Enclosed within are the quarterly department reports from Public Works, Parks and Recreation,
Finance, and Building/Code Enforcement departments. These reports are provided for your
information and review. These reports have not been scheduled as an agenda item; however,
staff will be available to answer any questions you may have regarding their content. I have
asked employees to provide you with a summary of information that has occurred in their
department since the first quarter reports,
Public Safety Budf!ets
Enclosed within are copies of the budgets proposed by the Ramsey County Sheriffs Department
and the Lake JohalUla Volunteer Fire Department (LJVFD). In the Ramsey County Sheriffs
budget a main budget increase is for an additional investigator for the Ramsey County Sheriffs
Contract Group. The amount for this additional investigator, $101,000, has been spread amongst
the cities based on the percentage according to the contract. The City of Arden Hills' share of
the proposed increase is $15.748.35.
The LJVFD 2002 proposed budget is a 13.67% increase to the City of Arden Hills, The main
increases are in Professional Fees from $10,569 to $24,419.47. This is due to the proposed Fire
Duty Crew for the entire year of2002. This a 131 % increase in that line item. The other main
increase is Fire Run Compensation. The 2001 Fire run Compensation proposed budget was
$32,940 and the 2002 budget is $45,776. This is a 39% increase, On tbe bottom of Page II of
20, you can see the total estimated calls for the 2001 budget was 10,980, The actual calls year to
date are 12,743 which is 16% over the estimated call volume.
It is my understanding Sheriff Fletcher, as well as Undersheriff Altendorfer, will be in attendance
to present their proposed budget and answer any questions. Fire Chief Schrier and Treasurer
Paul DeLaforest will be in attendance as well to present the LJVFD budget and be available for
any questions.

Arden Tower Discussion
Per your direction to follow-up with the outline of options for the Arden Tower property,
enclosed within is a copy of a client attorney letter from City Attorney Jerry Filla, This letter has
been copied only for City Council members and is protected by client/attorney privilege. Mr.
Dave Scherbel will be in attendance at the Council Worksession and available to answer any
questions, as will City Attorney Filla, We will need to be careful how we talk about this
property so that we do not jeopardize our case in the event we would end up in court with Mr.
Vaughn.
Rice Creek Watershed District Presentation
Ms. J anell Miersch, Program Coordinator with Rice Creek Watershed District, will be in
attendance to talk with the City Council regarding how the Rice Creek Watershed District can
cooperate and coordinate with the City of Arden Hills in the production and establishment of our
Stormwater Management Plan. Mr. Joel Schilling of SEH, our Stormwater Management
Consultant, will also be in attendance for discussion and available for questions.
One of the main topics to be considered and discussed is whether the City should develop their
own set of goals and objectives for the establishment and maintenance of a Stormwater
Management Plan or whether we want to go along with those goals established by the Rice e
Creek Watershed District. The direction given to the Consultant at this time is to incOlporate the
goals ofthe Rice Creek Watershed District based simply on the fact my sense is the City Council
and the City would not be in the Water Management Business. We most likely will not end up
owning a lot of the stormwater management ponds, particularly related to new development and
we do not have the manpower at this point in time to be the processing agent for any stormwater
permits or applications. The point of discussion is to find out how much, if any, we might be
able to modify the Rice Creek Watershed District goals to more closely fit what the City desires
out of stormwater management.

Public Works Second Quarter Report
Staff have responded to 42 after hour 'CaIl Outs'
Staff have made 239 visits to resident homes and in the process traveled 780 miles,
Hired two summer part time workers.
Completed spring street sweeping of the entire City
Lift Station #8, Ingerson Road & Hamliue A ve.North, was reconstructed
Crack sealing completed
Seal Coating of 26 streets was completed. Streets were swept clean by Staff.
24 mailboxes were repaired/replaced due to snowplow damage.
112 turf/curb areas were repaired due to snowplow damage.
100% staff participation in the City's 50th Anniversary Celebration.
Repaired 5 Sewer Line breaks
Repaired 4 Water Line breaks
Street repairs due to winter damage are proceeding, 50 % of the work has been
completed. Approximately 60 tons of asphalt has been used.
Storm water culvert was extended under Thorn Drive.
InstaIled new storm water catchbasin at the new City HaIl location,
Booster station received a maintenance check-up.
Removed fence from the new City Hall location.
InstaIled new storm water catchbasin on Venus Avenue.
InstaIled a safety video camera on the rear of Snowplow #110. The monitor is
located in the cab. AIlows the driver greater vision to rear.
Completed seasonal maintenance on all 14 Lift Stations.
Staff attended seminars/ workshops on; confined space, water, sewer, and
maintenance of Public Works vehicles.

