner with written reasons for an additional 60-day review period. The additional review period would extend to December 5, 2000. The City may, with the petitioners' consent, extend the review period beyond the December 5, 2000, date. Lastly, if the City denies the petitioners' request, Ii ... it must state, in writing, the reasons for the denial at the time that it denies the request. H Ontions 1. Backl!round The proposed construction of the screened porch with stairs and addition to the home actually decreases the current area of the house by 162 square feet. The addition onto the house is an additional 229 square feet. However, the size of the deck and steps decreases by 172 square feet and the patio area decreases by 219 square feet. Overall, the construction reduces the footprint of the house. The setback, determined by the DNR and adopted by the City, from the ordinary high water mark of Karth Lake (934.95) is 75'. It appears that a number of homes along Karth Lake are unable to meet this setback as they currently exist. Minnesota Rules 6120.3200 states that lakes classified as "general development" (Karth Lake) should have a structure setback of75' from the ordinary high water level for unsewered lots and 50' for sewered lots, Current City Code states the setback is 75' and, since this is the more restrictive ofthe two, this case must be evaluated according to this setback from the ordinary high water level. Variance Findinl!s In order to grant a variance, a hardship must be identified, as defined by the City and State criteria outlined above. The applicant has responded to the hardship criteria in a letter, as provided in Exhibit B. For this application for a variance from the ordinary high water mark ofKarth Lake at 1228 Karth Lake Drive, the following findings can be made: I. Whether the circumstances for which the variance is requested are unique to the property. There are a number of properties along Karth Lake that face the same situation as this property owner. It appears that a number of the houses on the east side of the lake are, on average, no more than fifty feet back from the ordinary high water mark (an estimation made from data provided through CitySight, a GIS-based program), not meeting the current ordinance requirements. The circumstances relating to this particular property are, therefore, not unique. . e e e 2. Whether granting the variance would be in keeping with the spirit and intent of the City's Zoning Code. The City's Zoning Code states as one of its intentions as, "To promote the character of and preserve and enhance the properties and areas within the City including wetlands, ponds and marshes". The setback requirements established by the Department of Natural Resources are enacted to preserve and protect the existing wetlands by not allowing development within a certain setback. Allowing for a variance from this would be contrary to the intent of the ordinance. 3. Whether the property in question can be put to a reasonable use without granting of a variance. A single family home is currently constructed on the property. Therefore, the property in question has already been put to a reasonable use. There is only a small portion ofthe proposed addition that juts into the ordinary high water mark setback. It is possible to reconfigure that addition in some matter to avoid requiring a variance from the ordinance. It can not be said that without this variance, the property could not be put to a reasonable use. 4. Whether the hardship was created by the property owner. Although the shape ofthe lot and position of the house are not the fault of the current owner, the owner is proposing the addition within the setback area, creating the need for a variance. This could be avoided by reconfiguring the addition so that it was not witllin the required setback area. The need for this variance is being created by the property owner. 5. Whether granting the variance will alter the essential character of the neighborhood. Granting this variance will set precedence for other properties along Karth Lake that are also nonconforming by the setback from the ordinary high water mark. This is contrary to the intent of the ordinance to allow nonconformity to continue to exist and be expanded without consideration for current ordinances. Again, staff would recommend that the ordinance be reviewed for this particular lake because of the current DNR rules, which would positively impact all properties along Karth Lake in the future. Although granting this variance would not visually impact the character of the neighborhood a great deal, it does set precedence for future applications. Deadline for Al!ency Actions The City of Arden Hills received the completed application for this request on August 7, 2000. Pursuant to Minnesota State Statute, the City must act on this request by October 5, 2000 (60 days), unless the City provides the petitioner with written reasons for an additional 60-day review period. The additional review period would extend to December 4,2000. The City may, with the petitioners consent, extend the review period beyond the date. Lastly, if the City denies the petitioners request, "...it must state in writing the reasons for the denial at the time that it denies the request". Options 1. Recommend approval as submitted. 2. Recommend approval with conditions. 3. Recommend denial with reasons for denial. 4. Table for additional information. e e . Recommendation The Planning Commission recommended that Planning Case #00-32, variance from the ordinary high water mark setback ofKarth Lake (69 feet proposed, when 75 feet is required), be approved based on the following findings and conditions: 1. The amount oflot coverage and size of the nonconformity is reduced by tbe proposal; 2. The shape of the wetland on the property creates an oddly configured parcel; 3. The proposal reduces the amount of encroachment into the setback; 4. If the structure were damaged in excess of the building code threshold for damage, the variance would no longer be valid. The homes directly to each side ofthe property do not comply with the high-level water restriction and are significantly closer to the lake than our property. 2. The requested variance will indeed be in keeping with the spirit and intent of the City's Zoning Code as the total of hardcover will decrease on this property. The remodel will enhance the lakeside of this home and increase the value of the property by showcasing the lake as one enters the home. Furthermore, the remodel will remove a deck and screened porch that are an eyesorc and badly in need of repair. The area requested for the variance is currently covered with this deck and porch. 