CITY HALL COUNCIL CHAMBERS, 1245 WEST HIGHWAY 96 CALL TO ORDER Mayor Probst called the meeting to order at 5:03 p.m. Councilmembers present were Beverly Aplikowski, David Grant, Lois Rem, and Gregg Larson. Staff present included Parks & Recreation and Interim Operations and Maintenance Director, Tom Moore; City Plarmer, Aaron Parrish; City Treasurer, Terry Post; City Engineer, Greg Brown; and Recording Secretary, Julie Bateman. COMMUNITY DEVELOPMENT Mills Corporation Presentation Mills Corporation presented a mixed use proposal (Arden Hills Townscape) for a portion of the TCAAP property that would include residential areas, retail, town center, and office space. Gateway Redevelopment Environmental Assessment Worksheet -Chesapeake Companies has followed all appropriate procedures for an Environmental Assessment Worksheet and to determine if an environmental impact statement (EIS) is necessary. Staff recommends that an EIS is not necessary due to information and input frorn MNDot and the Met Council. Planning Commission Appointments - There are currently tlrree applicants for the Planning Commission, excluding the list from last year's applicants. Mayor Probst stated he approached resident Megan Ricke regarding appointment to the Planning Commission. Council members will contact selected previous applicants to assess if they may still be interested in appointment to the Planning Commission. Applicants will be interviewed previous to the March 11 City Council meeting. Stormwater Management Plan - Planner Aaron Parrish addressed the Council asking for review and comments of the Stormwater Managernent Plan. After the plan is accepted by the Council it will be forwarded to the Rice Creek Watershed District for their approval, and then back to the Council for adoption. ARDEN HILLS CITY COUNCIL WORKSESSION MINUTES FEBRUARY 19,2002 2 Indykiewicz Remnant Parcel Appraisal- Council needs to define acceptable uses for the property for the appraisal to proceed. Generally, acceptable uses were identified for appraisal uses. e Finance Department The Finance Department will be implementing new software during second quarter and run the old and new software simultaneously until fully tested. Plans are to begin using only the new Springbrook software at the beginning of the third quarter. Public Works Department 2002 PMP Schedule - After Council is comfortable with the preliminary schedule, the next step is to begin arranging for neighborhood informational meetings. A March 4 neighborhood meeting is scheduled for the Hunters Park cul-de-sac property owners. Include on last regular March meeting agenda as an item to authorize the feasibility study. Larson suggested preliminary costs and assessments need to be researched before neighborhood informational meetings. Sewer work - Public Works staff have been attending sanitary sewer training. A camera to look into sewer was borrowed and used to determine sewer line status along Lake Johanna. Fire hydrants - Councilmember Rem expressed concern from a resident regarding the A painting of fire hydrants. Staff indicated there is a three year plan to paint fire hydrants .. and replace street signs. Currently there are three colors of fire hydrants and seven varieties of street signs. COUNCIL COMMENTS Councilmember Rem suggested other city sample resident information pieces be accumulated regarding planning and pavement management processes. Councilmember Grant asked regarding the status of the Lexington Avenue Xcel utility pole construction. Staff stated the Xcel construction was now probably completed. Xcel did not halt construction based on City concerns. Mayor Probst suggested the City continue to pursue the possibility that Xcel acted without approval or authorization. Councilmember Grant inquired as to the status of the Public Works Facility Task Force. Staff indicated that the Chair will set a meeting date some time this week for the first meeting. Mayor Probst asked that staff develop financing options for the new Public Works facility. ADJOURN Mayor Probst moved and all Councilmembers agreed to adjourn the meeting at 8:43 p.m. e . . . ,. Recommendation Staff recommends that Mr. Jim Perron to be appointed to the position of Operations & Maintenance Superintendent with the City of Arden Hills on a regular, full-time basis. In addition, Staff further recommends an appropriate pay increase for Mr. Perron to reflect his full-time status. . The City did not receive any communication from Xcel on this construction project. Weare requesting Xcel Energy contact the City of Arden Hills for all future projects, which include state, county, or city right-of-way, that occur within our city. Arden Hills does have ordinances in place which regulate any type of utility construction. For this reason, any construction should be reviewed by the city to verify compliance with our ordinances and to issue any type of permit that may apply. Both of those organizations were involved in the drafting of the model Right-of-Way Management Ordinance which was adopted by the City of Arden Hills and most of the other metropolitan area cities. The model Ordinance was intended to apply to the use of local streets and was based upon the enabling legislation contained in M.S. 237.162 and 237.163. State law defines right-of- way in the following manner: Public Right-of-Way. "Public Right-of-Way" means the area on, below, or above the public roadway, highway, street, cart way, bicycle lane, and public sidewalk in which the local government unit has an interest, including other dedicated rights-of-way for travel purposes and utility easements of local government units. Emphasis added. (M.S. 237.162, Subd. 3). As used in state law, the term "in which the city has an interest" is interpreted to mean over which the city has jurisdiction. The state definition ofright-of-way is essentially repeated in the City's Right-Of-Way Management Regulations (City Code Section 360.03II). . Consequently, the City's Utility Under Grounding Regulations apply to the under grounding of utilities in streets over which the City has jurisdiction. Therefore, the opinion which I expressed at the end of my correspondence of February 6, 2002 indicating that Excel Energy needed to obtain a right-of-way permit from the City was incorrect.
