Staffhas reviewed the current fee schedule, and finds most fees to be appropriate, with several minor changes to the fee schedule currently used. Those changes are: VII. Utility Hook Up Charges . Fee for customer requested water meter accuracy testing as reflected by ordinance V. Parks and Recreation . Resident and Non-Resident fees for Ball Field Rental, Ice Rink Rental, Warminghouse Rental, Picnic Shelters, and Community Garden Plots . Dog/Cat License Change to biannual These fees are more in keeping with the actual cost of doing business. Recommendation Staff recommends the adoption of Resolution #01-05, establishing the fee schedule for 2001. . CITY OF ARDEN HILLS COUNTY OF RAMSEY STATE OF MINNESOTA RESOLUTION NO. 01-05 A RESOLUTION ESTABLISHING THE FEE SCHEDULE FOR 2001 WHEREAS, Section 13-24 of the Arden Hills City Code provides that permit/license fees be established from time to time by Resolution adopted by the City Council; and WHEREAS, the Council has expressed a desire to review the fee schedule on a regular basis; and WHEREAS, staff has completed a formal review of all fees charged by the City, and would recommend that the attached fee schedule for the year 200 I; NOW THEREFORE, BE IT RESOLVED by the City Council of the City of Arden Hills that the attached fee schedule be adopted: (See Attachment A) . BE IT FURTHER RESOLVED, that these fees shall become effective upon January 1,2001. PASSED AND ADOPTED BY THE CITY COUNCIL OF THE CITY OF ARDEN HILLS THIS 8th DAY OF JANUARY, 2001. Also present were Councilmember Gregg Larson and Planner Jennifer Chaput, City Attorney Joe Filla, and Recording Secretary Mary Mullen, APPROVAL OF MINUTES FROM PLANNING COMMISSION MEETING HELD ON NOVEMBER 1. 2000 Commissioner Sand moved, seconded by Commissioner Duchenes, to approve the November 1, 2000 minutes, The motion carried unanimously (5-0), PLANNING CASE #00-37 - THOMAS WHITTLES - FRONT YARD SETBACK VARIANCE -1867 GLEN PAUL AVENUE - PUBLIC HEARING Chair Erickson opened the public hearing at 7:37 p,m. Ms. Chaput explained that the applicant is requesting a front yard setback variance (35,5 feet proposed, when 40 feet is required) for a kitchen addition at 1867 Glen Paul Avenue, zoned R-2, Ms, Chaput stated that Mr. Whittles, the applicant, contacted the City for a building permit in August, 2000, to discuss an addition to the front of his home, She added that it was identified that he required a front yard setback variance, She noted that the City received his application on September 25, which was found incomplete because the request was unclear and the applicant did not address the five hardship criteria, Ms, Chaput stated that Mr. Whittles submitted a letter with his application request. She added that the applicant was notified that the application was still incomplete since the hardship criteria, as requested previously, was not addressed. She noted that Mr. Whittles submitted an additional letter, addressing the five hardship criteria. Ms, Chaput stated that Mr, Whittles came before the Planning Commission with Planning Case #98-19, variance for a side yard setback for a detached garage (four feet where ten feet was required). She added that the applicant informed her that a survey was not required for this Planning Case and, upon further review, found that a survey was not submitted, She noted that she discussed this issue with the Building Inspector who confirmed that he did not have a survey ARDEN HILLS PLANNING COMMISSION - DECEMBER 6, 2000 2 for this property on file. e Ms, Chaput stated that the Building Inspector is convinced that Mr, Whittles is aware of his property line locations so he has not required a survey from him for work completed in the past, She added that the Building Inspector has found that Mr. Whittles installed the foundation for this project already, without a building permit. She noted that the foundation was not installed to meet frost requirements and, if the variance is granted, will have to be re-done, Ms, Chaput stated that the central front portion ofMr. Whittles' home is currently situated 35.5 feet from the front yard setback. She added it is currently non-conforming because it does not meet the front yard setback requirement. She noted that the remainder of the home is 39,5 feet from the front yard setback. Ms. Chaput stated that Mr, Whittles wishes to build an addition onto his home from the 39.5 feet to be in line with the portion that is 35.5 feet from the property line, She added that the front yard setback for the B-2 zoning district is 40 feet. She noted that he requires a front yard setback vanance. Ms, Chaput identified the variance criteria for this case and reviewed the variance findings as defined by the variance criteria, She added that the applicant has responded to the hardship criteria in a letter. She noted that for this application for a front yard setback variance at 1867 Glen Paul Avenue, staff can make the following findings: ], Whether the circumstances for which the variance is requested are unique to the property, .. The properties along Glen Paul Avenue are, generally, between thirty-five and forty feet from .. the front yard setback, The current code requires that the houses be placed forty feet from the front property line, There are no plans to amend the language of the ordinance nor does the comprehensive plan forecast any future changes to this area, This location of the home, terrain or shape of the property is no different than its neighboring properties. Therefore, this request does not possess any unique circumstances. 2, Whether granting the variance would be in keeping with the spirit and intent of the City's Zoning Code, The intent of the zoning ordinance is to ". ..fix reasonable standards to which building, structures and land shall conform for the benefit of all". The zoning ordinance also states that a variance should only be granted if the configuration of the property prohibits reasonable development that may be permitted on a similar sized lot within the same district. This lot is no different from other lots in the district. There is no physical feature of this property that is prohibiting development so that it needs to occur within the setbacks. Any reasonable development that could be constructed on any lot in the district could also be duplicated on this lot according to the standards that have been set. Therefore, granting a variance for this application would not meet the spirit and intent of the zoning ordinance, 3, Whether the property in question can be put to a reasonable use without granting of a variance, A single family home is currently constructed on the property, Therefore, the property in . question has already been put to a reasonable use, The applicant is proposing to add on to the front of his home because of the interior layout and location of the kitchen, However, it is possible to reconfigure the addition in some matter to avoid requiring a variance from the . . . ARDEN HILLS PLANNING COMMISSION - DECEMBER 6, 2000 3 ordinance. It can not be said that without this variance, the property could not be put to a reasonable use. 4. Whether the hardship was created by the property owner. Although the shape of the lot and position of the house are not the fault of the current owner, the owner is proposing the addition within the setback area, creating the need for a variance, This could be avoided by reconfiguring the addition so that it was not within the required setback area, The need for this variance is being created by the property owner. 