3. Without granting this variance the homeowner's will not be able to improve the kitchen and eating areas of their home to the standard of fine homes build with excellent lake views within the Twin Cities area. Not having the variance would eliminate the eating area of the remodel, which is the area of focus. e 4. The property owner did not create this hardship, the original builder set the location of the home on the property. Furthermore, the original design of the home focuses the kitchen and eating area on the interior views of the home and not the exterior views. Back!!round Earlier this year, staff received a few complaints regarding a business being operated out of a home at 3810 New Brighton Road. The situation was investigated and it was found that the home did not have approval for a Home Occupation (either Class I or Class II) at this location. The property owner was notified that shc was out of compliance with the Zoning Ordinance and asked that she respond to staff with a plan for compliance. As a result of this action, the property ovmer has made application for a Class II Home Occupation. As stated in her letter (Exhibit B), the property owner has been operating Always Wood Flooring at this location for ahnost three years. Prior to this, she was operating the same business in Shoreview for seven years. The business furnishes materials for wood floors, installs and repairs, resands and finishes existing wood flooring and does maintenance coating for wood flooring. The business owns a total of six vehicles with a working crew of seven people plus one office person. Work is done off-site with the exception of a part-time office person who offices on-site. Class II Home Occunation Review From the general requiremcnts for all businesses, as stated in the Zoning Ordinance, the following can be evaluated and determined: 1. It shall not result in traffic, parking, noise, light, fumes and odors to such an extent that it is noticeable that the property is being used for non-residential purposes. Complaints have been taken on this property because it was obvious that a home bllsiness was operating on the premises by the number of vehicles/business vans parked in the front yard. This property does not meet this requirement because the business is noticeable. 2. It shall be conducted entirely within the dwelling. Work is conductcd off site with the exception of office work that occurs in the living room area of the home. No part of this business operated outdoors on site. 3. There is no exterior evidence of the home occupation. . There is extcrior cvidence of the occupation through the variolls vehiclcs on the property used for the business. This property doesn't mcet this requirement. 4. It does not require any special entrances to the dwelling. No special entranccs or modifications to the house are reqllired tor this business. From the specific requirements for a Class II Home Occupation, as stated in the Zoning Ordinance, the following additional information can be detcrmined: 1. The primary business activity shall be conducted by an occupant of the residence; The owner of the company does live on site. Therefore, the primary business activity is conducted by an occupant of the residence. 2. One person not residing in the residence may be employed to assist in the business activity; More than one person not residing in the home is employed at this business. There is one part time office staff person in addition to a crew of seven who work off-site. Although it could be argued that the seven employees are not on-site at all during the day, they are still employed with the company and assist with thc business activity. Plus, they do come to the home at a minimum of twice a day to pick up and return a work vehicle. 3. It does not occupy more than thirty-three (33 percent) of the floor area of the dwelling; According to the applicant's plans, the office portion of the house is approximately 23% . which is less than thc maximum requircd of 33%. 4, It has a limited number of patrons visiting the premises; The applicant has stated that it is rare for a customer to come to the home. It is prcsumcd that there isn't traffic from this type of activity very often. 5. Ojfstreet parking for no more than two (2) additional vehicles than those required by the occupants shall be permitted; on-street parking shall not be used to satisfY required parking; There appears to be room for approximately five vehicles along side of the driveway on-site for workers. Thcrc is also area on the driveway and within the garage for vehicles. The pictures, as shown in Exhibits C and D, show that at least four vans sit, angle parked, offthe driveway. The applicant also states that there are typically five vehicles parked in the driveway and two on the street. This exceeds the maximum permitted of two additional vehicles beyond those used for the residents of the dwelling. 6, It requires delivelY of products to the premises no more than once per day. Deliveries of products to the resident do not exceed the frequency of no more than once per day. Always Wood Flooring has been in operation at this location for three years without the required approvals from the City, The applicant was unaware that this was a requirement and was not made aware ofthis until this past Spring. The applicant has worked to provide everything necessary to the City for the approval ofthis business and is open to any suggestions on how she could improve the . 2 . . . cUITent situation. The business, which I have been operating out of my home in Arden Hills for almost three years now, and previously in my Shoreview home for seven years, is Always Wood Flooring, Inc. I am sole owner of the Corporation which is involved in furnishing materials for wood floors, installing, sanding, and finishing of same, We also do repair of wood flooring, resand and finish existing wood flooring, and do maintenance coating of wood flooring. The business is run out of space that would be my living room and has a part- time office person (3 days per week), and my eldest son, Mark, who does estimatinglproposals/scheduling (partly from here and partly from his truck via cell phone). The work is performed at the homes of our customers, It is rare that a customer might stop by here and materials are atways delivered to our jobsites, The business owns four (4) mid-sized vans, (2 Chev. Astros/2 GMC Safaris), one (I) Dodge pickup truck, and one (1) Nissan pickup, The