Parks and Recreation Second Quarter Report
Parks
. Completed a citywide survey of Parks, Trails and Recreation for the Comprehensive
Park Plan process, The surveys were mailed to every resident of Arden Hills. The
response rate was 15%.
. Organized four citywide community meetings for the Comprehensive Park Plan
process.
. Participated in the City's 50th Anniversary Celebration on June 23. 2001.
. Playstructures, complete with safety boxes, were installed at Sampson Park and Floral
Park.
. Completion of Phase II of the Arden Manor Park improvement project. The following
work was completed; a fence around the basketball court, blacktop the access road,
final grade and sod laid
. Two members were added to the Parks, Trails and Recreation Committee. Total of 10
members.
. 38 Birdhouses installed by the Boy Scouts at Crepeau Park.
. Trail improvements at Crepeau Nature Preserve
. Tree work completed at Sampson Park. Floral Park and Ingerson Park,
. Vandalism, graffiti, occurred at Valentine Park, Hazelnut Park and Cummings Park.
All incidents were reported to Ramsey County Sheriff.
. Safety Fence for team benches installed at Valentine Park
. State Mandated bleachers were installed at Perry Park. Hazelnut Park and Floral Park.
. Swing Set safety pads installed at Cummings Park and Perry Park
. Friends ofthe Parks tree plantings at Sampson Park, Floral Park and Hazelnut Park.
. Hired three summer part-time workers, All three worked for the City last year.
. Park staff attended workshops/seminars on; small engine repair, Toro lawnmowers,
confined space, tree inspection, and weed control.
. Adopt-a-Flower Garden program was held on May 19,2001. The program includes
16 Gardens and 62 volunteers.
. Adopt-a-Park program has 12 volunteers,
. Adopt-a.Trail program has 5 volunteers.

Spring 2001 Recreation Program Report
Attached you will find the Spring, 2001 Program Report for the Recreation Department.
Summary:
.
@ We offered 35 classes in 2001, serving 564 participants. This is down from
42 classes. serving 830 participants in 2000. ,
@ We averaged 16 children per class, down from an average of 19.76 per class in
2000.
@ We cancelled three classes, which is a 91 % success rate compared to last
year's five classes cancelled at a 88% success rate.
Conclusion:
We did experience a decline in participants (-266) from last year due in large part to the
following programs:
Egg Hunt... -99 participants (Weather was a huge factor)
USA Youth Tennis Carnival ... -34 participants (Construction forced us to move
the location of the carnival to Roseville.)
Spring Ceramics (4 Classes) ... -44 participants (The instructor who taught these
specialty classes, sold her business.)
Track - Valentine Hills'" -18 participants (Numbers vary each year)
Track - Island Lake'" -19 participants (Numbers vary each year)
TOTAL of -214 for the above programs
Overall, we had a very successful spring season!

The Customer Service Representative (CCR) II position (formerly the Intermediate Accounting
Clerk position) is unfilled. The job description for this new position and responsibilities relative
to the CSR I position need to be finalized. Temporary clerical services are being utilized when
job duties spike; otherwise, they are being handled by the Senior Accounting Clerk and the City
Accountant
Second Ouarter Accomplishments
. The water utility achieved 100% compliance with respect to the installation of radio read
water meters,
. Although not specifically tasked with economic development responsibilities,
communications for specific development concepts in the Gateway Business District, the
remnant Indykiewicz parcel, the County Road DlNew Brighton Road Neighborhood
Business District, and a TCAAP planning option were maintained with potential developers.
. The December 31. 2000, external audit examination was completed with an unqualified
opmlOn,
. Final utility billings for residents moving out of the City were issued on a prompt basis.
Third Ouarter Goals
. Issue 2001 Budget Book.
. Assist the City Council and the City Administrator in the development of the preliminary
2002 budget and taxes payable 2002 levy.
. Complete training on the "mini-mobile" water meter reading hardware to utilize for third
quarter 2001 meter readings,
. Move into new City Hall, sever current lease obligation, and plan premises auction for
furnishings/computers not moving to the new City Hall.