5, Whether granting the variance will alter the essential character of the neighborhood, The current structure is situated at 35,5 feet from the front yard line, Therefore, to expand the home by four feet to match this setback will not significantly alter the character of the neighborhood, However, it should be noted that the structure is currently nonconforming by building placement and, by ordinance, nonconforming structures should not be expanded, If this is not the intent of the City, then the ordinance should be amended. Ms, Chaput stated that staff recommends that Planning Case #00-37, front yard setback variance (35.5 feet proposed, when 40 feet is required) for the property located at 1867 Glen Paul Avenue, be denied for the following reasons: 1, The circumstances of the request are not unique to this property in the Glen Paul Avenue area or the R-2 zoning district; 2, By not meeting the provisions of the ordinance, the application does not meet the spirit and intent ofthe City's Zoning Code; 3. The property can be put to a reasonable use without this variance and the proposal could be reconfigured outside of the setback area; and 4, The hardship is being created by the property owner by proposing an addition within the setback area, Ms. Chaput stated that if the Planning Commission makes a recommendation on this Planning Case, then it would be heard at the Monday, January 8, 2001 regular meeting of the City Council. She added that the City Council does not hold a second meeting in December, 2000, and the sixty days will be extended an additional sixty days for this application due to the holiday time table, Commissioner Duchenes stated the staff memo noted that the proposed addition could be reconfigured, She asked whether there was sufficient space in the sideyard setback for such an expansion, Ms, Chaput stated she does not know the full dimensions of the property and was not suggesting any alternatives, She added that a variance was granted to the homeowner for a detached garage a few years ago, and there is a large backyard, Tom Whittles, 1867 Glen Paul Avenue, stated the home is 40 years old, noting the home was built before City ordinances were in place, He added that other residents on his street have such an addition on the front oftheir homes. Mr. Whittles stated his home is on a narrow lot with little room for expansion, He expressed frustration that the City might deny his request. He added, in his opinion, City staff have been unwilling to cooperate with him, ARDEN HILLS PLANNING COMMISSION - DECEMBER 6, 2000 4 Commissioner Sand stated the Commission has yet to render an opinion, and requested that the applicant show some deference to the Commission, e Mr. Whittles reiterated his frustration that City staff are recommending denial of the case, He added the proposed addition would not bring the home any closer to the front lot line. He noted he applied for a building permit before any work was done, Chair Erickson asked whether work was initiated before the building permit was approved. Mr. Whittles confirmed that the blocklayer whom he hired completed the work while Mr. Whittles was on vacation, Chair Erickson stated it appears the work which was done did not meet the necessary requirements, Mr. Whittles stated it was not his intention to do anything behind the City's back, Chair Erickson reiterated that work on the project commenced before the building permit was secured, He added there are two separate issues to be considered: the zoning issue, and the permit application, Chair Erickson asked what portion of the home was adjacent to the proposed addition. Mr. Whittles stated the addition projects off the existing kitchen at the front ofthe home, Chair Erickson asked whether there are records regarding other homes in the area with similar additions, Mr, Whittles stated the homes near him were built with the addition he is proposing already attached, Chair Erickson stated he is unaware of the setbacks on those homes. Mr. Whittle stated the addition will improve the home and give him more living space, e Chair Erickson closed the public hearing at 7:50 p.m. Chair Erickson recalled similar cases on which the Council had decided, where the primary issue was whether the proposed addition extended the nonconformity of the home in question, Ms, Chaput stated that staffs evaluation of the case is based upon the City's zoning ordinance and represents the strictest interpretation of State and City variance codes. She added these include the basic principle that non-conforming structures should not be expanded, Chair Erickson reiterated that the Commission has had previous discussions regarding homes with some degree of nonconformity, which minor additions did nothing to increase, Commissioner Sand recalled a case involving a request for a deck on a home on the north shore ofKarth Lake. Chair Erickson recalled a case involving a request for a front entryway on a home near Lake Josephine. He added that if the proposal does not increase the nonconformity, it can fall within the code. Ms. Chaput recommended that the Commission might wish to amend the City ordinance pertaining to setbacks as it becomes difficult to maintain a precedence. Commissioner Baker stated that in previous cases, the Commission required that the nonconformity would not be allowed to continue through additional construction if the improvements were destroyed, Commissioner Sand stated he is familiar with the house and neighborhood in question, He added the proposed addition would improve the home, He added that if the kitchen is located at the front of the house, it would not make sense to put the addition in the back of the house, He noted that might represent the hardship in this case. Ms, Chaput stated that hardship should be related to the physical characteristics ofthe property. e . . . ARDEN HILLS PLANNING COMMISSION - DECEMBER 6, 2000 5 Joe Filla, City Attorney, stated that hardship is defined as three elements: whether the property owner has reasonable use of the land unless the variance is granted; whether the variance will alter the character of the neighborhood; and unique circumstances of the property, He added these are subjective standards which will change with the collective makeup and judgment of the decision-making body, Mr, Filla stated is it necessary to decide whether the applicant can have a reasonable use of his property without encroaching on the setback. He added the community standard of what is reasonable can change over time, Chair Erickson stated he is inclined to support the request, as 2 of the 3 conditions described by Mr. Filla support it. He expressed concern with regard to the applicant's disregard ofthe building permit process, noting that will be corrected if the variance is granted and the work will be redone according to City Codes. Ms, Chaput agreed. Commissioner Nelson asked where the footings should have been laid. Mr. Whittles stated that City code requires a setback depth of 42 feet, and the footings were laid at 32 feet. Mr. Whittles stated he is taking the blocklayer to municipal court, Commissioner Duchenes stated that the house predates the City's zoning ordinance which creates a unique circumstance for the property as a whole. She added that if the house had been built after the zoning ordinances were in place, it would have been within setback requirements with room for expansion, She noted that the home has existed without an addition for many years, Commissioner Baker stated he has difficulty finding a hardship in this case. He added that no photos of the property were included in the memo, so it is difficult to envision the addition on the property. He expressed concern that the Commission would approve an addition with no idea of what it will look like, and how it will impact the neighborhood. Commissioner Sand stated he would support the request as the addition would not detract from the character of the neighborhood. He expressed concern with regard to the process used by the homeowner. He added he hopes the applicant has realized the Commissioners are reasonable and willing to listen, noting that a friendly attitude would improve the applicant's chances. Commissioner Sand expressed concern that residents often assume that the City government is unreasonable and unwilling to cooperate with homeowners, He added that homeowners should follow the City's guidelines for building permits and variances. Commissioner Sand moved, seconded by Commissioner Nelson, to recommend approval of Plarming Case #00-37, front yard setback variance (35,5 feet proposed when 40 feet is required), 1867 Glen Paul Avenue, for the following reasons: 1. 