Dodge is driven by myself and the Nissan is driven only occasionally by one of our workmen. Mainly we use the four vans for our working crew of seven (7) men. Parking is done on a replacement basis, i.e., the man parks his own vehicle where the company van is ordinarily parked. There is space for five (5) to park in my driveway, one man does not drive, so there might be two vehicles parked on the street in front of my home on three days of the workweek, (when the office person is here). The workmen arrive here around 7:15 -7:30 a.m. and return at different times, generally between 3:00 p,m, and 5:00 p.m I have taken several snapshots ofthe house, yard, adjoining roadways, and neighbors, which show the entire situation with the vans in their slots alongside my driveway, You will note that the vans are quite hidden from the street side in most instances with the exception of being seen when driving northerly on New Brighton Road, I have also done a 'close' to scale drawing of the entire property which gives all of the dimensions and will illustrate further the parking area with relation to the trees which serve as good cover. The men are very careful when entering and teaving the driveway so as not to impede traffic on New Brighton Road, We also make a continuing effort to not offend the neighbors, I have spoken with those adjacent and across the street and do keep in contact with them to ask if there might be problems. In conclusion, I submit this request for a special use permit with sincerity and would definitely be open to any/all suggestions on ways in which I could improve the situation. The property at 3810 New Brighton Road is a single dwelling home with a garage. It appears the business being run from this property is not a "home business". There are either multiple vans for servicing the business and/or cars for the service personnel at the residence twenty-four hours a day. This is not appropriate for a single-family dwelling. The number of vehicles parked exceeds a reasonable or average level for a single dwelling home. Those vans and cars .are not housed so they become an ongoing eye sore for e neighbors. Additionally, it is a hazard to have the vehicles parked on the side of the street as they block the right turn lane that should remain accessible to cars turning onto County Road E2. While the inconveniences and hazards of the high number of parked vehicles are not appropriate for a single-family dwelling, movement of the many business vehicles is even more problematic. There already has been an incident of a vehicle backing into a car parked on the other side of the road. An added danger to regular traffic in the area is present daily as the vans leave for their work when the traffic flow on New Brighton Road is at one of its busiest times. Between the parked and moving vehicles, the corner has become a high congestion area. The most disheartening impact of this is that an increased risk now exists for children who play in the area and ride their bikes or walk to the public library. In a business area like the one on Cleveland Avenue, it might not be a problem to accommodate different zoning, However, in this case, it would perpetuate and possibly expand the safety risks and distractions now being endured by neighborhood residents, visitors, .and commuters. APPROVAL OF MINUTES FROM PLANNING COMMISSION MEETING HELD ON AUGUST 2. 2000 Commissioner Sand moved, seconded by Commissioner Duchenes, to approve the August 2, 2000 minutes. The motion carried unanimously (5-0). PLANNING CASE #00-31- HOOD FLEXIBLE PACKAGING -1887 GATEWAY BOULEVARD - PLANNED UNIT DEVELOPMENT AMENDMENT - PUBLIC HEARING Acting Chair Nelson opened the public hearing at 7:35 p.m. Staff explained that the applicant is requesting to amend the Planned Unit Development for 1887 Gateway Boulevard to allow the placement of a make-up air unit (-11' x 5 '9") and a chiller condenser (-1' x 5'6") in front of one of the business' existing loading doors. On July 14, 1997, the City Council approved Planning Case 97-06, PUD Master Plan and Final Plan (including variances), preliminary and final plat, and street vacation for the construction of three office/industrial buildings, currently addressed as 1787, 1887 and 1987 Gateway Boulevard. Hood Flexible Packaging came before the Planning Commission and City Council with Planning Case 00-17a to request the exterior addition of two exterior solvent tanks, a catalytic oxidizer and the expansion of one overhead door to accommodate these additions. This case was approved with the following conditions: 1. 2. 3. A minimum ofthree protective bollards be placed to protect the fence structure. The dock door closest to the oxidizer not be used once the oxidizer is in place. Solvent tank and oxidizer screening be cedar wood construction painted to match the building. No detectable odors from the printing process be present on the exterior of the building. tit Zoning Review 1. Make-up air unit. The proposed make-up air unit is required for the operation of Hood Flexible Packaging to bring warm air into the building in the wintertime to equalize airflow. A lot of air is exhausted out of the building and air must be returned to the building so that negative air pressure is not created. It would be difficult to open doors or efficiently dry printed materials without it. The unit would be located directly in front of one ofthe dock doors so the loading dock would no longer be utilized. 2. Chiller condenser. The chiller condenser is required to chill water that in turn cools down presses and machinery for the operation of the business. This would be placed to the south ofthe make-up air unit along the building. 3. Screening of Mechanical Equipment. Section VI, E, 4,j of the Zoning Ordinance requires that "Screening shall also be provided where mechanical operating equipment is located on the ground or on the roof of the premises. . . constructed and located to prevent direct view of the equipment". Screening types may be a fence, wall or landscaping area. It is the property owner's responsibility to provide screening, as required. The applicant is proposing that two types of mechanical equipment be located on the ground on this property. There is no screening plan provided with this application, but the applicant is .. willing to screen the units according to Planning Commission recommendation. Planning Case .. #00-17a required the same applicant at the same address to screen their proposed outdoor units with cedar wood construction, painted to match the exterior of the building. Ms. Chaput stated that staffrecommends approval of Planning Case #00-31, Planned Unit Development Amendment for 1887 Gateway Boulevard, for the addition of a make-up air unit and a chiller condenser, as shown in the applicant's submittal, with the following conditions: 1. Screening of the make-up air unit and chiller condenser must be constructed of cedar wood, painted to match the building. 