Second quarter for the year 200 I shows that the value of all construction was
$3,723,925.66. Total fees collected for the first quarter were $89,109.82. This
compares with a total value of $4,434,396,00 for the first quarter last year with total
fees collected of$81,996.38.
Even though the value of construction was down in the 2nd quarter compared to last years
2nd quarter, fees remained higher due to mechanical permits issued for Mounds View
High School.
Notable Commercial Construction
Some of the larger commercial projects permitted in the City for the second quarter are:
4201 Lexington - (old Control Data building), Major remodel of office spaces, cafeteria,
and rating corridors to code.
1341 Highway 96 - Remodel of National Guard maintenance garages.
3900 Bethel- Remodel of Getsch and Edgren Hall at Bethel College,

This past week, the City sent out 101 reminder letters to residents notifying them that they have
until August 1,2001, to correct and have their homes reinspected for compliance with the City's
Sump Pump Ordinance. As ofJuly 12. 2001, the City has reinspected 37 ofthose residence's _
and found them to be in compliance with the City's Sump Pump Ordinance. .,
This leaves 64 residents that have not yet responded to either of the two letters previously sent on
sump pump compliance.
On or before August 1, we will again send out a final notice letter and follow-up with a phone
call to try and obtain compliance before any fmes are levied,

SUBJECT: New City Hall Interior and Exterior Signage
At the July 9, 2001, regular council meeting, the Arden Hills City Council discussed signage at
the new City Hall. Earlier, in the June 29, 2001, non-agenda packet, staffhad provided a drawing
of what the interior (council dais back wall) and exterior (to the right of the main entrance) signs
were planned to look like. Both of the signs were simple block letters reading "THE CITY OF
ARDEN HILLS" in an anodized bronze color.
Council discussion at the July 9, 2001, meeting resulted in a consensus opinion to incorporate the
City's new logo and script into the signage at the new City Hall.
Council's request was communicated to Peter Vesterholt, representing Architectural Alliance, at
the July 10, 2001, weekly construction meeting, Mr. Vesterholt committed to attending the July
16,2001, council work session to discuss design change options with the City Council.

2001 Legislative Changes Affecting 2002 Budget

I called Gene Ranieri, AMNI Executive Director, yesterday to inquire about 2001 legislative
session impacts to the City of Arden Hills, The three primary topics we discussed were HACA,
LGA and tax increments.
HACA
The City of Arden Hills was certified by the Minnesota Department of Revenue to receive
$99,994 of Homestead and Agricultural Aid (HACA) in 2001. This aid has been eliminated and
the City will receive $0 in 2002. Even though the Implicit Price Deflator (IPD) will guide the
limits on levy growth, the legislature allows cities to levy back any net loss of aid from the
elimination of HAC A.
LGA
The City of Arden Hills was certified by the Minnesota Department of Revenue to receive
$10,242 in Local Goverment Aid (LGA) in 2001. Preliminary estimates are that this aid amount
will be frozen for 2002 (i.e., no increase or decrease).
Tax Increment
The class rate compression for commercial/industrial property (i.e., from 3.40% in Pay 2001 to
2.0% in Pay 2002) coupled with higher levels of state funding for the K-12 education will reduce
the City's 2002 tax increment by an estimated 38%.
Based upon July, 2001 tax settlement information, Round Lake Business (TIF District #2) 2001
annual tax increment is estimated at $502,274, A 38% reduction would reduce 2002 increment
dollars to $341,546. The 2002 G.O. bond debt service is $256,315.

We will be starting the Capital Imr rovement Plan preparation in June with final decisions on the
Capital Plan being made in July. I wllUld request that you provide us with an updated version of
tbe LJVFD Capital Schedule no later than July 1,2001. I would also like to request that your
proposed 2002 budget be submit1ed no later tban July 15.2001.