2. The variance is in keeping with the spirit and intent of the City's Zoning Code, A variance is necessary as the expansion of the kitchen is required at the front of the home where the kitchen is located. This Planning Case wil1 be reviewed at the Monday, January 8, 2001, City Council meeting, PLANNING CASE # 00-40 - MANUFACTURERS' SERVICES - PLANNED UNIT DEVELOPMENT AMENDMENT - 4300 WEST ROUND LAKE ROAD - PUBLIC HEARING Chair Erickson opened the public hearing at 8:16 p.m, Ms. Chaput explained that the applicant is requesting to amend the Planned Unit Development for 4300 West Round Lake Road for expansion of a trash compactor from eight yard compactor to a forty yard compactor, Ms. Chaput stated thatManufacturers' Services contacted the City regarding the expansion of their current compactor in October. She added that they have been located at 4300 West Round Lake Road since August, 1997, and since this time, they have grown significantly in staff and business, requiring the need for an expansion to their compactor. Ms, Chaput stated that the business currently uses an eight yard compactor and would like to expand it to forty yards. She added that the eight yard compactor was approved as part of Planning Case #96-12. She noted that the expanded compactor would al10w the business to operate more efficiently with a more cost effective way of disposing of solid waste. . Ms, Chaput stated, with regard to zoning requirements for screening of mechanical equipment, that Section VI, E, 4,j of the Zoning Ordinance requires that, "Screening shal1 also be provided where mechanical operating equipment is located on the ground or on the roof of the premises., ,constructed and located to prevent direct view of the equipment". She added that screening types may be a fence, wal1 or landscaping area. It is the property owner's responsibility to provide screening, as required, Ms, Chaput stated that the eight yard trash compactor is currently not screened, She added that it is situated outside a large screened area, holding liquid nitrogen tanks, She noted that the compactor is not currently enclosed because it is pul1ed five days a week for servicing and can not be accessed from within an enclosure, Ms, Chaput staled that the compactor is not visible from the road since it is screened by the adjacent enclosure, She added that since the proposed compactor is significantly larger than the existing compactor, the applicant has proposed a screening fence that juts out from the enclosure to solely screen the compactor from the road, She noted this would be one side of screening, not an enclosure. Ms. Chaput stated that the applicant proposes that it match the materials and height of the existing screening that is currently beside the compactor and extend for the length that the compactor surpasses the enclosure, She added the proposed forty yard compactor is an overall . length of26' plus the doghouse which is an additiona125', Ms. Chaput reviewed a site plan showing the phases of development in this area which demonstrates that the area where the compactor currently is situated and will be expanded within ARDEN HILLS PLANNING COMMISSION - DECEMBER 6, 2000 7 . does not affect parking or circulation in the parking area. She added there is plenty of room within the boundaries of the lot to accommodate the larger compactor. She reiterated that the proposed compactor is required for this business to operate efficiently, She noted there are no other zoning code requirements that require review for this application, Ms. Chaput stated that staff recommends approval of Planning Case #00-40, Planned Unit Development amendment for 4300 West Round Lake Road for the expansion of a trash compactor from eight yards to forty yards, with the following conditions: 1. Construction of a screening fence in the location shown on the applicant's plan of the same materials, opacity and height of the existing screened enclosure to the west of the existing compactor, screening liquid nitrogen tanks. 2, Application for a building permit must be made with the Building Inspector. Ms, Chaput stated that if the Planning Commission makes a recommendation on this Planning Case, then it would be heard at the Monday, January 8, 2001 regular meeting of the City Council. Commissioner Baker asked whether the applicant is proposing the relocation of the existing compactor. He added that Exhibit C-3/8 of the staff memo is a photo which depicts a small compactor located to the east of the nitrogen tanks, Suzanne Compton, a representative of Manufacturers' Services, stated that photo shows a dumpster which is used for wood skid recycling which is on-site permanently, She added the dumpster is emptied approximately once a month. Commissioner Sand asked whether that dumpster was included in the request. Ms. Chaput stated she was unaware of the presence of that particular dumpster. She added that she has brought such issues to the attention of United Properties, the property owner. Ms. Compton stated the wood skid dumpster is not a permanent fixture as it is taken away and emptied. She added that wood skids would clutter that area if the dumpster were not utilized, Ms, Chaput stated that she has met with Kelly Ortley, Property Manager for United Properties, about this and other dumpsters. She added Ms, Ortley is concerned with screening requirements for the dumpsters on this site, She noted this issue could be brought to Ms, Ortley's attention, Ms. Compton stated that her company has grown in recent years and has found its current compactor to be insufficient. She added that a bigger compactor would be installed in the same location as the current compactor, Chair Erickson stated the proposal is reasonable, He added the applicant is willing to extend the fence which is unusually tall. Ms, Compton stated the fence is 20 feet tall to cover the heights of the tanks, . Chair Erickson stated this case reiterates the Commission's concern with the lack of sufficient screening at this location. He added the Commission has brought this concern to United Properties in conjunction with previous planning cases. He noted he would favor wingwalls which would screen the entire area from the road. ARDEN HILLS PLANNING COMMISSION - DECEMBER 6, 2000 8 Chair Erickson requested that Ms, Chaput encourage United Properties to consider wingwalls in A her discussions with them, He added that another issue has arisen with this case which will .. require some discussion between the City and the applicant, which is the semi-permanent dumpster on the site which is apparently necessary for the business, He noted that some creative definition for this fixture is necessary as it does not technically require screening. Ms, Chaput stated that Ms. Ortley has indicated that screening would be the responsibility of