2. Application for a Building Permit must be made, meeting all building/fire code regulations. Ms. Chaput stated that if the Planning Commission makes a recommendation on this Planning Case, it would be heard at the Monday, September 25, 2000, regular meeting of the City Council. Mike Hill, a representative of Hood Flexible Packaging, stated that he was available for questions from the Commission, along with Corporate Engineer John Bulich. Kelly Ortley, a representative of United Properties, stated the building's ownership is in agreement with the proposal. She added that United Properties requests, with regard to screening, that wire fencing with vinyl webbing be considered rather than cedar fencing, which is . more difficult to maintain. John Bulich, Hood Flexible Packaging, stated that a cedar fence of 14 feet in height would be required for the unit, adding that wire fencing would be more appropriate for a loading dock area. e e e ARDEN HILLS PLANNING COMMISSION - September 6, 2000 3 He noted that the building's ownership is not in favor of installing rooftop units and would prefer to install the units at the building's south side with appropriate screening. Acting Chair Nelson closed the public hearing at 7:44 p.m. Commissioner Galatowitsch asked whether the cedar fencing would be 17 feet bigh, which is the height ofthe unit as stated in staffs memo. Ms. Chaput stated that staffs proposal is consistent with what was approved in the previous case for the same applicant. Commissioner Galatowitsch asked what purpose screening serves. Ms. Chaput stated aesthetics are a consideration, and the City's Zoning Code states that mechanicals must be screened to prevent direct view from other properties. She added the screening can be a fence, wall or landscaping. Commissioner Galatowitsch expressed concern that the City is not being consistent in its requirements with regard to screening. Commissioner Sand asked whether cedar fencing was approved for the previous planning case. Ms. Chaput confirmed that cedar fencing was approved for the equipment pad under Planning Case 00-17 a. Commissioner Sand asked how the fencing would be constructed. Ms. Chaput stated the fence will enclose the unit on the equipment pad but will not touch the building. Commissioner Sand asked whether drawings had been submitted. Ms. Chaput stated that no screening plan was submitted. Commissioner Sand asked whether the photos submitted of the applicant's equipment in other locations were taken in a city where screening was not required. Mr. Hall stated the equipment in question is located at an industrial park in Rogers, Minnesota. Commissioner Sand stated the applicant's proposal is for a building located in an industrial park as well but screening will be required. Commissioner Sand asked how many buildings in the area have wire and vinyl fencing. Ms. Chaput stated she had not reviewed the area with that in mind. Commissioner Sand stated that a wire and vinyl fencing would look appropriate, and a tall cedar fence would be difficult to construct. He asked whether the Commission could take action on the previously approved case if the wire and vinyl fencing were approved. Ms. Chaput stated the previous action was approved by the Council. Acting Chair Nelson stated that he would wish screening to be opaque and to match the building. He added it is important to provide entire screening. Mr. Hall stated that vinyl webbing with a thicker weave can be installed. Commissioner Duchenes asked for the required height with regard to the cedar fences approved in the previous planning case. Ms. Chaput stated she couldn't recall the specific height. Mr. Hall stated that six-foot fences were planned. He added the oxidizer is twelve feet in height. ARDEN HILLS PLANNING COMMISSION - September 6, 2000 4 Acting Chair Nelson expressed concern that the fencing will not be the same height as the oxidizer. He added he would wish the screening requirements to be tightened for future enforcement. e Commissioner Galatowitsch expressed concern that four separate units could be screened in different ways. She stated she would wish all the units to be screened in a consistent manner. She added that since the Commission could not go back and make them consistent, it would be necessary to do whatever was done before to ensure consistency. Acting Chair Nelson asked whether the applicant might resubmit their proposal for the previous planning case if wire and vinyl fencing were approved in this case. Mr. Hall stated that would not be a problem. Acting Chair Nelson stated he was inquiring whether the applicant might consider resubmittal after approval is granted. Acting Chair Nelson asked whether screening was approved recently for the other buildings on site in the last few years. Ms. Chaput stated screening might have been included under Planning Case #97-06. Commissioner Sand stated the applicant can consider re-applying for approval to change the requirements for other on-site screening and ensure consistency. Mr. Bulich asked whether his company can operate the equipment before a final decision is made by the Council. Ms. Chaput stated it might be an issue for the building inspector as screening .- was a requirement of approval. Commissioner Sand stated the applicant can not legally operate ., the equipment until Council approval is granted as the planning case involves both placement and screening ofthe equipment. He added the Council meets September 25,2000. Commissioner Sand moved, seconded by Commissioner Duchenes, to recommend approval of Planning Case #00-31, PUD Amendment, 1887 Gateway Boulevard, for the addition of a make- up air unit and a chiller condenser, with the following conditions: 1. Screening ofthe make-up air unit and chiller condenser must be constructed of fencing of a height equal to the equipment being screened, and have opaque vinyl material of a color similar to the wall of the building, subject to approval by City staff. 