Dear Mayor Probst:
The purpose of this letter is to set forth a basic outline for our continued discussions and
negotiations of an agreement by and between The Mills Limited Partnership, a Delaware limited
partnership or its assignee or designee ("MLP" or "Mills") and the City of Arden Hills ("City").
The City has expended and will continue to, expend time and efforts to secure the right to
acquire and redevelop that remaining land owned by the U.S. Army Ammunitions and Chemical
Command of the Department of Defense and known as the Twin Cities Army Ammunition Plant
("TCAAP") comprised of approximately 2370 acres ofland located within the boundaries ofthe
incorporated City limits and more particularly shown on Exhibit A (collectively, "Entire Site"). The
City and Mills are discussing the possibility of Mills acquiring a portion of the Entire Site of
approximately 100 to 150 developable acres for the development of a mixed use project with a
significant retail and entertainment component ("Land"). The Entire Site less the Land is hereinafter
sometimes described as the "Retained Parcel", In addition, Mills and the City is discussing Mills
acting as the master developer for the Retained Parcel, working in partnership with the City to either
develop or find suitable developers to develop housing, parks and recreational uses, offices or other
uses that the City and Mills agree to during the development of a "master plan" as hereinafter more
fully described.
Notwithstanding that the City has not yet acquired the Entire Site, Mills has indicated a
willingness to assist the City with respect to acquiring control of the Entire Site and masterplanning
same as requested by the City. The general outline of those discussions has been memorialized in a
letter from Liz Link to your offices dated April 19, 2001, In order for Mills to undertake these efforts,
Mills has requested that the City agree that in the event that there is any retail or entertainment
component planned or executed for the Entire Site, that Mills have the right on an exclusive basis to
be the retail/entertainment developer/manager/owner. The City has indicated a willingness to enter
into such an exclusive arrangement based upon the terms and conditions set for in this letter.

Accordingly, except as noted herein, this letter is intended only to provide a framework for
negotiation purposes of an Exclusive Option Agreement. It is the intention of the parties that if an
agreement in principle can be reached, an option agreement ("Agreement") with respect to the Land
would be negotiated prior to the expiration of the Initial Period as hereinafter defined.
Accordingly, as it relates to the assemblage ofthe Entire Site and the master planning process
with respect to the Entire Site, Land and Retained Parcel, the parties are in agreement on the following
concepts subject to the terms of this letter of intent:
A. Study Period. MLP and City agree that the Study Period shall commence upon execution of this
letter and extend for l20-days after the Agreement is executed, During the initial60-days of the Study
Period ("Initial Period"), the parties shall endeavor in good faith and use their commercial best efforts
to structure a program (and identify a source of funding for costs related thereto) which includes but is
not limited to the following:
. securing the right to acquire and develop the Entire Site by working with the state and federal
legislative body, as well as the Army;
. identifying highest and best uses for the Entire Site including but not limited to commercial, retail,
and residential;
. masterplanning the Entire Site and developing design standards;
.
. evaluating traffic impacts and conceptualizing the improvements that development of the base
would necessitate;
. monitoring the cleanup of the Entire Site to insure that future development is possible;
. any other teclmical assistance required to understand the restrictions, limitations and potentials
uses for the Entire Site;
. a market analysis,
The Mills acknowledges that the City shall have the primary responsibility and Mills will provide
assistance to the City, to negotiate for the acquisition of the base necessary to assemble the Entire Site.
In addition to the assemblage, during the Initial Period the parties shall agree on a process, budget,
consultant team and respective roles of responsibility with respect to jointly master planning and defining
the infrastructure necessary for the development of the Entire Parcel and with an attitude that is
consistent with and complimentary to the potential of developing the Land that will include a retail and
entertairunent project ("Project"). As part of this initial planning process during the Initial Period, MLP
and the City shall initiate a due diligence program related to envirorunental, transportation, infrastructure,
utility, approval and entitlements issues. It is the intention of the parties that once mutually agreed-to as
reflected in an initial strategy and budget, the parties would each be responsible for 50% of the cost of .
the budgeted items. The parties shall endeavor in good faith and use their reasonable efforts to agree on
a mutually acceptable schedule and list oftask to be undertaken during the Initial Period. Upon expiration
of the Initial Period, the parties shall enter into the second phase of the negotiations with respect to the