the management company. She added there were specifications in original PUD for screening, and Ms, Ortley was unsure how to approach the various individual enclosures, Commissioner Baker stated he would support this request. He added it is the first application of its kind to the Commission that has incorporated a screening design into its specifications, He expressed his appreciation of the applicant's efforts, He noted the City should find a more comprehensive solution to this issue. Commissioner Baker asked whether the 20 foot fence was the applicant's suggestion, Ms. Compton confirmed that her company believes that a consistent line would look better. The Commission agreed. Ms. Compton stated that the fence could not be constructed until warmer weather because cement could not be poured, She asked whether screening could be constructed in the spring, Dave Scherbel, Building Inspector, stated that such Spring projects are usually given a deadline A oOune 1. Commissioner Sand requested that a deadline oOune 1 be added as a condition of .. approval. Commissioner Baker moved, seconded by Commissioner Duchenes, to recommend approval of Planning Case 00-40, Planned Unit Development amendment for 4300 West Round Lake Road for the expansion of a trash compactor from eight yards to forty yards, with the following conditions: 1. Construction of a screening fence in the location shown on the applicant's plan of the same materials, opacity and height of the existing screened enclosure to the west oflhe existing compactor, screening liquid nitrogen tanks. 2, Application for a building permit must be made with the Building Inspector. 3, Installation of screening at a time agreeable with City staff when weather and soil conditions are suitable, no later than June 1,2001. She stated it would be necessary for a public hearing to be a matter of public record, e ARDEN HILLS PLANNING COMMISSION - DECEMBER 6, 2000 9 Chair Erickson opened the public hearing at 8:39 p,m, There were no comments on this case, . He closed the public hearing at 8:40 p.m. Commissioner Sand stated he was disappointed as he had wished to commend the applicant on their signage proposal and site plan, Ms, Chaput stated the property has a new owner who may wish to review the site plan which may be presented again at a future date, PLANNING CASE # 00-41 - CITY OF ARDEN HILLS - ZONING ORDINANCE AMENDMENT (NB DISTRICT LANGUAGE) SECTION 5 (E) AND (m #3 - PUBLIC HEARING Chair Erickson opened the public hearing at 8:41 p.m. Ms, Chaput explained that the City of Arden Hills requests that Section 5 (E) and (H) #3 of the Zoning Ordinance #291 be amended to allow multiple family dwelling units in the neighborhood business district, with restrictions, . Ms. Chaput stated that on September 27, 1999 (Planning Case #99-04), the language for a new zoning district, the neighborhood business district, was adopted by the City Council and inserted into the City's Zoning Ordinance, She added that while reviewing the proposed rezoning for seven groups of properties for this district at the November 1,2000 meeting (Planning Case #00- 38), the Planning Commission recognized that the neighborhood business district language did not permit any types of dwelling units. She noted that the Planning Commission directed staff to propose an ordinance amendment for the December meeting, addressing this issue. Ms, Chaput stated that this issue was also raised at the November 27,2000 City Council meeting. She added the City Council unanimously approved the change in zoning of the seven groups of properties to neighborhood business, as recommended by the Planning Commission. She noted that there was some concern about the limitations of the district language since dwelling units are not permitted. Staff informed the City Council that the Planning Commission would be reviewing this issue at the December 6, 2000 meeting. Ms, Chaput stated that the Zoning Ordinance lists a number of different dwelling types that are permitted in various districts of the City, She added the purpose of the neighborhood business district is to promote pedestrian fiiendly, mixed-use environments, similar to the popular planning concept of new urbanism. She noted this type of district should encourage live/work environments within it. Ms, Chaput stated that multiple family dwelling units are typically the more appropriate dwelling type to locate above a business in a district such as this. She added that since this is a business district, some restrictions should be placed on permitting dwelling units as a sole use on a property. She noted, as an example, that dwelling units should be mixed with a business use to ensure that the use continues to meet the intent of the district and the City's Comprehensive Plan. e Ms. Chaput stated that the neighborhood business district does not currently permit any types of dwelling units, She added that all of the dwelling unit types and their corresponding district regulations are shown in the "Dwelling" section of the Land Use Chart, Section 5 (E), of the Staff memo, She noted that staff proposes that "Multiple Family" dwellings be allowed in the neighborhood business district through a special use permit. ARDEN HILLS PLANNING COMMISSION - DECEMBER 6, 2000 10 Ms, Chaput stated that by making this use a special use in the district, an additional restriction can be placed on it to ensure that dwelling units can not be the sole use on the property, as proposed in Section 5 (H) #3, She reviewed proposed changes to Section 5 (H) #3, Special Regulations for Special Uses in the NB District. e Ms, Chaput stated that staffrecommends approval of Planning Case #00-41, amending Section 5 (E) and (H) #3 of the Zoning Ordinance #291 as presented in the "Proposed Amendments" section ofthis memorandum, Ms. Chaput stated that if the Planning Commission makes a recommendation on this Planning Case, then it would be heard at the Monday, December 11, 2000 regular meeting of the City Council. Chair Erickson closed the public hearing at 8:45 p,m, Chair Erickson asked whether the amendment should limit dwelling units to locations above street level, which is restricting, He added that special use allows some provisions, He noted that the uses could be associated or mixed with each other. Ms, Chaput agreed, adding that as long as the uses are mixed in some respect, it is not necessary to regulate where they are located. Commissioner Baker asked whether the amendments allow enough latitude to approve or disapprove specific applications which incorporate too much or not enough residential use, Ms, Chaput stated that parameters must be set for certain uses in terms of percentages, Commissioner Baker stated that sites are too varied for such specific parameters. Ms, Chaput agreed, e Commissioner Sand asked for clarification with regard to the definitions of multiple family and mixed residential. Ms, Chaput stated that mixed residential refers to single or two-family residences in R-3 and R-4 districts, Ms. Chaput stated that mixed residential use is only allowed in specific districts through the PUD process, She added that it does not specifically refer to multi-family use, Commissioner Sand asked whether mixed residential use might be considered a special use within the New Business District. Ms, Chaput stated that it would not be considered a single family home in the NB District as it would not be a free-standing dwelling. Commissioner Baker asked whether this might include townhomes. Chair Erickson stated it would be unlikely that a commercial business would have townhomes attached to it. Commissioner Baker stated that there might be different components, adding it