2. This Planning Case will be reviewed at the Monday, September 25, 2000, City Council meeting. Acting Chair Nelson requested that Ms. Chaput review the previons planning case to determine whether the height of the required fencing was stipulated. He added that appropriate measures should be taken ifno height was specified. e ARDEN HILLS PLANNING COMMISSION - September 6, 2000 5 PLANNING CASE # 00-32 - MA PETERSON DESIGN BUILD - 1228 KARTH LAKE e DRIVE - VARIANCE FROM OHW SETBACK - PUBLIC HEARING Acting Chair Nelson opened the public hearing at 8:18 p.m. Staff explained that the applicant is requesting a variance from the ordinary high water mark setback ofKarth Lake (69 feet proposed, when 75 feet is required) for the removal of an existing screen porch and deck and the construction of a smaller screen porch with stairs and an addition to the single family home, zoned R-1. Background The proposed construction of the screen porch with stairs and addition to the home actually decreases the current area of the house by 162 square feet. The addition onto the house is an additional 229 square feet. However, the size of the deck and steps decreases by 172 square feet and the patio area decreases by 219 square feet. Overall, the construction reduces the footprint of the house. e The setback, determined by the DNR and adopted by the City, from the ordinary high water mark ofKarth Lake (934.95) is 75'. It appears that a number of homes along Karth Lake (see Exhibit B) are unable to meet this setback as they currently exist. Minnesota Rules 6120.3200 states that lakes classified as "general development" (Karth Lake) should have a structure setback of 75' from the ordinary high water level for unsewered lots and 50' for sewered lots. Current City code states the setback is 75' and, since this is the more restrictive of the two, this case must be evaluated according to this setback from the ordinary high water level. Staff would recommend that this be re-evaluated during discussions regarding potential Zoning Ordinance changes. Variance Findings In order to grant a variance, a hardship must be identified, as defined by the City and State criteria outlined above. The applicant has responded to the hardship criteria in a letter, as provided in Exhibit C. For this application for a variance from the ordinary high water mark of Karth Lake at 1228 Karth Lake Drive, staff can make the following findings: 1. Whether the circumstances for which the variance is requested are unique to the property. There are a number of properties along Karth Lake that face the same situation as this property owner. It appears that a number of the houses on the east side of the lake are, on average, no more than fifty feet back from the ordinary high water mark (an estimation made from data provided through CitySight, a GIS-based program), not meeting the current ordinance requirements. The circumstances relating to this particular property are, therefore, not unique. e 2. Whether granting the variance would be in keeping with the spirit and intent of the City's Zoning Code. The City's Zoning Code states as one of its intentions as, "To promote the character of and preserve and enhance the properties and areas within the City including wetlands, ponds and marshes". The setback requirements established by the Department of Natural Resources are enacted to preserve and protect the existing wetlands by not allowing development within a certain setback. Allowing for a variance from this would be contrary to the intent of the ordinance. ARDEN HILLS PLANNING COMMISSION - September 6, 2000 6 3. Whether the property in question can be put to a reasonable use without granting of a variance. e A single family home is currently constructed on the property. Therefore, the property in question has already been put to a reasonable use. There is only a small portion of the proposed addition that juts into the ordinary high water mark setback. It is possible to reconfigure that addition in some matter to avoid requiring a variance from the ordinance. It can not be said that without this variance, the property could not be put to a reasonable use. 4. Whether the hardship was created by the property owner. Although the shape ofthe lot and position of the house are not the fault of the current owner, the owner is proposing the addition within the setback area, creating the need for a variance. This could be avoided by reconfiguring the addition so that it was not within the required setback area. The need for this variance is being created by the property owner. 5. Whether granting the variance will alter the essential character of the neighborhood. Granting this variance will set a precedence for other properties along Karth Lake that are also nonconforming by the setback from the ordinary high water mark. This is contrary to the intent of the ordinance to allow nonconformities to continue to exist and be expanding without consideration for current ordinances. Again, staff would recommend that the ordinance be reviewed for this particular lake because of the current DNR rules which would positively impact all properties along Karth Lake in the future. Although granting this variance would not visually impact the character of the neighborhood a great deal, it does set a precedence for future applications. e Ms. Chaput stated that staff recommends that Planning Case #00-32, variance from the ordinary high water mark setback of Karth Lake (69 feet proposed, when 75 feet is required), be denied based on the following findings, as outlined in staffs memorandum, dated August 24,2000: 1. The circumstances of the request are not unique to this property in the Karth Lake area; 2. The application does not meet the spirit and intent of the City's Zoning Code to preserve and protect wetlands; 3. The property can be put to a reasonable use without this variance and the proposal could be reconfigured outside of the setback area; 4. The hardship is being created by the property owner by proposing an addition within the setback area; and 5. Granting the variance will set a precedence for variance approvals in the Karth Lake neighborhood according to the current ordinance. The City's ordinance for OHW setbacks according to DNR rules should be reviewed by staff for potential amendment in the future. Ms. Chaput stated that if the Planning Commission makes a recommendation on this Planning Case, then it would be heard at the Monday, September 25, 2000, regular meeting of the City Council. Ms. Chaput stated that the applicant was not present at the meeting. e Acting Chair Nelson closed the public hearing at 8:24 p.m. Commissioner Sand stated, in his opinion, the applicant is requesting a variance which will reduce the property's footprint rather than expanding it. He added it constitutes a reasonable