Land and work together to negotiate a mutually acceptable Agreement prior to expiration of 60-days from
the expiration of the Initial Period ("Negotiation Period"). Ifthe parties are unable to mutually agree
during the Negotiation Period on the final form of an Agreement, either party shall have the right to
tern1inate this letter; provided, however, that each party would remain liable for and be required to make
arrangements for the payment of all amounts due pursuant to the agreed-upon budget expended to that
point in time. The Purchaser shall endeavor in good faith to cause an initial draft of the Agreement to be
delivered to the Seller within thirty days ofthe expiration of the Initial Period,
B. Master Planning Process. The intention of the parties is that the master planning of the Entire Site
shall be pursued "jointly". During the Initial Period, the parties shall agree on the responsibilities of each
party as it relates to the master planning process. A preliminary list of responsibilities shall include
environmental, zoning, entitlements, approvals, site planning, subdivision, utilities, storm water
management, surveys, public finance assistance, development agreements, road improvement approvals,
and cost contributions related thereto. A final approved schedule of each parties' obligations and when
these are expected to be performed shall be finalized during the Negotiation Period and attached to the
Agreement.
C. Confidentiality. Except as may be required by law, Seller and Purchaser agree to keep the terms
of this transaction confidential and not disclose the names of the parties or the terms of this Letter of
intent or the contract to any person who is not representing or assisting respective party in this
transaction, who must also keep such information confidential.
D. Exclusivity. During the Initial Period and the Negotiation Period hereinabove described, the City
shall not solicit any offers to purchase or develop all or any portion of the Land or enter into an
agreement with any other party for the development, sale of any part of the Land or any property adjacent
to or contiguous to the Land (for retail or entertainment purposes) until expiration of the Initial Period
and Negotiation Period, during which period of time Seller agrees to negotiate in good faith exclusively
with Purchaser to enter into a mutually acceptable Agreement that incorporates the terms summarized
in this letter of intent.
E. No Contract. Except for the agreements of Seller in Paragraphs C and D, Seller and Purchaser
understand there is no binding legal agreement between them concerning the Land until they execute
a mutually acceptable Agreement.
For your convenience, I have enclosed two (2) originals ofthis letter of intent. If the foregoing meets
with Seller's approval, please have the enclosed executed by or on behalf of the Seller and return one original
to me no later than 5:00 p.m, on July 15,2001. If! have not received one fully executed original by such
date, this letter of intent shall automatically expire.

Enclosed within is a copy of a memorandum I received from Dave Scherbel, Building Official,
that the City Council needs to take action on the telecommunications tower located at 1777
Gateway Blvd, As previously discussed and determined the tower does not meet the technical
interpretation of the building code of the State of Minnesota for compliance with the Yz" radial
ice provision. Mr. Dan Vaughn has previously approached the City for a building permit
application for reconstruction of the telecommunication's tower located at this address. The City
Council denied that building permit request. Subsequently Mr. Scherbel verified with the State
of Minnesota that they agree with his interpretation and the recommendation to the City Council
for denial based upon the State Building Code. But denial was based on a zoning issue because
the Gateway Business Zoning District does not allow telecommunications towers over 75' in
height in that district.

Mr. Vaughn has a development proposal which the planning commission will be reviewing at
their meeting on June 6, 2001. The development proposal includes reconstruction of the
telecommunications tower to height of750' along with the construction of two 4-story structures
located directly beneath the tower. This application is for a concept plan review only. The City
has a concept plan review, a preliminary plan review, and final plan review process. The
concept plan review allows an applicant to appear before the Planning Commission to receive
either positive or negative comments about a proposed development. If positive comments are
received the applicant would be encouraged to begin the preliminary plan and final plan review.
If negative comments are received the applicant should not proceed further with preliminary
plan or final plan review.
A conflict occurs because ofthe previous action taken by the City Council denying Mr.
Vaughn's building permit application for reconstruction of telecommunications tower. The
Planning Commission and the City Council cannot simultaneously deny a building permit for