would give the Commission some flexibility regarding these sites. Commissioner Nelson asked whether mixed residential use could be more than just single family use but something other than multiple family use, Commissioner Sand stated that multiple dwelling and multiple family are two different things, Ms, Chaput stated the Commission conld consider allowing one business with one dwelling unit attached to it. . Commissioner Baker stated that multiple family use can include ownership of three or more dwelling units, He added that would provide sufficient flexibility, Ms, Chaput stated that . e e ARDEN HILLS PLANNING COMMISSION - DECEMBER 6, 2000 11 different types of housing units were included in the category of Dwelling in the Ordinance Land Use Chart. Ms. Chaput stated that Section 5 (H) 5b of the Ordinance pertaining to buffer yards requires 30 feet in width adjacent to all residential uses, Ms, Chaput stated the amendments were scheduled for review by the Council at their December 11 meeting, prior to a pending case in February 2001. She added the Commission could take some time to review the issue, Commissioner Baker stated the Council had indicated a priority in getting this resolved, adding he would like to complete the NB District language amendments. Commissioner Sand stated that multiple family uses should not be limited, and the regulations should be as flexible as possible, Ms. Chaput stated that "outside the Neighborhood Business District" should be added where the ordinance refers to adjacent residential uses, Ms, Chaput stated she would review the amendments and insert additional language. She added she would bring the issue to the next Planning Commission meeting, She noted she would provide a definition for single family dwelling. Commissioner Sand moved, seconded by Commissioner Baker, to table Planning Case #00-41, Zoning Ordinance Amendment Section 5 (E), Land Use Chart and (H) #3, Special Requirements for the Neighborhood Business District. The motion carried unanimously (5-0). NEW BUSINESS A. Appeal of Building Inspector's Decision to Deny Permit (Vaugban Tower) Ms, Chaput explained that Dave Scherbel, City Building Official, denied a building permit application for the construction of a new antenna tower at 1777 Gateway Boulevard. She added the decision is being appealed by Mr. Vaughan, the property owner at 1777 Gateway Boulevard. She noted that staff requests that the Commission review the information and make a recommendation to deny or approve the appeal. Chair Erickson asked whether there are any other buildings on the property besides the tower, the height of which seems clear, Mr, Scherbel stated there is an equipment structure which is 20' x 20'. Chair Erickson asked whether the current tower is operational. Mr. Scherbel confirmed this, adding there are questions as to the safety of the tower. He added that the building permit submitted for construction of a new tower could not be granted due to new zoning regulations, He noted the permit could not be granted based on the City ordinance as it is currently written, Mr. Scherbel stated that the existing tower can not be modified, and additional bracing will add weight and surface area to the tower which would compound the problem. He added that the owner is unwilling to reduce the height of the current tower because many of the tower's users require a certain height for their transmissions, ARDEN HILLS PLANNING COMMISSION - DECEMBER 6, 2000 12 Mr, Filla stated that the existing tower was constructed in 1980 under a conditional use permit. He added there is disagreement between the City and the property owner with regard to the number of antenna on the tower. He noted the tower has continued to exist under the 1980 permit in that zone, . Mr. Filla stated that the City adopted Gateway Business District regulations in 1990. He added the tower continued to be a conditional use in the Gateway zone, He noted the property was rezoned from Limited Industrial or Residential to Gateway Business, Mr. Filla stated that the City adopted an ordinance which changed regulations in the Gateway zone in 1993. He added that towers such as the one in question were not allowed except as an accessory use, and the height limitation was reduced to 75 feet. He noted that the Vaughan tower became nonconforming at that point, and could not be expanded, Mr, Filla stated that a series of requests for additions to the tower caused Mr. Scherbel to review the tower and its history, concluding that the tower was not constructed according to State regulations and had many attachments never authorized by the City, He added the weight of additions to the tower appears to have caused stress to tower components and as a result is no longer safe, He noted the term "unsafe" is consistent with State building code regulations, Mr. Filla stated that upon Mr. Vaughan's request to build a new tower, Mr. Scherbel concluded that a new tower would not be allowed in the zone, He added the Commission must decide whether Mr, Scherbel acted properly given current City regulations. Commissioner Sand stated the Commission has never faced such an issue before, He asked whether it was within the Commission's jurisdiction, Mr, Filla stated the City has a process wherein properly owners who are dissatisfied with administrative decisions can appeal to the Commission for a recommendation. e John Bannigan, attorney for Mr. Vaughan, stated that this is an extremely unique matter. He added that equity lies with Mr. Vaughan, who applied to the City for his special use permit for the tower in 1981. He noted the use was appropriate and legal at the time, Mr. Bannigan stated that Mr. Vaughan had retained the services of a planner to review the existing City codes which do not permit the existence of a 700-foot tower. He added the planner recommended a PUD request. He noted the building inspector, Mr. Scherbel, had done what he is required by law to do, Mr. Bannigan requested that the Commission table the matter to allow his client to present the issue to the City Council for review. He added that is where the case properly lies, He noted the current property use is appropriate for the community and represents effective land use practice, Dan Vaughan, owner of 1777 Gateway Boulevard, stated he has always attempted to cooperate with residents near his property, He added he has always been willing to correct and resolve problems and work with the City on such issues. He noted the tower serves the entire metro area daily, both for business communication and personal use, . Mr. Filla stated that Mr. Vaughan is an open person who has taken the initiative to do some investigation. He recommended that the Commission act on this issue, He added that regulation changes could be initiated by the Council and come before the Commission at a public hearing. e e . ARDEN HILLS PLANNING COMMISSION - DECEMBER 6, 2000 13 Mr. Filla recommended that the Commission find that the Building Inspector acted properly in denying Mr. Vaughan's application for a building permit. Chair Erickson stated that he believes Mr. Scherbel appropriately denied the application. He agreed this denial should be moved to the City Council. He noted the Council could recommend further action from the Commission if required, Commissioner Duchenes asked what the consequence would be of upholding the decision if the applicant should decide to resubmit through the PUD process, Ms. Chaput stated there is no time limitation on the building permit application. Commissioner Sand expressed his agreement with the Building Inspector's actions. Commissioner Sand moved, seconded by Commissioner Baker, to deny Dan Vaughan's