use e e e ARDEN HILLS PLANNING COMMISSION - September 6, 2000 7 of the property, and does not violate the zoning code, which is currently under review. He noted that a number of properties on the east side of Karth Lake are similarly unique. He noted that a review ofthe zoning code around Karth Lake has been under discussion for some time. Commissioner Sand noted that precedence is always an issue, but added that the unique properties on Karth Lake will have to be dealt with on a case by case basis in any event. He added he would support the variance request. ???Commissioner Baker stated the lot's shape and location make it possible to avoid setting a precedence by having a finding that this particular lot has a unique and particular configuration which allows an exception. He added he lives near the lot in question, and residents on the lake support the proposal. He expressed concern that the lake quality is deteriorating and must be addressed at some point in the future. Commissioner Duchenes stated that the house addition does not appear to be extending further, if at all, into the setback than the existing deck. She added she would support the request. Commissioner Galatowitsch expressed agreement that the strange shape of the lot makes it unique. She added she would support the request. Commissioner Duchenes moved, seconded by Commissioner Sand, to recommend approval of Planning Case #-00-32, variance from the ordinary high water mark setback of Karth Lake (69 feet proposed when 75 feet is required), with the condition that the variance will terminate if the primary structure should be destroyed to the level that meets the building code threshold for being destroyed, based on the following findings: I. The overall lot coverage would be reduced. 2. The variance does not set a precedence due to the odd configuration of the parcel 3. The encroachment would be reduced into the setback from the existing encroachment. The motion carried unanimously (5-0). This Planning Case will be reviewed at the Monday, September 25, 2000, City Council meeting. PLANNING CASE # 00-33 - GAYLE GULSVIG - 3810 NEW BRIGHTON ROAD- SPECIAL USE PERMIT (CLASS II HOME OCCUPATION) - PUBLIC HEARING Acting Chair Nelson opened the public hearing at 8:37 p.m. Ms. Chaput explained that the applicant is requesting approval of a Special Use Permit (Class II Home Occupation) for the operation of her business, Always Wood Flooring, in her existing single-family home, located at 3810 New Brighton Road, zoned R-2. Earlier this year, staff received a few complaints regarding a business being operatcd out of a home at 3810 New Brighton Road. The situation was investigated and it was found that the home did not have approval for a home occupation (either Class I or Class II) at this location. The property owner was notified that she was out of compliance with the Zoning Ordinance and asked that she respond to staff with a plan for compliance. As a result of this action, the property owner has made application for a Class II Home Occupation. ARDEN HILLS PLM1NING COMMISSION - September 6, 2000 8 As stated in her letter, the property owner has been operating Always Wood Flooring at this location for almost three years. Prior to this, she was operating the same business in Shoreview e for seven years. The business furnishes materials for wood floors, installs and repairs, resands and finishes existing wood flooring and does maintenance coating for wood flooring. The business owns a total of six vehicles with a working crew of seven people plus one office person. Work is done off-site with the exception of a part-time office person who offices on-site. From tbe general requirements for all businesses, as stated in the Zoning Ordinance, the following can be detennined: 1. It shall not result in traffic, parking, noise, light, fumes and odors to such an extent that it is noticeable that the property is being used for non-residential purposes. Complaints have been taken on this property because it was obvious that a home business was operating on the premises by the number of vehicles /business vans parked in the front yard. This property does not meet this requirement because the business is noticeable. 2. It shall be conducted entirely within the dwelling. Work is conducted off site with the exception of office work that occurs in the living room area of the home. No part ofthis business operated outdoors on site. 3. There is no exterior evidence of the home occupation. There is exterior evidence of the occupation through the various vehicles on the property used for the business. This property doesn't meet this requirement. e 4. It does not require any special entrances to the dwelling. No special entrances or modifications to the house are required for this business. From the specific requirements for a Class II Home Occupation, as stated m the Zoning Ordinance, the following additional information can be determined: 1. The primary business activity shall be conducted by an occupant of the residence; The owner of the company does live on site. Therefore, the primary business activity IS conducted by an occupant of the residence. 2. One person not residing in the residence may be employed to assist in the business activity; More than one person not residing in the home is employed at this business. There is one part time office staff person in addition to a crew of seven who work off-site. Although it could be argued that the seven employees are not on-site at all during the day, they are still employed with the company and assist with the business activity. Plus, they do come to the home at a minimum of twice a day to pick up and return a work vehicle. 3. It does not occupy more than thirty-three (33 percent) of the floor area of the dwelling; According to the applicant's plans, the office portion of the house is approximately 23% which is less than the maximum required of33%. 4. It has a limited number of patrons visiting the premises; . The applicant has stated that it is rare for a customer to come to the home. It is presumed that there isn't traffic from this type of activity very often. e e e ARDEN HILLS PLANNING COMMISSION - September 6, 2000 9 5. Off-street parking for no more than two (2) additional vehicles than those required by the occupants shall be permitted; on-street parking shall not be used to satisfy required parking; There appears to be room for approximately five vehicles along side of the driveway on-site for workers. There is also area on the driveway and within the garage for vehicles. The pictures, as shown in Exhibits C and D, show that at least four vans sit, angle parked, off the driveway. The applicant also states that there are typically five vehicles parked in the driveway and two on the street. This exceeds the maximum permitted of two additional vehicles beyond those used for the residents of the dwelling. 