reconstruction of tower while considering approval ofredevelopment of the property. The
decisions need to be consistent with one another.
Denial of the concept plan approval does not resolve the situation, however. Mr. Vaughn will
continue to have a tower which does not teclmically meet the State Building Standards and
remains under staffs experience knowledge unsafe from a structure standpoint. I believe that
Mr. Vaughn is trying to seek all the administrative remedies he has at his disposal for
consideration of the reconstruction of the telecommunications tower. He has made application
for building permit which has been denied by the City Council. He has now made application
for a redevelopment proposal ofthis property which includes the reconstruction ofthe
telecommunications tower. It should be recommended for denial by the Planning Commission
and support by the City Council. Upon receipt of negative feedba_ck on the concept approval we
assume Mr. Vaughn will seek remedy through non-conforming rights language in the zoning
ordinance.
Staff has talked about the possibility about bringing forward a recommendation to the City
Council for "red tagging" the structure. This would not be wise at this time due to the fact that
the condemnation of such a structure would mean possible large financial reward for the property
owner based upon the replacement value ofthe telecommunications structure both from an
infrastructure standpoint and an income standpoint. However, based upon the fact that Mr.
Vaughn has brought forward a proposal for redevelopment of the property we will be coming to
a conjunction point where the City Council needs to consider what action it is willing to take on
this property. The options for the Council are: 1) Amendment to the current zoning ordinance to
allow telecommunications towers to be built in the Gateway Business District and including
language to allow Mr. Vaughn to rebuild his tower with or without any accompanying principle
structures; 2) To deny the development proposal by Mr. Vaughn to see ifhe seeks remedy
through non-conforming use issues contained within the zoning ordinance; 3) Allow Mr. Vaughn
to complete a preliminary and final development plan which would allow reconstruction of his
telecommunications tower; 4) Seek staff to have Mr. Vaughn remove the telecommunications
tower at the property with allowance of development of the property in conjunction with the
current provisions of the Gateway Business Zoning District.

Recommendations
The staff recommends that the City Council consider and discuss the options proposed here and
any others that are brought up during conversation, or modifications thereof. This is a separate
and distinct item from the concept plan approval that will be brought forward to the City Council
at your regularly scheduled meeting on June 25,2001. It is the intention to continue discussion
and ifthere is need for more information bring this issue back to your work session on June 18,
2001. Mr. Filla will be in attendance at the meeting on June 11, 2001, for clarification or
reference. Mr. Scherbel will also be in attendance at the June 18,2001, City Council work
session if you have any questions of him or need more background or information.

City Staff requests direction on how to proceed with the Arden Tower located at 1777
Gateway Blvd. (formerly 14th S1.) The Building Official has declared the Tower an
unsafe structure according to the state building code. The Arden Tower was declared
unsafe in a letter to the Tower's owner, Mr. Dan Vaughan, on 12/13/99, Following is a
brief outline of how that determination was made.

U,S. West made application to the City in Planning Case #98-10, to install an antenna
array on the tower at 1777 Gateway Boulevard (formerly 14th Street) owned by Mr. Dan
Vaughan. The application was approved with the condition that they comply with the
Ehresmann Engineering report dated February 2, 1998.
After reviewing the report, staff noted that the report did not include calculations for y,"
radial ice as required by the State Building Code. Staff requested additional engineering
that included calculations for y," radial ice.
Several reports were done, the first one was by Paul J. Ford Company for U.S. West. The
report stated the tower does not meet the State requirement for Yz" radial ice and a 69
m.p.h. wind. In fact, it could only safely withstand a 25 m.p.h. wind, with y," radial ice.
Ehresmann Engineering, at the request of Mr. Vaughan, also did two additional reports.
The first report was done with calculations including y," radial ice. This report indicated
the tower does not meet State Code, Another report was done without any calculations
for Yz" radial ice. This report raised serious questions as to the tower's loading and still
failed in several areas.

I have enclosed (highlighted) copies of these reports for your review. Based upon these
reports received by U.S. West, and Ehresmann Engineering, staff concluded that the
tower was an unsafe structure as stated in a letter to Mr. Vaughan dated December 13th,
1999 (copy attached.)