appeal of the Building Official's denial of a building permit application for the construction of a new antenna tower at 1777 Gateway Boulevard, based on the following findings: 1. Application was made by Mr. Dan Vaughan to build a new 700 foot tower on property he currently owns north ofI-694 in the Gateway Business District. The proposed tower would exceed 75 feet in height and would serve as principal rather than accessory use on the property, Building Official Dave Scherbel denied the application based on his interpretation of Ordinance 291-Sec.VI-3a, 291-Sec, VI-2 and 291-Sec, XI-A,1. Based on presentations by the applicant, Building Official and City Attorney, it is undisputed that the actions taken by Mr. Scherbel were proper and he correctly interpreted the ordinance provision, Denial of the application was appropriate, and the Commission recommends to the Council that the denial be affirmed, 2, 3, 4, The motion carried unanimously (5-0), OLD BUSINESS PLANNING CASE # 00-39 - CITY OF ARDEN HILLS -RIGHT OF WAY ORDINANCE (2ND REVIEw) Ms. Chaput stated that the model ordinance was drafted by engineering experts. She added that the Commission could defer approval of the document to the Council as it is not specifically a planning or zoning issue, Commissioner Sand moved, seconded by Commissioner Baker, to defer Planning Case #00-39, Right of Way Ordinance review, to the City Council for their review and subsequent action. The motion carried unanimously (5-0), The Commission expressed its appreciation of the City Engineer's comments on the model ordinance, and thanked him for reviewing the document. ARDEN HILLS PLANNING COMMISSION - DECEMBER 6, 2000 14 REPORTS a. Council Liaison e Councilmember Larson reviewed the Council's recent meeting at which zoning code amendments were approved. He added the Council approved the amendment of the zoning code map to include the newly created Neighborhood Business District. He noted the Lindimer family member representing Lindy's Restaurant was present at the Council meeting and presented a letter which was discussed during the Commission's review of the issue. Councilmember Larson stated a resolution was approved committing the City to adoption of an erosion and sediment control ordinance which is a Met Council requirement for completion of comprehensive planning. He added that a resolution was approved to complete and adopt a storm water management plan again, He noted it must be consistent with the Rice Creek Watershed District's current plans. Councilmember Larson stated the Council interviewed 8 applicants for the current Planning Commission vacancy as well as the upcoming vacancy, He added that a lot of good candidates applied, and an announcement is forthcoming. Commissioner Sand asked whether the City had received title to the City Hall property. Councilmember Larson stated title has not been received, although City staff is working hard on obtaining it, and the Corps of Engineers has suggested that some changes are being made to the agreement. e B. Planning Commissioners Chair Erickson asked, with regard to the Vaughan Tower denial, whether the property owner could propose a PUD amendment to justify his construction of his tower. Ms. Chaput stated the owner would be justifYing his tower by what he plans to construct underneath it. She added she is sure the issue will be back in the future. Commissioner Sand asked, with regard to an item in Ms, Chaput's Commission update memo, whether the City has a sign ordinance, Ms, Chaput stated the Council wanted to make the Commission aware of this issue, although it will be going straight to the Council due to urgency attached to it. Commissioner Sand stated he recalled banners being used when he served on the Parks Commission, Ms, Chaput stated banners are currently nonconforming based on an ordinance adopted in 1983. She added banners are clearly prohibited. Chair Erickson requested that a copy ofthe upcoming erosion control plan be forwarded to Marty Rye, since it was an issue he championed for many years. Commissioner Sand asked whether the County is considering moving its maintenance facility to the northwest corner of the Arsenal property away from the City hall facility, Councilmember .- Larson stated the County is still considering the current site, although they do not have title to the _ property. \ e e . ARDEN HILLS PLANNING COMMISSION - DECEMBER 6, 2000 15 Commissioner Sand stated the City should meet with the new Congressperson to ensure that she is aware of the history ofthe Arsenal property and the work of Bruce Vento. Councilmember Larson stated that there is no opposition, although large agencies are bureaucratic and slow. Chair Erickson asked whether the renumbering of the Zoning Ordinance was complete, Ms. Chaput stated the ordinance has been amended frequently, but copies are ready and will be sent to the Commissioners before the end of the month, C. Staff Ms, Chaput stated that two planning proposals are scheduled for January: a proposal from Walgreen's for a drive-thru, which are not allowed within a certain distance ofan existing drive- thru, and a 5-story office building at 1-694 and I-35W, She added the City ordinance does not allow 5-story structures. Commissioner Baker stated the property will need to be rezoned. Commissioner Sand stated consistent lighting requirements should be made along the visible front of the business park. Chair Erickson stated that the 35-foot height limit for buildings was created in 1990 and was extremely shortsighted. Councilmember Larson stated the language states 35 feet but calls for the encouragement of multi-story buildings to be regulated as it affects the safety of occupants, Commissioner Duchenes asked whether the City's zoning regulations are available on a website, Ms, Chaput stated the web site task force will meet next week and provide recommendations to the Council at its first January meeting, She added the task force will review structure and content of the web site. ADJOURNMENT Commissioner Baker moved, seconded by Commissioner Sand, to adjourn the meeting at 10:19 p,m, The motion carried unanimously (5-0), l- e e e CITY OF ARDEN HILLS MEMORANDUM DATE: December 8, 2000 TO: Mayor and City Council Jennifer Chaput, City Planner ~ Case #00-37, Front Yard Setback Variance Thomas Wbittles, 1867 Glen Paul Avenue FROM: SUBJECT: Reouest The applicant is requesting a front yard setback variance (35.5 feet proposed, when 40 feet is required) for a kitchen addition at 1867 Glen Paul Avenue, zoned R-2 (Exhibit A), Backl!:round Mr. Whittles contacted the City for a building permit in August 2000, to discuss an addition to the front of his home, At this time, it was identified that he required a front yard setback variance. The City received his application on September 25, which was found incomplete because the request was unclear and the applicant did not address the five hardship criteria, In response to my letter that his application was incomplete, Mr. Whittles submitted a letter with his application request (Exhibit B), At this time, the applicant was notified that the application was still incomplete since the hardship criteria, as requested previously, was not addressed, Mr. Whittles submitted an additional letter (Exhibit C), addressing the five hardship criteria, Mr. Whittles came before the Planning Commission with Planning Case #98-19, variance for a side yard setback for a detached garage (four feet where ten feet was required). The applicant informed me that a survey was not required for this Planning Case and, upon further review, found that a survey was not submitted, I discussed this issue with the Building