6. It requires delivery of products to the premises no more than once per day. Deliveries of products to the resident do not exceed the frequency of no more than once per day. Always Wood Flooring has been in operation at this location for three years without the required approvals from the City. The applicant was unaware that this was a requirement and was not made aware of this until this past Spring. The applicant has worked to provide everything necessary to the City for the approval of this business and is open to any suggestions on how she could improve the current situation. However, the business, as it currently operates, does not meet the requirements of the Zoning Ordinance for a Class II Home Occupation. Ms. Chaput stated that staffrecommends that Planning Case #00-33, Special Use Permit (Class II Home Occupation) for the operation of a business (Always Wood Flooring) in a single-family home, located at 3810 New Brighton Road, be denied since the application is unable to meet the following minimum requirements of the Zoning Ordinance for a Class II Home Occupation: 1. It is noticeable that the property is being used for non-residential purposes due to the number of employee vehicles and work related vehicles on the site; 2. More than one person not residing in the residence is employed to assist in the business activity; and 3. The business in not permitted to have more than two vehicles on-site, in addition to those required by the residents, on a daily basis and this limitation is exceeded. Ms. Chaput stated that if the Planning Commission makes a recommendation on this Planning Case, it would be heard at the Monday, September 25, 2000, regular meeting of the City Council. Gayle Gulsvig, 3810 New Brighton Road, stated she is the owner of the home in question and invited the Commission's questions. She added she regularly talks to her neighbors, who have never had any objections to her business. Ms. Gulsvig stated she has tried not to offend anybody in her neighborhood. She added that she would consider an alternative parking location for her vehicles. She noted that she bought the home when she realized her business was expanding and she needed more space. Ms. Gulsvig stated she believed the location of her home was suitable as it is across from a library and a church which generate a lot of traffic. She added she would consider allowing an access to her property from County Road E2. Ms. Gulsvig stated that there are two people working in the home beside herself, and between them, they work approximately 40 hours per week. Acting Chair Nelson closed the public hearing at 8:54 p.m. ARDEN HILLS PLA~G COMMISSION - September 6, 2000 10 Commissioner Galatowitsch stated she is familiar with the property as she frequently drives by it. _ She added the applicant is incorrect in assuming that alternative parking is the solution. She .. expressed concern that the applicant is running a business in a residential neighborhood, Commissioner Galatowitsch expressed her surprise that the applicant has been unaware for so many years that City approval is required to run a business of such magnitude. She added, in her opinion, the resident's concerns which were expressed to City staff are well- founded. She noted she would not support the request. Commissioner Galatowitsch recommended that the applicant relocate her business to the proper zoning district. Commissioner Duchenes stated, in her opinion, the applicant is fortunate to have the problem of an expanding business with which to contend. She added the applicant's request falls outside of what is permissible in residential zoning. She noted it would be difficult for the Commission to act based on whether the applicant moved her vehicles to off-site parking. She added she would not support the request. Commissioner Baker expressed his agreement that the request should not be granted. He added the business is being run illegally, with vehicles parked illegally. He noted he would recommend the application be denied. Commissioner Sand stated the applicant is in violation of zoning requirements which are extensive. He added he would not support the request. He noted the applicant herself had stated e that she has expanded considerably and should find a business location. Acting Chair Nelson stated the application does not meet the requirements of the City's ordinance. He added he would not support the proposal. Commissioner Sand requested clarification with regard to cessation of operations if the request were to be denied by the Council. Ms. Chaput stated she would review the situation with the City Attorney prior to the Council's next meeting. Commissioner Galatowitsch moved, seconded by Commissioner Sand, to recommend denial of Planning Case #00-33, Special Use Permit (Class II Home Occupation) for the operation of a business, Always Wood Flooring, in a single family home, located at 3810 New Brighton Road, since the applicant is unable to meet the following minimum requirements of the Zoning Ordinance for a Class II Home Occupation: 1. TOM GOSERUD - 4350 HAMLINE A VENUE SOUTH - MINOR SUBDIVISION - CONCEPT DISCUSSION Ms. Chaput stated that Tom Goserud was in attendance to discuss a possible minor subdivision at his property, and receive the Commission's comments. Mr. Goserud stated he has begun gathering preliminary information with regard to subdividing his property, and added he hopes to put together a proposal incorporating the Commission's comments. He noted the preliminary plans were prepared with the assistance ofthe City's former planner. Acting Chair Nelson stated he lives near this property, adding he was unaware the lot was so large. He added that Mr. Goserud operates a plant business there. Commissioner Galatowitsch asked whether the business would close ifthe property were subdivided. Mr. Goserud confirmed this. Commissioner Baker stated, in his opinion, it would be most appropriate to acquire a vacant lot located on Amble Road as well as part of Mr. Goserud's neighbor's property and create an access off Amble Road to the property. Mr. Goserud stated the lot on Amble Road is unbuildable land designated for the Watershed District. Ms. Chaput stated she would not be in favor of supporting this lot division which would create