Mr. Vaughan applied, on December 17, 1999, for a Building Permit to construct a new
tower on the site. On January 6, 2000, staff denied the Building Permit application based
on zoning related issues, On December 11, 2000 the City Council affirmed the Building
Official's denial of the building permit with the following findings;
e
1.) An application for a building permit was made by Dan Vaughan to reconstruct a new
700 foot antenna tower; and
2.) The proposed new tower is greater than 75 feet in height and serves as the principaJ
use on the property; and
3.) City staff denied the application based on staffs interpretation of City Ordinance 291;
and
4.) City staff correctly interpreted the Ordinance and the planning commission affirms
the denial.
Staff asked for and received confirmation from the State Building Codes & Standards
Division agreeing with the City's decision to de.clare the tower an unsafe structure (copy
enclosed. )
Summary
Staff has declared the tower an unsafe structure based upon the following reasons;
I) The tower was originally designed without y," radial ice and only three (3) antenna
groupmgs.
2) The safety of the tower has been compromised over the years with the addition of
numerous antenna groupings, (as many as 15), done without any of the required
amendments to the Special Use Permit or Building Permits. These additional
antennas have significantly decreased the safety of the tower.
3) The Tower, based upon engineering reports submitted from US West, and Mr.
Vaughan, shows that it does not meet the state building code.
4) Section 102 of the Uniform Building Code defines towers that are unable to sustain
the design loads that are specified in the UBC are hereby designated as unsafe.

Staff has denied the building permit application to build a 700-foot tower based upon the
following;
I) Ord.291-Sec.VI-3a. No antenna or tower shall exceed a height of seventy five ft.(75)
2) Ord,291,Sec,VI-2. Antennas, satellite dish antennas and towers are allowed only as
special accessory uses. They are therefore allowed only on property containing a
principal use to which the antenna, dish antenna or tower is accessory.
3) Ord.291-Sec.XI-A.1. No building permit or other permit pertaining to the use ofland
or buildings shall be issued unless such building is designed and arranged to conform
to the provisions of this ordinance.
Conclusion
As staff sees the issue, the following options remain;
1) Bring the Tower into compliance with City code, or if not possible, remove the
Tower. Staff understands the Tower cannot be reinforced, as this would only

compound the loading problem, However, the Tower may be able to be reduced to a
height ofless than 300 feet to be compliant.
2) Bring the Tower back into compliance with the original SUP which allowed for only
three antenna groupings, all over the 600 foot level. (This still may not bring the
Tower into compliance with the current code when calculating for 12" radial ice.)
3) Alter or change the City zoning code (the Tower as a primary use, and for over
seventy five feet in height) allowing for the Tower to be rebuilt to the current building
code.
Staff seeks direction on how to proceed to bring resolution to the Arden Tower by June
29th, 2001.

using infonnation that is now obsolete. I do not believe thai the engineers who prepared Ihe report were
able 10 actually observe the tower in order to prepare an accurate analysis which I personally would
require.
We are in the process of having a new study made using accurate information. As )'Ou know the
tower was built under the standards e<isting at the time of its construclil)n in 1981. 'lJlC:,iQ\'~r_never

lower was originally designed lor a constant wind pressure 0165 psI in accordance with the old EIA
RS-222"( standard. Ice accumulalion was ~ considered in the original tower design. ,
The purpose 01 our ana.lysis was 10 determine if the existing structure could meet the requirements of
the Minnesota Stale Building Code while supporting the revised antenna and coax loading as shown
on page one of the enclosed sketches. The Minnesola Slate Building Code is modeled after the
Uniiorm Building Code.(UBC , 994) and now requires that ice accumulation be considered. lhe
Minnesota Slate Building Code does nOllist design wind loads for Slrvclures over 400 It tall and
recognizes the Electronics Industry Associalie.n standard ANSllEIA.222-E as an acceptable national
design standard. '
Our analysis was performed in accordance with Ihe recommendations of the Ar-:SllEl....222.E standard.
The Minroesota Stale Building Code requires a minimum design wind velocity of 60 mph and also
requires Inat all structures in the state be designed lor y,' of radial ice. The EIA standard allow, the

Foundation:
Due to the lack of information regarding the
existing foundations for the anchors and tower
basel we are not able to comment on their capacity
at this time. Further subgrade inspection is
required to determine their capacity. It is
the tower owners option and responsibility to
complete this subgrade inspection.