Inspector who confirmed that he did not have a survey for this property on file, However, the Building Inspector is convinced that Mr, Whittles is aware of his property line locations so has not required a survey from him for work completed in the, past. For your information, the Building Inspector has found that Mr. Whittles installed the foundation for this project already, without a building permit. Plus, the foundation was not installed to meet frost requirements and, if the variance is granted, will have to be re-done, Currently, the central front portion ofMr, Whittles' home is situated 35,5 feet from the front yard setback. It is currently non-conforming because it does not meet the front yard setback requirement. The remainder of the home is 39,5 feet from the front yard setback. Mr. Whittles wishes to build an addition onto his home from the 39.5 feet to be in line with the portion that is 35,5 feet from the property line. The front yard setback for the B-2 zoning district is 40 feet. Therefore, he requires a front yard setback variance, Variance Findiul!:s In order to grant a variance, a hardship must be identified, as defined by the City and State criteria. The applicant has responded to the hardship criteria in a letter, as provided in Exhibit C. For this application for a, front yard setback variance at 1867 Glen Paul Avenue, staff made the following A findings: ,., 1. Whether the circumstances for which the variance is requested are unique to the property, The properties along Glen Paul Avenue are, generally, between thirty-five and forty feet from the front yard setback (Exhibit D), The current code requires that the houses be placed forty feet from the front property line, There are no plans to amend the language of the ordinance nor does the comprehensive plan forecast any future changes to this area. This location of the home, terrain or shape of the property is no different than its neighboring properties, Therefore, this request does not possess any unique circumstances. 2, Whether granting the variance would be in keeping with the spirit and intent of the City's Zoning Code, The intent ofthe zoning ordinance is to ",. .fix reasonable standards to which building, structures and land shall conform for the benefit of all", The zoning ordinance also states that a variance should only be granted if the configuration of the property prohibits reasonable development that may be perniitted on a similar sized lot within the same district. This lot is no different from other lots in the district. There is no physical feature of this property that is prohibiting development so that it needs to occur within the setbacks. Any reasonable development that could be constructed on any lot in the district could also be duplicated on this lot according to the standards 'that have been set. Therefore, granting a variance for this application would not meet the spirit and intent of the zoning ordinance. ], Whether the property in question can be put to a reasonable use without granting of a variance, e A single family home is currently constructed on the property. Therefore, the property in question has already been put to a reasonable use. The applicant is proposing to add on to the front of his home because of the interior layout and location of the kitchen, However, it is possible to reconfigure the addition in some manner to avoid requiring a variance from the ordinance, It can not be said that without this variance, the property could not be put to a reasonable use. 4, Whether the hardship was created by the property owner, Although the shape of the lot and position of the house are not the fault of the current owner, the owner is proposing the addition within the setback area, creating the need for a variance, This could be avoided by reconfiguring the addition so that it was not within the required setback area, The need for this variance is being created by the property owner. 5, Whether granting the variance will alter the essential character of the neighborhood. The current structure is situated at 35,5 feet from the front yard line, Therefore, to expand the home by foUr feet to match this setback will not significantly alter the character of the neighborhood, However, it should be noted that the structure is currently nonconforming by building placement and, by ordinance, nonconfonning structures should not be expanded, Ifthis is not the intent of the City, then the ordinance should be amended. e 2 e . e Deadline for Al!encv Actions The City of Arden Hills received the completed application for this request on November 8, 2000, Pursuant to Minnesota State Statute, the City must act on this request by January 7,2001 (60 days), unless the City provides the petitioner with written reasons for an additional 60-day review period, A letter of extension was sent to the applicant on December 18, 2000, extending the review date for this application to:February 16, 200 I, due to the cancellation ofthe second City Council meeting in December. The property can be put to a reasonable use without this variance and the proposal could be reconfigured outside of the setback area; and 4, The hardship is being created by the property owner by proposing an addition within the setback area. Plannine Commission Recommendation The Planning Commission recommends approval of Planning Case #00-37, front yard setback variance (35.5 feet proposed where 40 feet is required) for a kitchen addition, for the following reasons: 1, The hardship was not created by the property owner since the home existed before the Ordinance was adopted; and 2, The granting of the variance will not alter the character of the neighborhood; and 3. Back!!round Manufacturers' Services contacted the City regarding the expansion of their current compactor in October. They have been located at 4300 West Round Lake Road since August 1997, as stated in their letter (Exhibit B). Since this time, they have grown significantly in staff and business, requiring the need for an expansion to their compactor. Currently, the business uses an eight-yard compactor, approved as part of Planning Case #96-12. The expanded forty-yard compactor would allow the business to operate more efficiently with a more cost-effective way of disposing of solid waste. The City has reviewed the following requests for this property: Plannin!! Review Screening of Mechanical Equipment. Section VI, E, 4, j of the Zoning Ordinance requires that, "Screening shall also be provided where mechanical operating equipment is located on the ground or on the roof of the premises.. . constructed and located to prevent direct view of the equipment". Screening types may be a fence, wall or landscaping area. It is the property owner's responsibility to provide screening, as required. Currently, the eight-yard trash compactor is not screened. It is situated outside a large screened area, holding liquid nitrogen tanks, as shown in the pictures in Exhibit C. The compactor is not currently enclosed because it is pulled five days a week for servicing and can not be accessed from within an enclosure. Also, it is not visible from the road since it is screened by the adjacent enclosure. Since the proposed compactor is significantly larger than the existing compactor, the applicant has proposed a screening fence that juts out from the enclosure to solely screen the compactor from the road. This would be one side of screening, not an enclosure. The applicant proposes that it match the materials and height of... the existing screening that is currently beside the compactor and extend for the length that the compactor 'W surpasses the enclosure. The proposed forty-yard compactor is