RESOLUTION NO. 2026-037
RESOLUTION APPROVING A CONDITIONAL USE PERMIT FOR
1300 GREY FOX ROAD
WHEREAS, City Staff received a land use application for 1300 Grey Fox Road, legally
described on Exhibit A attached hereto("Subject Property")for a Conditional Use Permit and Site
Plan Review on May 27, 2026; and
WHEREAS, the Subject Property is zoned I-FLEX District and is guided as Light
Industrial & Offices uses in the Land Use plan; and
WHEREAS, a Conditional Use Permit is required for a warehousing use in this zoning
district; and
WHEREAS, on April 27, 1992, the City Council approved a Special Use Permit for a
warehouse and office use on the Subject Property with the ratio of special uses to the gross floor
area on the site established; and
WHEREAS, the Applicant proposes to create an internal drive lane with the addition of
6,098 square feet of pavement; and
WHEREAS,the proposed constitutes a substantial modification to the existing special use
permit and requires amendments and City review; and
WHEREAS, Chapter 13 — Zoning Code, Section 1355 Administration and Procedures
states an application for amendments to site plans and conditional use permits shall be
administered in the same manner as required for a new application; and
WHEREAS, the Subject Property meets the conditions as regulated in Section 1355.04
Subd. 3 Procedural Requirements for Conditional Use Permits; and
WHEREAS,pursuant to Minnesota State Statute,the City must act on this request by July
25, 2026 (60 days), unless the City provides the petitioner with written reasons for an additional
60-day review period; and
WHEREAS,the City provided the petitioner with written reasons for an additional 60-day
review period and extended the review period to September 23,2026 (120 days)based on the date

of the submission for review by the Planning Commission and the City Council during the July
meeting cycle; and
WHEREAS, the City Council directed Staff to prepare a Land Use Application Public
Policy Notification to notify all property owners within 1000 feet of Subject Property when a
request for the Planning Commission is to occur related to a land use application that requires a
public hearing; and
WHEREAS, the City's obligation has been met where the Arden Hills Planning
Commission did hold a public hearing on July 8, 2026. All persons present at said meeting were
given an opportunity to be heard and present written statements; and
WHEREAS the Planning Commission considered the Applicant's request for a
Conditional Use Permit and a Site Plan Review, and, as such voted 6-0 in favor of recommending
approval with conditions.
NOW, THEREFORE, BE IT RESOLVED THAT THE CITY COUNCIL OF THE
CITY OF ARDEN HILLS:
Hereby adopts Resolution 2026-037 approving Planning Case 26-013 for a site plan review
and a conditional use permit to create a new drive lane at 1300 Grey Fox Road.
BE IT FURTHER RESOLVED that City Council approves Planning Case 26-013 for a
site plan review and a conditional use permit to create a new drive lane at 1300 Grey Fox Road,
based on the findings of fact and the submitted plans and the July 27, 2026, Report to the City
Council, as amended by the following conditions:
1. The project shall be completed in accordance with the submitted plans as amended by
the conditions of approval. Any significant changes to these plans, as determined by
the Community Development Director, shall require review and approval by the
Planning Commission and City Council.
2. The proposed parking area shall conform to all other regulations in the City Code.
3. A Grading and Erosion permit shall be obtained from the city's Engineering Division
prior to commencing any grading, land disturbance or utility activities. The Applicant
shall be responsible for obtaining any permits necessary from other agencies,including
but not limited to, MPCA, Rice Creek Watershed District, MnDOT and Ramsey
County(i.e. ROW or access) prior to the start of any site activities.
4. The final plans shall be subject to approval by the City Engineer,Building Official,and
Fire Marshal prior to the issuance of a grading and erosion control permit.
5. Final grading,drainage,utility, and site plans shall be subject to approval by the Public
Works Director, City Engineer, and Community Development Director prior to the
issuance of a grading and erosion control permit or other development permits.
6. Upon completion of grading and utility work on the site, a grading as-built and utility
as-built shall be provided to the City for review.
7. Heavy duty silt fence and adequate erosion control around the entire construction site
shall be required and maintained by the Developer during construction to ensure that
sediment and storm water does not leave the project site.

8. If complaints demonstrate that future parking conditions create congestion in the
public rights of way, the applicant shall stripe the five spaces at the southeast corner
of the property as shown in Attachment G, Proof of parking.

That part of the Southwest Quarter of the Southeast Quarter(SWS/4 of SE1/4)of Section 27,Township 30, Range 23,
Ramsey County, Minnesota, lying Easterly of Trunk Highway No, S1-12S; lying Northerly of the North line of the Soo
Line Railroad Company's right of way; and lying Westerly of the following described line; Beginning at a point on the
North line of the Southwest Quarter of the Southeast Quarter of said Section 27, distant 390,3 feet West from the
Northeasterly corner of the Southwest Quarter of the Southeast Quarter of said Section 27; thence Southerly at right
angles with said North line a distance of 537.59 feet, more or less,to a point on the Northerly line of the Soo Line
Railroad Company's right of way and there terminating.