The 700' Rohn 80 guyed tower located at Arden Hills, MN does
not meet the specifications of TIA/EIA-222-F considering 80
mph wind and 1/2" ice with reduction allowed. This is based
on all information as supplied to EEl being correct and
current. If tower loading is changed or altered in any way,
we SUggest an additional analysis be completed.
Some of the stress rations outlined in this report are large
enoUgh that permanent deformation to some of the tower
members could occur if the analysis conditions were encoun- ~
teredo Due to the large degree of overstressing we feel ,..,
modifications are not feasible nor recommended to accommo-
dii.f'll the ice loading.
It is our opinion that if the subject tower must have ice
included in the analysis, we suggest the tower ei,ther, be

soils under the base foundation to safely support
this increased net bearing pressure. We suggest
the vertical load at the base of the tower is
forwarded to Subterranean Engineering, Inc. to
review th~ ,base design and their sofls report to
determine if soils are adequate. Modifications
may be required.
Inn ~ Actual vertical uplift load of 14.53 Kips and an
actual horizontal load of 18.79 Kips per our
analysis. Per the original reactions furnished to

Dear Dan,
The City of Arden Hills (City) wishes to Thank You for your engineering reports submitted
on 11/29/99 from EEl (Ehresmann Engineering Inc.) dated 11/15/99 and 11/23/99, regarding
the safety of your tower and its compliance with the State Building Code.
Summarizing the first report dated 11/15/99 by EEl Engineering, the Tower does not meet
State Code for y," radial ice and 80 mph winds, with reduction allowed. Further, the report
indicates that conditions may be worse than the report states if the Tower has suffered any
damage or corrosion and if a sub grade inspection reveals that it does not meet the required
minimwn capacity.

The second engineering report submitted by EEl engineering, dated 11/23/99, was done
without any calculations for W' radial ice.
Summarizing the engineering report dated 11/23/99 (analysis with out radial ice) many
questions remain as to the current safety of the Tower even without including \1," radial ice.
It also appears not all information given to EEl engineering has been correct, (i.e. feedlines)
and the Tower has more loading on it than originally designed, plus a foundation that is
overloaded from what it was originally designed for.
In conclusion, based upon all of the information that has been submitted by you to the City,
Staff believes there is sufficient information to deem the Tower an unsafe structure
according to the State Building Code. Without question, the Tower does not meet State Code
when including y," radial ice. It appears the Tower was never designed to be able to
withstand y," radial ice even though it was a requirement at the time the Tower was built.
The Tower was built in 1981, and the requirement to include \1," radial ice went into effect in
September of 1980.

There also have been many additions / alterations to the Tower over the years that have been
done without Building Permits or amendments to the Special Use Pemrit (attached) as
required by State and Local laws. These additions have substantially increased the loading
over what the Tower was originally designed for, which in turn has made the Tower even
less safe with each and every addition.

The original design of the Tower showed only 3 antenna groupings, all over the 600-foot
elevation. Today, as the engineering reports show, there are 20 antennas mounted at various
heights through out the Towers entire height.
Staff will commence proceedings to declare the Tower an unsafe structure according to the
State Building Code, on February 28, 2000; unless you are able to make alterations to the
Tower complying with the State Building Code.
We would like to meet with you to discuss your options with this tower at your earliest

decision declaring a 700 foot high tower in the city of Arden Hills unsafe
Dear Mr. Scherbel,
Based on the information you forwarded to us for review, we have concluded that you are correct
in declaring the tower unsafe. Both our structural engineer and I reviewed the materials and
agree with your action. If it appears that legal action may jeopardize your order, the city should
consider hiring their own consultant to personally evaluate the structure on site. To this point,
your conclusions are only based on the information supplied by the owner. In fact, an on-site
inspection could reveal additional issues as alluded to in one of the reports regarding corrosion.