an overall length of 26' plus the doghouse, which is an additional 5' (shown in Exhibit D). A site plan showing the phases of development in this area is provided for in Exhibit E. This shows that the area where the compactor currently is situated and will be expanded within does not affect parking or circulation in the parking area. There is plenty of room within the boundaries of the lot to accommodate the larger compactor. As stated previously, the proposed compactor is required for this business to operate efficiently. There are no other zoning code requirements that require review for this application. Deadline for Al:encv Actions The City of Arden Hills received the complete application for this request on November 7,2000. Pursuant to Minnesota State Statute, the City must act on this request by January 6, 2001 (60 days), unless the City provides the petitioner with written reasons for an additional 60-day review period. A letter of extension was sent to the applicant on December 18, 2000, extending the review date for this application to February 15,2001, due to the cancellation of the second City Council meeting in December. Construct a screening fence in the location shown on the applicant's plan of the same materials, opacity and height of the existing screened enclosure to the west of the existing compactor, screening liquid nitrogen tanks; and 2. Application for a building permit must be made with the Building Inspector; and 3. The compactor may be installed immediately on the condition that the screening will be in place by no later than June 1,2001. UDdates While reviewing this case, the Planning Commission expressed some dissatisfaction with an existing dumpster on the property, shown clearly in the pictures provided on the west side of the nitrogen tank enclosure. The compactor's overall length is 26' plus the doghouse, This would extend approximately an additional 25', We also have a fenced in area (next to our compactor) that measures 15.5' long x 33' wide. This area is screening liquid nitrogen tanks. If the trees do not provide a sufficient screen, we will add additional fencing along side the compactor to block the view from the road, It is very important for us to make these changes to our business. By replacing the current compactor: we will be able operate more efficiently, provide a closed box when the box needs to be pulled Oess trash will blow out), box will need to be pulled bi-monthly, and it is a more cost-effective way of disposing of solid waste. MCES will reimburse the City for $5800.00 of the $184,700,00 for the installation of a new flow monitoring meter to this slation, The remaining $178.900.00 is approximately S% greater than the Engineer's estimate of $170,000,00 (budget $175,000,00) for this portion of the projcCI. Considering the other two bids, the Engineer feels that this bid is represenlative of the current market value of the improvement and the City would not likely see a significant savings by rebidding the work, The sanitaIy sewer testing and sealing and trenchless spot repair of this project is was 17% more than the Engineer's estimate and budget of $100,000.00, The approximately 17% difference between the Engineer's estimate and the actual bid price can be attributed to a joint test prices which lire considerably higher than prices previously paid for similar work, Considering the two other bids, the Engineer feels that the joint test prices are represenlative of the current market vallie of the improvement and the City would not likely see a significant cost savings by rebidding the work, Therefore, although the base hid is approximately 12% ($32.000,00) greater than the Engineers estimate of e $270,000,00 the bids submitted were all relatively close in price and represent fair market value for the improvements. Therefore the City Engineer recommends that the City Council award tbe base bid for this project to Gridor Construction. Inc, Bid Alleniative #1 Bid a1temative #1 includes the various open trench spot repairs of 8" clay pipe, Bid prices received varied from $56.920.00 (tbe low base bidder) to $30,500.00, We believe the prices vary greatly because this work can become labor intensive, Although this work should be completed fairly soon. it is not required to be completed with the lift slation reconstruction. Bid Alternative #1 was included with this project in order to solicit coastru'tion costs and accomplisb the work if budgets allowed. The bid prices arc higher than expected for this work and it is not a necessaI)' component in the reconstruction of lift starion #8. Therefore the Engineer recommends that Bid Altemative #1 not be included in this project and be completed separate from this contract at a later date either by City forces. under pavement management progmm or with ne"t years sanitary sewer program. The City Engineer, therefore, recommends the award of the Base Bid for the 2001 Sanitary Sewer Rehabilitation Project to Gridor Construction, Inc., for lhe total base bid amount of $302.484,00, Both Bid Alternatives from all Contractors were higher than estimated based on previous cost of projects with the same elements, Therefore the City Engineer recommends not awarding Bid Alternative #1 or Bid Alternative #2, The project schedule outlined below is based upon award by the City Council On January 9.2001. The City has these towers inspected every eight years for any structural or coating failures, In the spring of2000, AEC Engineering of Minneapolis, a company that specializes in water storage facilities, inspected the north tower. A report on the north water tower condition was produced and supplied to the City, e North Water Tower Condition The ABC inspection report for the City of Arden Hills north water tower indicates the tower is in good condition, AEC has identified areas where spot repairs of the tank coating, both inside and out are recommended, Two copies of the report are available for City Council members to review, Costs Estimated costs for the recommended repairs to the City's north tower are $11,500 plus an additional $9,200 for AEC Engineers specifications for the repair and inspection costs, Arden Hills South Water Tower The City of Arden Hills south water tower was inspected in 1996 with follow-up repairs made in 1997, This tower is also in good condition and only minor coating repairs were made, An exposed ladder on the interior of the tower support structure provides access to the top of the south tower. Public Works employees have long sought a safety cage surrounding the ladder, which would bring the ladder up to today's OSHA standards, e Ladder Ca!!e Costs AEC estimates it would cost $7,000 to install a steel safety cage around the ladder that climbers could lean back and rest against. Additional costs for specifications and inspection of the cage installation are estimated to be $3,000, bringing the total costs for the south tower ladder cage to approximately $10,000, Water Tower Maintenance Page Two January 4, 2001 e Bud!!eted Staff had budgeted $42,500 for water tower engineering and maintenance in 2001. Recommendation The Public Works Director asked AEC to provide a proposal to furnish the City with specifications, bid administration and field inspection for the repairs identified in their 2000 inspection report, That proposal is also available for review, The Public Works Director recommends the City Council authorize staff to accept the proposal from AEC Engineering to provide Arden Hills with the scope of work outlined in the AEC Proposal including, but not limited to: 1, Specifications for the project 2, Bid administration 3, Necessary forms and documents 4, Field inspection 5.