properties with no public street frontage. She added this would affect future development in the area as well as have implications with regard to fire codes and public safety. Acting Chair Nelson stated that fire code would require a turnaround at the end of the driveway, which would take up a large portion of the third lot. Commissioner Galatowitsch expressed concern that such a lot division would set a precedence for other residents with large lots. She added she is also concerned with regard to creating lots which do not have public street access. She noted that Mr. Goserud presumably purchased his property as one parcel. Mr. Goserud stated he originally purchased four acres. He added that many homes in the Lake Josephine and Lake Johanna areas have shared driveways, and such precedence is already established. Commissioner Baker requested clarification Witll regard to the configuration of the proposed lots, and orientation of homes on the lots. Mr. Goserud stated the homes on the proposed lots would face each other. Commissioner Baker asked whether many existing trees would be lost during construction. Mr. Goserud stated the property is heavily wooded and would still be so after construction. Commissioner Sand stated that access through Mr. Aiken's property from Amble Road would be feasible in terms of long-range planning. He added this proposal would be dependent upon Mr. Aiken. Commissioner Baker stated that the loss of trees on such wooded property would not be without neighborhood controversy. ARDEN HILLS PLANNING COMMISSION - September 6, 2000 12 Mr. Goserud asked whether the Commission would favor a plan which proposed one newly created lot rather than two lots. Acting Chair Nelson stated a turnaround would still be . necessary. Commissioner Baker stated that a single newly created lot would still not have public street access. Commissioner Duchenes expressed concern that a single shared driveway would cause traffic problems for incoming and outgoing vehicles. Mr. Goserud stated the single drive would be wide enough for both incoming and outgoing vehicles. COUNCIL REPORT Councilmember Larson stated that the City Council, at its recent meeting, had an extensive discussion with regard to the Zoning Ordinance amendments. He added that some amendments were passed. He noted the Council had differing opinions with regard to the definition of Family, as well as the allowable number of cars parked in a driveway. He noted the Council hopes to discuss these items with the Commission at the next Council worksession. Councihnember Larson reviewed a special meeting which was held August 15, 2000, to discuss construction of the new City Hall facility. He stated that an agreement was reached between the City and the Department of the Army with regard to the Right of Entry to begin construction prior to transfer of title. He added that a contract with Roshon Corporation was approved, with a limit placed on the construction which could commence before transfer oftitle, including preparatory work, installation of utilities, and doing a median cut on Highway 96. He noted that the preliminary approved construction came to $360,000. e Commissioner Ga1atowitsch asked whether the Council was uncomfortable approving the contract before legal title was transferred. Councilmember Larson stated that after a lengthy discussion involving the City Attorney, it was decided that the contract must be awarded to avoid the possibility of running out of time and rebidding again. Councihnember Larson stated that the legal transfer and environmental work should be completed by the end of September. Commissioner Sand asked whether the agreement locked Roshon into the entire contract. Councihnember Larson stated the signed agreement is for the entire contract amount. He added that Roshon had some risk on their part in signing the agreement. Councihnember Larson reviewed the Council's August 21 worksession at which the Ingerson neighborhood plans were discussed, including City staffs findings as well as the neighborhood group's report. He stated the Council will discuss the reports at their September 11 meeting, after which staff will be directed to change the feasibility study to best reflect the findings on the issues. He noted it is a long but necessary process. Councilmember Larson reviewed the Council's August 28, 2000, meeting at which the planning case involving administrative approval for Gateway Boulevard properties was approved. He stated the Commission had recommended the increase of office space in 1887 Gateway a Boulevard to 25%. He added that staff did not feel comfortable with that decision and requested . that the same process be followed in each case. e e e ARDEN HILLS PLANNING COMMISSION - September 6, 2000 13 Commissioner Sand asked whether access to the City Hall facility will be available from Hamline Avenue as well as Highway 96. Counci1member Larson stated he is unsure, adding he has never seen a plan which indicated access from Hamline Avenue. Commissioner Sand stated that access from Hamline Avenue is important, adding that access only from Highway 96 could be difficult and dangerous. Commissioner Sand stated that it will be important to have access to the City's complex from Ham1ine Avenue in terms of long term planning. Councilmember Larson stated that Ramsey County has indicated they are reviewing possible locations for the public works facility other than Highway 96. Commissioner Sand asked who is the City's point person for the project. Councilmember Larson stated that Mayor Probst is involved in every aspect ofthe process, and City staff playa big role. He noted that Terry Post has been involved since the beginning. Commissioner Duchenes requested a timeline for completion. Councilmember Larson stated it is hoped that the facility will be open by the City's 50th anniversary celebration next year. He added that winter construction will be necessary. Commissioner Baker asked whether the 35W Corridor Coalition was handling the Highway 10/Highway 96 intersection review. Councilmember Larson stated that a firm had been retained to do a more detailed analysis of Highway 10. Commissioner Sand stated that park facilities in Tony Schmidt Park are being installed and look very nice. He added they will be an asset to the City. COMMISSION COMMENTS Acting Chair Nelson stated that the Commission is invited to attend the September 18, 2000, Council worksession, and should contact Jennifer Chaput. Acting Chair Nelson stated that the Commission's next meeting agenda should include the election of a new vice-chair.
